5. Conditional Use Permit (CUP) 20-006/Minor Development Review Application (MORA) 20- 017, a request to construct and operate a wireless communication facility in the Creekside Plaza shopping center located at 13573 Poway Road, within the Commercial General district of the Poway Road Specific Plan and determination the project is exempt from CEQA review Mayor Vaus opened the Public Hearing at 7:04 p.m.

City Planner Stan Donn presented the item along with a PowerPoint presentation. He noted the project is a request from Verizon Wireless to install and operate a new Wireless Communication Facility (WCF) within the Creekside Plaza Shopping Center. Mr. Donn identified the property location and noted the project site consists of a commercial building with multiple suites within the Commercial General District of the Poway Road Specific Plan (PRSP).

With the use of illustrations and photo simulations, Mr. Donn provided before and after images of the proposed WCF and noted the antenna structure would meet the 35-foot height limit for the zone. He stated the design is architecturally integrated with the existing commercial standard and is also consistent with the design of the other wireless antenna facilities located within Creekside Plaza and complies with the City Wireless Communication Policy as it will visually blend in with the existing building architecture and therefore would be minimally noticeable from their surrounding development.

Council responded positively to the proposed design.

School. Mr. Salgado noted Poway High School is located within the Public Facilities Zone, requiring the approval of a Conditional Use Permit (CUP) per the Poway Municipal Code (PMC).

Mr. Salgado used aerial images of the campus in his description of the proposed project. He provided elevation plans and details of equipment installation with enclosure. Mr. Salgado noted the proposed project complies with the City Wireless Communication Policy as the design visually blends in with the surroundings and therefore would be minimally noticeable to the surrounding development and existing conditions as seen from Espola Road.

A neighborhood meeting was held on January 24, 2024, to allow the applicant to present the project to surrounding residential property owners and to respond to any questions or concerns. City staff were in attendance along with four (4) residents who voiced concern over cumulative radiofrequency (RF) levels. Residents were assured the preliminary RF report prepared for the proposed wireless installation, calculating the cumulative RF levels of the existing and proposed wireless carriers, are within acceptable levels. Staff shared a condition of approval of the project will require a confirming RF report be completed and submitted to the City after the antennas are installed to verify operations comply with Federal Communications Commission standards.

Mayor Vaus closed the Public Hearing at 7: 16 p.m.

STAFF REPORTS:

7. Resolution to Participate in the County of San Diego Agricultural and Livestock Pass Program Senior Management Analyst Jenna Stein introduced the item. She explained the program would largely be administered together by San Diego County Fire and San Diego County Department of Agricultural Weights and Measures and would operate as a joint operation between the Fire and Sheriff's Departments during emergency evacuations. She stated the program is currently active in the unincorporated area of the County. 5 of 14 May 7, 2024, Item #2
City of Poway - Minutes - February 20, 2024
Sergeant Mike Davis from the San Diego Sheriffs Department Emergency Planning Division provided additional information about the program, including background on Assembly Bill 1103 which authorized the San Diego County Board of Supervisors to establish an agricultural (Ag) and livestock pass program. He noted AB 1103, Section 409.4(e) authorizes valid livestock pass members to, when approved by law enforcement, enter "soft" closure areas.

He stated the program is an evacuation pass for commercial agricultural or livestock operation and allows for the evacuation or care of livestock and tending to crop by owners, operators or managerial staff during a local emergency. Sgt. Davis detailed the program's rules and requirements for approval noting the pass allows for reentry during a "soft" road closure and only during daylight hours. Participants are issued an identification card which is good for one year as each participant is required to undergo annual recertification. Sgt. Davis noted the program as an "all-hazard" program, applying to all types of local disasters.

Sgt. Davis explained "hard closure" versus "soft closure" conditions, notification procedures, and approval to access the Ag Pass holder's commercial property.

Public Comment:

None.

End of Public Comment.

Council discussion ensued. In response to Council questions, Sgt. Davis confirmed the program is applicable to owner/operators and managerial employees of commercial properties only with access granted only during a soft road closure solely to the person with the Ag Pass identification card. Ms. Stein provided further details on publicizing the program and its inclusion as part of the Fire Department's community and emergency preparedness outreach efforts. Responding to Council questions, Ms. Stein noted, City staff anticipate approximately two dozen Poway businesses would be eligible for the program. She further noted businesses must have a current business certificate to participate in the program.

Motioned by Mayor Vaus, seconded by Deputy Mayor Frank to approve Resolution No. 24-007 entitled "A Resolution of the City Council of the City of Poway, California, to Participate in the County of San Diego Agricultural and Livestock Pass Program." Motion carried unanimously.

8. Approval of Encroachment Agreement (EA) between the City of Poway and Pome BESS, LLC for Long Term Encroachment of the Public Right-of-Way for the installation of an underground Gen-Tie (General Transmission) line
Assistant City Manager Wendy Kaserman presented the item and provided background. She noted, at the January 16, 2024 Regular City Council meeting, staff presented a proposed Encroachment Agreement (EA) between the City and Pome BESS, LLC (Pome BESS). Pome BESS is an administratively approved battery storage project on Danielson Street in the business park but requires long-term access to the City's right-of-way through an EA to provide for the transmission of power between the battery project site and the SDG&E substation located on Stowe Drive.

At the January meeting, Council raised concerns about the public benefits associated with the project and rejected the EA as it was proposed. Following the January meeting, 6 of 14 May 7, 2024, Item #2
City of Poway - Minutes - February 20, 2024
representatives from Pome BESS met with City Management to discuss public benefits and ways that Pome BESS could meaningfully contribute to the City of Poway.

Ms. Kaserman highlighted several proposed changes to the EA including: the proposed annual fee for the encroachment into the right-of-way increased to $100,000 annually, and will be adjusted annually for inflation; the agreement includes a guaranteed $50,000 in property tax revenue annually from the project with an annual look-back on the property valuation written into the EA; and finally, Pome BESS agreed to contribute $500,000 towards improvements at Community Park. Ms. Kaserman noted it is possible the City could see sales or use tax benefits associated with the project and have included language in the EA stating Pome BESS will take every step legally feasible to identify the project site as the point of sale and/or register the business location where sales and use tax should be attributed.

Public Comment:

Kathy Lin, representing Pome Bess, LLC, thanked Council for the opportunity to resubmit a revised Encroachment Agreement and added they are happy to have an opportunity to support Community Park and many local Poway businesses.

Kimberly Gudorf spoke in support of Item 8, citing the benefits of power grid reliability and stability.

End of Public Comment.

Council discussion ensued. Council responded positively to the applicant's revisions included in the Encroachment Agreement, noting the improved community benefit incorporated into the agreement and the contributions towards Community Park. Council further discussed power grid reliability, facility safety and long-term impacts to the Business Park.

Motioned by Mayor Vaus, seconded by Councilmember Pepin to approve the Pome BESS Encroachment Agreement with Pome Bess, LLC and authorize the City Manager to execute the Agreement on behalf of the City, as well as make any minor modifications or take further action that may be necessary to effectuate the intent of the Encroachment Agreement. 5. Amendments to Chapters 2.21, 13.12, 16.10, 17.02, 17.40, 17.46, 17.47, 17.48 and 17.50 of the Poway Municipal Code and the Master Fee Schedule Regarding Rehearing Procedures and Public Noticing
Mayor Vaus opened the Public Hearing at 7:26 p.m.

City Attorney Alan Fenstermacher presented the item. He described the proposed amendments as the result of City staff's periodic analysis and recommended edits to the Poway Municipal Code (PMC).

Mr. Fenstermacher explained most of the proposed edits to the PMC are for the removal of the rehearing procedure . He detailed the rehearing process noting it only being available if "new and different evidence not available at the previous hearing" is discovered within 1 0 days of the relevant hearing or decision and added the rehearing procedure is rarely used. Mr.

Fenstermacher noted it is an inefficient use of City resources and City Council's time, he spoke regarding the unlikely scenario by which new and different evidence would be discovered within 10 days of a City Council decision and the likelihood City Council would reverse course on a decision that was just made. Mr. Fenstermacher emphasized, any aggrieved party can still appeal any decision made by City staff or any inferior City body to the City Council or challenge a decision by the City Council in Superior Court.

Mr. Fenstermacher stated the second aspect of the proposed amendments is an update to the provisions regarding public notice requirements . He cited state law noticing requirements for various land use type approvals and the requirement to send a notice to all the property owners within 300 feet of the project, while the PMC requires noticing within a 500-foot radius.

The amendment would formally codify the process to provide notice to all occupants, including tenants, within 500 feet and shift costs of the noticing procedures to the developer.

Currently, the City either pays a third-party consultant to provide notice to occupants or pays postage for notices to property occupants . The changes would relieve staff of this task by requiring private applicants to pay for all noticing for their own projects.

