AGENDA REPORT CityofPoway
September 17, 2024
Honorable Mayor and Members of the City Council
Julie Procopio, Director of Development Service~
Sara Trunzo, Senior Civil Engineer s_1 (858) 668-4622 or [email protected]
CITY COUNCIL
Approval of Parcel Map for Tentative Parcel Map (TPM) 22-0001 (Poway Road Urban Lot Split); Walsh Engineering & Surveying, Inc., Applicant (APN 323-180-26) The final Parcel Map for Tentative Parcel Map (TPM) 22-0001 is ready for approval. This map subdivides one parcel totaling 0.44 acres into two single-family residential lots located at 14382 Poway Road. The proposed final Parcel Map implements a state mandated 58-9 Urban Lot Split, which means the City has no discretion to deny approval, provided the map meets specific state law criteria.
Recommended Action:
It is recommended the City Council approve the Parcel Map for TPM 22-0001 and direct its recordation.
Discussion:
This project meets the criteria for a Senate Bill-9 (SB-9) Urban Lot Split as it subdivides an existing residential parcel into two residential parcels of approximately equal area. In accordance with Government Code 66411.7, a provision of SB-9, the Tentative Parcel Map (TPM 22-0001) was approved ministerially on May 10, 2023. To be clear, state law mandated City Staff to ministerially approve TPM 22-0001, without a public hearing.
While the TPM was not permitted to be considered for approval by the City Council, the final Parcel Map is coming to the City Council for approval in order to comply with the Subdivision Map Act.
Pursuant to State Law, the City Council must approve the Parcel Map if it complies with all of TPM's conditions, which Staff has determined it does.
The existing residential parcel is located on the west side of Poway Road, north of Silver Ridge Road.
The project site is shown on the vicinity map included as Attachment A. Located within the Residential Single Family-2 (RS-2) zone, the existing parcel has a gross area of 19,352-square feet. The parcel map creates two parcels with a net area of approximately 8,500-square feet each. The approved TPM meets 1 of 6
September 17, 2024, Item #10
the front and street side yard setback requirements of the Poway Municipal Code. The rear and interior yard setbacks are 4-feet, which is the maximum setback that can be required by state law (see, Government Code 65852.21 ). Access is provided through the existing 20-foot-wide private driveway.
The Parcel Map, as shown in Attachment B, is in substantial conformance (per the Subdivision Map Act) with the approved TPM. All conditions of approval required prior to recordation of the parcel map have been addressed.
Environmental Review:
This action is not subject to review under the California Environmental Quality Act (CEQA).
The adoption of the Final Map is identified as a type of ministerial permit and is exempt from the CEQA State Guidelines; therefore, pursuant to the CEQA State Guidelines Section 15628(b) no environmental review is required.
Fiscal Impact:
None as a result of this action.
Public Notification:
None.

AGENDA RE PQ RT City of Poway
CITY COUNCIL
September 17, 2024
Honorable Mayor and Members of the City Council
Jodene Dunphy, Human Resources & Risk Management Director 10- Jodene Dunphy, Human Resources & Risk Management Director (858) 668-4413 or jdunphy@poway,org
Tentative Agreement Amending the Memorandum of Understanding between the City of Poway and the Poway Firefighters' Association
The existing Memorandum of Understanding (MOU) between the City of Poway (City) and the Poway Firefighters' Association (PFA) expires on June 30, 2027. The six-year agreement includes a re-opener clause for the Poway Firefighters' Association (PFA) to request to re-open contract negotiations with the City after July 1, 2024. The PFA requested to re-open negotiations, which occurred In July and August, and staff has reached a Tentative Agreement {TA) with PFA for the remaining three years of the six-year term of the MOU.
Recommended Action:
It Is recommended the City Council:
1) Adopt a Resolution authorizing the City Manager to revise and execute, on behalf of the City, the current Memorandum of Understanding between the City and the PFA, approving the terms of the TA, which has been ratified by the PFA, without further specific actions by the City Council and approve the Salary Schedule for the members of the PFA; and
2) Adopt a Resolution appropriating funds in FY 2024-25 to implement the financial terms of the TA with the PFA.
Discussion:
California law provides for the determination of public employee wages, hours and other terms and conditions of employment through a process of meeting and conferring between public agency representatives and employee bargaining unit representatives. Negotiations between the City and the PFA, representing 48 fire safety full-time equivalent (FTE) positions, began in July 2024 and a TA was reached on August 28, 2024. The PFA ratified the TA, which requires approval in open session by the City Council.

