City Council Staff Report - Page 1 of 3
ITEM 3.1.
DATE: August 29, 2023
TO: Honorable Mayor and Council Members
FROM: Stacy Leitner, City Clerk
SUBJECT: PUBLIC HEARING ON DRAFT COUNCIL DISTRICT AND BOUNDARY MAPS
RECOMMENDATION
1. Provide further discussion and direction to staff and consultant related to the number of districts.
2. Conduct the public hearing, receive public comments, provide feedback to the demographic consultant and staff regarding the draft Council District boundary maps, and consider designating a preferred map for inclusion in the ordinance that is to be drafted and brought to the Council for possible introduction at the public hearing on this topic on September 18, 2023.
3. Provide further discussion and direction to staff and consultant whether or not to transition from an appointed Mayor to a directly elected Mayor.
RESULT OF RECOMMENDED ACTION
Consultant will present the draft Council District boundary maps received for Council to consider and select maps on which the Council may focus its deliberations at future hearings and possible introduction in the Ordinance following the public hearing on this topic.
In addition, the City Council may further direct staff and consultants about the number of districts including whether or not to transition from an appointed Mayor to a directly elected Mayor.
BACKGROUND
The City Council was elected under an at-large election system, whereby Council Members are elected by voters of the entire City. On June 7, 2023, the City received a letter from attorney Scott J. Rafferty asserting that the at-large election system violates the California Voting Rights Act (“CVRA”) and threatens litigation if the City declines to voluntarily convert to district-based elections. District-based elections is a method of electing the members to the City Council in which the candidate must reside within an election district and is elected only by voters residing within that election district.
Mr. Rafferty and other attorneys have served similar letters and subsequently filed lawsuits in recent years against numerous other public agencies across the state for CVRA violations
City Council Staff Report - Page 2 of 3
alleging racially polarized voting. Upon receiving the letter from attorney Scott J. Rafferty, staff scheduled a closed session on June 19, 2023 to discuss the threatened CVRA litigation.
The CVRA provides a “Safe Harbor” provision to local government agencies with at-large election systems. Under the provision, a local agency has 45 days from the date of receipt of the letter to adopt a resolution of intent to transition from at-large to district-based elections. If the City of Rancho Cordova complies with the “Safe Harbor” provisions, the amount of attorney’s fees Mr. Rafferty can collect is expected to be approximately $37,000 if the City complies with the process to transition from at-large to district-based elections.
On July 17, 2023, the Council adopted a Resolution of Intent to work towards transitioning from at-large to district-based elections. Moving to district-based elections would require a Council Member (and all candidates for that position) to reside within a designated district boundary, and each Council Member would be elected only by voters of the appropriate district. A copy of the Council adopted Resolution 108-2023 declaring the City's intention to move to district-based elections is included in this report as Attachment 3.
As required by Elections Code Section 10010, the City will hold at least two (2) public hearings prior to the release of draft maps of Council election districts. Council will then hold an additional two (2) more public hearings to solicit public input regarding the content of the draft maps and the proposed sequence of elections. Furthermore, the Council may introduce for first reading an ordinance establishing the district boundaries and the district-based election method pursuant to California Government Code Section 34886 and Elections Code Section 10010. At the conclusion of the process, a public hearing will be held for a second reading of the ordinance implementing a Council election district map.
The first hearing was held on Monday, August 7, 2023. At that time, education was provided to help identify the neighborhoods, other "communities of interest," and other local factors that should be considered or used as 'building blocks' when drawing the draft maps and public comment was received. The Council also provided direction to narrow the number of potential districts down to the following options: five (5) districts with a council appointed mayor, six (6) districts with an elected mayor, or seven (7) districts with a council appointed mayor.
The second hearing was held on Monday, August 14, 2023. At that time, education was provided to help identify the neighborhoods, other "communities of interest," and other local factors that should be considered or used as 'building blocks' when drawing the draft maps and public comment was received. This hearing also highlighted resources available to the public on the City's website related to district-based elections.
These two public hearings met the requirement of California Elections Code Section 10010 that states: "(1) Before drawing a draft map or maps of the proposed boundaries of the districts, the political subdivision shall hold at least two public hearings over a period of no more than 30 days, at which the public is invited to provide input regarding the composition of the districts." In addition, a Community Forum was held on Thursday, August 10, 2023 on the topic of districting that brought nearly 50 people together. During the Community Forum, there was a mapping tools demonstration, staff highlighted resources available to the public on the City's website related to district-based elections and the public had an opportunity to ask questions and share their input.
City Council Staff Report - Page 3 of 3
On August 22, 2023, the City released initial draft boundary maps on the City website for community consideration. The maps and demographic profiles for each map have been posted on the City website, included in this report as Attachment 2, and can be accessed at the following url: https://drawranchocordova.org/draft-maps/ Tonight, Council has the opportunity to discuss the draft maps, possibly narrow the list of draft maps to a subset of "focus" maps, and/or direct that the demographer develop any new or revised maps for consideration at a subsequent hearing, and/or select a preferred map and election sequence for inclusion in a resolution or ordinance for formal adoption.
Number of Districts and Possible Transition to Elected Mayor The Council does need to provide further direction to staff and consultants to narrow down or decide upon the number of Council districts to be created including whether or not to transition from an appointed Mayor to a directly elected Mayor. The Council currently annually appoints a member of the City Council to serve for one year as Mayor of the City. Staff would welcome Council input and possibly direction.
FISCAL IMPACT AND FUNDING SOURCE
Neighborhood Elections Now will receive a partial reimbursement, capped at approximately $37,000 if the City complies with the process to transition from at-large to district-based elections.
The City is working with a professional demographer at an estimated cost of $60,000-$80,000 to assist the City with the process of transitioning from at-large to district-based elections.
The City will also incur additional fees for City Attorney time, community meetings, assistance from consultants for public outreach, and staff time.

