E-mail generates correspondence that may be recognized as official records in need of protection/retention in accordance with the California Public Records Act. Therefore, electronically stored records such as e-mail are subject to retention requirements.

Information Technology shall store all e-mails stored in the “In Box” or “Sent Items” for two (2) years, in compliance with the City’s records retention schedule.

E-mails stored in “Managed Folders” or “Archive” are not automatically deleted after two (2) years. Employees are responsible for deleting these in accordance with the City’s records retention policies.

Users are solely responsible for the management of their mailboxes, just as they are responsible for the contents of their physical inbox in their office. It is the responsibility of the user to conduct regular and routine management and deletion of all e-mail correspondence in both the “In Box” and “Sent Items” once they are no longer required.

Generally, the sender of the e-mail should be the person responsible for saving it electronically and/or printing and filing it, but persons responsible for a particular program or project file are responsible for retaining appropriate e-mail that they send or receive related to that program or project.

If an e-mail is required to be retained longer than two (2) years, the user is responsible for saving it in the appropriate file folder (electronic or paper) so it is retained for the applicable retention period, as determined by the City’s records retention schedule.

In general, e-mail communications fall into one of the following two categories:
i. Records that relate in some substantive way to the conduct of the public’s business such as e-mails that contain significant policy decisions, requests and replies to requests for public records or direction to staff or consultants, etc. should be printed or saved electronically, filed and retained pursuant to the City’s Records Retention Program.
ii. Preliminary drafts, notes, personal messages, announcements, interagency or intra-agency memoranda that does not relate in some substantive way to the conduct of the public’s business or are unrelated to the business of the City, that are created for convenience only and the information provides general information such as announcing the dates and times of meetings, responses to Listservs, and requests for general City information other than public records, etc. need not be saved. These records should be deleted once the information is understood or communicated (i.e., if it is an announcement of a meeting, place the meeting on your calendar and delete the announcement).

Retention of an e-mail, electronic, or paper record is determined because (1) a law required it to be kept or (2) it is necessary or convenient to the discharge of the public officer’s duties and was made or retained for the purpose of preserving its informational content for future reference.”

B. Managing Electronic Communications
E-mail is not a records management system - it’s a communication system. Staff are strongly discouraged from using it for storing records that are to be retained longer than two (2) years. Determining whether an e-mail is a record that needs preservation and retention is the responsibility of the employee or official, in accordance with the guidelines contained in this policy and the City’s Records Retention Program.

To ensure maximum efficiency in the operation of the e-mail system:

Once a City official or employee has determined that an e-mail should be maintained for longer than two (2) years, he or she must save the e-mail from his or her inbox to an electronic folder, or print and file the e-mail, or otherwise retain the e-mail.

Staff can use “Drag & Drop,” “Save As,” “Print to PDF,” “Print & File” or other methods to save e-mail into a project folder, both inside or outside the e-mail system. i. All incoming and sent e-mails that are older than two (2) years will be AUTOMATICALLY deleted on a daily basis.
i, All deleted items (trash folder) that are older than seven (7) days will be permanently deleted from the system.

4. PERSONAL DEVICES / PERSONAL ACCOUNTS / TEXT MESSAGES A. Use of Personal E-mail for City-Related Matters
All City officials and employees, whether hired, elected or appointed, are strongly discouraged from using personal e-mail accounts to conduct any City-related business on matters or items concerning the City.
i. Encourage Others to Send to Correct Accounts. City employees and officials shall endeavor to ask persons sending electronic communications regarding City business to a personal e-mail account or personal device, to please utilize the City’s official e-mail account, and likewise shall endeavor to ask a person sending e-mail communications regarding non-City (personal) business to NOT use the City’s e-mail account, but instead use the personal account or device for personal business.
i. Production of Records in Response to a PRA Request. If a request for records is received pursuant to the California Public Records Act, employees and/or officials are required to search their personal accounts and personal devices for any and all records that are responsive to the request and forward them to the City, whether or not they are confidential, or exempt from disclosure. The employee or official can request that appropriate records be held as exempt from disclosure, but the final determination of whether a record is disclosable or not shall be made by the City Attorney. The City has the right to request a declaration or affidavit from any employee or official stating that they have fully produced any and all records pursuant to a request.

Forwarding E-mails or Texts. E-mails may only be sent or forwarded to appropriate persons with a need to know the information in order to conduct City business. If an employee sends a text or e-mail from a personal account regarding City business which needs to be retained, they should immediately forward it to their City’s e-mail account for retention, and potential disclosure.

Protection of Confidential E-mail or Texts. Write the word, “Confidential” on protected e-mail. Do not interfile e-mail or other privileged correspondence from the City Attorney’s office with public documents (documents that are accessible to the public). These e-mails may be subject to the Attorney-Client and/or the Attorney Work Product privileges, and the contents should not be disclosed without first checking with the City Clerk.

Litigation Holds / Other Types of Holds. E-mails subject to litigation (including a reasonable expectation of litigation) claims, complaints, audits, records requests and/or investigations suspend normal retention periods (retention resumes after settlement or completion of the triggering hold).

B. Separation / Transfer of Employees
The City’s technology systems must be set up to immediately disable a separated employee’s access to City e-mail and/or other technology. Human Resources and Information Technology shall ensure timely notifications of all employee separations.

During separation, Human Resources will coordinate with separating employee’s supervisor to encourage the following:
1) Forward any e-mails or text messages relating to City business stored on personal devices or personal accounts to their City e-mail account. 2) Employees are to close and/or remove any access to City e-mail or other technology systems from their personal devices.

The records stored in the e-mail account (including any archives,) of an employee who separates or transfers shall be the responsibility of that employee’s (former) supervisor.

If a supervisor needs access to a former employee’s e-mail account, they shall notify Information Technology, who shall provide temporary access to the e-mail account, which shall not exceed two (2) years.

