Lucy Alvarez-Nunez, Management Analyst I
SUBJECT: Consideration to Adopt a Resolution Approving a Side Letter of Agreement Between the City of Rancho Cucamonga and the Executive Management Employee Group. (RESOLUTION NO. 2022-034) (CITY) RECOMMENDATION:
Staff recommends that the City Council adopt the attached resolution approving a side letter of agreement between the City of Rancho Cucamonga and the Executive Management Employee Group.
BACKGROUND:
The City Council previously approved a two-year Memorandum of Understanding (MOU) between the City of Rancho Cucamonga and the Executive Management Employee Group, effective July 1, 2019, to June 30, 2021. A side letter of agreement extended the MOU from July 1, 2021, to June 30,2022. The side letter of agreement included an automatic enrollment to direct deposit and deferred compensation for new members, and a discussion in the fall of 2021 regarding severance agreements.
Recently, the City and Executive Management Employee Group met and conferred in good faith.
The parties negotiated a side letter of agreement incorporating provisions related to severance compensation into the current MOU.
ANALYSIS:
Severance pay is a common benefit for at-will executive employees. This is a prospective benefit providing that executive employees with over one year of continuous employment with the City beginning July 1, 2022, who are terminated, will be eligible to receive severance pay of 90 calendar days of base salary. Executive employees with over five years of continuous employment with the City beginning July 1, 2022, who are terminated, would be eligible to receive 120 calendar days of base salary. As a condition of receiving severance pay, the terminated employee would need to voluntarily execute a Compromise and Release Agreement.
In addition, Department heads who work and provide guidance during the transition of a new Department Head, within their department, would be eligible to receive $2,600 a year in additional duties pay.
Staff recommends the City Council adopt the attached resolution approving the attached side

letter of agreement between the City and the Executive Management Employee Group.
FISCAL IMPACT:
The negotiated provisions would not result in a fiscal impact for FY 2021/22.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
This item addresses the Council’s goal to work together cooperatively and respectfully with each other, staff, and all stakeholders.

WHEREAS, representatives of the City of Rancho Cucamonga (City) and the Executive Management Group have met and conferred pursuant to the provisions of the Meyers-Milias- Brown Act (California Government Code §3500, et seq.) with regard to terms and conditions of employment; and
WHEREAS, representatives of the City and the Executive Management Group have agreed upon and presented to this City Council a Side Letter Agreement (see attached Side Letter Agreement) that Amends the Current Memorandum of Understanding effective July 1, 2019, to June 30, 2022, related to adding provisions for severance compensation into Section 29 and 30 of the MOU.

SIDE LETTER OF AGREEMENT
BETWEEN THE CITY OF RANCHO CUCAMONGA
AND THE EXECUTIVE MANAGEMENT EMPLOYEE GROUP
The City of Rancho Cucamonga ("City") and the Executive Management Employee Group (collectively, the "Parties") entered into a Memorandum of Understanding ("MOU") that commenced on July 1, 2019, and expires on June 30, 2021, a side letter agreement that extended the MOU from July 1, 2021, to June 30, 2022, and a subsequent side letter agreement adding new vacation buyback language.
The Parties have agreed to incorporate the following provisions for severance compensation into Section 29 and 30 of the MOU:
Article 29: Severance
All Executive employees are at-will employees who may be terminated with or without cause, and who have no appeal rights.
Executive employees with over one (1) year of continuous employment with the City from July 1, 2022, who are terminated, will be eligible to receive severance pay of 90 calendar days of their base salary if the terminated employee voluntarily executes a Compromise and Release Agreement, which includes a waiver of all claims against the City and/or challenges to their termination, within ten (10) calendar days of receiving notice of termination.
Executive employees with over five (5) years (60+ months) of continuous employment with the City from July 1, 2022, who are terminated, will be eligible to receive severance pay of 120 calendar days of their base salary if the terminated employee voluntarily executes a Compromise and Release Agreement, which includes a waiver of all claims against the City and/or challenges to their termination, within ten (10) calendar days of receiving notice of termination.
Employees are not required to execute the Compromise and Release Agreement since it is an agreement, and its execution is totally voluntary on the part of the employee. However, it is a condition of receiving the severance pay.
The severance pay is consideration for the Agreement.
Section 30: Senior Department Head Additional Duties Pay Department Heads who work and provide guidance during the transition of a new Department Head within their Department are eligible to receive $2,600 a year ($100 per pay period) in Senior Department Head additional duties pay for taking on the added responsibilities of assisting the new Department Head while retaining the duties of their current position.
This Side Letter of Agreement shall be incorporated into the MOU. The MOU shall remain in full force and effect except to the extent modified by this Side Letter of Agreement. This Side Letter of Agreement shall not be effective until ratified by the City Council and the membership of the Executive Management Group.

