CITY COUNCIL
Resolution Declaring the Property at 14025 Tierra Bonita Road Constitutes a "Public Nuisance" and Ordering the Property Owner to Abate the Violations This hearing is being held pursuant to Chapter 8.72 of the Poway Municipal Code (PM() for the purpose of determining whether the trash, junk (both inside and outside of the residence), miscellaneous debris, inoperable vehicle(s), weeds and overall physical condition of the residence located on the property at 14025 Tierra Bonita Road (APN 321-140-31) should be declared a "public nuisance" and whether the property owner should be ordered to correct these violations. City staff also recommends obtaining an inspection warrant for the entire residence to determine if its physical condition and interior condition, which appears from the outside to be significantly substandard, are health and safety issues that also require further action. The owner of the property is Dawn Montfort, and it is the City's understanding that the property is vacant. Should the City Council order that these violations be removed, and if the property owner fails to do so in the time allotted, then the City will complete the work and record either a lien or special assessment against the property for all costs and fees associated with securing compliance with the applicable codes.

Recommended Action:

It is recommended the City Council adopt the proposed Resolution (Attachment A) finding the conditions on the property constitute a public nuisance and declaring the City will abate the nuisance if the property owner fails to address the issues in a timely manner.

Discussion:

The property is located as shown in Attachment B, and contains a significant amount trash, junk/debris, weeds and inoperable vehicle(s) clearly visible from the public right of way, including a 1 of 74
November 18, 2025, Item #7
garage door that appears to never be closed. The property overall appears to be in significant disrepair, as does the driveway. The inside of the garage and residence can be viewed from the outside, and there appear to be numerous violations of the PMC and California Building Code therein, including an unpermitted water heater. The City first became aware of lack of compliance with the PMC on the property in 2020 and, since that time, has sent several notices of violation and issued numerous administrative citations (Attachments C & D). Despite these efforts, all the violations of the PMC remain.

In a final attempt to obtain voluntary compliance, on October 22, 2025, the City Attorney's Office sent the owner an additional Notice of Violation and final notice to abate the nuisance property (Attachment D). No response was received, and no action was taken.

If the City Council finds that the conditions on the property constitute a public nuisance, the City will, after the City both provides the owner with the required legal notice and secures an inspection and abatement warrant, abate the violations by removing all the outdoor trash, junk, miscellaneous debris and weeds, as well as the inoperable vehicles. Recent photos of the property are included as Attachment E to assist in this determination. The inspection warrant would also permit the City to inspect the physical structure/residence itself, including the inside, and determine if additional action needs to be taken to abate the potentially substandard condition thereof. All costs of the abatement will be kept and itemized and, if the owner refuses or fails to timely reimburse the City for such expenses, staff will return to the City Council to confirm the costs and then lien the property for the same.

If the City Council finds the conditions on the property constitute a public nuisance, City staff believes that eventually, a receivership may be required to fully remedy the violations. City staff will assess next steps following the issuance and execution of the proposed inspection and abatement warrant.

Environmental Review:

This item is not a "Project" pursuant to the California Environmental Quality Act (CEQA) and is therefore not subject to CEQA review.

Fiscal Impact:

All costs of the abatement, plus an administrative fee, will be assessed to the property owner via a lien and/or a special assessment.

Public Notification:

Public notice was published in the Poway News Chieftain on November 6th, 2025, and a copy of this report was sent to the property owner.

READ THE INFORMATION BELOW
YOU MAY BE CITED EACH DAY IF THE VIOLA TION(S) CONTINUE(S). OTHER ENFORCEMENT ACTION, LEGAL ACTION

AND PENALTIES MAY ALSO RESULT IF COMPLIANCE IS NOT ACHIEVED OR IF CORRECTIVE ACTION IS NOT COMPLETED. IF THE VIOLATION(S) IS/ARE CORRECTED WITHIN THE DEADLINE, CONTACT THE ISSUING·OFFICER TO OBTAIN AN INSPECTION BEFORE THE DEADLINE. FAILURE TO PAY THE FINE WITHIN THE REQUIRED DEADLINE MAY RESULT IN AN ADDITIONAL 50% PENALTY BEING ADDED TO THE ORIGINAL FINE AMOUNT LISTED ON THE

FRONT OF THIS CITATION AND MAY RESULT IN COLLECTION AS A LIEN ON THE PROPERTY OR ANY OTHER LEGAL REMEDY AVAILABLE TO COLLECT SUCH MONEY.

