Mayor Steve Vaus
Minor Development Review Application for Residential Projects The development review and permitting process is guided by numerous requirements set forth in state, county and local laws. While the City does not have control over state and county laws, we do have the opportunity, and I would argue the responsibility, to regularly review processes set forth in the Poway Municipal Code (PMC) to see where there are opportunities to cut red tape, improve efficiencies and reduce unnecessary costs and time associated with the development process. particularly for individual property owners trying to build a single home, complete an addition, remodel. a detached accessory structure, or build an unlighted recreational court.
Currently, per the PMC, the following types of projects require the processing and approval of a Minor Development Review Application (MORA) before a Building Permit application can be accepted by the City:
• A new single-family home. (Multiple new homes that are part of a tract housing project require a Development Review Application).
• A single-family home addition/remodel which results in 750 square feet, or more, of habitable space.
• A detached, non-habitable, accessory structure that exceeds 1,500 square feet on a residential lot less than 2 acres.
• Unlighted recreational courts.
• Additions to commercial buildings which are less than 10,000 square feet or 25 percent (25%) of the existing square footage, whichever is more restrictive. • Significant exterior renovations to commercial buildings. • Above ground public utility boxes that have a dimension of greater than 36 inches in any direction or any utility box within 100 feet of an existing utility box. • Other ground mounted equipment on commercial and industrial lots that are not enclosed within a wall or fence.
• Telecommunication facilities located within the South Poway Business Park.
While the MORA process is intended to help applicants by providing staff an opportunity to thoroughly review projects and identify potential issues prior to the building permit process, it results in additional costs to the applicant, requires additional staff time, provides little new 1 of Z February 6, 2024, Item #9

information, and causes substantial delays in permit approval and construction. It is also fairly unique to Poway. My proposal is that we direct staff to bring forward proposed changes to the PMC to eliminate the MDRA process for residential projects including the construction of a single home, additions, remodels, detached accessory structures, and unlighted recreational courts. The exception would be residential properties where habitat is identified by the City's Habitat Conservation Plan (HCP). Those projects, along with commercial projects and telecommunication facilities would all remain subject to current MDRA requirements in the PMC. Projects where cultural resources are identified may be subject to additional submittal and/or monitoring requirements and fees.
For projects eligible to skip the MDRA process, applicants would still be required to submit all of the technical documents and plans required by the MDRA process, however instead of doing that prior to application for a building permit, they would submit at the time of building permit application.
As part of the MDRA process, courtesy notices are provided to neighbors 10 days prior to approval.
Should the MDRA process be eliminated for residential projects this courtesy notification would no longer be provided, as the City does not provide advanced notice of approval of building permits. To do so would be overly burdensome.
Recommended Action:
Mayor Vaus requests concurrence to direct staff to bring forward recommendations for eliminating the MDRA process for residential projects including a single home, additions, remodels and detached accessory structures, and unlighted recreational courts with the exception of projects with habitat as identified in the City's Habitat Conservation Plan (HCP).
Should these changes to the PMC be approved at a future City Council meeting, it is recommended _ there be a one year .look back following implementation to assess its impact on streamlining the development process.

Information Sheet
Information for the following types of development:
• New Single-Family Residence
• Additions to Single Family Residence of 750 square feet or more of habitable space • Detached non habitable accessory structure that exceeds 1,500 square feet. • Unlighted Recreational Courts
Before submitting your building permit application to the Development Services Department, you are encouraged to contact the Planning Division to get clarification on the City submittal requirements specified below. Also be advised that, depending on the type and location of the project, additional special studies and/ or reports pertaining to biological or archeological resources, grading in hillside areas, and/or storm water quality may be required. Applications can be submitted anytime though the City of Poway Online Services portal at services.poway.org. Topics listed below need to be considered prior to building permit application submittal.
The purpose of a building permit is to ensure that new construction meets minimum code standards, which are designed to protect life and property. To accomplish this, building permit applications are reviewed by city staff against applicable state and local building and land development codes and regulations. Initial application submittals that are complete and accurate help streamline the department's review processes, which allows the city to issue permits quicker thereby saving applicants time and money.
Please note, applications for which no permit is issued within 365 days following the date of application shall expire with no extensions. Every permit issued shall become invalid unless the work on the site authorized by such permit is commenced within 365 days after it's issuance or if the work authorized on the site by such permit is suspended or abandoned for a period of 365 days after the time the work is commenced.
HABITAT/ BIOLOGICAL RESOURCES
When a project site contains habitat and/or a proposed project has the potential to impact habitat a biological report/assessment by a qualified biologist may be required.
An Administrative Clearing Permit (ACP) will be required for any impacts to habitat pursuant to Poway Municipal Code (PMC) Chapter 16.42.