DATE:March 16, 2022
TO:Mayor and Members of the City Council
FROM:John R. Gillison, City Manager
INITIATED BY: Noah Daniels, Finance Director
SUBJECT: Consideration of an Agreement with NBS Government Finance Group for D-FAST 3 Software License Agreement. (CITY)
RECOMMENDATION:
Staff recommends that the City Council approve an agreement with NBS Government Finance Group (NBS) to renew the D-FAST 3 Software License Agreement.
BACKGROUND:
The Finance Department utilizes D-FAST 3, proprietary software of NBS, to administer the City’s special financing districts, including assessment and improvement districts, community facilities districts, and landscape and street lighting maintenance districts. Currently, the Finance Department manages approximately 138,000 parcels for 35 special financing districts with the D- FAST 3 software.
The Finance Department has used this system for many years and renews the software license agreement every three years with NBS.
ANALYSIS:
The Finance Department utilizes the D-FAST 3 software to prepare the annual tax roll submission to the County of San Bernardino to place the assessment and special tax levies on property tax bills. Also, DFAST-3 is a financial analysis tool for the City’s special financing districts, providing an efficient means for revenues forecasts and delinquency analysis. Each special financing district has a unique levy formulation integrated into the software that allows for accurate and effective management of the districts.
The existing agreement with NBS expired, and recommends an agreement to renew the D-FAST 3 software license agreement. Under the new agreement, the software license increases by 3 percent annually, stabilizing the annual cost increase as the previous increases were based on changes in the consumer price index. This agreed-upon adjustment will provide expenditure relief due to inflation raising the consumer price index. For reference, the consumer price index increased 7.5 percent and is anticipated to continue rising.
If approved, this software agreement will be in effect for Fiscal Years 2021/22 through 2023/24.
This agreement is on file in the City Clerk’s Office.
1 1
5 9
FISCAL IMPACT:
There is no additional fiscal impact for the D-Fast 3 software as the $22,930 annual cost is already budgeted for the Fiscal Year 2021/22. Approval of the three-year license agreement for D-Fast 3 will allow the Finance Department to continue managing the City’s special financing districts.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
This item addresses critical elements of the City Council’s mission and vision statements by addressing the fiscal management of the City’s special financing districts, notably the annual tax roll submission to the County of San Bernardino.

SUBJECT: Consideration to Award a Contract to Gentry Brothers, Inc. for the "CDBG Concrete Rehabilitation Project". (CITY)
RECOMMENDATION:
Staff recommends the City Council approve the specifications, accept the bids received, award and authorize the execution of a contract in the amount of $1,378,207.60 (Base Bid plus Additive Bids No 1 and No 2) for the “CDBG Concrete Rehabilitation Project” to the lowest responsive bidder, Gentry Brothers, Inc., of Irwindale; authorize the expenditure of a contingency in the amount of $129,943.40 and appropriate $1,508,151.00 into account number 1204314- 5650/2105204-0 from the CDBG fund balance.
BACKGROUND:
This project will assist in reducing the backlog of needed sidewalk repair/replacement projects. As trees mature over the years, their roots damage nearby sidewalks, curb and gutter, and driveway approaches. With the availability of Federal Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds, the City will be able to significantly reduce the number of residential sidewalks, curb and gutter, and driveway approaches that need to be repaired/replaced. A City arborist will evaluate the trees that caused the damage to determine if the tree can remain with some trimmed roots, or if the roots are too extensive the tree must be removed.
ANALYSIS:
Six (6) bids for this project were opened at 2:00 pm on Tuesday, March 1, 2022 (see attached Bid Summary). Staff completed the required background investigation and finds that the lowest responsive bidder, Gentry Brothers, Inc. of Irwindale, has met the requirements of the bid documents.
The project is scheduled to be completed within one hundred fifty-two (152) working days – 120 working days for the Base Bid, 22 working days for Additive Bid No 1 and 10 working days for Additive Bid No 2.
Staff is requesting a contingency of $129,943.40, in the event something unexpected being discovered during the project.

7 1
A copy of the project contract can be found at the City Clerk’s Office.
FISCAL IMPACT:
There will be no negative impact to the General Fund as a result of this project. Funds for this project will be appropriated from the City’s Community Development Block Grant (CDBG) allocation. An appropriation is requested from CDBG fund balance to 1204314-5650/2105204-0 in the amount of $1,508,151.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
By removing and replacing damaged sidewalks, curbs and gutters, driveway approaches, the “CDBG Concrete Rehabilitation Project”, will enhance the appearance and safety of the affected neighborhoods.

SUBJECT: Consideration to Accept Public Improvements Located at the Northeast Corner of Foothill Boulevard and Klusman Avenue per the Improvement Agreement Related to Case No. DRC2008-00356, as Complete, File the Notice of Completion, and Authorize Release of Bonds. (CITY) RECOMMENDATION:
Staff recommends that the City Council:
1. Approve and accept the public improvements and their design, required for the development of Case No. DRC2008-00356 and authorize the City Engineer to file the appropriate Notice of Completion;
2. Release the Faithful Performance Bond for the associated public improvements;
3. Release the Labor and Material Bond; and
4. Waive the maintenance bond requirement.
BACKGROUND:
On January 11, 2012, the Planning Commission approved Case No. DRC2008-00356 for the construction of retail commercial center consisting of 3 buildings totaling 11,588 square feet on
1.08 acre of land located at the northeast corner of Foothill Boulevard and Klusman Avenue. An improvement agreement and securities were approved by the City Council on March 18, 2015, to ensure construction of the required public improvements; such as street and landscape improvements.
ANALYSIS:
All public improvements required of this development have been completed to the satisfaction of the City Engineer.
Prior to construction of the public improvements the developer, Gavriel Sfaee, submitted the following securities to ensure satisfactory completion of the improvements:
Faithful Performance Bond $134,200
Labor and Material Bond $134,200
City staff conducted a final inspection of the public improvements in December of 2020 and confirmed all work was completed to City Standards. The developer did not provide a maintenance bond to the City; therefore, the Faithful Performance Bond was retained for the

Consideration of Amendment No. 1 to the Professional Services Agreement with Cambridge Seven Associates (Contract No. 2020-120) for Design Services Not to Exceed $162,000. (CITY) RECOMMENDATION:
Staff recommends the City Council authorize Amendment No. 1 to the Professional Services Agreement with Cambridge Seven Associates (Contract No. 2020-120) for design services not to exceed $162,000.
BACKGROUND:
After conducting a competitive bid process, the City entered into a contract on October 21, 2020, with Cambridge Seven Associates (C7) to provide design services for the Rancho Cucamonga Public Library’s Second Story and Beyond ® project. The Second Story and Beyond ® (SSAB) project will create museum-quality, interactive exhibits which will be featured on the second floor of the Paul A. Biane Library. The museum’s literacy-themed exhibits will be custom designed and fabricated to meet the space’s unique layout and to complement the museum’s overall changing themes.
On February 8, 2022, the San Bernardino County Board of Supervisors voted to enter into a $2 million contract with the City of Rancho Cucamonga to enhance the SSAB . As a result, the contract with C7 needs to be amended in order to facilitate the building and pl acement of these enhancements.
ANALYSIS:
For the past 16 months, C7 has been working collaboratively with City staff throughout the development of the SSAB project. Construction drawings for the project’s initial scope were at 90% completion when the County’s contract was awarded. The County funded enhancements, not included in the project’s initial scope of work, will require additional design services from C7.
The increase in design services expenses will be covered by this amendment to the original contract. County enhancements to the project include:
• Creating additional experiences based on literary themes that bring stories and science to life.
• Providing enhanced layers of auditory and visual stimulation that facilitate rich sensory- based environments.
• Adding more engineering, mechanical, and water-based play components that are infused with Science, Technology, Engineering, and Mathematics (STEM) learning
opportunities.
TABLE 1 – Contract Cost Breakdown
Amount Not to Exceed
Original Contract $640,000
Amendment No. 1 $162,000
Grand Total $802,000
A copy of the contract is on file with the City Clerk’s Office.
FISCAL IMPACT:
The total cost for design services is fully funded through the County’s contract and under Library Capital Fund: 1329601-5650 Capital Project.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
Providing superior Library Services to residents enhances the overall quality of life in Rancho Cucamonga and the Second Story and Beyond® project will contribute to building and preserving the City’s family-oriented atmosphere.

SUBJECT: Consideration of an Easement Agreement Between Cucamonga Valley Water District and The City of Rancho Cucamonga for the Purposes of Constructing a Retaining Wall Within City Right-of-Way at the Northwest Corner of 19th Street and Sapphire Street. (CITY)
RECOMMENDATION:
Staff recommends that the City Council approve an easement agreement between Cucamonga Valley Water District (“CVWD”) and The City of Rancho Cucamonga (“City”) for the purposes of constructing a retaining wall within City right-of-way at the northwest corner of 19 th Street and Sapphire Street.
BACKGROUND:
CVWD owns certain real property (APN: 0201-413-11) located at 6662 Sapphire Street. CVWD has recently constructed facilities onsite to improve and expand their ability to provide water to our community. As part of their onsite improvements, CVWD needs to construct a retaining wall at the northwest corner of 19 th Street and Sapphire. The wall will be placed within City right-of- way.
ANALYSIS:
The planned retaining wall is depicted on the Street Improvement Plans (Drawing No. 2556) on file with the Engineering Services Department. The placement of the wall allows for the completion of the on-site improvements, including landscaping to screen CVWD’s facilities at this location and does not adversely impact the City’s use of the right-of-way for public access.
In order to construct the retaining wall, CVWD needs to obtain an easement from the City. The easement agreement (on file with the City Clerk) sets forth terms of the easement including a requirement for CVWD to maintain the wall.
FISCAL IMPACT:

COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
The project meets the City Council core values by promoting and enhancing a safe and healthy community for all, and by providing continuous improvement through the construction of high- quality public improvements.

(CITY)
RECOMMENDATION:
Staff recommends that the City Council approve the Purchase and Sale Agreement on file with the City Clerk for the acquisition of a temporary construction easement at 8821 Etiwanda Avenue (Assessor Parcel Number 0229-162-15) in connection with the Etiwanda Grade Separation Project and authorize the City Manager or his designee to sign the agreement and any documents necessary to complete the purchase.
BACKGROUND:
The Etiwanda Grade Separation Project (Project) will construct an overhead crossing, utilizing walls and embankments to support the raised approaching roadway. It will span the railroad right- of-way and provide access to adjacent properties. The Project will widen Etiwanda Avenue to four traffic lanes including a painted median/left turn lane with bike lanes and sidewalks on each side and a northbound right turn lane onto Whittram Avenue. When completed in 2024, the Project will reduce vehicle and truck delays, as well as queuing. It will improve mobility, safety, and level of service at the crossing, and it will provide for the safe transit of pedestrians, bicyclists, vehicles, trucks, and trains. Furthermore, the Project will provide for improved response times in the area for first responders such as police officers, firefighters, paramedics, and emergency medical technicians. The Plans for the Project are on file with the Engineering Services Department.
The Project requires the acquisition of an approximate 5,011 square foot temporary construction easement with a term of 18 months (Subject Property Interests) from the property located at 8821 Etiwanda Avenue owned by the Jones Family Trust, the Garness Family Trust, and the Clemons Revocable Trust (the Jones, Garness & Clemons Parcel) for grade separation and related purposes, and all uses necessary or convenient thereto. On January 19, 2022, the City Council held a hearing to consider adoption of a Resolution of Necessity declaring the Subject Property Interests necessary in conjunction with the Etiwanda Grade Separation Project. Following the hearing, the City Council adopted Resolution No. 2022-011 making the findings required by State law, declaring the property interests necessary, and authorizing their acquisition.

ANALYSIS:
Pursuant to Government Code Section 7260 et seq., the City of Rancho Cucamonga obtained a fair market value appraisal of the Jones, Garness & Clemons Parcel and the Subject Property Interests. The City set just compensation in accordance with the appraised fair market value, and extended a written offer on October 26, 2021 to the trustees of the Jones Family Trust, the Garness Family Trust, and the Clemons Revocable Trust, the owners of record. The fair market value appraisal used a date of value of October 14, 2021. Following negotiation with the property owners, an agreement has been reached for purchase of the Subject Property Interests in the amount of $10,150. A Purchase and Sale Agreement memorializing the negotiated agreement has been prepared, executed by the property owners and is on file with the City Clerk. Following approval of the Purchase and Sale Agreement, staff will proceed with opening escrow and completing the purchase.
FISCAL IMPACT:
Under the Purchase and Sale Agreement, the City will purchase the Subject Property Interests from the property owners for $10,150. Sufficient funds have been budgeted in Account No. 11813035650/1922181-0 for Fiscal Year 2021/22 to cover the purchase price and incidental costs related to the acquisition including escrow and title fees.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:

Following negotiation with the property owners, an agreement has been reached for purchase of the Subject Property Interests in the amount of $254,500.
Under the Purchase and Sale Agreement, the City will purchase the Subject Property Interests from the property owners for $254,500.

