CITY COUNCIL
Award of Contract to PK Mechanical Systems, Inc. for Emergency Interconnection No.1 at Avenida La Valencia/ Pump Station 17 Project, Bid No. 27-002 A request for bids (RFB) for Emergency Interconnection No.1 at Avenida La Valencia/ Pump Station 17 Project, Bid No. 27-002, was duly advertised on June 18 and June 25, 2026. A mandatory pre-bid meeting was held on June 30, 2026, and attended by three (3) potential bidders. Three (3) bids were received and publicly opened on July 16, 2026. Staff reviewed the bids and determined the lowest responsible bidder to be PK Mechanical Systems, Inc. (PK Mechanical).
With the goal of increasing the reliability of drinking water for water customers now and for generations to come, the City of Poway (City) is undertaking its largest capital improvement program in the City's history referred to as the Water Infrastructure Improvement Program (Program). The Program was presented to the City Council as an informational item, to provide updates and to request approval of the various components on March 18, 2020; June 16, 2020; October 20, 2020; November 17, 2020; March 16, 2021; April 20, 2021; June 1, 2021; July 20, 2021; August 17, 2021; April 5, 2022; October 18, 2022; February 7, 2023; May 16, 2023; August 15, 2023; September 19, 2023; November 19, 2024; April 15, 2025; September 16, 2025, and February 3, 2026. A comprehensive summary of the project background and status including photos and time lapse construction video can be found on the project webpage: https://poway.org/water-projects.
In accordance with the City's April 13, 2020, mutual agreement with the California State Water Resources Control Board, Division of Drinking Water (DDW), the City will construct two emergency treated water interconnections with the City of San Diego's (San Diego) water system. Emergency Interconnection No.1 (Interconnection No.1) is located on Avenida La Valencia near the Bridle Trail and Pomerado Road, and Emergency Interconnection No.2 is located along Poway Road, extending from Springhurst Drive in the City of San Diego to Francine Terrace in the City of Poway. Together with the Treated Water Facilities Project, these improvements will provide a reliable source of treated water during an unplanned outage affecting the Lester J. Berglund Water Treatment Plant. 1 of 12
August 18, 2026, Item #4
The Interconnection No.1 project includes the construction of a new emergency interconnection facility between the City and San Diego. The work generally consists of installing piping to connect the two water systems; constructing a buried flow meter vault within Avenida La Valencia; installing an above-ground packaged pump station on the north side of Avenida La Valencia; providing associated appurtenances, electrical service, instrumentation, pavement replacement, and site restoration; coordinating valve closures and system shutdowns with both agencies; and completing all incidental work necessary to deliver a fully operational facility in accordance with the approved plans and specifications.
Recommended Action:
It is recommended the City Council award the Contract for Emergency Interconnection No.1 at Avenida La Valencia / Pump Station 17 Project, Bid No. 27-002, to PK Mechanical Systems, Inc., and authorize the City Manager to execute the necessary documents.
Discussion:
The RFB was advertised on June 18 and June 25, 2026. A mandatory pre-bid meeting was held on June 30, 2026, and attended by three (3) potential bidders. Three (3) bids were received and publicly opened on July 16, 2026. After reviewing the bids, City staff determined PK Mechanical to be the lowest responsible bidder to provide the specified services to the City. A summary of the responsive bid results received is alphabetically listed in Table 1.
Table 1: Bid No. 27-002, Interconnection No.1
Responsive Proposers Summary

Company
PK Mechanical's bid was responsive and met the required bid specifications. The contract time for this project is 180 working days with an engineer's estimate of $1,000,000. Based on the work required to complete the project, PK Mechanical is qualified, and the price is fair and reasonable. Staff recommends awarding the Contract to PK Mechanical for the Interconnection No.1 in the total amount of $1,042,000.
Environmental Review:
This action is categorically exempt from the California Environmental Quality Act (CEQA) and a Notice of Exemption was filed with the State Clearinghouse on December 26, 2025.