GRADING
Projects that require a grading permit must apply for a grading permit and grading shall be completed prior to Building Permit issuance.
In general, a grading permit is required if the proposed excavation or fill exceeds 3 vertical feet in depth, if there is over 50 cubic yards in total excavation or fill, for the paving over an exposed ground surface of over 5,000 square feet, etc. To determine if your project requires a grading permit, please refer to PMC Chapter 16.42 and contact Engineering staff.
SLOPE
When a project is located in the RR-A, RR-B, RR-C, or RS-1 zone, a slope analysis is required pursuant to Resolution 01-103. The maximum allowable graded area will be based on the slope analysis. 10 of 11

CITY COUNCIL
Conditional Use Permit 24-0004 and Development Review 24-0001, a Request to Modify the Approved Conditional Use Permit 22-0006 and Development Review 22- 0005 by Relocating the Outdoor Dining Area for Raising Cane's, located at 12665 Poway Road (APN 317-490-14-00)
This project is a request to modify the previously approved Conditional Use Permit {CUP) 22-0006 and Development Review (DR) 22-0005 for the relocation of the outdoor dining area. The approved CUP was approved to demolish an existing 5,022-square-foot commercial building and redevelop the site with a 3, 144-square-foot drive-through restaurant, Raising Cane's, with outdoor dining located at 12665 Poway Road, in the Commercial Office {CO) land use district of the Poway Road Specific Plan (PRSP) area.
Recommended Action:
It is recommended the City Council take public input, close the public hearing, and adopt the Resolution {Attachment A) approving CUP 24-0004 and DR 24-0001 for the modification of CUP 22- 0006 and DR 22-0005 and make the determination the project does not require additional California Environmental Quality Act {CEQA) review pursuant to CEQA Guidelines 15162.
Discussion:
The applicant is Lester Tucker, for Raising Cane's, and the property owner is Deborah Falk Properties LLC. The subject property is a 0.93-acre site located at 12665 Poway Road, in the CO land use district of the PRSP area {Attachment B). The site is located at the southwest corner of Poway Road and lpai Waaypuk Trail. Surrounding land uses consist of a restaurant and office building to the east, an auto repair shop to the north, a music and dance studio to the west, and Kumeyaay lpai Interpretive Center to the south.
The site is currently developed with an old commercial barn building and pavement. The site was previously used for inventory storage for the Ford dealership. Development of a drive-through restaurant is allowed within the CO district with the approval of a CUP and DR. The findings for approval of a CUP are specified in Poway Municipal Code {PM() Section 17.48.070 and provided in 1 of 43

RESOLUTION NO. 24-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT 24-0004 AND DEVELOPMENT REVIEW 24-0001, A
MODIFICATION OF CONDITIONAL USE PERMIT 22-0006 AND
DEVELOPMENT REVIEW 22-0005, FOR THE CONSTRUCTION
OF A DRIVE-THROUGH RESTAURANT, LOCATED AT 12665
POWAY ROAD; ASSESSOR PARCEL NUMBER 317-490-1400
WHEREAS, Conditional Use Permit (CUP) 22-0006 and Development Review (DR) 22- 0005 were submitted by Jay Higgins, agent and applicant, for a proposal to demolish the existing 5,022 square-foot commercial building located at 12665 Poway Road in the Commercial Office (CO) land use district of the Poway Road Specific Plan (PRSP) area and to redevelop the site with a 3,144 square-foot drive-through restaurant building and outdoor dining space; WHEREAS, On October 3, 2023, the City Council approved CUP 22-0006 and DR 22- 0005;
WHEREAS, CUP 24-0004 and DR 24-0001, were submitted by Lester Tucker, agent and applicant, to request a modification to the approved CUP 22-0006 and DR 22-0005, to allow the relocation of the outdoor dining area from the northerly portion of the site to the south side of the restaurant building;
WHEREAS, on May 21, 2024, the City Council held a duly advertised public meeting to solicit comments from the public, both for and against, relative to this application; WHEREAS, Section 17.48.070 of the Poway Municipal Code (PMC) establishes findings required for granting a CUP and Section 17.52.010 establishes findings for granting a DR; and WHEREAS, the City Council has read and considered the agenda report for the proposed CUP and DR modification request and has considered other evidence presented at the public meeting.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows:
SECTION 1: This project conforms to the prior approved project CUP 22-0006 and DR 22-0005 and proposes relocation of the approved outdoor eating area from the northerly portion of the property to the south side of the restaurant building. Both the original proposal and this modification are substantially consistent with the PRSP. An Environmental Impact Report (EIR) was prepared pursuant to the California Environmental Quality Act (CEQA) in conjunction with the PRSP and certified by the City Council on December 5, 2017, where the Council found that the project was substantially consistent with the adopted PRSP, including its development standards and guidelines that were analyzed in the EIR. A traffic and parking analysis technical study was previously prepared that confirmed there are no substantial changes to either the project or surrounding circumstances, nor any new information that would require subsequent or supplemental environmental review pursuant to Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15163. The modification does not substantially change the land use, traffic, and other CEQA components from the original approved proposal; therefore, no further environmental analysis is required of the project. 4 of43

The location, size, design, and operating characteristics of the proposed use are in accord with the title and purpose of Chapter 17.48 PMC (Conditional Use Permit Regulations), the General Plan, and the development policies and standards of the City, including the PRSP, in that a drive-through is allowed on a property within the CO land use district of the PRSP with approval of a CUP, and will otherwise comply with all of the relevant codes and standards of the City.
