CITY COUNCIL
Resolution Declaring the Property at 16943 Valle Verde Road Constitutes a "Public Nuisance" and Ordering the Property Owner to Abate the Violation This hearing is being held pursuant to Chapter 8.72 of the Poway Municipal Code (PMC) for the purpose of determining whether the trash, junk, miscellaneous debris, weeds, inoperable vehicle, and physical condition of the residence (e.g., missing wall covered by plywood) located on the property at 16943 Valle Verde Road (APN 273-171-05) should be declared a "public nuisance" and whether the property owner should be ordered to correct these violations. The owner of the property is the Zam bus Family Trust. The property appears to be vacant and has been vacant for years as evidenced by the level of disrepair. Should the City Council order that these violations be removed, and if the property owner fails to do so in the time allotted, then the City will complete the work and record either a lien or special assessment against the property for all costs and fees associated with securing compliance with the applicable codes.
Recommended Action:
It is recommended the City Council adopt the proposed Resolution (Attachment A) finding the conditions on the property constitute a public nuisance and declaring that City abate the nuisance if the property owner fails to address the issues in a timely manner.
Discussion:
The City originally started receiving complaints about construction and installation of fencing/wall and sidewalk in the public right-of-way at 16943 Valle Verde Road in 2012. Attachment B is the aerial/site location map. After attempts to resolve the matter with the property owner failed, the City issued Notices of Violations, a Notice and Order to Abate, and three Administrative Citations to the property 1 of 35