Public Comment:

The following individuals spoke in opposition to Item #5 and the removal of the rehearing process:

Jeffrey Schmidt
Lori Grennan
Eric Weller
Barbara Diederichs
End of Public Comment.

Mayor Vaus closed the Public Hearing at 7:41 p.m.
11 of 14 May 7, 2024, Item #2
City of Poway - Minutes - March 19, 2024
Council discussion ensued. Mr. Fenstermacher elaborated on rehearings and appeals, noting the distinction between the two processes. Council responded positively to shifting all the costs of occupant public noticing to the project developer and to the removal of the rehearing process, citing its redundancy, inefficient use of time and resources and infrequent usage.

Council clarified City staff would continue to be responsible for public noticing which includes notifying the occupants as well as property owners. Council noted fees associated with noticing would now be the responsibility of the developer and not the City.

Motioned by Deputy Mayor Frank, seconded by Mayor Vaus to adopt Resolution No. 24-008 entitled "A Resolution of the City Council of the City of Poway, California, Amending the Master Fee Schedule to Add Fees Relating to Public Notices, and Remove Reference to Rehearing." Resolution Confirming Adjustments to EDCO Waste and Recycling Services' Rate Schedule
On June 2, 2020, the City Council for the City of Poway (City) adopted Resolution No. 20-034 (Attachment B) approving EDCO Waste and Recycling Services' (EDCO) rate schedule; and approving pass-through/inflationary adjustments through June 30, 2025, using the same methodology and formulas prescribed for rate adjustments in the franchise agreement between the City and EDCO. EDCO has requested the annual rate adjustment for Fiscal Year (FY) 2024-25. The proposed resolution (Attachment A) confirms the solid waste and recycling service and disposal rate schedule adjusted for FY 2024-25 is consistent with Resolution No. 20-034 and the approved methodology. These rates were last adjusted for FY 2023-24 through City Council adoption of Resolution No. 23-018 on May 16, 2023. This action will rescind Resolution No. 23-018.

Recommended Action:

It is recommended the City Council adopt the Resolution (Attachment A) confirming an adjustment to EDCO Waste and Recycling Services' rate schedule effective July 1, 2024, consistent with Resolution No. 20-034 and rescind Resolution No. 23-018.

Discussion:

The City has an exclusive Franchise Agreement with EDCO for solid waste collection and recycling services. The Franchise Agreement establishes the methodology for establishing rates for residential and commercial solid waste collection. On March 19, 2024, as required under the terms of the Franchise Agreement, EDCO notified the City of an increase in the Consumer Price Index (CPI) and requested a rate increase effective July 1, 2024 (Attachment C).

Any adjustment to the solid waste and recycling rate for residential and commercial collection services is subject to detailed notice and public hearing requirements, commonly referred to as Proposition May 7, 2024, Item #3
218. On June 2, 2020, the City Council held a noticed, public hearing pursuant to Proposition 218 and adopted Resolution No. 20-034 approving EDCO's rate schedule, which included the adoption of an organics recycling fee, and approved pass-through inflationary adjustments to EDCO's service fees through June 30, 2025. The Resolution specifies the method and formula to be used in calculating the maximum allowable rate adjustment based on the CPI and fluctuation in disposal tipping fees. In accordance with the Franchise Agreement with EDCO, solid waste service rates may only be increased because of landfill disposal fee increases, CPI or because of extraordinary circumstances. Per the Franchise Agreement, solid waste rate adjustment may be requested annually.

The City's solid waste service rates are comprised of four components: 1) service fee; 2) disposal fee; 3) California Integrated Waste Management Act (AB 939) fee; and 4) the franchise fee. Adjustments to the service fee, disposal fee and franchise fee are being requested at this time, which are based on changes in the EDCO service fee and the RSWA disposal tip fee CPI. No change to the AB 939 fee or the disposal fee is proposed at this time. As specified in the Franchise Agreement, the CPI adjustment is based on the second half of the previous twelve-month period for the San Diego-Carlsbad area index for All Urban Consumers. The second half of the 2022 index was 348.945 and the second half of the 2023 index was 365.529, a change of 16.584 points or 4.753 percent in the index. The CPI increase accounts for costs of labor, fuel, capital replacement and administrative costs.

