CITY COUNCIL
Approval of Consultant Agreement with Schmidt Design Group for the South Poway Pickleball Courts Project; RFP No. 27-003
This Consultant Agreement will provide design services for the South Poway Pickleball Courts project.

Recommended Action:

It is recommended the City Council approve the Consultant Agreement with Schmidt Design Group in the amount of $450,859.00 for the South Poway Pickleball Courts project and authorize the City Manager to execute the necessary documents.

Discussion:

The South Poway Pickleball Courts project was budgeted as a Capital Improvement project in response to sport popularity and community demand. The Community Park Needs Assessment performed in 2021, as well as requests presented to the Community Services Department, indicated public desire for dedicated pickleball courts in the City of Poway. A site selection assessment was performed to determine the best location for dedicated pickleball courts. The assessment considered available space, constructability, and proximity to residences and businesses. City staff ultimately recommended the vacant west corner of Crosthwaite Circle and Stowe Drive due to its size, distance from residences, and potential for development. This selection process was presented to the Parks and Recreation Advisory Committee May 14, 2026, during a public meeting. The committee indicated support and approval of the project location.

The project design will include between six and eight pickleball courts with lighting, fencing, and a shaded picnic area. If budget permits, this project will also include a restroom. This project will require a noise study, lighting study, and environmental review in accordance with the California Environmental Quality Act (CEQA).

On June 2, 2026, a Request for Proposal (RFP No. 27-003) was issued to provide design services. The City received proposals from 14 consulting firms. After evaluating and scoring the proposals, staff 1 of 29
October 6, 2026, Item #5
concluded Schmidt Design Group is the most qualified consultant for this project. Schmidt Design Group offers extensive experience in pickleball court design and local agency coordination across San Diego County. Their proposal showed a clear and thorough understanding of the project scope.

The project scope includes project management; preliminary engineering, including noise, lighting, and geotechnical studies; CEQA determination; preparing the construction documents; and providing construction support services.

Environmental Review:

The proposed action is Categorically Exempt from CEQA pursuant to CEQA Guidelines Section 15378, in that the award of a consultant agreement for design services only is not a project or authorizes any physical changes to the environment. Any future discretionary action to approve construction of the South Poway Pickleball Courts project will be subject to environmental review under CEQA, as appropriate.

Fiscal Impact:

There is sufficient funding available in the South Poway Pickleball Courts project (PK038) in the Adopted Fiscal Year 2026-27 Budget for this request. The consultant's fee will be based on the scope of work as outlined in the Consultant Agreement and the not-to-exceed fee of $450,859.00.

Public Notification:

None.

5. Schedule: SDG will provide a detailed project schedule to the City and design team with continuous updates, and a project status executive summary to be submitted with each monthly invoice.

Task 2 -Topographic Survey and Existing Utility Base Files Alyson Consulting (AC) will perform field topographic survey in accordance with City of Poway Requirements.

1. Horizontal and Vertical Survey Control: AC shall find and transfer CCS -NAD83 horizontal and NAVO 88 vertical control to the project. Horizontal and vertical survey control points set shall be made available to the client and will be maintained and utilized throughout the duration of the contract.

2. Topographic Survey: Consultant shall perform a ground topographic survey of the area shown on the provided exhibit. Area to be drafted at 10-scale and will include all hardscape, trees and visible above ground utilities. The inverts of sewer and storm drain manholes will be measured and included on the survey.

3. Utility Research/ Utility Survey: Consultant shall perform research at the City of Poway and the various other utility providers. This research will be used to create a utility base map that will aide in locating utilities in the field. The located utilities will then be added to the ground topographic survey.

4. Boundary Survey: Consultant shall perform research at the County of San Diego and on line resources to obtain record maps pertinent to the property boundary. A field survey will be performed to locate sufficient boundary monuments to solve the property boundary. *Note. This task does not include the setting of property corners or the recording of documents with the County of San Diego, the City of Poway or any other agency.

5. Plot Utilities: Consultant shall plot the utilities from the record utility maps and the field locations.

Task 3 -Geotechnical Evaluation
• Mobilization: Undertaking desktop study research to better understand the subsurface conditions within the project area. We will review historical documents including, but not limited to, topographic maps, aerial images, prior geotechnical reports for near-by properties, prior environmental reports for near-by properties (including boring/well logs and groundwater data), geologic maps, and hazard maps
• Subsurface Exploration: NVS proposes to advance between 4 to 6 test borings (using 1 day of drill rig rental time) within the proposed development area using a truck mounted drill rig with small diameter hollow stem augers to advance the borings to a target depth of 10 feet below surface grades or practical refusal. NVS will perform the following activities listed below:
14 of 29
a. Marking out the locations of the proposed explorations on the ground surface where most feasible. We will coordinate the boring locations with you to evaluate the proposed improvements once the site layout is confirmed.
b. Conducting the following utility clearance activities to review the location of explorations relative to underground utilities prior to commencing the field work:
i. Notifying Underground Service Alert (USA)
ii. Reviewing as-built utility plans (if available)
iii. Subcontracting with a private utility locating service c. Engaging a drilling contractor to advance 6-to 8-inch diameter borings to the target depths. The drilling contractor will obtain bulk samples in the upper 5 feet and drive samples using Modified California and Standard Penetration Test split-barrel samplers.

An NVS engineer or geologist will supervise the field work, log the borings, collect and label the soil samples, and transport them to our geotechnical testing laboratory. 2 October 6, 2026, Item #5
South Poway Pickleball Courts
City of Poway
September 2, 2026
d. Abandoning the explorations using drilling spoils and repair the boring locations to match existing conditions. Any excess soil cuttings will be thin spread on site. e. Drill two shallow borings to conduct field borehole infiltration testing near the proposed storm drain basin. We will coordinate with you to determine the actual infiltration test depth based on preliminary basin design assumptions.
f. The test holes will be pre-soaked and tested per County of San Diego requirements. Upon completion of infiltration testing, the test holes will be abandoned and explorations backfilled with soil.
• Geotechnical Laboratory Testing: NVS will conduct testing in one of our accredited laboratories in San Diego on selected samples obtained from the borings to assess pertinent physical and geotechnical engineering characteristics. We expect the laboratory testing program to focus on obtaining information about the physical characteristics of the soils. Laboratory testing may include in-place soil unit weight and moisture content, sieve analysis, expansion index, and corrosion tests. We will determine the actual program using the observation of soil types and conditions from the geotechnical borings.
• Interpretation, Analyses, and Reporting: NVS will compile the data, undertake geotechnical engineering interpretation and analyses, and prepare a draft Geotechnical Investigation Report.

The report will focus on describing the subsurface conditions interpreted within the planned development and pertinent recommendations for the design, such as post tensioned slab design, infiltration rate and grading recommendations. NVS will issue one draft report for internal review and revise the report considering any comments from the design team. We will not issue a final signed and sealed copy until instructed by you.

Task 4 -Preliminary Engineering

1. Research and Investigation: Design team will gather reference as-built drawings from the Client, City, and the franchise utility companies to determine the position of existing utilities on and adjacent to the property including one site visit to field verify the existence of utilities and other improvements on and adjacent to the site.

2. Schematic Design: Conceptual level Layout Plan: SDG will prepare minimum of three (3) Conceptual Level Layout Plans illustrating initial proposed uses and treatments for the site. The plans will be rendered, in color, and illustrate the pickleball courts location, connection to the street frontage and improved entry experience, immediate size context, pedestrian circulation patterns, visual screening, refined planting palette, site furnishings, and landscape areas. Civil input includes review of the site plan to address schematic grading requirements, utilities, drainage, ADA access, and preliminary stormwater BMP sizing. Electrical input includes placement of proposed pedestrian and sports court lighting.

3. Preliminary Plant Palette: SDG will develop a preliminary plant palette for the project. One (1) plant image board will be prepared to further illustrate the composition of the proposed palette.

4. Precedence Imagery: One (1) precedence image board will be prepared to further illustrate the intended character, composition, and materiality of the various outdoor spaces.

5. Renderings and Visualizations: SDG will develop two Renderings per concept for use by the City and stakeholders in decision making.

6. Concept Review Meeting: SDG will present the initial schematic design alternatives and associated imagery/renderings to the Owner for feedback.

7. Preferred Concept Design: A Preferred Design will be developed based on the input received from the Owner and team. The plan will reflect the preferred arrangement of programming elements, pedestrian circulation patterns, visual screening, refined planting palette, and site furnishings. Civil input includes review of the site plan to address schematic grading · requirements, utilities, drainage, ADA access, and preliminary stormwater BMP sizing. Electrical 3 15 of 29

input includes placement of proposed pedestrian and sports court lighting. The schematic design will be color rendered and suitable for presentation purposes. One (1) minor refinement to the Preferred Schematic Design is anticipated.

8. Meetings: SDG team will attend up to two (2) virtual meetings and two in-person meetings with the City and design team during this task attended by two SDG staff. (See Task 1-Project Management for meeting requirements).

9. Cost Estimating: The SDG team will prepare probable cost of construction estimates for the three (3) concept site plans.

10. Entitlement Documentation: SDG will assist the City with Entitlment documentation and attendance at a City Council Meeting for approval. It is anticipated that the approved Concept Design will satisfy the requirements of the Conditional Use Permit amendment.

Task 5 -Environmental and Cultural Evaluation
The overall approach is to develop a comprehensive and accurate Project Description that, once refined through coordination with City staff and SDG, will be provided to the technical resource teams to support their analyses of cultural resources, noise, and traffic. Based on the results of these technical studies, Dudek's CEQA Project Manager, Josh Saunders, will work closely with City of Poway staff to determine the appropriate level of environmental review. At this time and based on our understanding of prior environmental/CEQA documents prepared for the South Poway Sports Park that included two tennis courts, a parking lot, and racquet courts at the proposed pickleball courts project site, we assume that an Addendum to the City's General Plan Environmental Impact Report (EIR), the South Poway Specific Plan (SPSP) EIR, or the 1991 Initial Study/Mitigated Negative Declaration for the South Poway Sports Park would be an appropriate and legal y defensible CEQA document. As an Addendum to an EIR presents a stronger and more defensible approach due to an assumed more robust environmental record presented in an EIR (compared to a MND), an Addendum to a prior EIR is the recommended approach. However, as neither the General Plan EIR or SPSP EIR are available on the City's website and were not reviewed/available during preparation of this proposal, and because an Addendum to the 1991 IS/MND is an acceptable and defensible option, our approach is to work closely with City staff to determine availability of other prior CEQA documents prepared for the site prior to the initiation of proposed CEQA work. Based on our experience, close coordination with the CEQA Lead Agency and open conversations of intended approach ensures shared understanding of document defensibility and buy-in from all parties.

An addendum is considered an appropriate environmental document when minor technical changes or additions are required of the previously certified environmental document and none of the changes identified in the California Environmental Quality Act (CEQA) Guidelines Section 15162 are applicable.

The proposed change in court use from tennis to pickleball is a minor change that is unlikely to result in new, previously undisclosed impacts or more severe impacts than previously disclosed. As such, an addendum would provide the appropriate level of environmental review for the project's minor changes. The addendum would update the evaluation of all CEQA issues areas originally documented in the prior CEQA document (herein assumed to be the 1991 IS/MND but potentially subject to change).

The addendum also would evaluate other items such as whether existing conditions under which the project would be undertaken have changed, whether there are any new or different regulations that would change the previously disclosed impacts or if any new or different mitigation should be recommended. Ultimately, in all these instances, the goal of CEQA is to determine whether there would be any new or substantially more severe environmental impacts because of the changes to the project.

1. Project Start-up Activities

data and reports; clearly define the proposed project, discuss the schedule and assumptions for achieving the schedule, identify all discretionary actions, establish early community among various project team members. In addition to the above activities, Dudek staff will review relevant background materials related to prior development and environmental review of South Poway Sports Park, and South Poway Business Park. i. Deliverables:
• Attend one Kick off meeting
• Submit written request for additional information, if necessary.

2. Technical Analyses

a. Cultural Resources: The cultural resources inventory will include archival research, a search of the Native American Heritage Commission Sacred Lands File, a pedestrian survey, and documentation of results. All services proposed will be performed in compliance with CEQA. Dudek understands that no federal nexus has been identified that would require compliance with Section 106 of the National Historic Preservation Act (NHPA).
i. Record Search: Dudek will begin by conducting a California Historical Resources Information Systems records search of the current project area and a 1-mile radius at the South Coastal Information Center {SCIC), which houses cultural resource records for San Diego County. We assume no more than $800 in direct records search fees. The purpose of the records search is to identify any previously recorded cultural resources located within the project area and provide information on the type of resources known to the area. In addition to a review of previously prepared site records and reports, the records search will also provide information on historical maps of the project area; ethnographies; the National Register of Historic Places; the California Register of Historical Resources; the California Historic Property Data File; and the lists of California State Historical Landmarks, California Points of Historical Interest, and Archaeological Determinations of Eligibility.
ii. NAHC and Tribal Outreach: Dudek will contact the California Native American Heritage Commission (NAHC) for a review of its Sacred Lands File. The NAHC will determine whether any NAHC-listed Native American sacred lands are located within or adjacent to the project area. In addition, the NAHC will provide a list of Native American representatives who should be contacted for additional information. Dudek will prepare and mail a letter to each of the NAHC-listed contacts via Certified Mail, requesting that they contact us if they know of any Native American cultural resources within or immediately adjacent to the project.

We assume no more than 30 Native American will need to be contacted; however, the exact number may vary. This process is to inform the archaeological resources inventory and does not constitute consultation with tribes. iii. Survey: A qualified Dudek archaeologist will survey the approximately 5-acre project area for archaeological resources (including both prehistoric and historic archaeological resources). Dudek will subcontract a regionally appropriate Kumeyaay Native American monitor from Red Tail Environmental, Inc. to participate in the survey. Dudek assumes that the survey will require one qualified archaeologist and one Kumeyaay Native American monitor no more than one (1) day. Dudek also assumes that the survey will not identify archaeological resources that require formal recordation, including archaeological isolates and sites (i.e., no resources will be encountered, and no previously recorded resources will require updates). No artifacts, samples, or specimens will be collected during the survey. 5 October 6, 2026, Item #5

Should any resources be encountered during the survey requiring recordation, we will work with you to augment this scope and cost as appropriate to accommodate Department of Parks and Recreation (DPR) 523 series resource records. iv. Cultural Resources Letter Report: Dudek will prepare a negative cultural resources letter report in compliance with CEQA. The report will summarize the results of the records searches, Native American coordination, background research, and cultural resources survey. We assume no more than one draft and one final version of the report will be required.
v. Assumptions:
• Direct costs for the SCIC access and data costs will be no more than $800. • The NAHC contact list will consists of no more than 30 Tribal representatives. • The survey will require one (1) archaeologist and one (1) Native American monitor no more than one (1) day to complete.
• Mileage is calculated from the Dudek Encinitas office to the project area at the 2026 federal mileage rate.
• No archaeological resource discoveries will be made that require formal recordation or evaluation.
• A negative letter report will suffice for project documentation. • The report will require no more than one (1) round of edits for City approval. vi. Deliverables: Draft and Final negative resources letter report. b. Noise
i. Review of Project Materials: Dudek staff will review relevant materials provided by you, including site plans and the proposed schedule of court hours. After reviewing all available project materials, Dudek will prepare a request for any outstanding data needed to conduct the analysis. If precise information on a particular factor is not available, Dudek will make every effort to quantify these items using the best available information for comparable data sources, but in all cases will consult first with you regarding the information needed.
ii. Existing Sound Conditions Noise Monitoring: Dudek will conduct a sound monitoring survey to measure the existing background sound levels. The sound monitoring survey will include the collection of sound-level data at one long-term unattended and up to two short-term attended (10-to 15-minute) locations. Long term monitoring will be conducted for a multi-hour period comparable to the expected operations of the proposed court hours. The short-term attended monitoring will be conducted with concurrent traffic volume counts, if appropriate. The sites will be located on-site and/or adjacent to the nearest commercial properties in publicly accessible locations to quantify the diurnal sound exposure of the site and the surrounding land uses to roadway traffic and other existing sound sources.

Sound level measurements will be performed with American National Standards Institute (ANSI) Class 1 or 2 sound level meters (SLM). Due to the project proposing sources of sound to which humans are most sensitive (music and speech), background sound monitoring will include both A-weighted and 1/3 octave band sound pressure level data at some sites to aid in the comparison between background and predicted sound levels. Metrics will include the equivalent continuous level (Leq), and relevant percentiles, such as 5th, 10th, 50th, and 90th. iii. Analysis of Project Generated Noise: Sound propagation modeling for the project will be conducted using the Cadna/A sound prediction model, which implements the ISO 9613-2 standard by taking into account source and receptor locations, 6 October 6, 2026, Item #5

South Poway Pickleball Courts
City of Poway

varying terrain, source spectral content, and a number of other factors that have an effect on sound attenuation and propagation. The Cadna/A model has been accepted as an appropriate modeling program in California and permitting cases nationwide.

Dudek has conducted pickleball sound pressure level (SPL) measurements during competitive and recreational pickleball matches at other facilities. This measurement data will be used to inform inputs of the sound modeling. Receptor locations representing the closest offsite residences and other noise-sensitive land uses will be included in the model.

Model results will be analyzed for overall A-weighted sound levels. Up to two initial model runs are included in this scope for 1) a worst-case of 'recreational' pickleball use with all courts active and 2) a worst-case of 'competitive' pickleball use with all courts active. Following this initial modeling, if Project sound levels at the offsite receptor locations would exceed allowable City limits, Dudek will model portions of or the perimeter fencing as a solid barrier or make other recommendations (i.e., reorienting the courts, using low noise paddles, etc .. ).

Dudek will determine the heights of the proposed barrier segments, as necessary, to determine the overall height that would be necessary to attenuate pickleball noise at the closest residences to comply with applicable municipal code limits. Up to three mitigation model scenarios are included in this scope.

Prediction output will be tabulated for a set of nearest and/or representative offsite sensitive receptors and presented as color-coded noise level grids or "contour" (e.g., five-decibel (5 dB] decrements) maps of sound pressure levels across a horizontal plane at five feet above local grade (or at a different elevation serving the purpose of the assessment).
iv. Impact Analysis: Dudek will assess the significance of environmental noise impacts based on relevant City, state, and federal thresholds. If potentially significant noise impacts are identified, mitigation measures will be recommended to reduce impacts to a less-than-significant level (where feasible). XXX Calculated sound levels from the results of the sound propagation modeling of on-site operations, off-site traffic, and construction activities will be compared against Poway noise and vibration limits and the background sound levels occurring at the closest neighbors. If calculated sound or vibration levels are determined to exceed limits, recommendations for sound control will be provided (i.e., orientation of facility equipment, use of temporary sound barriers, quieter paddles, etc.) as supported by the predictive sound modeling scenarios as described above. XXX Humans are particularly sensitive to the sound characteristics of some of the proposed on-site activities (potentially impulsive sounds). The time-averaged A-weighted noise limits used by Poway and most other jurisdictions do not take into account this increased sensitivity of humans to impulsive type sounds. To address these sounds, and while their assessment may not be required under current CEQA regulations or expectations, we will supplement the City noise limits with recommendations provided by the World Health Organization (WHO) or other relevant sources (e.g., recent NoiseCon papers). The results of this analysis will be documented in the technical noise report for informational purposes but will not be included as part of the CEQA analysis framework. XXX This scope assumes that the project will generate minimal construction and traffic related impacts; therefore, quantitative construction and traffic noise analyses are not included in this scope. Similarly, given the proposed project being surrounded by an existing commercial-type built environment comprising single and multi-story structures 7 October 6, 2026, Item #5

prepare a final memorandum. A summary of the results of the transportation assessment will be included in the CEQA document.

3. Draft Addendum
a. Dudek will prepare an Addendum for the proposed project that is consistent with the procedural and substantive provisions of CEQA Guidelines Section 15063 and 15072. The objective of this task is to prepare a comprehensive, accurate, and objective project-level Addendum for the proposed project that fully complies with CEQA and the Guidelines, and all applicable guidance and procedures established by the City for the purposes of environmental review. This scope of work assumes that only some portions of the original MND (or EIR) for the site will require updating as part of the Addendum. If extensive sections require updating, this proposal will be updated accordingly. b. Utilizing the Appendix G Environmental Checklist from the current CEQA Guidelines, the addendum will look at all twenty (20) individual potential impact areas (and the individual thresholds) comparatively to analyze whether compared to the previously prepared MND (or EIR), there are any new or substantially more severe environmental impacts that would result from either (1) a change in existing conditions; (2) new or different environmental regulations; or (3) mitigation measures that are no longer enforceable or effective or new mitigation measures that should be considered. The addendum will be prepared in conformance with a City-approved initial study checklist format.
c. Deliverables: One electronic copy (in Word or PDF format) of the Draft Addendum.

4. Cost Assumptions
a. This scope of work, and cost estimate reflect our current understanding of the project requirements and assumes that the City will require the identified technical analyses to support the CEQA document approach. Please note that should the Addendum be subject to criticism from opponents or other parties prior to project approval and City staff determine that a more robust analysis (such as a new MND) is necessary, a change order and revised scope of work will be required. Amendments to the scope of work and cost will be necessary if the project conditions or assumptions outlined above are changed.

Task 6 -Plans, Specifications, Schedule Estimate, and Cost Estimate:

Contract Documents Phase and Permitting (50% and 100% submittals): SDG will provide one (1) scaled and dimensioned drawing package as necessary to communicate the design intent, sizes, and material selection for the project hardscape treatments, various amenity spaces, landscape improvements, and irrigation system(s).