Administrative Citation (PMC Chapter 1.10}
Poway Municipal Code Section 1.10.030 provides for the issuance of administrative citations for violation of ordinances or permit conditions. There are four levels of citations that can be issued progressively for a violation.

The fines, as indicated on the front of the citation, are $100.00 for the First Citation, $200.00 for the Second Citation, $500.00 for the Third Citation, and $1000.00 for the Fourth and subsequent Citations for the same violations within one year. These fines are cumulative and citations may be issued each day the violation exists. A warning, if issued, does not incur a fine and, therefore, may not be appealed.

Rights of Appeal {PMC Chapter 2.20}
You have the right to appeal this administrative citation within TEN (10) days from the citation issuance date by filing a Notice of Appeal together with an advanced deposit of the fine. An appeal must be in writing and delivered to the City Clerk's Office at City Hall, 13325 Civic Center Drive. A form may be obtained at that office. If you are unable to pay the fine, you must submit a hardship affidavit for consideration. That form may also be obtained at the City Clerk's Office. A properly filed appeal will result in an administrative hearing.

If the citation is not paid or appealed within the statutory time, you will receive an invoice from the City's Customer Services Division. Please follow the instructions on the invoice to ensure proper processing of your payment.

Payment of the fine shall not excuse the failure to correct the violation nor shall it bar further enforcement action by the City of Poway.

Failure of any person to properly file a written appeal within TEN (10} CONSECUTIVE days from the citation issuance date shall constitute a waiver of his or her right to an administrative hearing and adjudication of the administrative citation or any portion thereof and the total amount of the fine. If City Hall is closed on the 10th consecutive day, the deadline for appeal shall be 5 PM on the next business day.

The appeal must be legible and set forth:

1. The appellant's full name, address and phone number;

2. The subordinate entity;

3. The date of the determination;

4. The determination for which review is sought;

5. The appellant's interest in the appealed determination;

6. Each reason why the appellant appeals the determination including, if applicable, the Poway Municipal Code sections that are to be appealed; and

7. Be accompanied by the appeal fee established by resolution.

B. An insufficient appeal shall be returned to the appellant.

C. If the appeal is sufficient, the City Clerk shall set the matter for consideration by the hearing officer to be held in accordance with PMC 2.20.070.

Consequences of Failure to Correct Violations
There are numerous enforcement options that can be used to encourage the correction of violations. These options include, but are not limited to: civil penalties, abatement, criminal prosecution, civil litigation, and recording the violation with the County Recorder. Any of these options or others may be used if administrative citations do not achieve compliance.

How to Pay Fine/Questions Regarding Compliance
The amount of the fine is indicated on the front of this administrative citation. You may pay by mail (post marked prior to the deadline) or in person at Poway City Hall, 13325 Civic Center Drive, Customer Services Division.

Payment should be made by personal check, cashier's check, or money order, payable to the City of Poway. Please write the citation number on your check or money order. If you need further clarification about payment of the citation, please call (858) 668-4401 or email [email protected] for the Customer Services Division. If you need further information about the violations and/or how to comply, please call the officer designated on the front of this form at (858) 668-4660 or [email protected].

A full description of the hearing process for the City's administrative hearing violations and your rights in that process are found in Poway Municipal Code Chapter 1.10 and 2.20. 21 of 74

Administrative Citation (PMC Chapter 1.10)
Poway Municipal Code Section 1.10.030 provides for the issuance of administrative cilations ior violation of ordinances or permit conditions. There are four levels of citations that can be issued progressively for a violation.

The fines, as indicated on the front of the citation, are $100.00 for the First Citation, $200.00 for the Second Citation, $500.00 for the Third Citaiion, and $1000.00 for the Fourth and subsequent Citations for the same violations within one year. These fines are cumulative and citations may be issued each day the violation exists. A warning, if issL1ed, does not incur a fine and, therefore, may not be appealed.

Rights of Appeal {PMC Chapter 2.20}

YOU MAY BE CITED EACH DAY IF THE VIOLA T/ON(S) CONTINUE(S). OTHER ENFORCEMENT ACTION, LEGAL ACTION

AND PENALTIES MAY ALSO RESULT IF COMPLIANCE IS NOT ACHIEVED OR IF CORRECTIVE ACTION IS NOT COMPLETED. IF THE VIOLATION(S) IS/ARE CORRECTED WITHIN THE DEADLINE, CONTACT THE ISSUING OFFICER TO OBTAIN AN INSPECTION BEFORE THE DEADLINE. FAILURE TO PAY THE FINE WITHIN THE REQUIRED DEADLINE MAY RESULT IN AN ADDITIONAL 50% PENALTY BEING ADDED TO THE ORIGFNAL FINE AMOUNT LISTED ON THE

FRONT OF THIS GITA TION AND MAY RESULT IN COLLECTION AS A LIEN ON THE PROPERTY OR ANY OTHER LEGAL REMEDY AVAILABLE TO COLLECT SUCH MONEY.