E-mail that remains in an account (that is not saved in a subject / project file folder outside the e-mail system) will be backed up and retained for two (2) years.

5. USER GUIDELINES
A. Employees who are assigned a mailbox are responsible for checking their mailbox on a regular basis during the workday for messages. Messages received should be responded to promptly.

B. Incidental personal use of the City’s e-mail system is permitted. Such messages are subject to the access and disclosure statement set forth in this policy. Employees shall ensure that the content of their e-mail is in compliance with the standards of this policy.

C. E-mail should not be used for broadcast purposes unless the message is of interest to all users.

D. Inappropriate uses of e-mail include:
i Any private, profit-making activity such as “for sale” notices and wantads. i. Support or opposition to campaigns for candidates for elected offices or ballot measures.
ii. Messages of a religious nature or promoting or opposing religious beliefs. iv. Language and/or images which are insulting, offensive, disrespectful, demeaning, or sexually suggestive, or in violation of the City’s Workplace Bullying Policy. v. Harassment of any form, sexual or ethnic slurs, obscenities, or any representation of obscenities, or in conflict with the City’s Equal Opportunity, Harassment and Retaliation Policy.

Failure to comply with this policy may be cause for disciplinary action up to and including termination.

EXTERNAL EMAIL
Hello Tony,

I can promise that Chris Hazeltine deflects responsibility to address the request by labeling those who challenge or criticize his actions as "hostile." This tactic can be a way for someone to avoid addressing their behavior or wrongdoing by framing those who disagree with them as the problem. I am sure you have experienced the same behavior from him. Please review his email and my response and see how he avoided meeting with me to review landscaping prints and documents early last year (Mar 2024).

Thank you

Mr. Hazeltine,
Nothing surprises me anymore about the way you are conducting your business and your unprofessional behavior. You knowingly utilize the power given to you to make it impossible for us to communicate with the city.

I believe you have become aware and informed that the continuation of harassment, abuse, and interrupting our daily life under your leadership has been very well documented.

To respond to your recent email dated 3/5/2024. Let the record be known: up to this point, I have been very patient and respectful with you and your organization. This is true even during the time that you flat-out expressed your support for the abuse and discriminatory remarks that were made to me by the members of your organization. Now, you are simply retreating to what you are good at, “twisting the truth” and misleading information. You are making a lot of incorrect statements and accusations as a means to excuse and justify your moral ignorance and wrongdoing while at the same time deliberately making it extremely difficult for us to communicate with the city to address our concerns. If you recall, I have sent several emails with my concerns directly to you (per your requested route of communication), and I have yet to receive a response to any of them. This includes an email communication from Anita Edmondson stating you received my information and that you (Chris) would be taking action and getting back to me. You have left me no other option but to try and communicate my concerns respectfully via public comment at the city council 2030 of 2175

3 meetings. Clearly, this explains why you are throwing a temper tantrum, considering I am still here months later without a single response.

Since I am not allowed to meet with you to discuss the safety nightmare (near-miss) fatal accident on the service road adjacent to the walking trail behind our yard as a direct result of the poor design and lack of safety considerations that you have approved and administered, then at this time, I will go ahead and accept that you are so focused on your agenda that you will even go the distance to ignore the safety of residents living near the area, let alone ours.

Nevertheless, I have come to accept that you are an individual with very low moral standards. My desire to communicate or having any interaction with you at this juncture is pointless, however I will continue to be very alert as a taxpayer and concerned citizen, and I will attend and make public comments at the city council meetings to speak as it is necessary. I believe Poway deserves better.

On Tue, Mar 5, 2024 at 12:46 PM Chris Hazeltine <[email protected]> wrote:

I understand you stopped by the City Manager’s Office yesterday to request an in-person meeting with me. I am not inclined to accept your offer. In previous meetings with multiple staff members, you have come across as intimidating, bullying, and threatening; I personally have been on the receiving end of your threats “to come after me.” When I followed up to your statement by asking you if you were threatening me, you said you were “promising me you would come after me.” Additionally, you have attended multiple city council meetings where you made disparaging remarks and personal attacks against me, during the public comment portion of the meetings. For all these reasons, a personal meeting with you would not be productive.

I will respond as appropriate, to any email inquiries you make. And as you know, we will respond to any/all public records requests you make.

It’s unfortunate I find myself in this unique position, I do sincerely hope you and your family are able to find peace and accept The Farm development.

Noted that you will not be needing a binder moving forward.

As for your mail: Typically, I open Councilmembers mail (unless it says confidential) and if it is important and/or time sensitive, I scan a copy to them accordingly. If this is amenable to you, I’ll do the same with your mail.

Good Morning Councilmember Blain,

Your binder for next week’s council meeting is ready (and your mail is in the front flap).

If you happen to come by the office tomorrow, I’ll be out for a medical appointment and will leave it on my desk. Just a reminder this is our “Dark Friday” week and we’ll be closed for the holiday on Monday. If you’d prefer to wait until day of council meeting and get it when you come in, that is fine too.

City Attorney,

Your e mail is very threatening and confrontational. I believe you are weaponizing your position to single out Council member who you don’t like.

I could be wrong - if I am wrong, I apologize.

Thank you for being actively involved — it is very much appreciated / please also consider speaking at Public Comment at the next Council meeting 7 pm City Hall

EXTERNAL EMAIL
Good morning Mayor and City Council –

Another Brown Act reminder – please refrain from emailing the entire City Council how you plan to vote on an item before City Council. Pursuant to the Brown Act, a quorum of the council cannot discuss matters within its jurisdiction except at a public meeting. Details regarding emails to the entire Council and the Brown Act issues they create in my attached December 16th email. While provided in that previous email, this link bears repeating in this email: https://www.rwglaw.com/newsroom-news-california-open-meeting-requirements-state-local-agencies

The email below is particularly problematic because through the use of the word “we,” it appears to informs the remainder of the Council of how two City Councilmembers will vote, and thus any single Councilmember is able to ascertain how the majority will vote from the email. This is also problematic because a member of the public was included in the email, and therefore has notice of the Brown Act violation. Do not respond to the email below. Thank you.

One last quick comment, Chris: Are you aware that most Poway residents are scared of you? That is per my discussions with 5,000 residents. Nobody wants to tell you about complaints since they specifically tell me they fear retribution from you or City employees you supervise. This is going to change. You are NOT in charge of Poway. The City Council, and honestly 47,000 residents, are in charge of Poway. You simply work for us, and you are an At Will employee, meaning your employment can be ceased at any time if your employer deems necessary or for the good of the City (i.e., for the good of 47,000 residents who elect the City Council).

I know you are going to get angry and probably threaten me again since I am simply telling you the truth with the above statement.

In the time you have left in your employment, please just do the right thing and help me, Jenny, and 47,000 residents and get us the water fee/ rate data I requested, and just try your best to do your job and help us manage this wonderful City of Poway.

Chris,

1. Let me clarify: your future employment will be based on your PAST and FUTURE job performance based on discussions with all PAST and FUTURE employees and city residents. Our decision to continue your employment will be extremely objective. As you know, I personally recently spoke with at least 5,000 residents and I received many complaints about you, which I have asked everyone to document.

2. Again, this is at least the 6
th time I have asked you a very simple question: Please at least give me an introductory approach on how you are going to get me specifically where every dime of our water fees goes to. You have NOT responded appropriately or in any detail. I can only conclude you are hiding what you know. Please just do the right thing and get me these details expeditiously.

Councilmember Blain-

Of all the words I could’ve possibly contemplated to describe our first few weeks of interaction, “honeymoon” couldn’t have been further from consideration.

I choose to sit idly by and ignore your
threats of intimidation when you incessantly state you will have three votes of the city council in 11 months, and you will be mayor in 23 months, all implying you will have the votes necessary to separate me from my position as city manager.

But you crossed a line again, when you stated you “don’t think I will be quick and transparent” with your request for water rate information.

As I stated to you before in response to a December 10, 2024 email in which you accused me of “scheming to recall you,” I am a dedicated public servant bound and committed to a professional code of ethics.

I love Poway, I take my job seriously, and I
2055 of 2175
July 1, 2025, Item #3
am a consummate professional. I will continue to act in that matter, even with you, but I will not allow you to tarnish my name with unfounded presumptions or accusations.

Further, in the December 10, 2024 email response to you, “I implore(d) you to please refrain from any further harassing, bullying, or threatening messages.” I am no longer imploring, and respectfully requesting doesn’t seem strong enough, so I am now demanding you cease subjecting me to these types of behaviors, which now include acts of intimidation delivered electronically or otherwise.

For
what it’s worth, never in my nearly 40 year career did I ever think I would be so overwhelmingly compelled to make this kind of statement to an elected official, and I take no pleasure in doing so.

Specific to your water rates request, your question has been asked and answered on more than one occasion.

In our efforts to be helpful, the most recent response to your request even included directions on how to read the budget; you are either unable or unwilling to do so. The assertion we are not being transparent is laughable. The City’s finances are audited annually, and we annually receive the Government Finance Officers Association award for our budget development.

Additionally, the amount of review and analysis of our water enterprise fund conducted by third parties as part of the issuance or revenue bonds to finance our water improvement program was an unprecedented exercise.

All subject matter experts agreed the City’s water enterprise fund is managed responsibly.

I struggle to determine if your actions toward me are driven by ignorance or arrogance, I suspect it’s a combination of both.

I standby, willing to assist with addressing the ignorance, but you are on your own to address the perceived arrogance.

In the earlier referenced December 10 email, I stated, “I am very hopeful this email exchange can be nothing more than a small blip in an otherwise professional and productive working relationship.”

Here we are a month later, I suppose I’m still hopeful.

-Chris

Discussion and Possible Action to Fill City Council Vacancy

CITY COUNCIL
On November 25, 2024, District 1 Council member Brian Pepin provided notice that he will resign from his position on the City Council "effective upon my seat being filled with a replacement." (Attachment A). The term of office for this City Council seat concludes following the November 2026 General Municipal Election.

At the City Council meeting on December 3, 2024, the Council voted to initiate an appointment process to fill the vacancy. Per the Council's direction, the City Clerk began accepting applications from Poway registered voters residing in District 1 on Wednesday, December 4, 2024. The application period closed at 4 p.m. on Friday, January 10, 2025 (Attachment B).

Any individual appointed to fill the vacancy would hold office until the current District 1 term ends (Gov. Code § 36512(b)(2)(B)). Currently, it is not possible for the Poway City Council to appoint someone to serve only until a special election. In order to have this option, the City Council would be required to adopt an ordinance/Municipal Code amendment requiring that option for all vacancies (Gov. Code§ 36512(c)(3)). Were there to be City Council direction at the January 21, 2025 City Council meeting to bring back such an ordinance for City Council consideration at a future meeting, it would become effective thirty days after a second reading adopting the ordinance, assuming it was approved.

Recommended Action:

It is recommended the City Council:
1) Review the applications;
2) Allow each applicant three minutes to briefly present their qualifications and why they would be the best candidate to fill the vacant Council seat;
3) Ask questions of the candidates, if desired; and
4) Council may either (i) appoint a new Council member at the end of the meeting, (ii) continue the 1 of38
2059 of 2175
July 1, 2025, Item #3
January 21, 2025, Item #4
matter to another meeting, or (iii) decide to call a special election instead of appointment.

Discussion:

At the City Council Meeting on December 3, 2024, the City Council voted to initiate the appointment process, and accept applications from qualified District 1 Poway residents to fill the District 1 City Council seat that will become vacant as a result of the resignation of Councilmember Pepin.

Applications were made available on the City's website from December 4, 2024 until 4 p.m. on January 10, 2025. Applications received by the deadline are attached to this report.

The City Clerk received a total of six (6) applications from Poway registered voters residing in District 1 for Council's consideration. The applicants are listed below in alphabetical order by last name, and each application is attached (see, Attachment C):

1. Gregg Brandalise

2. John R. Carson

3. Hannah Mondo

4. Peter James Neild

5. Christopher J. Pikus

6. Ronald Allan Romero
Special Election
While the Council has voted to proceed to fill the vacancy by appointment, until the appointment is actually made, the Council still has the option to instead call a special election, if it so chooses.

The special election must be held on the next regularly established election date not less than 114 days from the call of the special election (Gov. Code § 36512(b)(1 )). As a result, for an in-person and by-mail special election, it would occur on November 4, 2025. (Elec. Code§ 1000.) For an all-mail (no in-person voting) election, the City Council would need to first adopt a resolution authorizing such an election, and if such a resolution was adopted, an all-mail election would occur on August 26, 2025 (Elec. Code§§ 4004(c)(1 ), (2); 1500). The only other established election date for an all-mail election is May 6, 2025, which is less than 114 days away.

A special election could not be called until Councilmember Pepin's seat is actually vacant (Gov Code§ 36512(b),(e)). Councilmember Pepin is only permitted to remain in office until the appointment of a replacement, not until the results of a special election (Gov. Code§ 36512(e)).

The County Registrar of Voters has provided an estimate of between $225,000 -$300,000 for the cost of a standard special election, and $150,000 to $225,000 for an all-mail election (Attachment D).

Finally, Council member De Hoff and Mayor Vaus have each individually requested that certain emails regarding a potential special election from Councilmember Blain be included as part of the record for this agenda item, and those are collectively attached hereto as Attachment E. 2 of38
2060 of 2175
July 1, 2025, Item #3
January 21, 2025, Item #4
Environmental Review:

This informational report and potential action regarding filling a vacancy is not a "project" subject to California Environmental Quality Act (CEQA).

Fiscal Impact:

There is no fiscal impact associated with appointing a City Council Member.

The City received estimates from County Registrar of Voters of $225,000 -$300,000 for the cost of a standard special election, and $150,000 to $225,000 for an all-mail election (Attachment D). In addition to the election costs paid to the Registrar of Voters, as is true for all elections, the City would also incur costs associated with the public noticing and translating of election notices required per California Elections Code.

Public Notification:

None.

Please

why
you
want
to
be
appointed
to
City
Council;
a separate
sheet
may
be
attached.

I am
well-suited
for
this
role.

I have
been
blessed
with
the
opportunity
to
serve
others,
guided
by
humility
and
empathy.

My
experiences
in
the
United
States
Marine
Corps
have
ingrained
in
me
the
values
of
leadership
and
adaptability.

Additionally,
my
wife
Amanda
has
taught
me
the
vital
importance
of
active
listening.

Combining
these
experiences
with
my
education
has
prepared
me
to
contribute
effectively
to
your
team.

A
brief
overview
of
my
background:

I grew
up
in
Indiana
and
Kentucky,
where
I completed
my
high
school
education.

Shortly
after,
I joined
the
Marine
Corps,
arriving
at
boot
camp
just
14 days
following
the
tragic
events
of
September
11,
2001.

Throughout
my
service,
I was
stationed
across
the
Eastern
United
States
and
in
Okinawa,
Japan.

I later
returned
to
Camp
Pendleton,
where
I was
deployed
multiple
times
to
Kuwait
and
Iraq.

Leading
fellow
Marines
in
combat
remains
one
of
my
proudest
achievements.

After
transitioning
from
Camp
Pendleton
to
duty
at
MCAS
Miramar
in
2006,
I
separated
from active
service
in
October
2008,
an
experience
that
has
profoundly
shaped
my
life.

In
November
2008,
I enrolled
at
National
University
while
concurrently
working
as
a
facilities
manager
for
various
biotech
companies.

I graduated
in
2011
with
a Bachelor
of
Science
in
Business
Administration.

Upon
completing
my
degree,
I accepted
a position
at
Motorola
Solutions,
focusing
on
customer
service
and
business
development.

In
this
role,
I collaborated
with
local,
state,
and
federal
agencies
to
provide
public
safety
communication
equipment,
during
which
I gained
a deep
understanding
of
the
contracting
processes
and
the
critical
needs
of
public
safety
personnel
throughout
the
West
Coast.
/
Currently,
I serve
as
a veteran
advocate
for
several
organizations,
with
a strong
desire
to
give
back
to
the
community
that
has
supported
us
all.

Mondo's
Statement
on
Consideration
for
Appointment
to
fill
District
1 Vacancy
When
my
young
family
and
I had
an
opportunity
to
move
to
the
San
Diego
area
due
to
a change
in
employment
-
I thoughtfully
researched
where
we
would
be
planting
ourselves.

We
had
lived
our
lives
mostly
in
the
California
valley
and
grew
up
in
cities
and
counties
that
valued:
family,
preservation
of
open
spaces,
California's
·history
of
agriculture
and
small
businesses.

My
husband
and
I looked
for
a
community
in
San
Diego
where
we
could
grow
our
family
in
a similar
culture
to
what
we
knew
growing
up
.

We
found
it
in
Poway.

That
was
well
over
5 years
ago
now
and
we
consider
ourselves
blessed
to
have
found
The
City
in
the
Country.

Our
world
changed
greatly,
and
for
the
better.

At
every
turn
we
were
amazed
by
the
warmth
, new
friendships,
and
opportunities.

Poway
is
a
great
city
to
live
in,
start
a
small
business
(as
I have
done),
nurture
a family
and
enjoy
the
great
outdoors
.

While
I am
a transplant,
my
story
is
far
from
unique
to
others
in
this
city.

I would
be
honored
to
be
appointed
to
the
District
1 Council
seat
because
I humbly
submit
that
I have
all
the
unique
skillsets,
experience
and
passion
for
civic
service
that
would
be
an
asset
to
ensuring
Poway
remains
a world
class
city
to
raise
a family,
start
a small
business,
and
live
.

My
work
experience
spans
from
starting
at
World
Vision
(an
international
non-profit)
as
an
advocacy
and
government
relations
assistant
where
I prepared
materials
seen
by
world
leaders
at
the
G8
in
Washington
D.C.
in
2012
. I have
also
been
a California
State
Senate
Fellow,
where
I learned
all
about
the
California
legislative
process
from
the
inside.

From
there,
I became
a
Legislative
Aide
to
a Senator
where
I became
a
subject
area
expert
in
Human
Trafficking
laws
and
wrote
two
bills
that
would
have
amended
California
law
to
be
tougher
on
those
found
guilty
of
Human
Trafficking.

Further,
I worked
as
an
Assemblymember's
Scheduler
where
I successfully
navigated
the
high
paced
demands
of
an
Assemblymember's
first
year
in
office
by
creating
a welcoming
environment
in
the
office
and
fulfilling
the
administrative
duties
that
keep
a California
legislative
office
running
smoothly.

From
2015
to
20171
worked
at
a
Public
Affairs
and
Public
Relations
office
carrying
as
many
as
5 clients
at a
time.

My
work
included
creating
and
implementing
comprehensive
digital
communications
plans
to
support
traditional
PR
communication
efforts.

Four
years
ago,
I founded
Mondo
Creative
from
the
ground
up
here
in
Poway.

Mondo
Creative
allowed
me
to
add
to
my
experience:
balancing
budgets,
billing,
invoicing,
receipts,
tracking
hours
and
more
. My
clients
are
small
businesses
as
I am
passionate
about
telling
their
unique
stories
on
line
through
many
channels.

Mondo
Creative
also
gave
me
experience
in
negotiating
contracts
and
opened
my
eyes
to
the
difficulties
small
business
owners
face
every
day.

If
I were
chosen
to
fill
the
seat,
it
would
not
be
my
first
time
taking
an
oath
of
office
to
uphold
the
values
of
our
great
state
and
country.

This
I do
not
mention
lightly,
for
when
I took
my
first
oath
in
2006
when
I
first
served
in
a
public
capacity,
I believe
there
are
no
expiration
dates
on
oaths
as
they
are
binding
promises
civil
servants
make
for
life
. It
is
a
promise
to
uphold
the
Constitution
of
our
great
country
and
apply
oneself
as
a
servant
leader
to
those
you
are
representing.

When
I saw
the
opening
for
the
District
1 Council
Seat
I was
convinced
that
it
was
time
to
give
back
to
Poway
what
it
has
so
generously
and
freely
given
me
and
my
family
. I am
ever
thankful
for
your
consideration

Re: My interest in being appointed to City Council Dec 9, 2024 I bought a home in Poway and moved here in 2003. At the time, I didn't think Poway was that different from any other city; I was wrong. Over the years I've come to appreciate the fact that Poway doesn't have the problems that other San Diego cities have. There's almost no crime. The fire department is superb.

The schools are great. The roads are smooth. There are no water main breaks that make the evening news. No flooding after severe storms. We have a pool, a senior center, parks, trails, and a center for the performing arts. There's no litter. And almost no homeless. It was obvious that Poway is a very well-run city; dare I say the envy of other municipalities around the county. And it is clearly attributable to the very competent city staff and astute guidance and fiscal stewardship provided by the city council.

During my three years on the Budget Review Committee, I learned a lot more about how the city was run and came away even more impressed. I often brag to others about how well managed Poway is. This is why I want to serve as councilman for district one -I love this city and I want it to keep running well. And I know this is not by accident; it's the result or a lot of good people committed to keeping the city in good shape. I want to be a part of this team and do my part to keep this city great.

I intend to take this position seriously. I realize that this as a more-than-part-time job and expect to put in commensurate effort. I will do my homework and be fully versed upon each issue before the council at each meeting. Like former councilmember Dave Grosch, I will take the time to meet with anyone who lives or works in Poway to discuss their concerns about how the city operates or how to improve it. While I would represent the people of district one, I will look out for the interests of all Poweigans.

As for commitment, I will do this job for as long as I need to. I intend to finish this term and run for re election in 2026; and if elected, I will serve the full term.

I did a lot of praying and contemplation about whether I was doing this for the right reasons. I know it's a cliche, but I truly do want to serve the people of Poway and give back to the community-much like my service on the Budget Review Committee, which sparked my love for the city and my desire to keep it running well.

I thank you for your time and consideration, and I do hope you pick the most qualified person for this job, whomever it is.

2 Appointed
to
city

I have
always
felt
a
connection
with
my
community
and
a
desire
to
serve
my
community.

I
actually
considered
applying
as
a
volunteer
Sheriff
and
running
for
Poway
City
Council
but
was
limited
by
IHSS
on
the
number
of
hours
I could
work
outside
of
IHSS
until
July
2024
when
the
policy
changed.

I now
have
great
flexibility
to
work
for
IHSS
and
any
other
full-time
position.

This
enables
me
to
pursue
to
serve
my
family
and
my

I was

in
San

County
with
the
exception
of
my

in
the

and
relocating
to
Florida
for
5 years
for
my

I am

an
awesome

who

I have

who

gay,
a
14 year
old
son
who
currently
attends
Poway

, and
11 year

I feel
living
in
such
a
diverse
family
helps
me
to
empathize
with
the
complexities

diverse
needs. I was
employed
as

from

I was

where
I managed

in
three
countries
with
great
success.