SUBJECT: Consideration to Receive and File Report on the Measures Taken to Alleviate the Conditions Which Led the City of Rancho Cucamonga to Enact Interim Urgency Ordinance No. 980 on April 21, 2021, Establishing a Moratorium on the Approval of Building Permits or Other Entitlements for New Service Station Uses or the Expansion of Existing Service Station Uses in the City of Rancho Cucamonga. (CITY)
RECOMMENDATION:
Staff recommends the City Council issue the attached report in conformance with California Government Code Section 65858 on the measures taken by the City to alleviate the need for Interim Ordinance No. 980.
BACKGROUND:
At the regular City Council meeting of March 17, 2021, the City Council directed the City Manager to research and compile information about service stations in the City related to the following topics of concern:
The number and location of existing service stations in the city; Analysis of the land use benefits of service stations to the community; Analysis of the fiscal benefits of service stations and how this compares to other retail uses; Land use impacts of service stations on the surrounding commercial districts and/or residential neighborhoods;
Costs to the City of providing service at service station locations, particularly calls for public safety services;
Land use policies that will be included in the General Plan update the City is currently preparing and which will be available in draft form within the next month; and Possible performance stations and/or conditions that could be placed on service station projects in the future.
On April 21, 2021, the City Council conducted a special study session during which they received a report prepared by staff that described the impacts of service stations in the City. The City Council then discussed these impacts, the moratorium’s purpose, and the applicability/timing of the moratorium. At their regular meeting on that date, the City Council subsequently adopted Urgency Ordinance No. 980 establishing an interim urgency zoning Ordinance, pursuant to Government Code Section 65858, establishing a moratorium on the approval of applications for
1 1
6 7
building permits or other entitlements for new service station uses or the expansion of existing service station uses in the City. The temporary interim urgency ordinance was extended to April 20, 2022 on June 2, 2021 (as it would have expired on June 5, 2021 otherwise).
ANALYSIS:
Section 65858(d) of the California Government Code provides that, “Ten days prior to the expiration of that interim ordinance or any extension, the legislative body shall issue a written report describing the measures taken to alleviate the condition which led to the adoption of the ordinance.” The 10-day report does not modify nor extend the City’s existing moratorium related to service stations. Rather, issuance of the 10-day report satisfies a statutory step in the process to permit the City Council to consider that potential extension at its next regular meeting on April 6, 2022. The following specific activities are currently being undertaken to alleviate the conditions which led to the adoption of Interim Ordinance 980.
The City adopted an updated General Plan on December 15, 2021. The new General Plan incorporates a refined set of goals and policies to implement the City’s vision for land and economic development. It also included new land use designations that the development of new service stations may be inconsistent with. To implement the goals and policies of the General Plan, the City is now in the process of updating the Zoning Map and the Development Code to incorporate appropriate land use regulations and technical/design standards for all types of development within the City.
As a part of this effort, the City is in the process of identifying updates that will specifically address the development and operation of service stations. In considering land use and zoning provisions for service stations, staff has been, and will continue to, evaluate whether the City’s residents and visitors are adequately served by the 32 existing service stations in the City and 2 other service stations that are under construction. This will assist in determining whether there is a need for more service stations. Or, if the needs of the City are being met, that the City has reached a saturation point with service stations. As the City becomes more “built-out” there is less vacant land available for development that will fulfill the City Council’s and community’s vision for ‘A World Class Community.’
Thus, the answers to this evaluation also will be critical in shaping the next phase of development, and the pattern of that development, in the City for decades into the future. Most of the remaining vacant land in the City is surrounded by existing development that are considered “sensitive” uses such as residential neighborhoods, schools, and parks. As a result, it has become more important and relevant to consider surrounding uses and context/compatibility when reviewing proposals for service stations. Their location near sensitive uses increases the risk of contaminant exposure to vulnerable populations. This problem is magnified in instances where a service station may become obsolete and become a “brownfield” site, i.e. a property of which the expansion, redevelopment, or reuse may be complicated by the presence or potential presence of a hazardous substance(s), pollutant(s), or contaminant(s). Exposure to the types of contaminants that are present, or are potentially present, at service stations threatens the public health, safety or welfare of neighboring sensitive uses.
This outcome is not accounted for in the City’s current land use regulations and, as a result, they will be updated. A disproportionate amount of the City’s existing service stations uses are concentrated in the southwest and central areas of the City. The proliferation of service stations in these areas of the City inequitably increases health risks for the residents of in these locations due to the potential contaminants present at service stations. Under consideration will be where service station uses are designated as a permitted or conditionally permitted use in the City’s
1 1
6 7
General Plan and Zoning Map, and how such uses are regulated in the Development Code. The purpose of this will be minimize the undue concentration of service stations in any one area of the City. The updates to these documents also will include an analysis of the land use compatibility of service stations with sensitive uses. Further analysis will be conducted on the contribution of service stations to the fiscal vitality of the City and demand for public safety services generated by service stations.
These topics are both further discussed below:
Staff is researching the fiscal impacts of existing service stations in the City. Staff will be evaluating, for example, the sales tax revenue of each of the existing and potential service stations in the City and comparing their fiscal performance with other commercial uses that could potentially be developed on the property. Based on staff’s preliminary analysis, the collective sales tax revenue of the existing service stations in the City has been generally trending downward.
Staff also will be researching, for example, the tax revenue generated by service stations in other cities to see how they compare the revenue generated in the City. Note that trends in changing technology may further erode and depress sales tax revenue. As part of staff’s efforts, there will be an evaluation of service stations fiscal performance in this context and whether such uses could become obsolete. Staff will also be evaluating the fiscal performance of service stations relative to the demand on public safety services (and the cost to provide them);
Staff is researching the demand for public safety services generated by existing service stations in the City. Based on staff’s preliminary analysis using data provided by the San Bernardino County Sheriff’s Department, total calls for service of any kind at service stations in the City have generally increased since 2016. There were 637 calls for service in 2016 compared to 1,059 calls for service in 2020. Data for 2021 is incomplete (but will be researched further to include the latter half of 2021 and 2022 to date) but by that point in time there were 135 calls for service. Over that 5-year period, this equates to an average of about 924 calls for service. Similarly, the time spent by deputies on these calls during the same period has increased from about 1,101 hours to about 2,455 hours. The average amount of time spent on location is about 1,870 hours. The number of calls for service and the time spent at service stations cause public safety resources to be used in a likely inefficient and potentially unsustainable manner.
Furthermore, service stations draw away an important and critical service from other areas of the City. Up to June 2021, there were a combined total of 4,754 calls for service for all service stations. The total calls for service are not equal among the various service stations. It is not yet clear why this disparity exists. As part of the evaluation of the demand for public safety services, staff will reach-out to representatives from the Sheriff’s Department to determine what they believe are the underlying causes for the increase in calls and time spent on location. Staff will also be researching the operating characteristics of all 32 service stations (and eventually the 2 service stations that are under construction) in the City. Staff believes that the disparity in total calls for service may be due to service stations having different operating characteristics. For example, if a service station sells alcohol; is open 24 hours; has accessory uses such as a car wash or a restaurant; or provides services such as vehicle repair, then staff will utilize that information to determine the relationship with demands
1 1
6 7
on public safety resources. If necessary, staff will develop new regulations and standards that will allow public safety resources to be used more efficiently and sustainably. Staff is researching how conventional service stations may be affected by:
a. Advancements in electric vehicle (EV) technology such as increases in their range due to more efficient batteries;
b. The adoption of EVs as a practical alternative to fossil fuel powered vehicles due to the introduction of chargers that bring the batteries of EVs to a full charge faster or batteries that have the capacity to power heavier vehicles such as trucks; c. The availability of a variety different mobility options, or the preference for them, such as ridesharing services and mass transit; and
d. New government regulations restricting or prohibiting the sale of vehicles with conventional combustion engines at a specified time in the future. Staff is drafting amendments to the Development Code, and other relevant documents as necessary, related to technical/design standards and requirements for service stations within the City for consideration by the Planning Commission and City Council by April 2023. As part of this process, staff will be developing new regulations such as those that would, for example, regulate physical requirements such as the number of service stations at street intersections and the minimum distance, or separation, between services stations; regulate operating conditions such as the hours that service stations are open and whether they sell alcohol; and determine what accessory uses or services could (or if the City prefers, should) be included with service stations such as the sale of fresh food.
As part of this effort, staff has been reviewing the municipal/development codes of neighboring jurisdictions to determine how they regulate service stations and the technical/design standards that those communities apply to them. Similarly, staff has been researching how older, built-out communities manage service stations within their jurisdictions. When possible, staff will contact their counterparts at these other jurisdictions to discuss their experiences with service stations.
The above reflect the actions taken since the adoption of Interim Ordinance No. 980. The City Council must issue the attached report that describes these actions in order to extend the interim urgency ordinance currently in effect. An opportunity for full public comment on the extension of Interim Ordinance No. 980 will be provided at the City Council's Public Hearing to be held on April 6, 2022 prior to the City Council’s consideration of an ordinance to extend Interim Ordinance No. 980.
FISCAL IMPACT:
None.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
The measures taken to alleviate the need for Interim Ordinance No. 980 will ensure that the City will fulfill its mission and vision as guided by the City Council’s core values such as providing and nurturing a high quality of life; promoting and enhancing a safe and healthy community; intentionally embracing and anticipating the future; and relentlessly pursuing improvement.