Administrative Citation (PMC Chapter 1.10)
Poway Municipal Code Section 1.10.030 provides for the issuance of administrative citations for violation of ordinances or permit conditions. There are four levels of citations that can be issued progressively for a violation.

The fines, as indicated on the front of the citation, are $100.00 for the First Citation, $200.00 for the Second Citation, $500.00 for the Third Citation, and S1000.00 for the Fourth and subsequent Citations for the same violations within one year. These fines are cumulative and citations may be issued each day the violation exists. A warning, if issued, does not incur a fine and, therefore, may not be appealed.

Riahts of Aopeal (PMC Chapter 2.20)
You have the right to appeal this administrative citation within TEN (10) days from the citation issuance date by filing a Notice of Appeal together with an advanced deposit of the. fine. An appeal must be in writing and delivered to the City Cleric's Office at City Hall, 13325 Civic Center Drive.

Payment of lhe fine shall not excuse the failure to correct the violation nor shall it bar further enforcement action by the City of Poway.

Failure of any person to properlv file a written appeal within TEN (1 O) CONSECUTIVE days from the citation issuance date shall constitute a waiver of his or her right lo an administrative hearing and adjudication of the administrative citation or any portion thereof and the total amount of the fine. If City Hall is closed on the 10th consecutive day, the deadline for appeal shall be 5 PM on the next business day.

The appeal must be legible and set forth:

1. The appellant's full name, address and phone number;

2. The subordinate entity;

3. The date of the determination;

4. The determination for which review is sought;

5. The appellant's interest in the appealed determination;

6. Each reason why the appellant appeals the determination including, if applicable, the Poway Municipal Code sections that are to be appealed; and

7. Be accompanied by the appeal fee established by resolution.

B. An insufficient appeal shall be returned to the appellant.

C. Ii lhe appeal is sufficient, the City Cleric shall set the mailer for consideration by the hearing officer lo be held in accordance with PMC 2.20.070.

Consequences of Failure to Correct Violations
There are numerous enforcement options that can be used to encourage the correction of violations. These options include, but are not limited to: civil penalties. abatement, criminal prosecution, civil litigation, and recording lhe violation with the County Recorder. Any of these options or others may be used if administrative citations do not achieve compliance.

How to Pay Fine/Questions Reoarding Comoliance
The amount of the fine is indicated on lhe front of this administrative citation. You may pay by mail (post marked prior to the deadline) or in person at Poway City Hall, 13325 Civic Center Drive, Customer Services Division.

Payment should be made by personal checl1, cashier's check, or money order, payable to the City of Poway. Please write the citation number on your check or money order. 14025 Tierra Bonita Rd
Poway CA, 92064
Subject: 2019 gas leak response incident and water heater change-out lacking permits; Case No. 19-0771
Dear Property Owner,
This City had been made aware of an emergency response by Poway Fire Department on November 18, 2019, occurring within the attached garage on your property located at 14025 Tierra Bonita Rd.

Poway, CA 92064. Subsequent investigation revealed evidence that you hired a plumber to replace the faulty water heater and gas line connection that caused the gas leak response incident however, the work was done without obtaining the necessary plumbing permit. A phone call to All American Plumbing revealed that you opted to have the work completed without first having the hired plumber obtain a permit.

Within fifteen ( 15) days from the date of this notice, you are required to obtain a plumbing permit. The permit fee is $305. Although the fee may be doubled as the work was completed without a permit, we will waive the penalty should you obtain the permit in a timely manner. Once the permit has been issued, you would be required to complete all necessary inspections, including final with a "pass" result.

Questions regarding plumbing permits may be directed to Trish Johnson, Building Services Manager, at (858) 668-4648 or [email protected], or by calling our permit counter staff at (858) 668-4645 or [email protected].

Failure to comply with this notice may result in issuance of a Notice of Violation to you. Further non compliance may result in fines being issued to you.

Thank you for your cooperation in this matter. Should you have any questions, I may be reached at [email protected] or (858) 668 4664.
