CITY COUNCIL
Approval of Final Parcel Map for Tentative Parcel Map (TPM) 22-0003 (Somerset Road/Janette Lane Urban Lot Split); Bill Yen & Associates, Inc., Applicant (APN 314-242- 05)
The final Parcel Map for Tentative Parcel Map (TPM) 22-0003 is ready for approval. This map subdivides one parcel totaling 0.49 acres into two single-family residential lots located at 13647 Somerset Road and 13646Janette Lane. The proposed final Parcel Map implements a state mandated Senate Bill-9 (SB-9) Urban Lot Split, which means the City has no discretion to deny approval, provided the map meets specific state law criteria.
Recommended Action:
It is recommended the City Council approve the final Parcel Map for TPM 22-0003 and direct its recordation.
Discussion:
Background:
The California Subdivision Map Act outlines a two-step process for subdivision of land. Generally, the first step is a quasi-judicial public hearing to consider the tentative map or the tentative parcel map for four or fewer parcels. This step involves evaluating a project for alignment with existing objective standards, conditions, and policies. After a hearing and evaluation of the evidence, a written decision or resolution is adopted based on evidence presented.
The second step is consideration of the final (parcel) map which is the technical document showing the distances and bearings for each property line of the parcels included in the tentative (parcel) map.
This action is ministerial, meaning state law requires approval of any final (parcel) map conforming to the approved tentative (parcel) map and conditions of approval. A "ministerial action" refers to an act performed by a government official or employee that strictly follows established rules and procedures, without requiring any personal judgment or discretion; essentially, they are simply carrying out a duty as outlined by law, with no room for individual decision-making. In other words, if 1 of 8

CITY OF POWAY
DEVELOPMENT SERVICES DEPARTMENT
SB 9 Developments & Urban Lot Splits: General Information What does Senate Bill 9 (SB 9) do?
The Bill mandates jurisdictions, like the City of Poway, to ministerially approve a housing development containing no more than two (2) single-family dwelling (SFD) units on a single lot within a single-family residential zone, excluding certain areas.
It also allows Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs)1 on lots with SFDs.
Additionally, the City must ministerially process an urban lot split in accordance with SB 9 and eligible development standards.
How do I apply and obtain permits for a SB 9 development and Urban Lot Split? For housing development, hire a designer or architect to prepare a building set of plans in compliance with the building permit application requirements and pay applicable plan check fees. Corrections on plan check reviews must be addressed before the permit is approved and ready to issue. Once the building permit is approved, pay applicable issuance and impact fees2, obtain your permit and begin building. For an urban lot split, civil drawings prepared by an engineer are required for the submittal and a ministerial Tentative Parcel Map (TPM) then a Final Map with appropriate fees are required.

Discussion and Possible Action to Fill City Council Vacancy
CITY COUNCIL
On November 25, 2024, District 1 Council member Brian Pepin provided notice that he will resign from his position on the City Council "effective upon my seat being filled with a replacement." (Attachment A). The term of office for this City Council seat concludes following the November 2026 General Municipal Election.
At the City Council meeting on December 3, 2024, the Council voted to initiate an appointment process to fill the vacancy. Per the Council's direction, the City Clerk began accepting applications from Poway registered voters residing in District 1 on Wednesday, December 4, 2024. The application period closed at 4 p.m. on Friday, January 10, 2025 (Attachment B).
Any individual appointed to fill the vacancy would hold office until the current District 1 term ends (Gov. Code § 36512(b)(2)(B)). Currently, it is not possible for the Poway City Council to appoint someone to serve only until a special election. In order to have this option, the City Council would be required to adopt an ordinance/Municipal Code amendment requiring that option for all vacancies (Gov. Code§ 36512(c)(3)). Were there to be City Council direction at the January 21, 2025 City Council meeting to bring back such an ordinance for City Council consideration at a future meeting, it would become effective thirty days after a second reading adopting the ordinance, assuming it was approved.
Recommended Action:
It is recommended the City Council:
1) Review the applications;
2) Allow each applicant three minutes to briefly present their qualifications and why they would be the best candidate to fill the vacant Council seat;
3) Ask questions of the candidates, if desired; and
4) Council may either (i) appoint a new Council member at the end of the meeting, (ii) continue the 1 of38
January 21, 2025, Item #4
matter to another meeting, or (iii) decide to call a special election instead of appointment.
Discussion:
At the City Council Meeting on December 3, 2024, the City Council voted to initiate the appointment process, and accept applications from qualified District 1 Poway residents to fill the District 1 City Council seat that will become vacant as a result of the resignation of Councilmember Pepin.
Applications were made available on the City's website from December 4, 2024 until 4 p.m. on January 10, 2025. Applications received by the deadline are attached to this report.
The City Clerk received a total of six (6) applications from Poway registered voters residing in District 1 for Council's consideration. The applicants are listed below in alphabetical order by last name, and each application is attached (see, Attachment C):
1. Gregg Brandalise
2. John R. Carson
3. Hannah Mondo
4. Peter James Neild
5. Christopher J. Pikus
6. Ronald Allan Romero
Special Election
While the Council has voted to proceed to fill the vacancy by appointment, until the appointment is actually made, the Council still has the option to instead call a special election, if it so chooses.
The special election must be held on the next regularly established election date not less than 114 days from the call of the special election (Gov. Code § 36512(b)(1 )). As a result, for an in-person and by-mail special election, it would occur on November 4, 2025. (Elec. Code§ 1000.) For an all-mail (no in-person voting) election, the City Council would need to first adopt a resolution authorizing such an election, and if such a resolution was adopted, an all-mail election would occur on August 26, 2025 (Elec. Code§§ 4004(c)(1 ), (2); 1500). The only other established election date for an all-mail election is May 6, 2025, which is less than 114 days away.
A special election could not be called until Councilmember Pepin's seat is actually vacant (Gov Code§ 36512(b),(e)). Councilmember Pepin is only permitted to remain in office until the appointment of a replacement, not until the results of a special election (Gov. Code§ 36512(e)).
The County Registrar of Voters has provided an estimate of between $225,000 -$300,000 for the cost of a standard special election, and $150,000 to $225,000 for an all-mail election (Attachment D).
Finally, Council member De Hoff and Mayor Vaus have each individually requested that certain emails regarding a potential special election from Councilmember Blain be included as part of the record for this agenda item, and those are collectively attached hereto as Attachment E. 2 of38
January 21, 2025, Item #4
Environmental Review:
This informational report and potential action regarding filling a vacancy is not a "project" subject to California Environmental Quality Act (CEQA).
Fiscal Impact:
There is no fiscal impact associated with appointing a City Council Member.
The City received estimates from County Registrar of Voters of $225,000 -$300,000 for the cost of a standard special election, and $150,000 to $225,000 for an all-mail election (Attachment D). In addition to the election costs paid to the Registrar of Voters, as is true for all elections, the City would also incur costs associated with the public noticing and translating of election notices required per California Elections Code.
Public Notification:
None.

I'm emailing to let you know that I will be stepping away from the city council effective upon my seat being filled with a replacement.
My work in political consulting and communications consulting has expanded and grown since I joined the city council, and I'm choosing to focus on continuing to grow my business in the coming years.
It has been a privilege to work with Mayor Vaus, my colleagues on the city council, you, and all of Poway's talented city staff. I'm confident that Poway will continue to prosper and thrive moving forward.
Thank you,

Mondo's
Statement
on
Consideration
for
Appointment
to
fill
District
1 Vacancy
When
my
young
family
and
I had
an
opportunity
to
move
to
the
San
Diego
area
due
to
a change
in
employment
-
I thoughtfully
researched
where
we
would
be
planting
ourselves.
We
had
lived
our
lives
mostly
in
the
California
valley
and
grew
up
in
cities
and
counties
that
valued:
family,
preservation
of
open
spaces,
California's
·history
of
agriculture
and
small
businesses.
My
husband
and
I looked
for
a
community
in
San
Diego
where
we
could
grow
our
family
in
a similar
culture
to
what
we
knew
growing
up
.
We
found
it
in
Poway.
That
was
well
over
5 years
ago
now
and
we
consider
ourselves
blessed
to
have
found
The
City
in
the
Country.
Our
world
changed
greatly,
and
for
the
better.
At
every
turn
we
were
amazed
by
the
warmth
, new
friendships,
and
opportunities.
Poway
is
a
great
city
to
live
in,
start
a
small
business
(as
I have
done),
nurture
a family
and
enjoy
the
great
outdoors
.
While
I am
a transplant,
my
story
is
far
from
unique
to
others
in
this
city.
I would
be
honored
to
be
appointed
to
the
District
1 Council
seat
because
I humbly
submit
that
I have
all
the
unique
skillsets,
experience
and
passion
for
civic
service
that
would
be
an
asset
to
ensuring
Poway
remains
a world
class
city
to
raise
a family,
start
a small
business,
and
live
.
My
work
experience
spans
from
starting
at
World
Vision
(an
international
non-profit)
as
an
advocacy
and
government
relations
assistant
where
I prepared
materials
seen
by
world
leaders
at
the
G8
in
Washington
D.C.
in
2012
. I have
also
been
a California
State
Senate
Fellow,
where
I learned
all
about
the
California
legislative
process
from
the
inside.
From
there,
I became
a
Legislative
Aide
to
a Senator
where
I became
a
subject
area
expert
in
Human
Trafficking
laws
and
wrote
two
bills
that
would
have
amended
California
law
to
be
tougher
on
those
found
guilty
of
Human
Trafficking.
Further,
I worked
as
an
Assemblymember's
Scheduler
where
I successfully
navigated
the
high
paced
demands
of
an
Assemblymember's
first
year
in
office
by
creating
a welcoming
environment
in
the
office
and
fulfilling
the
administrative
duties
that
keep
a California
legislative
office
running
smoothly.
From
2015
to
20171
worked
at
a
Public
Affairs
and
Public
Relations
office
carrying
as
many
as
5 clients
at a
time.
My
work
included
creating
and
implementing
comprehensive
digital
communications
plans
to
support
traditional
PR
communication
efforts.
Four
years
ago,
I founded
Mondo
Creative
from
the
ground
up
here
in
Poway.
Mondo
Creative
allowed
me
to
add
to
my
experience:
balancing
budgets,
billing,
invoicing,
receipts,
tracking
hours
and
more
. My
clients
are
small
businesses
as
I am
passionate
about
telling
their
unique
stories
on
line
through
many
channels.
Mondo
Creative
also
gave
me
experience
in
negotiating
contracts
and
opened
my
eyes
to
the
difficulties
small
business
owners
face
every
day.
If
I were
chosen
to
fill
the
seat,
it
would
not
be
my
first
time
taking
an
oath
of
office
to
uphold
the
values
of
our
great
state
and
country.
This
I do
not
mention
lightly,
for
when
I took
my
first
oath
in
2006
when
I
first
served
in
a
public
capacity,
I believe
there
are
no
expiration
dates
on
oaths
as
they
are
binding
promises
civil
servants
make
for
life
. It
is
a
promise
to
uphold
the
Constitution
of
our
great
country
and
apply
oneself
as
a
servant
leader
to
those
you
are
representing.
When
I saw
the
opening
for
the
District
1 Council
Seat
I was
convinced
that
it
was
time
to
give
back
to
Poway
what
it
has
so
generously
and
freely
given
me
and
my
family
. I am
ever
thankful
for
your
consideration

Re: My interest in being appointed to City Council Dec 9, 2024 I bought a home in Poway and moved here in 2003. At the time, I didn't think Poway was that different from any other city; I was wrong. Over the years I've come to appreciate the fact that Poway doesn't have the problems that other San Diego cities have. There's almost no crime. The fire department is superb.
The schools are great. The roads are smooth. There are no water main breaks that make the evening news. No flooding after severe storms. We have a pool, a senior center, parks, trails, and a center for the performing arts. There's no litter. And almost no homeless. It was obvious that Poway is a very well-run city; dare I say the envy of other municipalities around the county. And it is clearly attributable to the very competent city staff and astute guidance and fiscal stewardship provided by the city council.
During my three years on the Budget Review Committee, I learned a lot more about how the city was run and came away even more impressed. I often brag to others about how well managed Poway is. This is why I want to serve as councilman for district one -I love this city and I want it to keep running well. And I know this is not by accident; it's the result or a lot of good people committed to keeping the city in good shape. I want to be a part of this team and do my part to keep this city great.
I intend to take this position seriously. I realize that this as a more-than-part-time job and expect to put in commensurate effort. I will do my homework and be fully versed upon each issue before the council at each meeting. Like former councilmember Dave Grosch, I will take the time to meet with anyone who lives or works in Poway to discuss their concerns about how the city operates or how to improve it. While I would represent the people of district one, I will look out for the interests of all Poweigans.
As for commitment, I will do this job for as long as I need to. I intend to finish this term and run for re election in 2026; and if elected, I will serve the full term.
I did a lot of praying and contemplation about whether I was doing this for the right reasons. I know it's a cliche, but I truly do want to serve the people of Poway and give back to the community-much like my service on the Budget Review Committee, which sparked my love for the city and my desire to keep it running well.
I thank you for your time and consideration, and I do hope you pick the most qualified person for this job, whomever it is.

Appointment of Deputy Mayor for 2025
CITY COUNCIL
In September 1990, the City Council adopted Resolution No. 90-179 which provided guidelines for the selection of Deputy Mayor. In accordance with the Resolution, the Deputy Mayor:
1. Will serve a maximum term of one year;
2. Will be appointed at the first regular meeting in December in odd-numbered years; and
3. Will be appointed at the first regular meeting held thirty days following the general municipal election in even-numbered years.
The December 17, 2024 City Council meeting agenda included the appointment of the Deputy Mayor for 2025. At the meeting, the City Council failed to appoint a Deputy Mayor for 2025. Mayor Vaus and Councilmember De Hoff voted to appoint Councilmember De Hoff as Deputy Mayor, Councilmember Blain and Councilmember Maeda abstained from voting on the item, and Councilmember Pepin was absent from the City Council meeting. As City Attorney Fenstermacher explained, Councilmember Blain and Councilmember Maeda's abstentions counted as no votes. In order to be approved, the item required support from a majority of the City Council. Therefore, item was continued to the January 21, 2025 City Council meeting.
Discussion:
Per Resolution No. 90-179 the City Council annually appoints a member of the City Council to serve as Deputy Mayor. In addition to Poway's local resolution, California Government Code also includes a requirement the City Council selects a member of the City Council to serve as mayor pro tempore (referred to as Deputy Mayor in Poway).
Following the seating of Councilmembers Blain and Maeda at the December 17, 2024 City Council meeting, the City Council considered the appointment of a Deputy Mayor for 2025. The City Council failed to appoint a Deputy Mayor at the meeting. Mayor Vaus and Councilmember De Hoff voted for 1 of4
January 21, 2025, Item #5
Council member De Hoff to be appointed Deputy Mayor. Councilmember Blain and Councilmember Maeda abstained from voting on the appointment and Councilmember Pepin was absent from the meeting. In order to be approved, the appointment required an affirmative vote by the majority of the City Council. The appointment of the Deputy Mayor was continued to the January 21, 2025 City Council meeting, as a Deputy Mayor still needs to be appointed for 2025. The Deputy Mayor is responsible for leading City Council meetings in the Mayor's absence, as well as representing the Mayor at various meetings and events if he is unable to attend.
Finally, Council member De Hoff has requested that certain emails regarding the appointment of the Deputy Mayor from Councilmember Blain be included as part of the record for this item, and those are attached hereto as Attachment A.
Recommended Action:
It is recommended the Mayor appoint a Council member to serve as Deputy Mayor for the one-year term commencing January 21, 2025.
Environmental Review:
This action is not subject to review under the California Environmental Quality Act (CEQA).
Fiscal Impact:
None.
Public Notification:
