SUBJECT: Acceptance of the FY 2024-25 Street Overlay Project with Quality Construction & Engineering Inc., as Complete
Summary:
On May 20, 2025, the City Council awarded the FY 2024-25 Street Overlay project contract to Quality Construction & Engineering Inc., Bid No. 25-010, in the amount of $2,628,512.00. This action will accept the project as complete.
Recommended Action:
It is recommended the City Council:
1) Accept the FY 2024-2025 Street Overlay project, as complete; 2) Authorize the City Clerk to file and record the Notice of Completion; 3) Authorize the release of the retention in the amount of $144,031 .39 if unencumbered, 45 days after City Council acceptance;
4) Release the Swiss Re Corporate Solutions America Insurance Corporation Bond for Material and Labor in the amount of $2,628,512.00 after the release of retention; and 5) Retain the Swiss Re Corporate Solutions America Insurance Corporation Bond for Faithful Performance for a period of one (1) year.
Discussion:
The scope of work included the asphalt overlay of residential streets including, Casa Court, Evalyn Place, Rick Street, Tustin Steet, Meadowbrook Road, and 9th Street within Street Maintenance Zone 8.
Asphalt patch repairs were completed on residential streets and arterial streets including Poway Road from west city limits to Community Road, Pomerado Road from Poway Road to south city limit, Scripps Poway Parkway from west city limits to Pomerado Road, and Ted Williams Parkway from west city limits to Pomerado Road. Americans with Disabilities Act (ADA) pedestrian ramp removal and replacement was completed on overlayed residential streets and arterial roads.

Engineering Inc. has completed all work in accordance with the contract plans and specification. Four change orders, totaling $252,115.63, included costs for materials and labor associated with overtime work, additional pavement treatment, and emergency repair services not included in the initial project scope. The final contract amount is $2,880,627.63.
Environmental Review:
The action of acceptance of public improvements, which was the subject of a prior environmental determination, is not considered a Project as defined under Section 15378 of the California Environmental Quality Act (CEQA) State Guidelines; therefore, pursuant to the CEQA State Guidelines Section 15378(b)(5) no environmental review is required.
Fiscal Impact:
Sufficient funds are available in the project account (ST031) for the release of retention.