The RSWA disposal fee increase is typically calculated separately from the EDCO CPI adjustment. The increase is determined following provisions contained in the Regional Solid Waste Association (RSWA) Disposal Agreement with EDCO, of which the City is a member agency. The RSWA disposal rate will increase 3.47% resulting in an increase of $1.68 per ton. Effective July 1, 2024, the new tip fee is $50.21 per ton for roll off activity.

The total fees when applied will result in residential rates increasing from $30.06 to $31.37 per month.

An increase of $1.31 per month for households using a 95-gallon cart. Commercial rates for a three cubic yard bin, the most common service, would increase from $132.00 to $137.82 or $5.82 per month.

For illustrative purposes, the following tables show the current monthly rates and the proposed FY 2024-25 monthly Solid Waste/Recycling Service Rates for the three most common service levels and commercial commingled organics.

EDCO WASTE AND RECYCLING SERVICES RATE SCHEDULE
AND RESCINDING RESOLUTION NO. 19-026
WHEREAS, the Public Resources Code Section 41901 provides local jurisdictions the authority to assess solid waste fees to meet state-mandated costs associated with the passage of AB 939;
WHEREAS, the City Council awarded the exclusive Solid Waste Franchise Agreement to Mashburn Waste and Recycling Services on September 21, 1994; and Mashburn became EDCO Waste and Recycling Services (Contractor) in 1998;
WHEREAS, the City Council revised Article 8 of the Franchise Agreement between the City of Poway and Contractor by adding AB 939 fees as an additional criterion for the annual adjustment of monthly rates upward or downward;
WHEREAS, Article 8 of the Franchise Agreement requires City Council approval prior to any increase in the Contractor's service rates;
WHEREAS, Article 8 of the Franchise Agreement allows the Contractor to request an adjustment to monthly rates due to the Contractor's increased costs resulting from changes in landfill disposal fees, changes in the Consumer Price Index (CPI) or special circumstances; WHEREAS, the current rate schedule (attached hereto as Exhibit A) has been revised to reflect the effects of a 2.59 percent landfill disposal fee increase, a 1.93 percent change in the CPI, various commercial organic waste collection service fees, and a $3.68 per month residential organic recycling fee to be implemented when EDCO's Anaerobic Digestion Facility becomes operational;
WHEREAS, the City Council of the City of Poway held a public hearing on June 2, 2020, notice of which was duly provided, and which was conducted, pursuant to the provisions of Article XIIID of the California Constitution and the Proposition 218 Omnibus Implementation Act (California Government Code section 57350 et seq.);

Disposal Fee
The Franchise Agreement with EDCO and the Regional Solid Waste Association allows for an annual increase of the disposal tip fee, effective July 1 of each year. The following table uses a formula and the Los Angles-Anaheim-Riverside, CA area (CPI) for all items, base period of 1982-84=100, published by the United States Department of Labor, Bureau of Labor Statistics for the latest 12-month period for which statistics are available.

The adjustment is calculated by comparing the Los Angeles-Anaheim-Riverside CPI for the latest 12-month period for which statistics are available. The adjustment is calculated by subtracting the previous CPI for December of year one (X) and the last CPI for December of year two (Y) which produces an index change. This number is divided by the previous period {X) and multiplied by 100 which is the value used as the multiplier for the disposal tip fee component of the base rate.

This percent change may be adjusted by applying a calculation that includes, in part, a modifier of the percent increase of the previous year's increase in waste tonnage. Any adjustment to the base multiplier will modify the disposal tip fee component of the formula. This cannot be determined in advance.

SECTION 7: The changes in fees shall take effect on July 1, 2020 at which time Resolution 19-026 will be hereby rescinded.

RE:

Dear
Jennafer:

March

Article
8 of
the
Poway
Solid
Waste
Franchise
Agreement
allows
annual
rate
adjustments
based
on
increases
in
the
San
Diego
area
Consumer

(CPI)
and
any
applicable
increases
in
solid
waste
tip
fees
under
the
Region
al Solid

Association
agreement,
to
which
Poway
is
a
party
. Under
the
provisions
of
the
franchise
, EDCO
Waste
&
Recycling
Services
is
requesting
a
rate
adjustment
effective
July
l, 2024.

CPI
Adjustment
To
calculate
the
CP[
portion
of
the
adjustment,
the
second
half
of
the
2022
index
(348.945)
was
compared
to
the
second
half
of
2023
index
(365.529)
which
produced
a

16.584
point
change
or

4.753%
increase.

The
CPI
indexes
are
attached
for
your
reference.