I was
able
to

with
a

and

degrees.

I was able
to
accomplish
this
successfully
by
cultivating
the
team
as
a
contributing
unit,
and
not
as
a
boss
merely
telling
people
what
to
do.

I set
aside
my
career
for
my

particularly
my
twins,
so
that
I could
participate
in
Early
Intervention,

have
been

Prior
to

I feel

EXTERNAL EMAIL
Good evening Mayor and Councilmembers –
2098 of 2175
July 1, 2025, Item #3
2 Prior to seeing the attached email from Councilmember Blain at 3:48 pm, I was already considering whether or not I had an obligation to send the below email chain to all of you. At this point, I know that I must.

As you can see from the email chain below from 11:36 am to 2:55 pm today, I received some questions from Councilmember Blain relating to his emails to Councilmember DeHoff and Mr. Pikus included in the January 21 agenda, and I offered to answer Councilmember Blain’s inquiries in writing. I did not want to become an accessory after the fact to potential felonies, or otherwise somehow infect the City with liability if I had a phone conversation that later became a “he said, she said” situation. This is all new territory for me, and frankly I am not entirely sure what the rules of the road are for potential violations like this.

For context, since you all are likely not aware of nature of our communications over the past several months, other than one several minute phone call earlier this week or last week about the Public Records Act, Councilmember Blain and I have not spoken on the phone, and never met in person (notwithstanding my offers to do so). I have, however, fielded dozens of emails (and been copied on well over 100 I am sure) where I have provided comprehensive legal answers in writing. This seems to be the preferred method of communication.

Thus, when Councilmember Blain flatly refused to put questions in writing without explanation – which if legitimate and related to seeking legal advice as a Councilmember / for the City, would be covered by attorney-client privilege – I can only assume that he was hoping to enlist me in the defense of potential criminal actions or some sort of related mitigation strategy. There is no other explanation for multiple phone calls and requests for phone calls after months of no such calls or requests, the first ever text message, and his refusal to email questions. From November until today, I went very few days where I did not see emailed questions from Councilmember Blain. Obviously, that is not my role as the City Attorney, where my duty is to the municipal corporation.

Furthermore, as I stated below, I was worried that if I refused to assit Councilmember Blain on the phone, he would retaliate against me. My worry was driven in part by his many threats to report me to the state bar or fire me in 10 or 23 months when he gets an answer he does not like, even if completely benign, objective and legally correct.

Unfortunately, less one hour later, that retaliation already occurred, as you can see from the attached email from 3:48 pm. Councilmember Blain apparently plans to comment on my two 4+ year old donations to Steve Vaus’ campaign for County Supervisor, which he must think will embarrass me, or pose a problem for me.

Setting aside the questionable propriety of a Councilmember attacking a City staff member (or contractor) during a City Council meeting based on a topic totally unrelated to any agendized business as a Councilmember item/report – under the Brown Act or otherwise – I wanted to let you all know that there is nothing legally wrong with my contributions.

While I have never and will never contribute to a City of Poway election, I have a First Amendment right to make political
contributions in entirely unrelated races, and there is no body of law that makes this a conflict, illegal, or anything else improper. The Form 460 Councilmember Blain attaches did not take a super sleuth to find – it is publicly posted online.

Given I am a career municipal lawyer and a Section Head at one the largest and most respected municipal law firms in the state, I obviously knew and know that any contributions I make will be properly reported on Form 460s, and are completely public. If there was an issue, I would have never made this contribution. Further, it bears pointing out that had Mayor Vaus won and become County Supervisor, he would no longer be Mayor and I would no longer work with him. Thus, if Councilmember Blain alleges my contributions create some sort of conflict, it does not even make sense.

While I have no obligation to explain contributions, as some of you know, my sister and her family, as well as my parents in 2020, live in the unincorporated County of San Diego, and I am in the district often for work (obviously) and for pleasure. In fact, during COVID/2020, I was living in unincorporated San Diego county about as often as home. I have an interest in contributing to someone that I felt would do a good job, and that is my personal choice. As for the $100 contribution from my now retired partner Mr. Cosgrove, I can’t speak to his motivation, but he did a significant amount of work in San Diego County, including in Lakeside, where I know he had friends. To my memory, he never did even one hour of work for Poway.

Finally, while I have not told any of you this, I think it is time you know – the last two months have included some of the worst of my career. When I was with my children on both Halloween and Thanksgiving night, I received emails calling me unethical, demanding I resign and that I would be reported to the state bar, for completely unstated reasons. Literally, I 2099 of 2175
July 1, 2025, Item #3
3 was in costume with my kids while receiving emails from a man I had never even actually met, threating not just this my position with Poway, but my entire career, for reasons that were not articulated, and I could not even fathom. During November, I endured several weeks of emails, where every other day, I was told to resign, or how I would be fired in 10 or 23 months, or how “every person in Poway” wants me to resign or agrees I should resign, with social media statistics attached. I am an experienced litigator, but no one has ever treated me and other City professional staff as poorly as I have experienced and seen the last few months – not senior partners when I was a first year associate, not the most hardened, type A opposing counsel in the midst of a brutal trial, or after a tough loss. I have never had my credibility repeatedly questioned or attacked by anyone, but it became routine. This treatment continued at various times even after Councilmember Blain was sworn in and I provided him all the legal advice he requested, to the best of my ability.