B. The location, size, design, and operating characteristics of the proposed use will be compatible with and will not adversely affect or be materially detrimental to adjacent uses, people, buildings, structures, or natural resources in that all business operations will occur inside the proposed drive-through restaurant with parking and circulation occurring within the parcel boundaries.
C. The proposed use is in harmony with the scale, bulk, coverage, density of, and is consistent with, adjacent uses in that the project involves the demolition of the existing 5,022 square-foot commercial building and the construction of a smaller new 3,144 square-foot drive-through restaurant, with this modification allowing for the relocation and resizing of the outdoor dining area.
D. There are adequate public facilities, services, and utilities available at the subject site to serve the proposed use.
E. There will not be a harmful effect upon desirable characteristics in that the project has been designed to be consistent with the drive-through guidelines contained in the PRSP.
F. The establishment of a drive-through restaurant will not adversely impact the capacity and physical character of the surrounding streets and/or the Transportation Element of the General Plan in that the project has been designed to handle the queueing of vehicles in the proposed drive-through lane and will not impact traffic flow on lpai Waaypuk Trail or Poway Road.
G. The site is suitable for the type and intensity of use or development that is proposed in that the proposed restaurant is smaller in size than the existing commercial building that is being replaced on the site and the project has been designed to handle onsite drive through traffic. Additionally, parking for the use will be accommodated onsite.
H. There will not be significant harmful effects upon the environmental quality and natural resources in that the site was previously graded, paved and fully developed and contains no natural habitat. Archaeological monitoring shall be conducted during ground-disturbing activities to ensure that if buried cultural materials, either historic or prehistoric are present, they will be handled in a timely and proper manner.
I. There are no relevant negative impacts of the proposed use that cannot be mitigated.
J. The impacts, as described in subsections A through I of this Section, and the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties in the vicinity, nor be 5 of 43
May 21, 2024, Item #13
contrary to the adopted General Plan.
Resolution No. 24-
K. The proposed conditional use will comply with each of the applicable provisions of PMC Title 17 (Zoning Ordinance), in that the proposed use is a conditionally permitted use and has been designed such that it will not result in significant environmental impacts.
L. The granting of the CUP would not be materially detrimental to the public health, safety or welfare within the community since the proposed project will complete improvements . necessary for the proposed drive-through restaurant. The proposed relocation for the outdoor dining area, as shown on the plans, is a suitable location for the outdoor area, and removes a potential pedestrian hazard.
M. The proposed relocation of the outdoor dining area allows the northerly portion of the property to be more fully landscaped, with rest benches for pedestrians on Poway Road, thereby further implementing the PRSP.
SECTION 3: The findings, in accordance with Section 17.52.010 of the PMC, to approve DR 24-0001, incorporates the findings made for DR 22-0005, are made as follows:
A. The project has been designed to be architecturally compatible with surrounding development and conforms to the PRSP development standards and design guidelines.
Therefore, the project respects and recognizes the interdependence of land values and aesthetics to the benefit of the City.
A. The project has been designed to minimize impacts on surrounding development by utilizing an architectural design that is substantially consistent with the PRSP and will be compatible with surrounding commercial center development. Therefore, the proposed development respects the public concerns for the aesthetics of development and encourages the orderly and harmonious appearance of structures and property within the City.
8. The granting of the original and modified CUP and DR would not be materially detrimental to the public health, safety, or welfare within the community since the proposed redevelopment project will complete improvements necessary for the proposed drive through restaurant.
C. The design and improvements of the proposed development are substantially consistent with all elements of the Poway General Plan and the PRSP.
