CITY COUNCIL
Approval of Final Map for Tentative Parcel Map 24-0002; Todd Wiersum, Applicant (APN 321-110-52-00)
The final parcel map for Tentative Parcel Map (TPM) 24-0002, is ready for approval. This map subdivides 43.64 acres of land and creates two separate lots.
Recommended Action:
It is recommended the City Council approve the final Parcel Map for TPM 24-0002 and direct its recordation.
Discussion:
Background:
The California Subdivision Map Act (SMA) outlines a two-step process for subdivision of land. Generally, the first step is a quasi-judicial public hearing to consider the tentative map. This step is a discretionary decision by the City Council, and involves evaluating a project for consistency with existing objective standards, conditions and policies as set forth in the Poway Municipal Code (PMC) and SMA. After a hearing and evaluation of the evidence, a written decision, or resolution, is adopted based on evidence presented.
The second step is consideration of the final parcel map which is the technical document showing the distances and bearings for each property line of the parcels included in the tentative parcel map. This action is ministerial, meaning state law requires approval of any final parcel map that conforms with the already approved tentative parcel map and complies with all conditions of approval imposed thereon. A "ministerial action" means an act performed by a government official or employee that strictly follows established rules and procedures without requiring any personal judgment or discretion. Essentially, they are carrying out a duty as outlined by law with no room for decision making. Here, as in all ministerial actions, if the specific requirements are met, the map must be . . . . 1 of 24

approved. Recording the final parcel map is the last step in creation of a new parcel.
Project Details:
TPM 24-0002 is located south of Misty Meadows Road and northwest of Lucidi Farms Way. The project site is shown on the location map included as Attachment A. This final Parcel Map subdivides one existing parcel of land, totaling 43.64 acres of land, into two lots.
Both parcels are accessed via Mina de Oro Road and Misty Meadow Road. Access to the southern parcel (Parcel 2) will be provided through the existing private driveway on Parcel 1 located on Misty Meadow Road. In accordance with the conditions of approval for TPM 24-0002, the required improvements to provide access to Parcel 2 and to ensure compliance with stormwater treatment requirements must be completed prior to final Parcel Map approval, or alternatively, improvement securities shall be posted to guarantee the completion of said improvements.
TPM 24-0002 was approved by the City Council on May 20, 2025, pursuant to Resolution No. 25-010 (Attachment B). The final Parcel Map, as shown in Attachment C, is found to be in substantial conformance (per the SMA) with the approved TPM. All the conditions of approval required prior to recordation of the final Parcel Map have been addressed and complied with. The requested action does not impact the prior approval of the project.
Environmental Review:
Approval of final subdivision maps is considered a ministerial action, which is exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to the CEQA State Guidelines Section 15268(b)(3).
Fiscal Impact:
There is no Fiscal Impact as a result of the requested action.
Public Notification:
None.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows:
SECTION 1: The above recitals are true and correct.
SECTION 2: Environmental Finding: Pursuant to Section 15183 (a) of the California Environmental Quality Act Guidelines, the proposed project is consistent with the development density established by the existing zoning and General Plan policies for which an EIR was previously certified and does not require additional environmental review. Since there are not any identified project-specific significant effects peculiar to the project or its site, this determination streamlines the review of such projects and reduces the need to prepare repetitive environmental studies.
SECTION 3: The findings in accordance with Chapter 16.20 of the Poway Municipal Code (PMC) for TPM 24-0002 are as follows:
A. The design of the proposed subdivision is consistent with the General Plan in that the approved lot sizes and configurations adhere to the development standards of the General Plan and PMC.
B. The site is physically suitable for the type of development and the density proposed, in that the site is large enough to accommodate the proposed density and is compatible and in character with development in the vicinity.
C. The design of the TPM is not likely to cause substantial environmental damage and avoidable injury to humans and wildlife or their habitat, in that the proposed Project will be developed in accordance with City and other governmental agency requirements and mitigation measures will be incorporated.
D. The design of the subdivision is not likely to cause serious public health problems in that City water services is available to the site.
E. The design of the lot division will not conflict with easements, acquired by the public at large, for access, or use of, property within the proposed subdivision. Existing or new easements will not have any obstructions or impacts from this subdivision.
F. The Project has been designed to minimize impacts on surrounding development in that the proposed design, size, and scale of the project is compatible with and will not adversely affect, or be materially detrimental to, adjacent land uses, residences, buildings, structures, or natural resources.
G. The granting of this TPM would not be materially detrimental to the public health, safety, or welfare since the project has been designed to minimize impacts both on the surrounding community and on the systems that serve that community.
H. Therefore, the proposed development respects the interdependence of land values and public concerns for the aesthetics, design, health, and safety of development, and will not have any unmitigated impacts.
SECTION 4: The findings in accordance with California Government Code (CGC) Title
7. Division 2. Chapter 2. Article 3. Parcel Maps (Section 66444-66450) for TPM 24-0002 are made 5 of 24
February 17, 2026, Item #3
as follows:
Resolution No. 25-010
A The proposed subdivision map is consistent with the objectives, policies, general land uses and programs of the Subdivision Map Act (SMA) in that it proposes to create two residential lots at a density that is consistent with the Poway General Plan designations and PMC standards.
B. The design of the proposed subdivision is consistent with the General Plan in that the approved lot sizes and configurations adhere to the development standards of the General Plan and PMC.
C. The site is physically suitable for the type of development in that the site is large enough to provide two lots meeting size standards.
SECTION 5: The findings in accordance with PMC Chapter 8 Health and Safety for TPM 24-0002 are as follows:
A The design and improvements of the proposed development are consistent with all elements of the Poway General Plan, as well as City Ordinances, because necessary facilities will be available to serve this project. The applicant provides services such as potable water wells, water tanks, and septic systems for facilities not currently available to this property.
B. The construction of improvements may be required as a result of the proposed development to protect public health, safety and welfare as identified below:

2. Street improvements, including private streets and driveways
3. Storm water drainage contained onsite
4. Landscaping and protection of existing habitats

SECTION 6: Pursuant to Government Code Section 66020, the design and improvements of the proposed development are consistent with all elements of the Poway General Plan, as well as City Ordinances, because all necessary services and facilities will be available to serve this project.
SECTION 7: The City Council hereby approves TPM 24-0002 as shown on the approved plans, on file with the Development Services Department and subject to the following conditions:
