B2. Presentation of a Certificate of Recognition to Alta Loma High School Student Bodie Chapman and Campus Security Officer Corey Richardson for Heroically Saving the Life of a Driver in a Car Crash.

Fire Chief Rojer shared the heroic efforts by Alta Loma High School Student Bodie Chapman and Campus Security Officer Corey Richardson during an incident involving an elderly male driver who suffered a medical emergency while driving on Base Line Road. Mayor Michael and Members of the City Council recognized Bodie Chapman and Officer Richardson and thanked them for their courage and service.

B3. Announcement and Request for Community Action Regarding State Redistricting and the Effort to Stop the Proposal to Split Rancho Cucamonga Into Multiple Congressional and State Districts.

Hope Velarde, Management Analyst I, City Manager’s Office, shared a PowerPoint presentation informing the community of the state’s redistricting proposal to split Rancho Cucamonga into multiple Congressional and State Districts. Mayor Michael encouraged the community to voice their concerns to keep Rancho Cucamonga whole by visiting www.wedrawthelinesca.org/contact.

H. CITY MANAGERS STAFF REPORT(S)
H1. Consideration to Approve Actions Related to the Acquisition of 8234 Almond Street. (FIRE) City Manager Gillison introduced the item along with Mike McCliman, Deputy Fire Chief, and Augie Barreda, Deputy Fire Chief, who provided a PowerPoint presentation on the proposed acquisition of 8234 Almond Street.

Deputy Fire Chief McCliman shared the importance of the property location for the Cucamonga Foothill Preservation Alliance as the property is uniquely situated to serve as a base of operations during an emergency due to its location and proximity to Cucamonga Canyon.

City Manager Gillison informed that once the City has acquired the property the City plans to move forward in acquiring an adjacent property to have more access for the Cucamonga Foothill Preservation Alliance and make necessary improvements. In response to Mayor Michael, City Manager Gillison reviewed the process for the U.S.

Forest Service to ratify the final Cucamonga Canyon Management Plan.

MOTION: Moved by Council Member Hutchison, seconded by Council Member Scott, to approve the Board President’s execution of an agreement with the County of San Bernardino and The Jane Anne Morgan Revocable Living Trust dated September 18, 2019 to purchase 8234 Almond Street (APN: 1061-172-19). H2. Receive Presentation on Senate Bill 9 (Housing Development) and Provide Direction to Staff on Responding to Upcoming SB 9 Regulations. (CITY)
City Manager Gillison introduced the item and Sean McPherson, Senior Planner, who provided a PowerPoint presentation with the background and overview of Senate Bill 9 (Housing Development). Senior Planner McPherson detailed Senate Bill 9 provisions, policy and development code considerations and possible impacts to the community. He concluded by stating that upon receiving direction from the City Council, staff intends to return to the City Council within the first quarter of 2022 with recommendations on Development Code Amendments to comply with SB-9 and to maintain the public health, safety and welfare of the City.

Council and staff discussion ensued regarding SB-9 provisions, impacts and limitations, including the regulation of provisions.

MOTION: Moved by Council Member Hutchison, seconded by Mayor Pro Tem Kennedy, to receive and file report and approve further research into the following areas: Objective Standards for Zoning, Objective Standards for Subdivisions, Historic District, Very High Fire Severity Zones, Public Health and Safety Considerations, SB 9 Units as Affordable Housing and return to the Council in the first quarter of 2022 with Development Code Amendments to maintain compliance with SB 9 regulations. H3. Update Regarding State Redistricting by the California Redistricting Commission and its Potential Impacts on Rancho Cucamonga’s Representation in Congress and in the California State Legislature. (CITY)
City Manager Gillison introduced Hope Velarde, Management Analyst I, who provided a PowerPoint presentation on State Redistricting by the California Redistricting Commission. She advocated the need for effective representation and keeping the City whole and urged the community to voice their opinions and concerns at www.wedrawthelinesca.org/contact. Mayor Michael encouraged the public to reach out and voice their opinion on maintaining the City as a whole.

RECOMMENDATION:

Staff recommends that the City Council/Board of Directors of the Fire Protection District make the following findings in order for the City’s legislative bodies to continue meeting virtually: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact of the ability of the members of the City’s legislative bodies to meet safely in person.