SECTION 4: The City Council rescinds the prior approval of CUP 22-0006 and DR 22- 0005, and approves both CUP 24-0004 and DR 24-0001, as shown on the approved plans on file with the City, subject to the following conditions:
A. The applicant shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any and all claims, actions, proceedings, damages, judgments, or costs, including attorney's fees, against the City or its agents, officers, or employees, relating to the issuance of this permit, including, but not limited to, any action to attack, set aside, void, challenge, or annul this development approval and any environmental document or decision. The City may elect to conduct its own defense, participate in its own defense, or obtain independent legal counsel in defense of any claim related to this indemnification. 6 of 43
May 21, 2024, Item #13
Resolution No. 24-
In the event of such election, applicant shall pay all of the costs related thereto, including without limitation reasonable attorney's fees and costs. In the event of a disagreement between the City and applicant regarding litigation issues, the City shall have the authority to control the litigation and make litigation related decisions, including, but not limited to, settlement or other disposition of the matter. However, the applicant shall not be required to pay or perform any settlement unless such settlement is approved by applicant.
B. Approval of this modification, in conjunction with the approved CUP and DR request shall apply only to the subject project and shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of Building Permit issuance.
C. Within 30 days of the date of this approval, and before the issuance of any permit: (1) the applicant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant Regarding Real Property. In order for the City to prepare the Covenant, the applicant must first submit a legal description of the subject site, including the lease area.
D. The developer is required to comply with the Poway Noise Ordinance (PMC Chapter 8.08) requirements that govern construction activity and noise levels.
E. The findings and conditions of CUP 24-0004 and DR 24-0001 incorporate the previously approved conditions for CUP 22-0006 and DR 22-0005, and therefore replace those findings and conditions. CUP 24-0004 and DR 24-0001 shall remain in effect for the life of the subject use and shall run with the land and be binding upon future owners, successors, heirs, and transferees of the current property owner.
F. CUP 22-0004 and DR 24-0001 may be subject to annual review, as determined by the Director of Development Services, for compliance with the conditions of approval and to address unresolved operational concerns that may have been raised during the prior year.
G. Prior to opening of business, the applicant shall apply to obtain a Business Certificate through the Customer Services Department of the City of Poway. Prior to a business Certificate, the Applicant shall comply with the following:
1. The site shall be developed in accordance with the approved plans on file in the Development Services Department and the conditions contained herein. A final inspection from the appropriate City departments will be required.
2. Any signs proposed for the restaurant and drive-through shall be designed in accordance with the Sign Ordinance. The necessary Sign Permit(s) and Building Permit(s) approvals for signage shall be obtained prior to installation.
H. Prior to issuance of a Building Permit, the applicant shall obtain approval of a Grading Permit. Compliance with the following conditions is required prior to issuance of the Grading Permit:

that the contracted archeologist is required to attend the pre-construction meeting when the project grading permit is to be issued.
In the event unanticipated, buried prehistoric archaeological resources (lithic material, fauna!, pottery, etc.) or historical archaeological resources (ceramics, building materials, glassware, etc.) be unearthed during construction or any ground disturbing activities within the project footprint, resource treatments would become necessary. Once a potential resource has been identified, all work within 100 feet must be halted until the findings can be assessed by a qualified archaeologist.
19. Label and dimension all surface improvements (e.g., walkways, patios, landscape areas). The grading plan shall indicate the location of the projects required trash enclosure area. The area shall be an adequate size to accommodate recycled material and composting bins in addition to the trash dumpster.
20. The grading and improvement plans shall show all existing trees on the site and call out if they are proposed to remain or to be removed.
21. A Tree Removal Permit shall be obtained prior to the removal of all existing trees.
A separate permit is required for trees within the public right-of-way and trees located on private property. The removal of both public and private trees shall conform to Chapter 12.32 (Urban Forestry) Articles II and Ill of the PMC. If the trees are proposed to be removed during the recognized nesting season for birds (February 15 through August 15), a nesting bird survey shall be conducted by a qualified biologist and report the findings in writing to the City. Between February 15 and August 15, removal of trees containing nests shall be delayed until such time as the nest(s) have been abandoned unless the removal can be completed in accordance with California State codes and the Federal Migratory Bird Treaty Act of 1918.
22. Landscape and irrigation on-site and within the right-of-way fronting the property shall be provided in accordance with the PSRP and the Poway Landscape and Irrigation Design Manual. Plans shall be submitted and a minimum of one staff review shall be completed prior to issuance of a grading permit and/or improvement plan. The landscape and irrigation plans shall demonstrate compliance with the City of Poway Landscape and Irrigation Design Manual, PMC Chapter 17.41, and all other applicable standards in effect at the time of landscape and irrigation plan check submittal. The landscape and irrigation plan submittal is a separate submittal from other project plan check submittals, and is made directly to the Planning Division. Contact the Planning Division for copies of applicable City standards, the landscape and irrigation plan submittal checklist and the plan review fee worksheet. Landscape and irrigation plan review fees are required and are the responsibility of the applicant.

