NOTICE OF CITY COUNCIL PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City Council of the City of Poway will hold a Public Hearing to consider the following item: Specific Plan Amendment (SPA) 22-0002, a request for approval of a Ordinance amending the South Poway Specific Plan (SPSP) to amend the land use designation for the northerly portion of the parcel addressed as 13501 Kirkham Way from the Mineral Resources Extraction (MRE) land use designation to the Light Industrial (LI) land use designation, a Development Review (DR) 22-0001, and a Community Benefit Agreement for the Nighthawk Battery Energy Storage System (BESS) project at this location. Pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15164, an Addendum has been prepared to the (1) Environmental Impact Report (EIR) (State Clearinghouse Number 84053008) for the SPSP, as certified by the City Council on July 30, 1985; (2) the Subsequent Environmental Impact Report (SEIR) (State Clearinghouse Number 880427161) as certified by the City Council on July 28, 1988, for an amendment to the SPSP, and (3) a subsequent SEIR (State Clearinghouse Number 89010025) as certified by the City Council on July 23, 1991, for the Cal-Mat Conditional Use Permit (CUP 89-05). The analysis from the EIR and SEIRs, together with the analysis in the Addendum, support the conclusion that the addition of the proposed Project will not result in any new significant impacts or significant impacts that would be more severe than those identified and analyzed in the previously certified EIR and SEIRs, nor are any other circumstances set forth in CEQA Guidelines section 15162(a) present that would allow or necessitate the preparation of a subsequent or supplemental SEIR. Pursuant to CEQA Guidelines Section 15164(a), the City may rely on the EIR and SEIRs, as updated with the Addendum, for documentation of the effects of the Project on the environment, as all the proposed Project’s significant impacts were fully disclosed, analyzed and mitigated in the EIR and SEIRs.