BACKGROUND:

On March 4, 2020, Governor Newsom proclaimed a state of emergency to exist in California due to the spread of COVID-19. This proclamation is still in effect. The Governor subsequently issued numerous executive orders suspending or modifying state laws to facilitate the response to the emergency. Among other things, these executive orders superseded certain Brown Act requirements and established special rules to give local public agencies greater flexibility to conduct teleconference meetings. The special rules included provisions allowing local public agencies to conduct teleconference meetings without having to provide a physical location from which the public may attend or comment; without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. Those special rules expired on September 30, 2021.

On September 16, 2021, in anticipation of then-imminent expiration of his special rules for teleconference meetings, Governor Newsom signed AB 361. In key part, this bill amends the Brown Act to establish special requirements for teleconference meetings if a legislative body of a local public agency makes two findings pursuant to Government Code Section 54953(e)(3). Like the special rules in the Governor’s executive orders, the special Brown Act requirements in AB 361 include provisions allowing public agencies to conduct teleconference meetings without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. The AB 361 special Brown Act requirements are scheduled be repealed on January 1, 2024.

In order for a local public agency to be subject to the AB 361 special Brown Act requirements for teleconference meetings, a legislative body of a local public agency first must make a finding that it has “reconsidered” the circumstances of a declared state of emergency. Second, there must

be a finding that such emergency continues to directly impact the ability of legislative body members to meet safely in person. Alternatively, for the second finding, there must be a finding that state or local officials continue to impose or recommend social distancing measures. These findings must be made within 30 days after the first teleconference under AB 361 and on a monthly basis thereafter.

ANALYSIS:

Due to the continuing, rapid spread of the Omicron and Delta variants of COVID-19, staff is recommending that the City Council make the necessary findings in order to continue holding teleconference meetings. The findings were first made at the January 5, 2022 City Council meeting. Federal and state officials continue to recommend social distancing measures, including limiting in-door gatherings, in order to limit the spread of the highly transmissible Omicron variant of COVID-19.

It is expected that virtual meetings will only be conducted pursuant to AB 361 where a City Council Member or other member of a commission/committee is unable to meet in person due to exposure to COVID-19. Under AB 361, the public must also be given an opportunity to participate in a virtual meeting via a teleconference option, and the amended agenda provides call-in information.

However, the public will continue to be permitted to attend the meeting in person. It is unclear if future meetings will require teleconferencing.

FISCAL IMPACT:

There is no fiscal impact caused by this item. The City already has the necessary equipment to hold a teleconferenced meeting.

RECOMMENDATION:

Staff recommends that the Fire Board of the Rancho Cucamonga Fire Protection District (the District) adopt the attached resolution modifying how the District pays and reports the value of employer paid member contributions (EPMC) to CalPERS for the Fire Management Employee Group and Fire Union Local 2274 bargaining group.

BACKGROUND:

The Rancho Cucamonga Fire Protection District has had existing written labor agreements which specifically provide for the normal CalPERS member pension contributions to be paid by the employer (the District) and, in accordance with PELRA, reported as additional compensation. This benefit has applied to all District bargaining groups.

The City Council previously approved a four (4) year Memorandum of Understanding (MOU) between the District and Fire District bargaining units, including Fire Management Employee Group (Fire MEG) and Fire Union Local 2274 (Fire Union), effective July 2019 through June 2023.

These MOUs specifically modify how the District will pay and report the value of EMPC. These agreements have required employees to contribute toward their pension costs by reducing the District’s payment and reporting of EPMC in phases.

Although modifications have been incorporated in the respective MOUs, they must also be adopted by Resolution in accordance with CalPERS regulations.

ANALYSIS:

Existing MOUs provide for modifying how the District pays and reports the value of EPMC to increase employee contributions toward pension costs. This benefit consists of paying the following percent of normal member contributions as EPMC, and reporting the same value of compensation earnable as additional compensation as set forth below.

Effective February 5, 2022, the next step in the reduction of EPMC will be implemented in accordance with the MOU’s. This benefit will be modified for each of the bargaining units as set forth below:

It is recommended that the City Council approve a three (3) year agreement with Okta, Inc. for identity management, single sign-on, and multi-factor authentication services in the total amount of $171,051 with costs shared between the City and the Fire District covering the life of the agreement.