RESOLUTION NO. 23-050
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT 22-0006 AND DEVELOPMENT REVIEW 22-0005 FOR
THE CONSTRUCTION OF A DRIVE-THROUGH RESTAURANT
LOCATED AT 12665 POWAY ROAD; ASSESSOR PARCEL
NUMBER: 317-490-1400
WHEREAS, Conditional Use Permit (CUP) 22-0006 and Development Review (DR) 22- 0005 were submitted by Jay Higgins, applicant, for a proposal to demolish the existing 5,022- square-foot commercial building located at 12665 Poway Road in the Commercial Office (CO) land use district of the Poway Road Specific Plan (PRSP) area and to redevelop the site with a 3, 144-square-foot drive-through restaurant building and outdoor dining space; WHEREAS, on October 3, 2023, the City Council held a duly advertised public meeting to solicit comments from the public, both for and against, relative to this application; and WHEREAS, the City Council has read and considered the agenda report for the proposed Conditional Use Permit request and has considered other evidence presented at the public meeting ..
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows:
SECTION 1: This project replaces an existing commercial building with a new restaurant and is substantially consistent with the PRSP. An Environmental Impact Report (EIR) was prepared pursuant to the California Environmental Quality Act (CEQA) in conjunction with the PRSP and certified by the City Council on December 5, 2017. This project is substantially consistent with the PRSP including its development standards and guidelines that were analyzed in the EIR. A traffic and parking analysis technical study was prepared that confirmed there are no substantial changes to either the project or surrounding circumstances, nor any new information that would require subsequent or supplemental environmental review pursuant to Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15163.
Therefore, no further environmental analysis is required of the project.
SECTION 2: The findings, in accordance with Section 17.48.070 of the Poway Municipal Code (PMC), to approve CUP 22-0006, are made as follows:
A. The location, size, design, and operating characteristics of the proposed use are in accord with the title and purpose of Chapter 17.48 PMC (Conditional Use Permit Regulations), the General Plan, and the development policies and standards of the City, including the PRSP, in that a drive-through is allowed on a property within the CO land use district of the PRSP with approval of a CUP, and will otherwise comply with all of the relevant codes and standards of the City of Poway.
20 of 43 ATTACHMENT C
May 21, 2024, Item #13
Resolution No. 23-050
C. The proposed use is in harmony with the scale, bulk, coverage, density of, and is consistent with, adjacent uses in that the project involves the demolition of the existing 5,022-square-foot commercial building and the construction of a smaller new 3, 144- square-foot drive-through restaurant.
J. The impacts, as described in subsections A through I of this Section, and the proposed location, size, design, and operating characteristics of the proposed use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties in the vicinity, nor be contrary to the adopted General Plan.
K. The proposed conditional use will comply with each of the applicable provisions of PMC Title 17 (Zoning Ordinance), in that the proposed use is a conditionally permitted use and has been designed such that it will not result in significant environmental impacts.
SECTION 3: The findings for DR 22-0006, in accordance with the PMC 17.52.010 Purpose of Development Review, are made as follows:
A. The project has been designed to be architecturally compatible with surrounding development and conforms to the PRSP development standards and design guidelines.
Therefore, the project respects and recognizes the interdependence of land values and aesthetics to the benefit of the City.
B. The project has been designed to minimize impacts on surrounding development by utilizing an architectural design that is substantially consistent with the PRSP and will be 21 of 43
May 21, 2024, Item #13
Resolution No. 23-050
compatible with surrounding commercial center development. Therefore, the proposed development respects the public concerns for the aesthetics of development and encourages the orderly and harmonious appearance of structures and property within the City.
C. The granting of the DR would not be materially detrimental to the public health, safety or welfare within the community since the proposed redevelopment project will complete improvements necessary for the proposed drive-through restaurant.
D. The design and improvements of the proposed development are substantially consistent with all elements of the Poway General Plan and the PRSP.
Section 4: The City Council hereby approves CUP 22-0006 and DR 22-0005 as shown on the approved plans on file with the City, subject to the following conditions:
A. The applicant shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any and all claims, actions, proceedings, damages, judgments, or costs, including attorriey's fees, against the.City or its agents, officers, or employees, relating to the issuance of this permit, including, but not limited to, any action to attack, set aside, void, challenge, or annul this development approval and any environmental document or decision. The City may elect to conduct its own defense, participate in its own defense, or obtain independent legal counsel in defense of any claim related to this indemnification.
