I have just finished reading item #4 on the agenda for next week's City Council Meeting. I am outraged at the private email correspondence between yourself and Councilmember De Hoff and one of the applicants for appointment to the D1 vacancy. Your offer to squash a recall effort against Councilmember De Hoff, your threat to file a recall petition against this applicant, as well as your offer to support Councilmember De Hoff's nomination for Deputy Mayor in exchange for their vote to support a special election is nothing short of a bribe and attempt to coerce and the very definition of corruption.

You have spent the better part of the last two years accusing the Mayor, former and current members of the City Council of corruption and backroom dealings. You have never provided a shred of evidence to support these allegations . Now, in your first opportunity to make a meaningful contribution to the governance of our city, you have attempted to influence the vote of a sitting councilmember and the future vote of a potential appointee through an open threat of retribution should they not comply with your wishes.

Such behavior is unacceptable and intolerable on the part of an elected official. It is likely criminal in nature. As such, I am demanding you recuse yourself from voting on item #4 at the 21 January City Council meeting and immediately resign from the Poway City Council. You are unfit and undeserving to represent the people in District 2 and should you foolishly decide to continue your effort to become Mayor, I will make it my goal to ensure every voter in our City is aware that you have attempted to influence those that represent their interests through threats and coercion. 2 of 56 January 21, 2025, Item #4
In closing I have not forgotten that you continue to block me on social media where you continue discuss city business. That is, according to recent court decisions, a violation of my First Amendment rights. I would like to remind you that just a few weeks ago, you raised your right hand and took an oath of office. That oath began with the words "I swear or affirm that I will support and defend the Constitution of the United States." You and I have both taken that oath a number of times in our lives. It meant something to me.

Based on your recent actions, I have to question what it now means to you.

We want to bring to your attention Brian Pepin's ineligibility to continue as a Poway City Council member. Given the clear evidence that Mr. Pepin no longer resides in District 1 or Poway for that matter, he is disqualified from participating in any capacity as a City Council member. This includes casting votes during the upcoming January 21 meeting, as any such actions would be in direct violation of municipal law. Any votes cast by Mr. Pepin will be illegal and therefore legally contested.

Furthermore, while we recognize that in past cases council members have provided valid rental agreements to demonstrate continued residency, we suspect that Mr. Pepin may attempt to produce a backdated agreement or similar documentation to justify his eligibility. We want to make clear that any such backdated arrangements will be scrutinized thoroughly. The integrity of this process demands transparency and corroboration with independent evidence to ensure compliance with the law.

Poway Municipal Code Section 2.04.070(C):
" ... the member of the City Council elected or (in the event of a vacancy filled by the City Council) appointed to represent a district must reside in that district and be a registered voter in that district ... Termination of residency in a district by a member of the City Council shall create an immediate vacancy for that Council district unless a substitute residence within the district is established within 30 days after the termination of residency." In his resignation letter to City Manager Chris Hazeltine, Mr. Pepin cited work obligations as the reason for stepping away from the Council:
"My work in political consulting and communications consulting has expanded and grown since I joined the City Council, and I'm choosing to focus on continuing to grow my business in the coming year."
However, the letter made no mention of his relocation outside District 1 or Poway. Furthermore, no record exists of Mr. Pepin re-registering to vote at a new residence within the district.

Residency is inconsistent with active representation
Since submitting his resignation, Mr. Pepin has been notably absent. He did not attend the December 3 or December 17 council meetings. In response to a December 19 email inquiry from Chris Cruse, you indicated that Mr. Pepin's absences were "excused." However, these absences, combined with the evidence of his relocation, suggest he has effectively ceased to fulfill the duties of his office.

Conclusion
The evidence is clear: Mr. Pepin's residency in District 1 has been terminated, and he has not established a new residence within the district. This renders him ineligible to continue as a council member, and an immediate vacancy must be declared pursuant to Poway Municipal Code Section 2.04.070(C). Any attempts to justify his eligibility through backdated or otherwise questionable arrangements must be carefully scrutinized and challenged.

We demand that you take immediate and decisive action to enforce Poway's municipal laws by declaring an immediate vacancy for the District 1 council seat. Upholding the integrity of our city government requires holding all council members accountable.

Please include these personal comments as additional material for the potential appointment to D1.

I am writing as the former appointed, elected at large, and elected District 2 Councilmember.

Although family health circumstances caused me to step down from my elected position, I will always have strong ties to the City that my family called home for over 20 years. It is unfortunate that CM Pepin will not complete his elected term but there is a process in place to address this situation and I trust that the Council will do what is best for the entire City of Poway and the taxpayers.

There are some people who have been outspoken about the 'troubled history' of appointments in Poway. This is a phrase that was coined by a man who lost an election (by a wide margin) yet feels entitled to another shot by the D1 voters and at considerable cost to all taxpayers. Where is the evidence of this 'troubled history'? It doesn't exist.

I went through a serious appointment vetting process that started with 20 candidates.

Three rounds of interviews were very public and I was chosen based on my business experience, community involvement and deep understanding of the operations of the City government. The voters of Poway and D2 apparently agreed that I deserved to represent them as I was elected twice since.

Mrs. Caylin Frank was appointed to the City Council based on her resume, deep understanding of local government and her desire to serve the city. She was by far the strongest candidate and my top choice. She also was a young mom and a resident of South Poway. She was attacked for not living in Poway 'long enough' by the same people who complained that no women, young mothers or South Poway residents were on the Council. What part of this qualifies as a 'troubled history'? Anita Edmonson was appointed to replace me when I had to step down in June 2023.

Anita did an outstanding job for the residents of D2 and was a strong contributor to the council. I am very pleased that she shared my negative opinion about the size and location of the Life Time proposed club at The Farm. The only 'trouble' I have with this appointment is that she was required to pledge not to run for the position in the next general election. This was intended to appease the complainers but it was a big mistake. Anita should have been able to run in the next election. She would have won and served D2 honorably.

Elections have consequences. This has never been more evident than it is today in Poway. I am disgusted with the actions of the newly elected D2 rep who campaigned by attacking the integrity of the Mayor, Councilmembers and Staff working for the residents. To claim that there is a history of 'backroom deals' and dishonesty in the city was unforgivable and unsupported by any evidence. These lies along with a promise to 'clean up' Poway government by getting rid of electeds and staff professionals was a 22 of 56 January 21, 2025, Item #4
dishonest way to encourage voters to do the wrong thing. Today we can all bear witness to a potential 'backroom deal' by the person who accused others of the very same thing. There is a very dishonest attempt to influence the vote based on a promise to go along. This is known as Quid pro quo.

In addition, the 02 rep has reached out to a potential candidate who is seeking appointment to the council with a threatening message if he were to go forward with his desire to serve the City. This behavior may go on in other cities but should never be accepted in Poway. Citizens should never be harassed or intimidated by an elected official.

To me, these actions are not only shameful, but illegal. I would expect the 02 rep to submit his resignation over these actions, just as he has been asking for the resignation of others .... because in his case there is ample justification from his own emailed attempts at vote-trading and bribery, to justify such an action. Time to practice what you preach, honesty and transparency are not just words.

At the very least, the 02 rep needs to recuse himself from any discussion of this agenda item. At best there will be serious legal consequences.

It is my strong opinion that an appointment better serves the residents of Poway. There is a very public call for candidates, hopefully good people with strong resumes can apply and be vetted. The Public can witness the process and participate if they choose.

The goal of an appointment process should be to get the best qualified candidate onboard in the shortest amount of time and at the least cost to the taxpayers. A special election will be time consuming, expensive and could result in another poor candidate getting elected. The last thing the residents need is another councilmember who doesn't seem to know what Integrity means.

With several San Diego County jurisdictions, including the County itself, faced with unanticipated vacancies, there are different perspectives on how to best fill the open seats. The supporters of special elections are active and loud, but their premise is invalid, their arguments are flawed, and their conclusion is not supported by the facts.

Separating fact from fiction and looking at past appointments with objective hindsight points to a well-reasoned conclusion that appointing a qualified applicant is the better and wiser choice.

Let's look at what we know the facts to be:

FACT #1: The California Constitution explicitly permits appointments as a legitimate process to ensure timely and competent representation. They are legally sound and a well-established and widely accepted democratic safeguard.

FACT #2: A Special Election would delay representation. Under California Election Code, the earliest possible special election to fill a vacancy would occur in November 2025. Certification wouldn't happen until December 2025, leaving some residents voiceless for nearly a year. That's an unacceptable timeline for a jurisdiction where important decisions can't wait.

But the fact that appointments are legal doesn't necessarily mean they are appropriate or effective. Let's consider that by looking at Poway's history with examples of how effective appointing has been and can be - again separating fact from fiction.

FACT #3: Poway's appointments have a proven track record. Despite claims to the contrary, Poway has no "troubled history with appointments_;, In 44 years, the city has made just four councilmember appointments, all of which were success stories. The two most recent appointees, Barry Leonard and Caylin Frank were each subsequently elected and reelected with overwhelming support - a clear endorsement by the voters of the judgement of the Council and clear expression of voter satisfaction .

FACT #4: Appointments can and have identified and introduced exceptional leaders.

One of these was Mickey Cafagna, a former council member and beloved mayor.