in the TA included in the attached Resolution. The financial terms incorporated in the MOU will not extend beyond those outlined in the attached Resolution.
The six-year agreement with PFA was approved in 2021 as an investment in the City’s high performing and valued fire safety employees. The TA reflects a commitment to remain competitive in the San Diego market in order to attract and retain highly qualified and exceptional Firefighter/Paramedic candidates through a one-time median market salary adjustment of 5% across all firefighter ranks , additional vacation time and holiday pay . It includes the restructuring of the current paramedic incentive pay from a flat rate of $1,000 annually for Firefighter/Paramedics and $1,800 annually for Fire Engineer/Paramedics and Fire Captain/Paramedics to 1.5% of top step Firefighter/Paramedic for all ranks . This will help to attract and retain quality candidates with experience and exceptional paramedic skills to the Poway Fire Department. A certification incentive program designed to support current Fire Department personnel in obtaining additional knowledge and skills to prepare for internal promotional opportunities and a new wellness incentive, which prioritizes firefighter health and wellness, will be implemented.
Environmental Review:
This a
ction is not subject to review under the California Environmental Quality Act (CEQA).
Fiscal Impact:
The estim
ated fiscal impact of the TA with PFA is outlined by fiscal year in the table below.
Fiscal Year Estimated Cost Increase
General Fund
2024-25 $429,124
2025-26 $492,471
2026-27 $821,623
Totals $1,743,218
The tota
ls shown in the table above include roll-up costs and funds will be allocated from the General Fund. The Resolution in Attachment B includes the appropriations necessary to adjust the Fiscal Year 2024-25 budget to implement the provisions of the TA with PFA.
Public Notification:

Letter in Support of Proposition 36: Homelessness, Drug Addiction and Theft Reduction Act
In 2014, California voters approved Proposition 47. The intent of the legislation was to reduce California's prison overcrowding by reducing many theft and drug felonies to misdemeanors. The unintended consequences experienced by cities and law enforcement throughout California have been an increase in retail theft and trafficking of deadly hard drugs because people committing these crimes do not face serious consequences.
Proposition 36, is a citizen initiative that qualified to be on the November 5, 2024 election ballot after more than 900,000 signatures were gathered from California registered voters. The ballot initiative, called the Homelessness, Drug Addiction and Theft Reduction Act, seeks to change provisions of Proposition 47.
On the retail theft front it would increase penalties for smash-and-grab crimes, create tougher penalties and more accountability for repeat retail theft offenders, and allow stolen property values from multiple thefts to be combined.
In terms of drug related crimes, it would enact stricter penalties for drug dealers whose trafficking causes death or serious injuries, ensures fentanyl is treated like heroin, cocaine, PCP, and methamphetamine when offenders possess a firearm and toughens penalties for selling large amounts of fentanyl.
Proposition 36 also promotes drug and mental health treatment by restoring incentives for people to utilize drug courts that mandate treatment, creates a "treatment-mandated felony", and allows individuals who successfully complete treatment to avoid jail time and expunge their records.
While Poway remains the safest city in San Diego County and one of the safest cities in California, we are not immune to the unintended impacts of Proposition 47. We believe both residents and the business community would benefit from the changes proposed in Proposition 36. We are therefore recommending the City Council agree to submit a letter in support of Proposition 36 to San Diego District Attorney Summer Stephan, who has been part of the statewide coalition of state and local 1 of 3

Dear District Attorney Stephan:
On behalf of the Poway City Council, thank you for your leadership in the efforts to place Proposition 36 on the November 5, 2024 ballot. The City Council discussed the ballot measure at its September 17, 2024 meeting and is in full support of the critical changes this measure will bring to our criminal justice system.
The unintended consequences of Proposition 47 can no longer be ignored. As leaders of our community, preserving the health and safety of Poway is our highest priority. It is imperative there be real consequences to those who commit property theft against businesses and those who sell and distribute illicit drugs in our communities.
Proposition 36 provides valuable tools to law enforcement and prosecutors and is widely supported by a broad coalition of state and local officials, public safety leaders, chambers of commerce, trade groups, private businesses and justice and victim advocacy groups. While it is hoped the changes will serve as deterrents for some, it is equally important that those who choose to commit crimes are held accountable for their actions. We also recognize the value of incentivizing people to utilize drug courts that mandate treatment and the cascading benefits of getting individuals into drug and mental health treatment instead of sending them to jail.
We do acknowledge there will be costs associated with implementing this legislation if it is approved by voters, however the costs of doing nothing and continuing with the status quo are far greater. Businesses are impacted by retail theft which threatens their viability and in some cases results in closures which affects the economy and jobs. Having little to no consequences associated with illicit drug sale and distribution means we will only continue to see an increase in the devastating impacts of fentanyl in our communities. We also recognize simply sending people to prison is not a real solution to the issues surrounding drug addiction and mental health which is why the incentives included in Proposition 36 to utilize drug courts that mandate treatment are so essential.
Again, Poway appreciates your leadership and advocacy on this necessary legislation. Even though our immediate focus is Poway, we believe all Californians will benefit from the passage of Proposition 36.
Sincerely,
Steve Vaus, Mayor Caylin Frank, Deputy Mayor