B. Approval of this CUP and DR request shall apply only to the subject project and shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances in effect at the time of Building Permit issuance.
E. The conditions of CUP 22-0006 and DR 22-0005 shall remain in effect for the life of the subject use and shall run with the land and be binding upon future owners, successors, heirs, and transferees of the current property owner.
F. CUP 22-0006 may be subject to annual review, as determined by the Director of Development Services, for compliance with the conditions of approval and to address unresolved operational concerns that may have been raised during the prior year.

CITY COUNCIL
Underground Waiver (UW) 23-0002; a Request For a Waiver of the Requirement to Underground an Existing Overhead Pole and Utility Lines By Paying an In-Lieu Fee to Be Established By Resolution of the City Council
The owner and developer of a single-family residence, Nilesh Patel, has requested to pay an in-lieu fee to be determined by the City Council instead of undergrounding existing overhead utilities across his property at this time. The City of Poway staff has confirmed an in-lieu fee payment would be acceptable to defer undergrounding until undergrounding the entire system is feasible.
Recommended Action:
It is recommended the City Council adopt a resolution (Attachment A) to establish the in-lieu fee amount to be paid by the applicant for the deferral of the undergrounding requirements.
Discussion:
The proposed development consists of demolition of an existing single-family home and construction of a new single-family residence in the Residential Rural (RR)-C zone. The new single-family residence on Creek Road has been approved per Minor Development Review Application (MORA) 21-028. A standard requirement with a MORA is the undergrounding of any overhead utility lines spanning the property. Per the policy established by Resolution 91-003 (Attachment B), the project qualifies for a waiver of the requirements to underground utilities per Section I.C: "where less than 1,000 feet of overhead lines are to be undergrounded, the property owner shall have the option of paying an in lieu fee to be established by resolution of the City Council." The total amount of existing overhead lines over the property is approximately 97 feet. This is a portion of overhead lines that also crosses two other parcels. There are no utility poles on this property.
After coordination with San Diego Gas & Electric (SDG&E), City staff was informed the ultimate underground service in the area will be connected from source lines along Creek Road fronting the property and neighboring properties instead of across the rear yard of the project and neighboring 1 of 10
May 21, 2024, Item #14
properties, where the current overhead lines are located. Mr. Patel is placing underground service lines along the frontage of his property as a part of the new single-familiy residence construction. City staff also worked with Mr. Patel and SDG&E on the removal of the existing overhead lines across this property. This would require the removal of an existing pole on the neighboring property to the northwest and the installation of a new pole near the southeast property line of Mr. Patel's property.
Access for SDG&E was a primary concern and ultimately, there was no acceptable design solution found.
For these reasons, staff supports the request of an in-lieu fee for the removal of the existing overhead lines within the subject parcel to be paid now. The paid fee will be kept in an account held by the City until the time the actual work to remove the overhead utilities is to be completed. The individual property owners are responsible for the removal costs associated with the portion of overhead lines spanning their property. The payment of the in-lieu fee does not absolve the property owner of the requirement to pay their pro rata share of the actual costs of the removal of the existing overhead transmission lines within the project property at the time the work is done. Since there are no overhead poles within the limits of the parcel, this may require the removal of adjacent pole(s) located offsite. The applicant has also signed a covenant agreeing not to oppose a future private or public utility undergrounding district and to pay their pro rata share of the actual removal costs of the existing overhead transmission lines within the property.
MORA 21-028 for this project has been approved with a condition the in-lieu fee determined by City Council be paid prior to building permit issuance for the residential structure. City staff recommends the fee to be paid should be the actual cost of the work if it were to occur presently, as calculated by the applicant's utility contractor per Attachment C. The amount calculated by this cost estimate is $9493.20 and the cost involves the removal of transmission lines within the property only, which entails the relocation of an overhead pole from the northwesterly to the southeasterly property boundary. A pole relocation will not be necessary when the scope of the project is to underground all overhead utilities across the rear yard of the project and neighboring properties. Attachment D shows the span of the existing overhead lines across the rear of three properties with the portion Mr. Patel is responsible for highlighted in blue.
Environmental Review:
This action is not subject to review under the California Environmental Quality Act (CEQA).
Fiscal Impact:
City to hold the in-lieu payment as a deposit under the Land Development Engineering Deposit In Lieu account: 305030-86900.
Public Notification:
A public notice was mailed to any property owners directly affected by the existing overhead transmission lines in the area.