SUBJECT: Public Hearing for the Approval of the Draft Substantial Amendment to the 19-20, 20-21, and 21-22 Annual Action Plans for the Community Development Block Grant (CDBG) Program. (CITY)
RECOMMENDATION:
Staff recommends that that the City Council:
1. Conduct a public hearing to receive comments concerning the draft Substantial Amendments to the 19-20, 20-21, and 21-22 Annual Action Plans for the Community Development Block Grant (CDBG) funds.
2. Approve the Substantial Amendments to the 19-20, 20-21, and 21-22 Action Plans, and authorize the City Manager, or designee, to submit the plan and any necessary amendments to the plan to the United States Department of Housing and Urban Development (HUD).
3. Authorize the City Manager, or designee, to negotiate, execute, and amend contracts with subrecipients, developers, or professional service providers as necessary to implement CDBG funds under the approved projects identified in the Substantial Amendments to the Action Plan.
4. Authorize the City Manager, or designee, to execute, amend, and submit to the United States Department of Housing and Urban Development all plans and documents necessary to administer the Amended 2021-2022 CDBG projects.
BACKGROUND:
The U.S. Department of Housing and Urban Development (HUD) requires all entitlement communities receiving Community Development Block Grant (CDBG) funds, such as the City of Rancho Cucamonga, to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development actions. The City’s current 2020-2024 Consolidated Plan, which was approved in April 2020 and later amended in January 2021, encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities. Per the City’s Citizen Participation Plan (CPP), a Substantial Amendment to a Consolidated Plan and Action Plan is required when a “substantial” change is proposed as it relates to funding priorities, proposed activities, goals, and objectives.