The

4.753%
increase
is
applied
to
current
rates
after
franchise
fees
, AB939
and
disposal
fees
are
deducted
from
the
current
gross
rate.

RSWA
Disposal
Fee
Adjustment
The
City
is
a
member
of
RSW
A
that
regulates
waste
disposal
tipping
fees
for
its
member
agencies
.

Currently
the
tip
fee
for
Poway
is
$48
.53
per
ton.

Effective
July
I, 2024,
the
tip
fee
for
Poway
will
increase
to
$50.21,
representing
a 3.47%
increase
in
the
tip
fee
component
of
the
rate
calculation. Rate
Summary
The
total
fee
adjustments
as
outlined
above
when
applied
will
result
in
residential
rates
increasing
from
$30
.06
to
$31.37
per
month
, an
increase
of
$1.31
per
month
per
household
for
customers
using
a
95 Gallon
Cart.

Commercial
rates
for
the
most
common
service
(a
three
cubic
yard
bin
served
once
weekly)
would
increase
from
$132.00
to
$137.82
or
$5.82
per
month
. We
propose
to
implement
both
residential
and
commercial
rate
changes
on
July
I,
2024
.

3. Volume Rebate Calculation
The current annual volume rebate of $401,852 is multiplied by the CPI capped increase of 3.47%, which generates an additional $13,944.26 in rebate revenue. The adjusted volume rebate is $415,796.26. 1/3 of this amount ($138,598.75), is adjusted by the percentage change in tonnage generated in 2023 compared to 2022, (-.4%). Since the tonnage change is negative, it results in 0% change for this component of the rate.

Therefore, the total volume rebate payable to RSWA beginning July 1, 2024 is $415,796.26.

Please review these calculations at your earliest convenience so we may proceed with rate changes in all RSWA cities.

Resolution Authorizing the City of San Diego Solid Waste Local Enforcement Agency to be the Lead Waste Agency for the Regional Tire Enforcement Program The City of San Diego Solid Waste Local Enforcement Agency {LEA) invited the City of Poway to be a participant in the San Diego Regional Waste Tire Enforcement Program. Funded by a grant from the California Department of Recycling and Recovery (Cal Recycle), the program ensures local businesses comply with all laws and regulations for the disposal of tires. The Waste Tire Enforcement Grant is an annual grant offered by Cal Recycle and will be in its 30th grant cycle for Fiscal Year (FY) 2024-25. The City of San Diego will serve as the Primary Collaborative Jurisdiction to submit the grant application and implement the Waste Tire Enforcement Program.

Recommended Action:

It is recommended the City Council adopt the Resolution authorizing the City of San Diego Solid Waste LEA to apply'for funds and administer the San Diego Regional Waste Tire Enforcement Program on behalf of the City of Poway through FY 2028-29.

Discussion:

According to CalRecycle, California is faced with the significant challenge of diverting or safely managing more than 51 million reusable and waste tires generated each year. It is estimated fewer than 25,000 waste tires remain in stockpiles throughout California. These stockpiles pose a potential threat to public health, safety an~ the environment. In 1989, the California Legislature enacted comprehensive requirements for the storage and disposal of waste tires and Cal Recycle was charged with the responsibility for tire pile stabilization and remediation where public health, safety and the environment may be at risk.

CalRecycle adopted regulations to establish and enforce waste tire storage and handling standards through a statewide manifest system. Cal Recycle delegated the responsibility for the administration of the enforcement, compliance and surveillance activities at the waste tire facilities to local solid 1 of 5

AG EN DA REPORT City of Poway

CITY COUNCIL
May 7, 2024
Honorable Mayor and Members of the City Council

[email protected]
Proposed Amendment to Section 2.04.020 of the Poway Municipal Code to Increase Mayor and City Councilmember Salaries
California Government Code section 36516 provides that a City Council may establish their salary by ordinance, with a maximum initial salary determined by the City's population. As a general law city, not a charter city, Poway is limited to specific salary increases. Salaries may be increased beyond the specified amount by an ordinance amendment up to an amount equal to five percent (5%) for each calendar year from the last compensation adjustment, without compounding. The most recent Poway City Council salary adjustment was approved in 2022 (effective January 1, 2023). There is no state law limit on additional compensation that may be provided to a separately elected Mayor, but City policy states that the Mayor should make approximately 40% more than the other Councilmembers.

