A Resolution Accepting Real Property for Street Purposes on Durhullen Drive East of Derringer Road
A one-foot strip of land on Durhullen Drive, east of Derringer Road, within County of San Diego Map No. 7570, needs to be accepted for street purposes. This strip of land will provide connectivity and a continuation of existing public right-of-way on Durhullen Drive.
Recommended Action:
It is recommended the City Council adopt the Resolution (Attachment A) accepting real property for street purposes on Durhullen Drive.
Discussion:
When the County of San Diego recorded Subdivision Map No. 7570 on February 28, 1973 (Attachment B), Lots 11 and 12 were approved with a one-foot panhandled portion of each lot extending across Durhullen Drive. These portions of Lots 11 and 12 were offered for dedication for future street access rights. This offer was rejected by the County of San Diego at the time of map recordation. Section 66477.2 of the Government Code of the State of California provides that a rejected offer of dedication shall remain open and subject to future acceptance by the City. Attachment C provides a location map and zoomed in view of the non-dedicated roadway.
County of San Diego Tract Map No. 7892 was recorded with the County of San Diego on March 5, 1974 (Attachment D). Approval of the final map extended Durhullen Drive east to Derringer Road. As part of the final map acceptance, the County should have accepted the one-foot portion of Lots 11 and 12 from Map No. 7570 in order to connect one section of public street to another, however that acceptance was not completed. Durhullen Drive is currently maintained by the City including the one foot strip of land that has not yet been accepted as public right-of-way. While conducting research on other traffic-related matters on Durhullen Drive it was discovered that the strip of land was never accepted. This action is essentially a "clean-up" item. Acceptance of this strip of land is in the public interest and necessary to ensure continued proper maintenance of the roadway. 1 of 15