AGENDA REPORT CityofPoway

Honorable Mayor and Members of the City Council
Robert Manis, Director of Development Services M,
Mary Piscitelli, Associate Planner ,v{f

CITY COUNCIL
Pre-Development Conference 24-0001, a Proposal for a Specific Plan Amendment to Allow a Car Wash as a Conditional Use in the Mixed Use Land Use Designation in the Poway Road Specific Plan, APN 317-540-64-00
The applicant is proposing a Specific Plan Amendment {SPA) to allow Car Washes with a Conditional Use Permit {CUP) in the Mixed Use (MU) land use designation of the Poway Road Specific Plan {PRSP).
If such an amendment is approved, the applicant will propose the demolition of an existing structure and construction of a 4,330 square-foot {sf) car wash with three drive aisles funneling into the wash tunnel building. The project will be subject to three submittal applications: a SPA to the PRSP, a CUP for the car wash use, and a Development Review {DR) for the site planning and design of the car wash.
The review of the PDC 24-0001 is advisory only. The applicant is seeking feedback on their proposed plans. The City Council will not render any decision.
Recommended Action:
It is recommended the City Council provi9e input and direction regarding the request.
Discussion:
The applicant and property owner is Mike Foster, for Foster & Company, with Super Star Car Wash as his agents for site planning, design, and construction. The site is designated Mixed Use {MU) in the PRSP. The project site is located at 12509 Poway Road, on the south side of Poway Road east of Pomerado Road {Attachment A). Existing surrounding land uses within the PRSP include fast food, small offices, retail, and automotive services {auto body repair) to the north; small shops and service businesses to the east; automotive services {oil change business) and small professional offices to the west; and single-family residences and apartments are located to the south of the subject site which are zoned Residential Apartment {RA).
In accordance with the PRSP, new automotive uses are prohibited in the MU Land Use District. Prior to the adoption of the PRSP, automotive services, gas stations, and similar automotive uses were allowed in this segment of Poway Road. With the adoption of the PRSP, those existing uses are now 1 of 20
May 21, 2024, Item #15
nonconforming and new automotive uses are prohibited as they are not consistent with the goals and objectives of the MU Land Use District.
Project Summary
The applicant is proposing to construct a 4,330-sf car wash on the subject property, a 40,792.85-sf (0.68 acre) existing site. The car wash is proposed to have three access lanes funneling into a single lane wash tunnel structure. The architectural design incorporates a modern design with grey, red, beige, and white colors. The project plans are included as Attachment B.
The property currently has a vacant building facing the street, with a parking lot behind. It was once a bank building, with the drive-up banking aisles on the back (south) side of the building. A total of 28 parking spaces would be proposed, including 3 employee spaces, 2 ADA-accessible vacuum bay stalls, 20 vacuum bay parking stalls, and 3 additional parking spaces. Setbacks are in accordance with the MU district from the PRSP. Maximum lot coverage in the MU district is 55 percent, and this project utilizes 10.8 percent lot coverage for the building only.
Poway Road Specific Plan
The land use designation for the parcel is MU in the PRSP. The MU land use district was developed to allow for residential development to complement long established retail and commercial uses. The objectives of the MU land use are to create development at key locations to support pedestrian activity, integrate residential uses either as stand-alone residential or combined with mixed use projects, and to ensure that building massing along large blocks are designed to allow for through passage and pedestrian circulation with pathways leading to destinations, including outdoor plazas, paseos, and courtyards. The MU land use was developed to provide incentives for mixed use development with retail emphasis on the ground floors and residential uses above, activating building edges with housing and/or office uses above. The MU land use also encourages lot consolidation and improvements for underutilized space to transform the district into a vibrant mixed-use area. The Land Use Plan Map is included as Attachment C.
The concept of this MU district for Poway Road was to support a broader mix of uses, including retail and service businesses. The MU land use is structured in the PRSP to balance the corridor with infill development consisting of retail, office, and residential uses, while coordinating with existing and new buildings, including new multi-family residential condos and apartments. This section of the PRSP is included as Attachment D.
Currently, the PRSP does not allow new automotive and vehicle-related businesses in the MU\land use designation, including automobile washing and detailing facilities. Other areas of Poway Road, such as east of Community Road, are designated for automotive and general commercial use in the PRSP.
This area allows a wide variety of automobile-related uses. The Land Use Matrix in PRSP, pp. 3-13 -3- 14, is included as Attachment E.
Specific Plan Amendment (SPA)
In order to allow the project, a SPA would be required for the following reasons:
• Establish Automotive Washing and Detailing as a Conditional Use in the MU land use designation.
o Automotive Washing and Detailing is currently a Conditional Use in the Commercial 2 of 20
May 21, 2024, Item #15
Office (CO) land use and the Commercial General (CG) land use in the PRSP.
Conditional Use Permit and Development Review
If the City Council approves the SPA to allow car washes with a CUP in the MU designation, the applicant would submit applications for a CUP and DR for this car wash to be developed.
Major Issues brought up in the review included:
• Trip Generation analysis would be required with an automotive use. Depending on the number of trips being generated, the project may be required to complete a Local Mobility Analysis (LMA).
• As it is currently designed, the project may require a grading permit. • As it is currently designed, the project may require a Priority Development Project (PDP) Storm Water Quality Management Plan (SWQMP).
• The building design incorporates a modern design with bright colors, which are not recommended in the PRSP.
• A taller (26') grey masonry wall with white bands is shown on the project plans at the front of the building for signage. The PRSP recommends stepping back walls taller than 18' for fa~ade articulation.
Next Steps:
If the applicant wishes to proceed with their application, it is with the understanding the City Council has made no representation upon which the applicant may rely. The Agreement of Understanding is included as Attachment F.
Environmental Review:
Because no action can be taken, this item is not a "Project" pursuant to the CEQA and therefore is not subject to CEQA review. After project submittal, staff will determine the appropriate CEQA document to be prepared.
Fiscal Impact:
None.
Public Notification:
None.

entertainment uses and vibrant street

z buildings, cultural uses, and parks and
--4
c other pub lic spaces.
The Town Center is distinguished by a
distinct and exciting "Main Street'
character, with pedestrian-oriented
buildings. The goal is to have a mix of uses
that draw people during the day, evenings,
and on weekends.
Physical Form: The physical form consists
of two- to three-story vertical and/or
horizontal mixed-use building types that
accommodate active storefronts,
• boutiques, restaurants, cafes, small offices,
civic uses, and residential uses. Wide
sidewalks, consistent street tree planting,
public plazas, and well-designed buildings
will support the pedestrian character of the
Town Center.
Mixed Use (MU)
Intent: To accommodate new resident ial
development types that provide
opportunities for home ownership, and to
encourage new reta il activity that
complements well-established businesses
and serves surrounding neighborhoods.
Allowed uses include attached and
detached residential developments,
mixed-use residential/commercial projects,
and stand-alone retail, service, office,
dining, and recreational and entertainment
businesses. Places of public assembly are
permitted through discretionary review.
Specifically prohibited are heavy
commercial uses and any use that creates
noise, odors, and similar adverse conditions
that are incompatible with residential uses.
Physical Form: The physical form
emphasizes two- to three-story
development that has a clear relationship
to the street and a mix of residential and
commercial uses along the street frontage.
Commercial/Office (CO)
Int ent: To provide an environment for
professional office, service, and retail
uses where local and
national/international businesses ca n
meet the needs of Poway residents,
support the local economy, and provide
opportun ities for new jobs.
Allowed uses include a full range of
commercial businesses. Places of public
assembly and housing are permitted
through discretionary review.
The Commercial/Office district is a dynamic
employment center where established
office and retail space is enhanced by new
infill development and creative, flexible
building spaces that meet emerging
business needs and practices, including
buildings with large

:::j and open layouts that can easily be
0 ;::; reconfigured and places where multiple
0 individuals or companies can co-locate.
The physical form consists of lower-intensity
office and retail buildings, with opportunities
for office on upper floors above retail.
Commercial General (CG)
Intent : To strengthen establ ished reta il
businesses and accommodate a d iverse
range of shopping, personal service,
dining, enterta inment , and hotel uses
within a business-friendly environment
that supports the need s of the local
commun ity, visitors, a nd tourists.
The Commercial General district provides
opportunities for retail and service
businesses to locate in a central
commercial environment and to establish
incubator space for small and local
businesses. Housing may be allowed
through discretionary review.
Physical Form: The physical form responds
to the need for maximum flexibility to allow
buildings and uses to easily transform over
time as market demands shift. Buildings do
not necessarily require immediate street
frontage, but all street-facing facades
need to welcome pedestrians and
contribute to an aesthetically pleasing
street presence .
Automotiv e/Co mmercial General
(A/CG)
-----
Intent : To accommodate a full range of
retail, service, and wholesale commerc ial
act ivities and particu larly, a uto sa les an d
vehicle service and repa ir businesses.
The Automotive/Commercial General
district supports a broad array of more
intensive commercial businesses that are
appropriately separated from residential
uses and clearly oriented toward auto
dependent and auto-related uses and
customers. While the district serves as a
place for clustering auto sales and related
activities, technological and market trends
over the longer term may lead to changes
in space required to accommodate such
uses. Thus, land use regulations provide
flexibility for other commercial uses that
require larger lots and separation from
residential development. Housing is not
permitted in this district.
Physical Form: The physical form consists
of medium to large commercial buildings
designed for maximum flexibility and
compatibility, along with accommodation
of a range of concentrated commercial
uses.
