We seek to understand the impact of these legacies on all beings and to find ways to make repair.

TOWN OF PORTOLA VALLEY
STAFF REPORT
____________________________________________________________________________________ TO: Mayor and Members of the Town Council
FROM: Corie Stocker-Pedalino, Assistant Town Manager
Mark Linder, Interim Town Manager
DATE: May 14, 2025
RE: Adopt a Resolution Amending the Salary Schedule to Reflect a Change in Title of Lead Maintenance Worker to Maintenance Worker III
RECOMMENDATION
Staff recommends that the Town Council adopt a Resolution to amend the current Salary Schedule to reflect a change in title of Lead Maintenance Worker to Maintenance Worker III, to right-size and create a career ladder for staff.
BACKGROUND/DISCUSSION
Every fiscal year the Town Council adopts an updated Salary Schedule along with the upcoming fiscal year budget. The Salary Schedule is the governing document that regulates both pay scales and job classifications. The Salary Schedule is adopted via Resolution, which additionally is utilized by the California Public Employees’ Retirement System (CalPERS) to audit any retiring employees from the Town. The Town Council must adopt any changes that are made to this document to ensure it complies with state regulations. However, not every position listed on the Salary Schedule is to be filled.
In previous years, there have been additional iterations of the ‘Lead’ position and the Maintenance Worker series. The title has additionally been listed as ‘Senior Maintenance Worker’ in addition to a combination role a level below the ‘Lead’ titled ‘Recreational Facilities Coordinator/Worker.’
The Lead Maintenance Worker job classification was written and adopted in approximately 2007, the Senior Maintenance Worker approximately in 2008, and the lower-level classification of Recreational Facilities Coordinator/Worker was approved by the Town Council in 2019.
This change is intended to only update the title of the classification from ‘Lead’ to ‘Maintenance Worker III’, which is the highest level of Maintenance Worker in many municipalities. We do not currently have any employees in the ‘Lead’ classification.
There is no salary adjustment with the title update, it will maintain the current salary listed on the Salary Schedule which is a range from $93,890 to $131,667.
Adjusting the title in the Salary Schedule allows the Town an opportunity to create a career ladder of level I, level II and level III for Maintenance Worker staff, in addition it can improve recruitment in the future. The Town currently employs two Maintenance Worker level staff, one at the Maintenance Worker II level and one at the Recreational Facilities Coordinator/Worker level. This adjustment would give each of those staff members a potential growth opportunity.
The Maintenance Worker III job description primarily mirrors the Senior Maintenance Worker job description, with the only addition of items listed in the Recreational Facilities Coordinator/Worker job description and additional list of trails work. The job descriptions are not meant to be all inclusive of every task.
FISCAL IMPACT
There is no fiscal impact related to changing the title of Lead Maintenance Worker to Maintenance Worker III.

RE: Resolution establishing a Donation and Gift Acceptance Policy and creating a Special Revenue Fund for Undesignated Donations RECOMMENDATION:
Adopt a resolution that establishes a Donation and Gift Acceptance policy and authorizes the creation of a Special Revenue Fund:
REPORT SUMMARY
On February 12, 2025, the Town Council reviewed and provided direction on a proposed donation and gift acceptance policy. Discussion included the following:
1. Threshold acceptance levels.
2. Disposition of surplus funds and return policy.
3. Purpose and use of special revenue fund.
4. Town approved projects.
The Council dismissed threshold acceptance levels.
A substantive discussion was held on the disposition of surplus funds. Specifically, returning designated donations should they not be spent within a certain timeline, or returning any surplus designated donations after completion of the project. The policy includes language that requires the donor to specify the disposition of funds before the funds are accepted. The policy also includes language stating absent any designation by the donor on the use of surplus funds, any remaining funds, plus interest, will transfer to the General fund for general operations.
In most cases, donations received will be designated for specific functions or projects.
However, there may be a donation received with no designation. In this instance, a special revenue fund needs to be created to deposit and account for these donations.
The intent of the fund is for the balance to grow, and annual interest generated will be
TOWN OF PORTOLA VALLEY
STAFF REPORT
deposited into the General Fund for general purposes. Also, if the balance does grow to a significant amount, the principal will be available for use at the Council’s discretion.
Town approved projects must be approved by Council via Resolution. Town staff or a Town Committee can identify a project that could be subject to this policy. The identified project will be presented to Council for approval. Council will be given the scope of the project, including timelines and the amount of donations committed for the project. The Shady Trail Rehabilitation Project was used as a pilot program for donations designated for a Town-approved project.
Also in the policy is language related to donations managed by a third-party organization. Third-party organizations could include Foundations, youth sport organizations, or non-profits, etc. Policy language places the burden of donation acceptance and acknowledgement on the third-party organization. Any funds received from these organizations will be received and acknowledged as a grant by the Town.
Jon Goulden will also make a presentation on the Portola Valley Fund, a fundraising non-profit established to assist the Town in fundraising for projects.