In March 2016, the City Council adopted Resolution No. 16-005, which directs City staff to review Mayor and City Council salaries every even-numbered year and present salary recommendations to Council for consideration and direction in a public meeting.

Recommended Action:

Staff recommends
the City Council adopt a proposed ordinance (Attachment A) adjusting Mayor and City
Council member salaries, which would take effect in January 2025 following the November 2024 General Municipal Election, raising Council salaries by 5% for each of the two calendar years since the last increase. City staff is not recommending increasing the Mayor and Council members mileage and cell phone reimbursement allowances, which were increased along with salaries effective January 2023. The City Council may modify the amount of the proposed increase(s) during the public hearing, if desired, or reject any portion thereof.

Discussion:

California Government Code section 36516 provides that a city council may establish their salary by ordinance, with a maximum initial salary determined by the City's population, and limits future 1 of 5
May 7, 2024, Item #7
increases .. California Government Code section 36516.1 allows the Mayor to receive additional compensation as compared to Councilmembers, reflecting the Mayor's additional duties. Following the most recent salary adjustment to City Council salaries, which were approved in 2022 and took effect January 1, 2023 (Ordinance 857), the current Council salaries and cost reimbursement allowances are as follows:
• Mayor -
• Council member -
$2,306.91 monthly salary
$500 per month mileage reimbursement
$90 per month cell phone reimbursement
$1,647.79 monthly salary
$360 per month mileage reimbursement
$60 per month cell phone reimbursement
The City Council's salaries may be increased beyond the specified amount by an ordinance amendment up to an amount equal to five percent (5%) for each calendar year from the last compensation adjustment. Thus, the maximum increase permitted by law at this time is a total of 10%, non-compounded.

Pursuant to City Council Resolution No. 16-005, Mayor and Councilmember salary increases should generally reflect changes to the Consumer Price Index (CPI), but not exceed limits set forth by California Government Code of 5% each year. This Resolution also states that the Mayor should generally make 40% more than the other Councilmembers, in recognition of the extra time commitments required for the position of Mayor. Thus, the recommended (and maximum) amount would be an increase of $164.78 per month for each Councilmember, and $230.69 per month for the Mayor, which reflects the same 40% differential that exists today.

Staff recommends the City Council adopt the proposed ordinance (Attachment A) that would result in the following new salary and cost reimbursement allowances, the latter of which remain unchanged:
• Mayor -
• Council member -
$2,537.91 monthly salary
$500 per month mileage reimbursement
$90 per month cell phone reimbursement
$1,812.57 monthly salary
$360 per month mileage reimbursement
$60 per month cell phone reimbursement
Pursuant Government Code section 36516.5, a change in compensation does not apply to an elected official during his or her term in office. However, the compensation of all members of a City Council serving staggered terms can be adjusted by virtue of the beginning of a new term of office for a single member. Therefore, any approved salary increase will not take effect until after the November 2024 election, but will apply to all members of the City Council. If approved, these increases would take effect on January 1, 2025.

Environmental Review:

None.
2 of 5
May 7, 2024, Item #7
Fiscal Impact:

Approval of this item will result in an adjustment to the proposed Fiscal Year 2024-25 operating budget and will reflect increased annual salary and related benefit costs of approximately $6,917. As noted earlier in the report, if approved, the proposed changes would not take effect until January 2025, therefore the fiscal impact for year 1 only reflects costs from January 2025 through June 2025.

The full fiscal impact would not be realized until FY 2025-26.

Public Notification:

None.

CITY COUNCIL
Resolution Adopting the Trans Net Local Street Improvement Program List of Projects for Fiscal Years 2024-25 through 2028-29
The San Diego Association of Governments (SANDAG), as the regional Metropolitan Planning Organization (MPO), is required by State and Federal laws to develop and adopt a Regional Transportation Improvement Program (RTIP) every two years. The RTIP is a five-year program of proposed major highway, arterial, transit, pedestrian and bikeway projects funded by revenues from the TransNet half-cent sales tax. Pursuant to the TransNet Extension Ordinance, all local agencies are required to submit a list of proposed capital projects to be included in the proposed RTIP. The 2025 RTIP includes the list of projects proposed for full or partial funding by TransNet revenues for Fiscal Years (FY) 2024-25 through 2028-29.

Recommended Action:

It is recommended the City Council take public input, close the public hearing and adopt the Resolution (Attachment A).