ANALYSIS:
In 2008, the City received funds under the Neighborhood Stabilization Program (NSP) which Congress created to counteract the negative consequences of the foreclosure crisis brought about by the housing market collapse. Since its inception, the City has expended all its NSP grant funds and closed out the program during the 2022 calendar year. This created program income in the amount of $959,404.00 from NSP that could be reprogramed to CDBG activity.
This substantial amendment to the 2019-2020, 2020-2021 and 2021-2022 Action Plans is necessary because the City is proposing to a) allocate $548,747 in prior year uncommitted CDBG funds, and (b) transfer $959,404 of NSP program income to the City’s newly proposed 2021-2022 CDBG Concrete Rehabilitation Project. The Concrete Rehabilitation Project has been identified as a shovel ready project that would enable the City to provide a suitable living environment, and expand economic opportunities in Southwest Cucamonga.
FISCAL IMPACT:
There will be no negative impact to the City’s General Fund. The Amendment to the 19-20, 20- 21, and 21-22 Action Plan propose to use uncommitted CDBG funds in the amount of $548,747 and NSP Program Income of $959,404.00. The following appropriation is requested from CDBG fund balance to 1204314-5650/2105204-0 in the amount of $1,508,151.00.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
While approval of the Draft Substantial Amendment to the 2019-2020, 2020-2021 and 2021-2022 Annual Action Plan is not a specific goal of the City Council, this action does help carry out the Council’s core values. This action allows the City to work towards promoting and enhancing a safe and healthy community for all.

Draft Action Plan Substantial Amendment 1
Executive Summary
Background
The U.S. Department of Housing and Urban Development (HUD) requires all entitlement communities receiving Community Development Block Grant (CDBG) funds, such as the City of Rancho Cucamonga (City), to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development actions. The City’s current 2020 -2024 Consolidated Plan, which was approved in April 2020 and later amended in January 2021, encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities.
The Consolidated Plan is carried out through Annual Action Plans which provide a concise summary of the actions, activities, and the specific federal and non-federal resources that will be used each year to address the priority needs and specific goals identified in the Consolidated Plan. As of the date of this document, the City is current in its 2
nd year of its Consolidated Plan cycle.
In addition, in 2008, the City received funds under the Neighborhood Stabiliza tion Program (NSP) which Congress created to counteract the negative consequences of the foreclosure crisis brought about by the housing market collapse. Since its inception, the City has since expended all its NSP grant funds and anticipates closing out the program during the 2022 calendar year. As part of the NSP closeout process, the City is allowed to transfer program income it generated under the program, over to the CDBG program to be repurposed for CDBG eligible activities.
Per the City’s Citizen Participation Plan (CPP), a Substantial Amendment to a Consolidated Plan and Action Plan is required when a “substantial” change is proposed as it relates to funding priorities, proposed activities, goals, and objectives. This substantial amendment to the 2019-2020, 2020-2021 and 2021-2022 Action Plans (Action Plans) is necessary because the City is proposing to a) allocate $548,747 in prior year uncommitted CDBG funds, and (b) transfer $959,404 of NSP program income to the City’s newly proposed 2021 -2022 CDBG Concrete Rehabilitation Project.