Notwithstanding all of this, I decided to take the high road and provide high quality legal advice in response to being inundated with questions, often for the second or third time, thinking that maybe the relationship would change. I never once responded to the resignation demands, either via email or when made in person at a Council meeting, despite having the opportunity to do so. I tried to think to myself “do not get in the mud with pigs, you both get dirty, and the pig likes it.” Instead, I did my job – for many more hours than I have ever spent responding to 7 years’ worth of all other Councilmember inquiries, combined. I actually had legitimate hope that maybe once Councilmember Blain got to know me, stopped campaigning and got to the work of governing, we could move past all of the bluster. While it got a bit better this past month, and out and out resignation demands stopped, the reference to 10 or 23 months always hung in the air, and every morning I would check my email bracing myself for several emails from Councilmember Blain, never knowing if it was a thank you, or an attack. It seems that now, with Councilmember Blain’s most recent decision to attack me after months of actually trying to assit him and help in avoid breaking the law – including stopping him from calling law enforcement on two separate individuals who complained to him via official City email, resulting in a slam dunk lawsuit loss for the City – the bullying and harassing behavior has returned in full force. I truly dread the hostile work environment that awaits me in the coming months.

Councilmember Blain – to you personally, I do not you have now fixed your ire on me (again), other than I gave you a legal opinion that you did not want to hear. It is also just that – an opinion – it is not up to me. More to the point, I had nothing to do with your emails in question, you wrote them, and you are solely to blame for the position you now find yourself in, whatever that may be. Despite all your conspiratorial allegations that I am political, out to get you, or the like, I have viewed this job
for over 7 years as simply calling balls and strikes for the Council, not ever taking a position or having an opinion, and I have consistently done that. Ironically, the only Councilmember in my 7+ years here that has asked me to be political and attempted to weaponize me against their colleagues is you. I can only assume that is what you hoped to do on the phone today. I have never written an email like this to a “client” and certainly not a City Councill, and I hope I never have to again – ever single other email I wrote to this Council or other individual Council members has been dry, boring legal advice. I still ponder how our very first interaction nearly a year ago was me reaching out looking to help you file your nomination papers remotely – something I had never dealt with, and was struggling to find an answer to – and you immediately responded with vitriol. As I have repeatedly explained, considering I was trying to assit, I did not understand it then, and I don’t understand any of this now.

Thank you Council for your time to read this lengthy email, and please respond to just me with any questions.

EXTERNAL EMAIL
Franky, I am more comfortable communicating via email given the potential serious implications of what has occurred. I want my advice to be on record if this matter ever gets to a criminal proceeding, and do not want to be accused of saying something I did not. On several occasions, you have threated to report me to the state bar on me for not giving the answer you wanted (or for no reason at all), emailed me demanding my resignation every other day for weeks in October and November (including twice on holidays, at night), etc., so I certainly do not know if I can trust you in this type of a situation. Based on this past behavior and what I have seen in the more recent emails, I am worried you will take adverse action against me if I do not do what you want with respect to these potential crimes, which again, appear to include both vote trading and threating adverse action against your colleagues if they do not vote as you wish them to.

Additionally, at this point I need to look after the interests of the City and protecting it from liability.

You have not taken
(or perhaps misunderstood) my advice on other issues, despite repeated advice on topics such as the Brown Act, and First Amendment issues relating to social media use. I would like all my advice to be clear and in writing. I will answer your questions in writing. Hopefully you can understand that.

Councilmember Blain –

Sorry for the delay past 1:30. I saw you called again as well, but I am on the other line/in another zoom meeting.

However, I can handle questions in writing if you’d like during certain portions of this.

With respect to the below, I am not sure if you asking if your emails that were posted to the agenda report violated the Brown Act. In of themselves, unlikely, but if you emailed other Councilmembers about how you were voting on the Deputy Mayor or special election items, potentially yes. I think you may have done his, but I am not sure. Per my repeated, previous advice regarding the Brown Act and digital violations, you cannot send any communications (whether emails, texts, social media messages, etc.) to two different Council members where you inform them both how
you plan to vote on any specific item, or otherwise discuss your vote.

However, I would be (and am) more concerned about the emails because of vote trading, which is a form of bribery that is a felony. I am not an expert in criminal law, but as a City Attorney I do know that vote trading is illegal, in fact, it’s a bullet on my slide deck that I presented to all candidates at the candidate forum. One of your email chains with Councilmember DeHoff appears to be soliciting vote trading. Take a look at Penal Code section 86:
https://codes.findlaw.com/ca/penal-code/pen-sect-86/. I would also be concerned about threatening adverse action against a fellow Councilmember if they failed to vote your way on a certain item coming before you, but I am not an expert. Take a look at Penal Codes sections 165 & 518, as well. FYI, I cannot advise you on any defense if any future criminal matter comes of this, and have to represent the City as the municipal corporation.

Vaus and DeHoff are idiots for forcing me to listen to your illogical political lies at Public Comment with a new City ordnance and change of Poway Municipal Code. You should all be terribly embarrassed, but of course in your twisted logic you somehow think such a law 2146 of 2175

I’m sure and unethical and extremely Vaus appointed Poway City Attorney Alan Fenstermacher masterminded your silly game just like he masterminds how to allow Councilmembers who no longer live in Poway to attend and vote at Council meetings. We will reverse all this crazy Chicago-style dirty politics the second I get elected Mayor NOV 2026. Enjoy your dirty politics while it lasts.

We will immediately delete this law the second we have 3 votes on Council in DEC 2026.

Anita, are you running for D2? Maybe you can actually get elected this time instead of a developer-endorsed Vaus & DeHoff & Pepin & Frank highly biased political appointment.

I will be responding 100% of the time to 100% of Public Comments next 10 years - listen and have fun.