Discussion:

The goal and purpose of the RTIP is to enhance the regional transportation system and improve regional air quality. In order for local agencies to receive their allocated portion of annual TransNet half-cent sales tax funds, projects must be included in the RTIP, and must comply with the requirements as outlined in the SAN DAG memorandum dated February 14, 2024. The SANDAG Board is scheduled to adopt the 2025 RTIP at its September 27, 2024, meeting.

The TransNet Extension Ordinance requires local agencies every two years to adopt a five-year list of projects to be included in the RTIP and funded with TransNet revenues. In developing the list of projects, local agencies shall give a high priority to the use of these funds for improving regional arterials and related facilities contributing to congestion relief. Attachment B is the proposed 2025 RTIP five-year list of projects for the City of Poway.

Staff is proposing to add three new projects into the RTIP as follows:
1 of 7
May 7, 2024, Item #8

1. Midland Road Safety project (STR0002) in the amount of $50,000. The RTIP funds will supplement the Midland Road Safety project approved by City Council on October 17, 2023.

This project proposes to improve pedestrian safety along Midland Road between Norwalk Street to Putney Road by installing fluorescent yellow-green signs, rapid flashing beacons, and a speed feedback warning sign to reduce vehicular speed. The project is currently bidding and will be constructed this summer.

2. Poway Road Safety Improvements project (ST018) in the amount of $75,000. The RTIP funds will be used as a local match to the Highway Safety Improvement Program grant. The project will modify four existing concrete medians to restrict dangerous left turn movements from side streets onto Poway Road, upgrade signal controller cabinets, install video detection systems at five traffic signal intersections, and upgrade intersection regulatory signs. The contract will awarded at the May 21, 2024 City Council meeting.

3. Traffic Signal Improvements in the amount of $300,000. The project will upgrade the video detection systems, install back-up batteries, appurtenant wiring, and replace other aging signal equipment at the signal intersections of Twin Peaks and Community Road and Pomerado Road and Meadowbrook.

Staff is also proposing to add $500,000 in additional appropriation to the Neighborhood Sidewalk project. The project will install sidewalks where they are currently missing along Powers Road, north of Tassel Road. This is a continuation of the Neighborhood Sidewalk Project that was programmed in FY 2022-23 and was chosen based upon proximity to Meadowbrook Middle School. A total of $315,000 is proposed for the FY 2024-25 Annual Street Maintenance project, which will slurry streets in pavement management Zone 7. A total of $2,353,391 is proposed for the annual street overlay projects. The proposed FY 2024-25 Annual Street Overlay will include $1,653,091, which will address the needed repairs in pavement management Zone 8 and the remaining $700,300 will be appropriated with the FY 2023-24 Annual Street Overlay addressing repairs in pavement management Zone 7, which is anticipated to be awarded at the May 21, 2024 City Council meeting. A total of $60,000 is proposed for the Espola Road Safety Improvements Phase 2. The project is complete, however, additional expenses were identified that were not reimbursed by SAN DAG after reconciling the project accounts. Programming the additional funds will re-open the project with SANDAG in order for the City to submit a reimbursement request.

The City of Poway's total share of the TransNet revenues for local street and road program improvements is estimated at $10,855,000 over the five-year period covered in the proposed 2025 RTIP (Attachment C). The Trans Net Ordinance requires no more than 30 percent of revenues be spent on local street and road maintenance related projects. Funds not used during each fiscal year are carried over to the next year as part of the total revenues available to the City. A total of $1,560,691 of available unspent funds from the annual Street Maintenance, annual street Overlay and Espola Road Median project are being carried over from previous fiscal years and reprogrammed into the various projects listed in FY 2024-25 and 2025-26 as shown in Attachment B.

Several projects identified in the City's 2023 RTIP have been completed including the FY 2021-22 and FY 2022-23 Annual Street Overlay projects (ST019 and ST023), and the FY 2021-22 and FY 2022-23 Annual Street Maintenance projects (ST016 and ST022). The FY 2021-22 Neighborhood Sidewalk project is currently bidding and a construction contract will be awarded in June.

CITY COUNCIL
Conditional Use Permit (CUP) 22-0007, a request to amend CUP 13-005 to Increase the Allowable Student Enrollment of an Existing School at 12642 Monte Vista Road in the Commercial Office (CO) Zone and Determination that the Project is Exempt from CEQA review
Country Montessori School of Poway is requesting to amend CUP 13-005 to allow its enrollment to increase from 165 to 195 students. The school is located at 12642 Monte Vista Road in the CO zone.