INITIATED BY: Lori Sassoon, Deputy City Manager/Administrative Services Linda A. Troyan, MMC, Director of City Clerk Services
Patricia Bravo-Valdez, MMC, Deputy Director of City Clerk Services SUBJECT: Consideration of First Reading of Ordinance No. 997, to be Read by Title Only and Waive Further Reading, Adjusting the Boundaries of the Four City Council Districts and Adopting a New Official Council District Map Based on the Results of the 2020 Decennial Census. (CITY) RECOMMENDATION:
Staff recommends that the City Council introduce for first reading Ordinance No. 997, to be read by title only and waive further reading, adjusting the boundaries of the four City Council Districts and adopting a new official Council District Map for the City of Rancho Cucamonga based on the results of the 2020 decennial census.
BACKGROUND:
On November 8, 2016, the voters of Rancho Cucamonga approved Ordinance No. 887, providing for the election of four members of the City Council by four districts, with a Mayor elected at large, and establishing the boundaries and election order of each district. At that time, the Council districts were drawn using the 2010 Census data as was required by law.
Following each U.S. Census, which occurs every ten years, cities with by-district election systems must use the new census data to review and, if needed, redraw district lines to reflect how local populations have changed. This process, called redistricting, ensures all districts have nearly equal population.
By law, the City must hold at least four (4) public hearings that enable community members to provide input on the drawing of district maps. At least one hearing must occur before the city or county draws draft maps. At least two public hearings must occur after the drawing of draft maps.
The Government Code requires that a final map be adopted and submitted to the County no later than April 18, 2022.
The City scheduled five (5) hearing dates for the Council Redistricting process and conducted extensive community outreach efforts. Four public hearings took place on September 15, 2021, November 3, 2021, January 19, 2022, February 2, 2022 and on March 2, 2022 at 8:00 PM.
Recordings and informational materials for those hearings are available at www.drawrc.org.
The districts must be redrawn using the 2020 census data and in compliance with the Fair Maps Act, which was adopted by the California Legislature as AB 849 and took effect January 1, 2020.
Under the Act, the Council shall draw and adopt boundaries using the following criteria in the listed
1 1
5 3
order of priority in accordance with Elections Code 21601(c):
1. Comply with the federal requirements of equal population and the Voting Rights Act
2. Geographically contiguous
3. Undivided neighborhoods and “communities of interest” (socio-economic geographic areas that should be kept together)
4. Easily identifiable boundaries
5. Compact (do not bypass one group of people to get to a more distant group of people)
6. Shall not favor or discriminate against a political party Once the prioritized criteria are met, other traditional districting principles can be considered, such as:
1. Minimize the number of voters delayed from voting in 2022 to 2024

3. Future population growth
One map was submitted by the public through the public participation process. This map submittal was provided to the City Council with the February 2, 2022 City Council meeting Staff Report, including the City’s demographer’s review of the map, with the associated data.
At the City Council Meeting on February 2, 2022, the City Council gave direction to move forward with Map 105 as its preferred map and directed staff to prepare the final map and ordinance for first reading at its March 2, 2022 City Council meeting.
At the March 2, 2022 public hearing meeting, Mayor Michael informed the City Council that he had received several written comments requesting a minor revision to the proposed map to include certain residents in the Alta Loma in District 1 instead of District 4. The small area to be included in District 1 is bordered between the 210 Freeway to the north, Haven Avenue to the east, Hermosa Avenue to the west and 19 th Street to the south. The City Council directed staff to publish the revised map based on the public input received so that the City Council could consider its adoption at the March 16, 2022 meeting.
Additionally, and in accordance with the Mutual Release and Settlement Agreement and Amendment entered with the Southwest Voter Registration Project (“SVREP”) and Louisa Ollague (Collectively “Plaintiff”), the City submitted a draft map to the Plaintiff on October 29, 2021 for their review and consideration. Subsequently, ongoing discussions and reviews took place. The preferred map was developed, and the parties indicated their agreement to submit this map to the City Council in accordance with the settlement agreement. Following the March 2, 2022 public hearing, the proposed map revision was submitted to the Plaintiff, and no further comment has been received as of the publication of this report. The proposed change to the preferred map does not impact District 2 demographics, which were a primary concern of the Plaintiff.
ANALYSIS:
The preferred map is in compliance with the various legal requirements as noted above and is now proposed for adoption. Election sequencing has not changed and will be in accordance with Rancho Cucamonga Municipal Code Section 2.11, which in summary provides that elections for the Council seats in Districts 2 and 3 will be held every four years beginning in November 2018, along with the election of Mayor. The elections for Districts 1 and 4 will be held every four years beginning in November 2020. The district numbers in proposed map align with the current district numbers of districts that generally align with the same territory.

5 3
Some of the major components and highlights of the proposed map include:
Having a balanced population between districts in accordance with applicable legal standards;
Having compact geographical shapes for Fair Map Act purposes and requirements; Avoids separating communities of interest; maintains the more modern/post incorporation of planned communities of Terra Vista and Victoria more fully intact in District 3;
Pushes District 2 boundary north of Foothill all the way to Base Line between Hellman and Hermosa for optimum density, and creating an area of highest Latino Citizen Voting Age Population (CVAP) at 44%;
District 4 boundary is revised for better population balance between Districts; The attached ordinance is presented for the City Council’s consideration in adopting the preferred map as the City Council District Map. As was the case with the original preferred map, this revised map meets the required federal and state criteria and would make minimal changes to the existing City Council District boundaries.
No additional public comments have been received since the last hearing date.
FISCAL IMPACT:
None.
COUNCIL MISSION / VISION / GOAL(S) ADDRESSED:
