AGENDA RE PQ RT City of Poway
CITY COUNCIL
September 17, 2024
Honorable Mayor and Members of the City Council
Jodene Dunphy, Human Resources & Risk Management Director 10- Jodene Dunphy, Human Resources & Risk Management Director (858) 668-4413 or jdunphy@poway,org
Tentative Agreement Amending the Memorandum of Understanding between the City of Poway and the Poway Firefighters' Association
The existing Memorandum of Understanding (MOU) between the City of Poway (City) and the Poway Firefighters' Association (PFA) expires on June 30, 2027. The six-year agreement includes a re-opener clause for the Poway Firefighters' Association (PFA) to request to re-open contract negotiations with the City after July 1, 2024. The PFA requested to re-open negotiations, which occurred In July and August, and staff has reached a Tentative Agreement {TA) with PFA for the remaining three years of the six-year term of the MOU.
Recommended Action:
It Is recommended the City Council:
1) Adopt a Resolution authorizing the City Manager to revise and execute, on behalf of the City, the current Memorandum of Understanding between the City and the PFA, approving the terms of the TA, which has been ratified by the PFA, without further specific actions by the City Council and approve the Salary Schedule for the members of the PFA; and
2) Adopt a Resolution appropriating funds in FY 2024-25 to implement the financial terms of the TA with the PFA.
Discussion:
California law provides for the determination of public employee wages, hours and other terms and conditions of employment through a process of meeting and conferring between public agency representatives and employee bargaining unit representatives. Negotiations between the City and the PFA, representing 48 fire safety full-time equivalent (FTE) positions, began in July 2024 and a TA was reached on August 28, 2024. The PFA ratified the TA, which requires approval in open session by the City Council.

in the TA included in the attached Resolution. The financial terms incorporated in the MOU will not extend beyond those outlined in the attached Resolution.
The six-year agreement with PFA was approved in 2021 as an investment in the City’s high performing and valued fire safety employees. The TA reflects a commitment to remain competitive in the San Diego market in order to attract and retain highly qualified and exceptional Firefighter/Paramedic candidates through a one-time median market salary adjustment of 5% across all firefighter ranks , additional vacation time and holiday pay . It includes the restructuring of the current paramedic incentive pay from a flat rate of $1,000 annually for Firefighter/Paramedics and $1,800 annually for Fire Engineer/Paramedics and Fire Captain/Paramedics to 1.5% of top step Firefighter/Paramedic for all ranks . This will help to attract and retain quality candidates with experience and exceptional paramedic skills to the Poway Fire Department. A certification incentive program designed to support current Fire Department personnel in obtaining additional knowledge and skills to prepare for internal promotional opportunities and a new wellness incentive, which prioritizes firefighter health and wellness, will be implemented.
Environmental Review:
This a
ction is not subject to review under the California Environmental Quality Act (CEQA).
Fiscal Impact:
The estim
ated fiscal impact of the TA with PFA is outlined by fiscal year in the table below.
Fiscal Year Estimated Cost Increase
General Fund
2024-25 $429,124
2025-26 $492,471
2026-27 $821,623
Totals $1,743,218
The tota
ls shown in the table above include roll-up costs and funds will be allocated from the General Fund. The Resolution in Attachment B includes the appropriations necessary to adjust the Fiscal Year 2024-25 budget to implement the provisions of the TA with PFA.