The increased number of students would be accommodated within the existing classrooms.

Recommended Action:

It is recommended the City Council take public input, close the public hearing, and adopt the resolution (Attachment A) approving CUP 22-0007.

Discussion:

The applicant is Adela Corrales, Head of School representing the Country Montessori School. The property owner is Country Montessori School of Poway. The subject property is located at 12642 Monte Vista Road in the CO zone (Attachment B). Surrounding land use consists of a medical office complex to the west, an office complex and vacant parcel to the north, a memory care facility to the east, and a single-family residential development to the south.

In 1991 the Country Montessori School received approval of CUP 91-08 to continue school operation at its Monte Vista Road location for up to 150 students and to add two modular classroom buildings.

Up until then the school had been operating out of an existing 4,200-square-foot building that had been converted from a single-family residence to classrooms. In 1998 the school received City Council approval of a modification to the CUP to allow the student enrollment to increase up to 165 students and to install a new modular classroom building. Considering the school was using three modular buildings and concerns about neighborhood compatibility, the City Council included a condition of approval that no more than the three modular buildings should ever be allowed at this school and 1 of 10
May 7, 2024, Item #9
that any replacement of these buildings would have to be with conventional construction.

In 2002, the school needed more capacity. A request was submitted and received City Council approval for another expansion to allow up to 195 students and the installation of an additional 1,440-square foot temporary modular classroom. However, the City Council established a 3-year time limit on the school's CUP with the intent to direct the school to develop a business plan for a permanent solution to address its growth by either constructing permanent facilities onsite or by building a school on a new site. There had also been on-going complaints from the neighborhood about the school's operations regarding traffic, parking, noise, and lighting.

Over the next few years, the City Council granted three separate time extensions, to allow the Country Montessori School additional time to find a permanent solution. The school purchased a property on 9th Street and received City approvals in 2007 to establish a new school campus at the new location.

However, anticipated funding to construct the school did not materialize, and the school had to abandon the plan to build a new school at the 9th Street location and sold the property.

On June 16, 2009, the City Council approved a request from the school to modify CUP 91-08 to remove the time limit on the CUP so they could stay at their Monte Vista Road location on a permanent basis.

In return, the school reduced the allowable student enrollment back to 165 students and removed the temporary classroom that had been installed in 2002. The school had also been taking measures to address neighborhood complaints, and by 2009, the City had not received any complaints about the school in the prior five years.

In 2013, the school requested and received staff-approval of a minor modification to CUP 13-005 and a Minor Development Review Application (MORA) 13-004 to demolish the existing 4,200-square-foot classroom building and construct a new 3,973-square-foot classroom building. The approval also included the installation and maintenance of a temporary 2, 160-square-foot classroom building to be used while the new classroom building was under construction. The enrollment would remain at 165 students. The new classroom was completed in 2014 and the temporary classroom was subsequently removed.

The school is currently requesting that its allowable enrollment be increased from 165 to 195 students. The school has seen significant increase in students over the past few years and would like to have more capacity available for new students. The additional students can be accommodated using the existing classroom and other campus facilities. No temporary buildings remain on the site.

It has been estimated the additional 30 students would result in an increase in 44 additional trips. The school submitted a traffic memo outlining how the additional trips will be addressed by extending and staggering the morning arrival and afternoon dismissal process. Both the parking lot and the designated loading/unloading zone curb on Monte Vista Road will continue to be used at arrival and dismissal times. Teachers will also continue to assist in the loading and unloading of the students to keep the flow of cars moving and to keep students safe. Attachment C shows the school site and designated drop-off and pick-up areas.

Neighborhood Meeting:

A neighborhood meeting was held on February 27, 2024, to allow owners and occupants within 500 feet of the site to learn about the project, ask questions, and provide comments. Only representatives for Country Montessori School were in attendance.

May 7, 2024, Item #9
Environmental Review:

The project is Categorically exempt from the California Environmental Quality Act (CEQA), as a Class 14 Categorical Exemption, pursuant to Section 15314 of the CEQA Guidelines, which exempts minor additions to schools where the addition does not increase original student capacity by more than 25% or ten classrooms, whichever is less. This project involves the increase of approximately 19 percent of the currently allowed student attendance and would be accommodated within the existing classrooms.

Fiscal Impact:

None.

Public Notification:

A Notice of Public Hearing was published in the Poway News Chieftain of April, 25, 2024. A public notice was mailed to property owners and occupants located within 500 feet of the project site.
