CITY COUNCIL
SUBJECT: Acceptance of the Annual Channel Rehabilitation Project with L. B. Civil Construction, Inc., as Complete
Summary:

On February 17, 2026, the City Council awarded the Annual Channel Rehabilitation project contract to L. B. Civil Construction, Inc., Bid No. 26-007, in the amount of $661,500. This action will accept the project as complete.

Recommended Action:

It is recommended the City Council:
1) Accept the Annual Channel Rehabilitation project, as complete; 2) Authorize the City Clerk to file and record the Notice of Completion; 3) Authorize the release of the retention in the amount of $34,655, if unencumbered, 45 days after City Council acceptance;
4) Release the Hanover Insurance Company for Material and Labor in the amount of $661,500 after the release of retention; and
5) Retain the Hanover Insurance Company for Faithful Performance for a period of one year.

Discussion:

The Annual Channel Rehabilitation project addressed deteriorating conditions within several concrete stormwater channels throughout the City. Public Works staff identified areas requiring repair along the Pomerado Road, Floral Avenue, and Allbrook Drive channels. The project included repairs to deteriorated channel sidewalls and bottoms, clearing and grubbing, and removal of trees and vegetation contributing to structural damage.

This action accepts the Annual Channel Rehabilitation project as complete; however, the contract will remain open to allow the contractor to repair a section of the newly constructed channel floor at the Pomerado location that was damaged after installation. The damage is unrelated to the contractor's completed work, and the remaining repairs do not affect the completion of the overall project. There were two change orders for this project, totaling $31,600. 1 of 2

The change orders provided additional contract time and addressed unforeseen subsurface conditions encountered during construction. One no-cost change order extended the contract by 12 working days due to unanticipated and unauthorized upstream discharges requiring dewatering and diversion efforts, unsuitable subgrade conditions and the need to reschedule remaining shotcrete work. The second change order added 79 cubic yards of void backfill for another unsuitable subgrade area with voids that were concealed beneath the existing concrete channel and could only be identified after removal of the channel floor. The affected areas were excavated and backfilled with crushed rock to provide a stable base for the new concrete repairs. The final contract amount is $693,100.

Environmental Review:

This action to accept completed public improvements, which were the subject of a prior environmental determination made in connection with the award of the project contract on February 17, 2026, is not a "Project" pursuant to Section 15378(b)(5) of the California Environmental Quality Act (CEQA) Guidelines and, therefore, is not subject to CEQA.

Fiscal Impact:

There are sufficient funds available in the project account (DR009) for the release of retention. Funds remaining in the project at year end will remain in the Drainage Fund accou-nt to be combined with future appropriation for this annual channel CIP program. Funding for the noted project came from the City's Drainage Fund 2310.