BACKGROUND:

The implementation of multi-factor is considered one of the most effective defensive measures to protect the City’s digital estate. Multi-factor authentication requires users to present two forms of validation in order to log into the City’s network and digital services, providing an additional layer of security in the event an employee’s credentials are compromised. In February 2021, the City of Rancho Cucamonga and Okta, Inc. entered into a one-year agreement utilizing the NASPO ValuePoint Master Agreement awarded by the State of Utah to Carahsoft Technology Corporation and its list of retailers which, includes Okta, Contract No. AR2472, for the first-year deployment of user identity management and multi-factor authentication services. During this first year of full deployment DoIT evaluated the Okta platform for user engagement, ease of administration, and overall effectiveness as a cybersecurity asset.

ANALYSIS:

DoIT has fully deployed Okta identity management and multi-factor authentication (MFA), updating the City’s accepted user practices to improve our overall cybersecurity posture. The team in DoIT is continuing to develop out additional services in Okta, including federating single sign on (SSO) to enterprise applications, simplifying password management for users, and improving identity management practices, increasing the overall value of the investment in Okta.

Staff recommends a multi-year agreement under the same NASPO ValuePoint Master Agreement that is valid through 2026 to continue Okta services while managing costs and accurately forecasting future commitments.

FISCAL IMPACT:

The total cost to over the life of the three-year agreement is $171,051 which includes all hosting, support, and maintenance costs. The Fire District is requesting an appropriation of $14,254 into account No. 3281501-5300 (Contract Services) to fund the first year of the agreement. Sufficient funds are available in the current Fiscal Year City General Fund budget to cover the City portion of the first year of the agreement Account No. 1001209-5300 (Contract Services). Staff recommends that the City Council adopt the attached 2022 Legislative Platform.

BACKGROUND:

Each year, there are many bills introduced in the State Legislature and U.S Congress that directly impact the operations of municipal government. Often, the City needs to take a position on a particular piece of legislation that will impact the City or local government in general. City staff carefully monitors pending state and federal legislation. Once a position is adopted, staff works closely with the City Council to advocate on behalf of the City to members of the State Legislature, the Governor’s office, members of Congress, or various state and federal agencies.

The 2022 Legislative Platform serves as an outline and reference guide for legislative positions and objectives that shape the actions of both City Council and staff. It is the foundation of a focused advocacy strategy with the primary purpose of adopting official City positions on clearly stated legislative issues at the start of the legislative session. It encourages collaboration with Cal Cities and other local agencies in supporting the City’s diverse legislative interests. The City of Rancho Cucamonga does not typically address matters not pertinent to local government services or duties, such as socially divisive, partisan, or international affairs.

The Legislative Platform is adopted on an annual basis and directs the City’s Legislative Program through the incorporation of key strategic actions that include the communication of legislative positions on proposed Federal, State, and County legislation, measures, initiatives, and governmental regulations, as well as the pursuit of Federal, State, and County funding for City projects, services, and programs. The attached 2022 Legislative Platform builds upon this foundation and has been updated to reflect issues anticipated to continue or emerge throughout the upcoming legislative session. Issues that have been resolved or are no longer relevant are typically removed.

The Legislative Platform is continually reviewed using the goals and objectives of the City Council, a review of legislative priorities from the Cal Cities and other regional agencies, research of current law and pending legislation, as well as input from City departments, local legislative staff, and the City’s legislative advocates.

For the 2022 Legislative Platform, staff has taken a comprehensive approach to update the document. Staff carefully analyzed and identified positions for redundancy and relevancy, with several of these either removed or consolidated with existing positions in the Platform.

Specifically, the removal of several positions related to COVID-19 as issues on vaccine distribution and funding allocations were no longer pertinent. New items have also been added to the Platform to reflect the City’s current interests, such as equitable access to the funding made available by the Infrastructure Investment and Jobs Act and the advocacy for multi-modal transportation projects within the City’s HART District.

Support Efforts To:
Restore sustainability of Public Pension benefit plans by implementing reform measures such as modifying retirees’ COLA increases, permitting cities to modify benefits prospectively for active employees, and limiting the practice of divestment. Gather data regarding where goods originate and are delivered to better understand the impact of online transactions and inform an equitable sales tax allocation policy. Support sales tax reform which modernizes the tax structure to reflect the increasing use of e-commerce and considers consumption of personal or retail services so that sales tax is equitably distributed to those communities where the purchase is made and those communities which are part of the supply chain or have a physical presence or impact. Streamline environmental processing for regulatory permits issued by Caltrans and various other state and federal agencies for the purpose of expediting public infrastructure developments.

Incentivize solar PV generation, energy storage, and micro-grid technologies for utilities in order to make the transition to renewable energy more financially attractive and help meet the State’s 2030 emission targets.

Staff recommends that the City Council ratify the City Manager’s execution of the San Bernardino contract and authorize the appropriation of the additional funding.

BACKGROUND:

The County of San Bernardino’s Board of Supervisors works with community partners, through contractual agreements, to provide services to citizens that promote health, safety, economic well- being, education and recreation that enhance quality of life and meet the needs of the County’s residents. The County’s $2 million contract with the City will support education and literacy for children and teens in Rancho Cucamonga and the surrounding communities through the enhancement of the Paul A. Biane Library’s Second Story and Beyond® capital project.

ANALYSIS:

On September 21, 2021 and November 16, 2021, the County’s Board of Supervisors allocated a total of $55 million for their district specific Priorities Program. These funds are meant to support contractual agreements for services with community partners through identified programs, projects and initiatives that support the County’s mission.

As part of her Priorities Program, Second District Supervisor Janice Rutherford recommended a $2 million contract with the City for the Library Services Department’s Second Story and Beyond® project. As a contractual community partner, the Library will provide education and literacy skills for residents of Rancho Cucamonga and surrounding communities through programming offered at the Second Story and Beyond®.

Funding from the County contract will be used to support enhancements to the Second Story and Beyond®, blending traditional lifelong learning with child development and informal education. The enhancements to Second Story and Beyond® include:
• Creating additional experiences based on literary themes that bring stories and science to life. • Providing enhanced layers of auditory and visual stimulation that facilitate rich sensory-based environments.
• Adding more engineering, mechanical, and water-based play components that are infused with Science, Technology, Engineering, and Mathematics (STEM) learning opportunities.

3. Release the Labor and Material Bond; and

4. Waive the maintenance bond requirement.

BACKGROUND:

On September 13, 2017, the Planning Commission approved Case No. SUBTPM19836 for the subdivision of 0.92 acres into 2 parcels of land for construction of two single family residences located at the southeast corner of Wilson Avenue and Winchester Court. An improvement agreement and securities were approved by the City Council on June 6, 2018, to ensure construction of the required public improvements; such as street and landscape improvements.

ANALYSIS:

All public improvements required of this development have been completed to the satisfaction of the City Engineer.

Prior to construction of the public improvements the developer, Yousef Audi, submitted the following securities to ensure satisfactory completion of the improvements:

Labor and Material Bond $51,200 #100269296
Monumentation Cash Deposit: $2,860 #286889
City staff conducted a final inspection of the public improvements in August of 2019 and confirmed all work was completed to City Standards. The developer did not provide a maintenance bond to the City; therefore, the Faithful Performance Bond was retained for the satisfactory period (one

year from final inspection). City staff has confirmed the improvements have remained in good workmanship and free of defects. City staff recommends the maintenance bond requirement be waived.

BACKGROUND:

The City Council previously approved a one-year Memorandum of Understanding (MOU) between the City of Rancho Cucamonga (City) and the Rancho Cucamonga City Employees Association (RCCEA), effective June 7, 2021, through June 30, 2022. This MOU provides for a “Conditional COLA and Decrease of EPMC.” In summary, the City and RCCEA agreed to a 1.5% cost of living adjustment, along with a 1% decrease in Employer Paid Member Contributions to be effective May 2022, if certain terms related to tax revenue were met.

ANALYSIS:

Considering the “great resignation,” where 41% of workers across 31 countries are considering leaving their current jobs (Microsoft Survey) and 55% of working Americans say they plan to look for a new job in the next 12 months (Bankrate survey), the City felt it was important to remove the uncertainty of this section of the RCCEA MOU and move up its implementation.

Accordingly, the City and RCCEA met and conferred in good faith in January 2022. The parties agreed to amending Section 53 of the current MOU, “Conditional COLA and Decrease of EPMC.” The negotiated terms provide for a 1.5% cost of living adjustment and a 1% reduction in the amount the City pays towards an employees’ retirement (Employer Paid Member Contributions) effective the first full pay period in March 2022. This change to the MOU reflects the City’s commitment to recruitment and retention.

WHEREAS, representatives of the City of Rancho Cucamonga (City) and the Rancho Cucamonga City Employees Association have met and conferred pursuant to the provisions of the Meyers-Milias-Brown Act (California Government Code §3500, et seq.) with regard to terms and conditions of employment; and
WHEREAS, representatives of the City and the Rancho Cucamonga City Employees Association have agreed upon and presented to this City Council a Side Letter Agreement Amending the Current Memorandum of Understanding effective June 7, 2021 to June 30, 2022, related to Section 53, Conditional COLA and Decrease of EPMC; and WHEREAS, the City Council of the City of Rancho Cucamonga has previously adopted salary resolutions establishing salary ranges, benefits and other terms of employment for employees of the City of Rancho Cucamonga; and
WHEREAS, the City Council of the City of Rancho Cucamonga recognizes that it is necessary from time to time to amend the salary resolution to accommodate changes in position titles, classifications salary ranges, benefits and other terms of employment; and WHEREAS, the City Council of the City of Rancho Cucamonga has the authority to implement Government Code Section 20691; and
WHEREAS, the City has written labor agreements which specifically provide for the normal member contributions to be paid by the employer; and reported as additional compensation; and
WHEREAS, one of the steps in the procedure to modify Section 20691 is the adoption by CITY of a resolution modifying paying and reporting the value of Employer Paid Member Contributions (EPMC) for employees who meet the conditions set forth; and WHEREAS, the City has identified the following conditions for the purpose of its election to pay EPMC:
This benefit shall apply to all miscellaneous employees within the Rancho Cucamonga City Employees Association.
This benefit shall consist of paying 2% of the normal contributions as EMPC, and reporting the same percent (value) of compensation earnable* (excluding Government Code Section 20636 (c)(4) as additional compensation for employees hired prior to September 1, 2020).

SIDE LETTER OF AGREEMENT

BETWEEN THE CITY OF RANCHO CUCAMONGA

AND THE RANCHO CUCAMONGA CITY EMPLOYEES ASSOCIATION
The City of Rancho Cucamonga ("City") and the Rancho Cucamonga City Employees Association (“RCCEA) (collectively, the "Parties") entered into a Memorandum of Understanding ("MOU") that commenced on June 7, 2021, and expires on June 30, 2022.

SECTION 53: COLA AND DECREASE OF EPMC
The City and RCCEA agree to a COLA of 1.5% for all RCCEA covered positions, along with a decrease to the amount of EPMC paid by the City of 1% for all Tier I, II, and Ill CalPERS classic members, effective the first full pay period in March 2022. The City will adopt an updated salary schedule and a resolution to reflect this reduction of the EPMC prior to the effective date
This Side Letter of Agreement shall be incorporated into the MOU. The MOU shall remain in full force and effect except to the extent modified by this Side Letter of Agreement. This Side Letter of Agreement shall not be effective until ratified by the City Council and approved by the Rancho Cucamonga City Employees Association.

RECOMMENDATION:

Staff recommends that the City Council:

1. Approve the final map for Tract 20148;

2. Approve an Improvement Agreement for related public improvements and authorize the Mayor and the City Clerk to sign said agreement;

3. Approve the plans and specifications for the related public improvements on file with the City Engineer;

4. Accept security in the form of bonds for completion of the related public improvements; and

5. Adopt the attached resolutions ordering the annexation to Landscape Maintenance District No. 9 and Street Lighting Maintenance Districts Nos. 1 and 8.

BACKGROUND:

On June 24, 2020, the Planning Commission approved Case No. SUBTT20148 for the development of a 131 residential units, 4 commercial ready units and a 1,500 square foot commercial space on 11.44 acre project site in the Community Commercial (CC) District, located on the west side of East Avenue and north of Foothill Boulevard.

Case No. SUBTT20148 was approved subject to a condition that certain public improvements be constructed including; curb and gutter, a driveway approach, street lights, street trees, street improvements and storm drain improvements.

ANALYSIS:

The developer, SC Westbury Limited Partnership has submitted a final map for consideration of

approval. Staff has determined the final map (on file with the City Engineer) is in substantial conformity with the approved tentative map and conditions. Further, an Improvement Agreement and securities to guarantee construction of the off-site public improvements in the following amounts have been submitted:

Approval of this item by Council would approve the Improvement Agreement, accept the securities for the construction of certain public improvements, and order the annexation into Landscape Maintenance District 9 and Street Light Maintenance Districts 1 and 8. Copies of the agreement and the Consent and Waiver to Annexation forms are on file in the City Clerk’s Office.

FISCAL IMPACT:

The proposed annexations would satisfy the conditions of approval for the development and supply additional annual revenue into the landscape and lighting maintenance districts in the following amounts:

Landscape Maintenance District No. 9: $40,861.52 Street Light Maintenance District No. 1: $2,327.87 Street Light Maintenance District No. 8: $4,008.60 The developer will be installing 11 new street trees and 7 new street lights that will be maintained by the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

RANCHO CUCAMONGA, CALIFORNIA, ORDERING THE

ANNEXATION OF CERTAIN TERRITORY TO LANDSCAPE
MAINTENANCE DISTRICT NO. 9 (LOWER ETIWANDA) FOR
CASE NO. SUBTT20148
WHEREAS, the City Council of the City of Rancho Cucamonga, California, has previously formed a special maintenance district pursuant to the terms of the “Landscape and Lighting Act of 1972”, being Division 15, Part 2 of the Streets and Highways Code of the State of California (the “Act”, said special maintenance district known and designated as Landscape Maintenance District No. 9 (Lower Etiwanda) (the “District”); and WHEREAS, the provisions of Article 2 of Chapter 2 of the Act authorize the annexation of additional territory to the District; and
WHEREAS, such provisions also provide that the requirement for the preparation of resolutions, and assessment engineer’s report, notices of public hearing and the right of majority protest may be waived in writing with the written consent of all of the owners of property within the territory to be annexed; and
WHEREAS, notwithstanding that such provisions of the Act related to the annexation of territory to the District, Article XIII D of the Constitution of the State of California (“Article XIII D”) establishes certain procedural requirements for the authorization to levy assessments which apply to the levy of annual assessments for the District on the territory proposed to be annexed to such District; and
WHEREAS, the owners of certain property described in Exhibit A attached hereto, and incorporated herein by this reference, have requested that such property (collectively, the “Territory”) be annexed to the District in order to provide for the levy of annual assessments to finance the maintenance of certain improvements described in Exhibit B hereto (the “Improvements”); and
WHEREAS, all of the owners of the Territory have filed with the City Clerk duly executed forms entitled “Consent And Waiver To Annexation Of Certain Real Property To A Maintenance District And Approval Of The Levy Of Assessments On Such Real Property” (the “Consent and Waiver”); and
WHEREAS, by such Consent and Waiver, all of the owners of the Territory have expressly waived any and all of the procedural requirements as prescribed in the Act to the annexation of the Territory to the District and have expressly consented to the annexation of the Territory to the District; and
WHEREAS, by such Consent and Waiver, all of the owners of the Territory have also expressly waived any and all of the procedural requirements as prescribed in the Act and/or Article XIII D applicable to the authorization to levy the proposed annual assessment against the Territory set forth in Exhibit B attached hereto and incorporated herein by this reference and have declared support for, consent to and approval of the authorization to levy such proposed annual assessment set forth in Exhibit C attached hereto; and

WHEREAS, by such Consent and Waiver, all of the owners of the Territory have also expressly agreed for themselves, their heirs, successors and assigns that:
(1) The proportionate special benefit derived by each parcel in the Territory from the District Improvements has been determined in relationship to the entirety of the maintenance and operation expenses of the Improvements; (2) The proposed annual assessment does not exceed the reasonable cost of the proportional special benefit from the Improvements conferred on each parcel in the Territory.
(3) Only the special benefits derived or to be derived by each parcel in the Territory from the Improvements have been included in the proposed annual assessment.

WHEREAS, at this time the City Council desires to order the annexation of the Territory to the District and to authorize the levy of annual assessments against the Territory in amounts not to exceed the amounts set forth in Exhibit C hereto.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO CUCAMONGA HEREBY RESOLVES AS FOLLOWS:

SECTION 1: That the above recitals are true and correct.

SECTION 2: The City Council hereby finds and determines that:
a. The annual assessments proposed to be levied on each parcel in the Territory do not exceed the reasonable cost of the proportional special benefit conferred on each such parcel from the Improvements. b. The proportional special benefit derived by each parcel in the Territory from the Improvements has been determined in relationship to the entirety of the cost of the maintenance of the Improvement. c. Only special benefits will be assessed on the Territory by the levy of the proposed annual assessments.

SECTION 3: This legislative body hereby orders the annexation the Territory to the District, approves the financing of the maintenance of the Improvements from the proceeds of annual assessments to be levied against the Territory and approves and orders the levy of annual assessments against the Territory in amounts not to exceed the amounts set forth in Exhibit C.

SECTION 4: All future proceedings of the District, including the levy of all assessments, shall be applicable to the Territory.