4 Community Input
Communities of Interest suggested by forum & hearing participants:
• Neighborhoods north and south of Folsom are very different from each other and should be drawn in separate districts.
• On the west end of Folsom Blvd, the neighborhoods north and south of Folsom Blvd. share similarities and should be drawn in one district. • Districts should be drawn to cross over Folsom Blvd to reduce the division between the north and south.
• Keep old Rancho Cordova together; keep the neighborhood bounded by Coloma, Sunrise, Zinfandel, and Folsom Blvd. together.
• Use the freeway as a natural border.
• Consider business districts.

18 Public Hearing & Discussion
August 29, 2023
Which group’s approach best represents your neighborhood or community of interest?
Are there any group you would propose eliminating the entire group? In each group, which maps do you prefer?
Goal: narrow list down to 3 to 5 “focus” maps, or 2 maps per # of districts Allows residents to focus on a few key maps in detail rather than all 20 maps Council can ask demographer draw variations or revisions of a map The public can continue to draw and submit additional maps Any Council direction on revisions or combinations of maps NDC should prepare?

BACKGROUND
On August 7, 2023, staff heard public comments and received City Council input. Based on that input, staff performed additional analysis of CEQA exemptions and confirmed that the proposed ordinance is exempt from CEQA.
City Council Staff Report - Page 2 of 2
On August 21, 2023, staff presented the above revisions to City Council. On that same date, the City received a letter with questions about the proposed CEQA exemptions. Staff recommended that the item be continued to allow time to analyze the submitted letter. City Council waived the first reading of the ordinance and continued the second reading to August 29, 2023. If the ordinance were to be adopted on August 29, 2023, it would require an emergency ordinance. In addition, City Council directed staff to contact the California Department of Water Resources (CADWR) to evaluate options for extension of the Federal Emergency Management Agency (FEMA) August deadline to September 5, 2023.
Staff reached out to CADWR to request an extension. CADWR stated that if the Floodplain Ordinance is adopted September 5, 2023 it will still allow Rancho Cordova to meet FEMA's adoption timeline. Therefore, staff recommends continuing adoption of the proposed ordinance to the September 5, 2023 City Council Meeting.
FISCAL IMPACT AND FUNDING SOURCE
