Subject: Request for a rehearing of Poway City Council Meeting Dec 3, 2024, Agenda Item #12. Discussion and Possible Action to Fill City Council Vacancy.
City Manager's Recommendation: It is recommended the City Council consider the alternatives available for filling the City Council vacancy and provide direction to staff.
Mr. Mayor and Council Members,
I am formally protesting the vote taken and the decision made at the Dec 3, 2024 council meeting regarding Agenda Item 12.
Not only does the decision to hand-select a replacement for our District 1 council position disenfranchise the district 1 residents, but the decision was made at a meeting without a district 1 representative being present and without having all the options disclosed to the public prior to the meeting as is required by law. Legally (and to be fair) Item 12 should have been deferred until all facts regarding all options and costs were on the table.
It is my view that the city leaders and staff purposely omitted from the staff report the option of a smaller, lower cost, and timely option to have a mail-in vote. Also, there is no question that mayor refused to consider the option and excluded it from the vote after it was disclosed by speakers at the meeting. It is evident that the current city council and mayor have been at odds with a group of residents criticizing them at the council and behind closed doors. Councilman Dehoff even openly disregarded the pleas of many residents making an excuse that they were solicited on social media by some of those clashing residents. Therefore, it is clear that the council cannot and will not be unbiased in the selection process for our district 1 councilman.
I am requesting a voluntary rehearing of Dec 3, 2024, item #12 and I implore that the council select the option that was illegally omitted from the Dec. 3 agenda to hold a mail in election for the district 1 city council seat of Poway, Ca.
As a district 1 resident of Poway, I am adamant that Poway holds a mail-in election to allow the district 1 residents to fairly choose their representative for the Poway City Council. 3 of 14 December 17, 2024, Public Comment
Additionally, I recommend reinstating the rehearing process, which was recently repealed, as a demonstration of the council's dedication to ethical governance and accountability to its constituents.

Attached are the names of 250 Poway residents who have signed a letter urging the Council to hold a rehearing and reconsider the decision to proceed with an appointment for the District 1 vacancy. These signatories represent Powegians from all districts and across the political spectrum, united by one message: voters-not politicians-should decide who represents District 1.
Poway's troubled history with appointments has eroded trust and left many residents feeling disconnected from their government. By choosing an appointment over a special election, the Council risks further alienating the very people it is meant to serve. A rehearing is an opportunity to show that you value the voices of Poway residents and are committed to transparency and democracy.
We strongly urge you to honor this request and revisit your decision during the December 17 session. Do not discard the concerns of residents who are calling for a process that prioritizes fairness and reflects the will of the people.

Re: 12/17/24 council meeting, #public comment: special election for D1 council vacancy Dear Mayor Vaus and Members of the City Council,
We, the undersigned residents and stakeholders of Poway, urge the City Council to agree during the December 17 session to hold a rehearing at the next council meeting to reconsider the decision to fill the District 1 vacancy through an appointment. This matter requires further discussion to fully explore options, including a timely and cost-effective all-mail special election in May, that better reflects the will of the people and restores trust in local government.
Poway's troubled history with appointments has left residents feeling disconnected and frustrated. While we recognize the Council's decision to extend the timeline and include newly elected members, this action does not fully address concerns about transparency and fairness.
The original hearing lacked key information about the feasibility, cost, and timeline of a special election. An all-mail election in May could provide District 1 residents with a timely and cost-effective way to choose their representative. The cost of a mail-in election is an investment in trust and transparency, something Poway desperately needs after years of frustration with appointments .
A rehearing is an immediate and proactive step to ensure this process respects voters and prioritizes democracy. We urge the Council to fully discuss all viable options that give District 1 residents the opportunity to choose their representative. The undersigned include a majority of District 1 residents, as well as supporters from across Poway who care deeply about democratic representation and transparency.
Democracy requires effort, and the cost of a special election is a small price to pay for restoring public trust and ensuring true representation for District 1.