Mr. Blain –

First and foremost, whatever you
heard is false. I am not involved,
and would never get involved, in
any recall proceedings other than
as required by my official role as
City Attorney (e.g.,
advising/assisting the City Clerk
2162 of 2175
July 1, 2025, Item #3
3 when the recall petition and
related paperwork is filed). I am
not a politician or elected official,
but instead contracted
professional working for, and with
a duty to, the City Council as a
whole and the City generally – not
any individual Councilmember,
regardless of who it is. I am sure
Chris will speak for himself, but in
my opinion, he is a consummate
professional City Manager that I
strongly believe would not risk his
reputation or integrity get involved
in that sort of thing.

Second, I would like to express
that I find this email very
disappointing, which is one of
dozens I have received over the
past 6 to months or so attacking
my integrity, which I take
extremely seriously. In talking to
Chris yesterday, it sounded like
you two had a candid, productive,
professional and respectful
meeting, and that was carried
through to our email exchange last
night regarding social media use.

Following that, I was looking
forward to meeting with you soon
to fill you in on the rules of the
road as a new Councilmember,
including social media, the Brown
Act, and many other laws that now
apply to you. Again, I serve the
entire Council, and my interest is
in making sure all of you follow the
law, to limit the City’s
liability. Indeed, during my tenure,
the City has avoided litigation that
plagues many other cities, and I
am extremely proud of the part I
have played in ensuring that is the
case.
2163 of 2175
July 1, 2025, Item #3
4 My sincere disappointment also
comes from the fact that I was –
and still am – willing to put all your
past emails to me behind me, and
start completely fresh and build a
strong, professional relationship
with you. As you know, I have not
responded to your repeated
emails demanding my resignation,
including those coming in at all
hours and on holidays, such as
Thanksgiving during dinner time.

These emails stated no grounds
for your demands, and multiple
times threatened complaints to
the State Bar. As a holder of a
professional license yourself,
surely you are well aware of the
serious nature of such complaints.

I also did not respond to your
resignation request made orally at
the last City Council meeting. All
this is to say that to see this email,
which appears to be based on
either misinformation, or no
information at all, seems to put as
back where we have been for
months now. I am sending this
email because I cannot continue
to not respond to serious and false
allegations, and most importantly,
as an attempt to extend an olive
branch I sincerely hope you will
take.

To that end, I do not know why you
seem to have animosity for
me. Our first interaction (at least
that I recall) was when I reached
out to you and candidly told you I

deployment abroad, and neither

5 had the City Clerk. I thought, as a
long serving member of the armed
forces, you might have some
knowledge or perhaps could point
me in the right direction. I was truly
shocked when you responded
negatively, with immediate harsh
words. I tried to explain that I was
just trying to find a solution, but
there was clearly a
misunderstanding. I have attached
those emails, and I am hoping a
fresh read with an open mind,
months later, you might realize
now we were just trying to help. As
of course you know, we ended up
finding a solution anyway, after
extensive research on our own. I
would think my effort to continue
helping you in this regard, despite
the harsh rhetoric and
accusations lobed in my direction,
demonstrates my
professionalism, and importantly,
how I plan handle requests from
you or otherwise interact as a
sitting Councilmember – the same
as any other Councilmember.

Finally, I note that I do not believe
we have ever spoken on the
phone, or in person. I am happy to
do either, and still stand ready to
move forward in a professional,
productive matter. I find those
types of communications much
more productive – even when I am
dealing with an opposing attorney
in a contentious matter – rather
than email, where folks are often
speak with vitriol that they would
not otherwise.

Councilmember Maeda –

2169 of 2175
July 1, 2025, Item #3
2 I hope you had a good long weekend. I know we have not spoken much and only had one short meeting thus far, but I wanted to reach out personally, particularly after your kind message the other evening. I want you to know, from me directly, that I do not care about how you or any other Councilmember votes, what their policy goals are, if they want to completely change policies or keep everything the same. I am not a sixth council member – I have no policy opinions. My
job is to call balls and strikes for the Council and keep you all from violating the law, and limiting the City’s liability. I am very proud of what I have done since 2018, where the City has prevailed or resolved every litigation or administrative challenge I have been involved in, and mostly completely stayed out litigation entirely at least in part as a result of my advice, saving the taxpayers money.

As I have stated before, my fiduciary duty is to the City, the municipal corporation, not any Councilmember. I want you to rest assured that I will provide complete and accurate legal advice to any issue raised by a City Councilmember, regardless of the issue or if that Councilmember has repeatedly promised to fire me, or has been rude to me, etc., as I have done dozens of times for Councilmember Blain. I actually do not even mind if at any time, the Council majority chose to make a change at City Attorney – I would not begrudge them that, that is their choice, and it certainly happens.

I do not need this client nearly enough to compromise my integrity or my reputation for any future City I may work for, other cities I work for, or any other client. The only thing I do believe is inappropriate is dozens of threats regarding firing me on nights, holidays and weekends, accusations about integrity, threating to report me to the state bar, gloating, or whatever else you want to call it. To that end, I know there has been many accusations thrown my way that you have been copied on, but I am not some “deep state” official protecting the majority -I aim to simply call it like I see it. In fact, you may recall when then Councilmember Frank submitted a ballot designati on challenge against you, the City
Clerk and I rejected it. If I was “corrupt” or beholden to the incumbents, that certainly would not have happened.

Anyway, in specific regards the below, I do not think my message was remotely “threatening” nor have any of mine been, but I would like your perspective if you disagree and I will try to change that. I am looking for another perspective here on these interactions. I hope to try to establish a working relationship with you as we move forward, and again encourage you to feel free to reach out as desired. 949-500-8247, any time. See you this evening.

Thank you.

Dear Council,
It needs to stop. Appointments are not democracy in action. Let taxpayers, the residents of that district, choose their own representative.

If not, we will be looking to vote/recall you out, those who choose personal power over the will of the people.

This is a crucial time in our city politics, history, but more importantly, our future.

Local citizens, local media, national media, state officials will have much to say, and look into, should democracy be averted.

Again, let there be a special election ..