RE: Annual Housing Element Progress Report for 2024
RECOMMENDATION
Staff recommends receiving the report and providing any comments to staff for inclusion in the submittal to the State Department of Housing and Community Development (HCD).
BACKGROUND
On January 24, 2024, the Town of Portola Valley’s City Council adopted the 2023-2031 Portola Valley Housing Element Update. The Housing Element examines the success of past housing efforts, evaluates the need for and status of housing in the town, considers constraints to expanding the housing supply, and identifies sites available for housing. The Housing Element also responds to requirements set forward in the California Government Code.
State law requires that all jurisdictions, including the Town of Portola Valley, submit a Housing Element Annual Progress Report (APR) to the California Department of Housing and Community Development (HCD) and the Governor’s Office of Planning and Research (OPR). State law also requires that the governing body consider the APR at a public meeting where members of the public are invited to comment. This report must be provided annually on forms developed by HCD and completed by Town staff. The information collected for the report covers activity during one calendar year. The Town’s progress towards meeting its goals is tracked primarily through issued building permits during the reporting year. The Town’s APR for Calendar Year 2024 is the second reporting year for the 2023-2031 Housing Element, also called the 6th Cycle.
DISCUSSION
The Town of Portola Valley’s Regional Housing Needs Allocation (RHNA) for the 6th Cycle
TOWN OF PORTOLA VALLEY
STAFF REPORT
increased the amount required during the 5th Cycle (2015-2022 Housing Element) from 64 net new units to 253 units.
The Association of Bay Area Governments (ABAG) is responsible for allocating the RHNA goals for each jurisdiction in the San Francisco Bay Area by income level. The following table identifies the Town’s RHNA Goals and the progress the Town has made in meeting these goals over the past year and in total for the 6th Cycle. In most cases, the Town uses affordability assumptions for ADUs. This methodology was developed by ABAG and agreed upon by HCD. The allocation is 30% very low income, 30% low income, 30% moderate income and 10% above moderate income.
Total net new units are distributed across income categories as shown in the table below and are from HCD’s Annual Progress Reporting Form (see Attachment 1). The total number of new net units during this RHNA cycle is 50. New units are based on building permit issuance.

In addition to reporting on the Town’s progress towards meeting RHNA Goals, the Housing Element Annual Progress Report (APR) also requires an update on the Town’s Housing Element programs. Below is a table identifying programs that were completed in 2022 or 2023, are planned to be ongoing throughout the 6th Cycle, are in progress in 2024, or will begin later in 2024. There are additional programs that begin in 2025 or later which are included in the APR and are further detailed in Attachment 1 to this staff report. It should be noted that some of the Hosing Element program implementation was delayed by limited staff and budget. The Planning and Building Director was and is filled by a part time retired annuitant and the sole planning staff position was un-occupied for much of 2024.

RE: Report of 04/22/2025 Conservation Committee meeting Action Items
Notes
1. Concerns about removal of redwood trees - too close to the house - fire protection need - Fire department ordinances require limbing up trees and removing conifers within 30 feet of the house. Require WFPD to evaluate trees.
2. Discussed budget
3. Process for reporting code violations - [email protected] - other issues go to pvconnect app.
4. Scenic corridor on Portola Valley - agreement with Midpen to help clear views to remove brush - public works or chain saw - WFPD right of way work.
5. Subcommittee on ADU checklist - Judy, Marianne, and Nona
6. Wildlife Corridor Fencing Guidelines - presented to ASCC - constructive feedback - 2 acre + parcels - already have code for required yard - 20 or 50’, on property line, only horse fencing.
Issue of smaller properties - recommendation to remove the regulations for under 1 acre.
Public study session to evaluate 1 acre properties on June 10 afternoon.
7. WFPD - joint event - early June - Joint event Balancing Fire Safety with Habitat Preservation - picking date for June
8. Tip of the month - weed control - thistles - nesting birds
9. Owl Box - location chosen on Frog Pond open space
10. Open Space - Discussion of options for Ford Park at Town Council. Deed restriction for field may include parking lot. Grant from the state to build the ball field (and possibly the field). 182 links in the Almanac about Ford Field.
11. Open Space Committee - planning to discuss wildlife corridors (not fencing)
12. Spring Down - Joint meeting with Open Space - mixed success with wildflowers. Recommend for two year retraction - provide Public Works with a time table to tractor mow every 6 weeks - not based on timing plus two days of hand weeding of thistle and bad weeds. After 2 years when staffing is stable with funding, then revisit decision on how to manage the property.
Funded by Open Space Fund.

14. Meeting with Woodside and Open Space. Woodside wants to become a rodenticide free community - Nona shared PV’s brochures and our drafted ordinance. Woodside Back yard habitat - sent out a postcard to get people to apply - CC could add note to weekly update for properties to apply.
15. Site review - revise the template for property consevation review- Discussion of scenic corridors and view shed - ASCC realm.
16. CC and ASCC - reworked screening plants and marked locations with hollywood cherry and toyon. Remove the deodar cedar and eucalyptus.

TITLE: Open Space Liaison Report
During oral communications the committee agreed informally that the fees for the appraisal of the Fogarty property could be deducted from the Open Space Fund.
The committee noted that Bev Lipman stepped down from the committee, and made comments of gratitude for her work for the committee. They welcomed their new member, Jackie Magno and appointed her as secretary of the committee.
The committee discussed an update on the status of the HCD letter/zoning submission in light of a recent Town Council meeting.
They discussed plans for maintenance of certain open space parcels, and noted that some of their directives, as well as some from the Conservation Committee, about how the maintenance should be conducted may not have been followed. They would appreciate input from staff on why this occurred, and how better to coordinate going forward given that Open Space Funds are used for these activities.
The committee discussed a potential project to monitor wildlife corridor areas to comply with 2023 legislation to amend General Plan to include a required aspect addressing wildlife corridors. Their initial focus may be on pumas in the area as some information already exists for that species.
Concerns regarding fencing interfering with wildlife corridors were raised for future consideration.