Fiscal Impact:
Sufficient funds are available in the relevant Capital Improvement Program project account WT044 to award the Contract for Interconnection No.1 for the recommended amount of $1,042,000. The City 2 of 12

g. Contractor agrees and acknowledges that if it fails to obtain all of the insurance required in this Agreement in accordance with the requirements herein, or to obtain and ensure that the coverage required herein is maintained by any subcontractors or others involved in any way with the Project, Contractor shall be responsible for any losses, claims, suits, damages, defense obligations, or liability of any kind or nature attributable to the City, and/or its officers, employees, servants, volunteers, agents and independent contractors, that result from such failure by Contractor.
16. a. Contractor shall provide certificates of insurance with original endorsements to the City as evidence of the insurance coverage required herein. Certificates of such insurance shall be filed with the City on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with the City at all times until completion of performance and acceptance by the City.
b. Notwithstanding any inconsistent statement in any required insurance policies or any subsequent endorsements attached thereto, the commercial general liability and commercial vehicle liability policies shall bear endorsements whereby it is provided that the City, and its officers, employees, servants, volunteers, agents and independent contractors are named as additional insureds. Additional insureds shall be entitled to the full benefit of all insurance policies in the same manner and to the same extent as any other insureds and there shall be no limitation to the benefits conferred upon them other than policy limits to coverages. c. Contractor shall require the carriers of all required insurance policies to waive all rights of subrogation against the City, and its officers, employees, servants, volunteers, agents and independent contractors.
d. Each policy required herein must be endorsed to provide that the policy shall not be cancelled in coverage or limits (except by paid claims) unless the insurer has provided the City with 30 days prior written notice of cancellation. Contractor agrees to provide the City with 30 days written notice prior to any non-renewal or reduction in coverage or limits.
e. All insurance policies required to be provided by Contractor or any other party must be endorsed to provide that the policies shall apply on a primary and noncontributing basis in relation to any insurance or self-insurance, primary or excess, maintained or available to the City, and its officers, employees, servants, volunteers, agents and independent contractors.
17. a. Contractor shall defend, indemnify and hold harmless the City, its officers, officials, agents, employees and volunteers from and against any and all claims, demands, actions, losses, damage, injuries, and liability, direct or indirect (including any and all costs and expenses in connection therewith) to the extent actually caused by the negligence of Contractor, Contractor's employees, subcontractors or independent contractors except for any such claim arising out of the negligence or willful misconduct of the City, or its officers, agents, employees or volunteers. 8 of 12
August 18, 2026, Item #4
b. The City does not, and shall not, waive any rights that it may have against Contractor under this Section because of the acceptance by the City, or the deposit with the City, of any insurance policy or certificate required pursuant to this Agreement. The hold harmless, indemnification and duty to defend provisions of this Section shall apply regardless of whether or not said insurance policies are determined to be applicable to the claim, demand, action, damage, liability, loss, cost or expense described herein.
18. Any amendments to any of the Contract Documents, including but not limited to Contract Change Orders, must be in writing executed by the Contractor and the City. Any time an approval, time extension, or consent of the City is required under the Contract Documents, such approval, extension, or consent must be in writing in order to be effective.
19. The Contract Documents contain all of the agreements and understandings of the parties and all previous understandings, negotiations, and contracts are integrated into and superseded by this Contract.
20. In the event that any one or more of the phrases, sentences, clauses, paragraphs, or sections contained in this Contract shall be declared invalid or unenforceable by a valid judgment or decree of a court of competent jurisdiction, such invalidity or unenforceability shall not affect any of the remaining phrases, sentences, clauses, paragraphs, or sections of this Contract which are hereby declared as severable and shall be interpreted to carry out the intent of the parties hereunder.
21. The persons executing this Contract on behalf of the parties hereto warrant that they are duly authorized to execute this Contract on behalf of said parties and that, by so executing this Contract, the parties hereto are formally bound to the provisions of this Contract.
22. This Contract shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, personal representatives, successors, and assigns.
23. In performing its obligations and duties under this Contract, each party shall comply with all applicable local, state, and federal laws, regulations, rules, standards and ordinances.