Mickey was originally appointed in 1992 and subsequently elected mayor twice and 24 of 56 January 21, 2025, Item #4
became one of the most effective and respected leaders in San Diego County. His leadership became a cornerstone of Poway's success and his legacy underscores how appointments can introduce capable and visionary leaders into public service.

Lastly, the appointment process will vary depending on how the vacancy was created, but for Poway:

FACT #6: Brian Pepin is currently still a councilmember, so the seat is not vacant.

Per California election code, a special election cannot be called if there is no vacancy.

Hence, the council's December 3rd vote to direct staff to prepare for the appointment process to replace Pepin was not only the better and wiser option, it was the only option.

Over the next six months, you, the Poway Council, will decide on critical issues directly affecting residents, including a new four-year water rate structure, annual budget, allocation of city funds for capital improvement projects, and potential development projects. All of Poway's residents need and deserve immediate representation to ensure their voices are heard on these pivotal decisions.

Larger jurisdictions may discount these facts to reach a different conclusion . Larger jurisdictions may decide they can afford and endure a drawn-out and distracting election cycle. Poway should do neither. For Poway, it's not just about filling a vacancy - it is about preserving a tradition of good governance and ensuring residents are represented when it matters most.

Poway has enjoyed the benefit of solid leadership and sound governance since its incorporation in 1980 - consistently aiming a laser focus on its core priorities of funding law enforcement and fire protection, regularly maintaining our streets and infrastructure, providing outstanding community service to residents.

The city's history of making wise and well-reasoned appointments when necessary is further proof of its commitment to being the best-run city in the county. All jurisdictions facing a vacancy, including and especially Poway, should appoint the best applicant available to fill the vacancy, then return its focus to their core mission of efficient local governance.

I am a Poway resident residing in district 1. I, along with many other district 1 residents of Poway, have urged the City Council to vote to hold an all-mail-in special election so that we can select a replacement for Councilman Brian Pepin.

There has been questionable information and reasoning given to the district 1 constituents about why a special election isn't the best choice . However, it is apparent that those reasons, cost, and date limitations, given to weaken the option of a special election are not fully justified . Any city should budget for the inevitability of a special election. In fact, the cost of such is a fraction of a percent of Poway's operating cost . And besides, it is a small price to retain a sense of fairness and democracy . Also, it seems like the city could have met the stated dates to hold an election if desired . It is unclear to me why those certain dates available for special election were chosen.

Of course, only you council members and staff really know your true intent ions. However, we all know what the ethical and fair choice is. Of course, that is to hold a special election so that District 1 residents can select their own representative . To deny district 1 the opportunity to vote in this current atmosphere of distrust, after large numbers of residents have voiced their wishes, would be appalling and would justify the distrust that is building among Poway's citizens.

You still have the opportunity to show integrity, do the right thing, and vote for a special election.

This form collects signatures for a letter urging the Poway City Council to reconsider the appointment process for the District 1 vacancy and prioritize a special election. Your information will only be used for this purpose.

Dear Mayor Vaus and Members of the City Council,
We, the undersigned residents and stakeholders of Poway, respectfully urge the City Council to listen to the community and vote for a special election to fill the District 1 vacancy. The County Board of Supervisors recently faced this decision, and they voted unanimous for a special election.

Poway's troubled history with appointments has eroded trust in Poway government. While we appreciate the Council's decision to extend the timeline and include newly elected members in the decision, it falls short of addressing core concerns about transparency and fairness.

The original hearing for a special election lacked key information about the feasibility, cost, and timeline of a special election. A timely, cost-effective, all-mail special election offers a practical solution to fill the District 1 vacancy while respecting the will of the people. Investing in a special election is an investment in trust and transparency-something Poway desperately needs to rebuild after years of frustration with appointments.

A vote for a special election is an immediate and proactive step to ensure this process respects voters and prioritizes democracy. We urge the Council to give District 1 residents the opportunity to choose their representative . The undersigned include a large number of District 1 residents, as well as supporters from across Poway and across the political spectrum who care deeply about democratic representation and transparency.

Democracy requires commitment, and the cost of a special election is a small price to pay for restoring public trust and ensuring voters have a voice in choosing their representative .

EXTERNAL EMAIL
I would like my voice heard urging the city council and especially Mayor Vaus to hold a special election for the district one seat. The citizens of Poway deserve to select their own representation. Mayor Vaus's history of selection of representation has left the city with the need for change.

I believe a mail in ballot for the electorate living in District 1 is an excellent way to select new representation. This is a cost saving, fair method and breaks the pattern of abusive management shown by Mayor Vaus.

For the record, I reside at 15335 Poway Springs Court. It is my firm belief that the people of District 1 deserve to select their own representation .
