I1. COUNCIL ANNOUNCEMENTS
Council Member Hutchison announced he attended meetings the day before in the City of Rancho Cucamonga and earlier that same day in the City of Fontana where he received updates on Brightline West’s high-speed rail project.

Council Member Scott spoke about the regional benefits and opportunities that will be offered through the high-speed rail project.

Mayor Pro Tem Kennedy spoke about the new high-speed rail project and it being an economic driver for the region and announced she was appointed as President of ConFire and looks forward to serving in that capacity.

Council Member Hutchison spoke about NFL player Damar Hamlin’s injury and first responders aid with an AED defibrillator and requested an opportunity to renew the understanding of AEDs, CPR, and the City’s mobile application.

City Manager Gillison responded that this item would return at a future city council meeting as a presentation.

Staff recommends that the City Council/Board of Directors of the Fire Protection District make the following findings in order for the City’s legislative bodies to continue meeting virtually: (1) the City Council has reconsidered the circumstances of the COVID-19 state of emergency; and (2) the COVID-19 state of emergency continues to directly impact of the ability of the members of the City’s legislative bodies to meet safely in person.

BACKGROUND:

On March 4, 2020, Governor Newsom proclaimed a state of emergency to exist in California due to the spread of COVID-19. This proclamation is still in effect. The Governor subsequently issued numerous executive orders suspending or modifying state laws to facilitate the response to the emergency. Among other things, these executive orders superseded certain Brown Act requirements and established special rules to give local public agencies greater flexibility to conduct teleconference meetings. The special rules included provisions allowing local public agencies to conduct teleconference meetings without having to provide a physical location from which the public may attend or comment; without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. Those special rules expired on September 30, 2021.

On September 16, 2021, in anticipation of then-imminent expiration of his special rules for teleconference meetings, Governor Newsom signed AB 361. In key part, this bill amends the Brown Act to establish special requirements for teleconference meetings if a legislative body of a local public agency makes two findings pursuant to Government Code Section 54953(e)(3). Like the special rules in the Governor’s executive orders, the special Brown Act requirements in AB 361 include provisions allowing public agencies to conduct teleconference meetings without having to use teleconference locations that are publicly accessible; and without having to identify teleconference locations on the agenda. The AB 361 special Brown Act requirements are scheduled be repealed on January 1, 2024.

In order for a local public agency to be subject to the AB 361 special Brown Act requirements for teleconference meetings, a legislative body of a local public agency first must make a finding that it has “reconsidered” the circumstances of a declared state of emergency. Second, there must be

a finding that such emergency continues to directly impact the ability of legislative body members to meet safely in person. Alternatively, for the second finding, there must be a finding that state or local officials continue to impose or recommend social distancing measures. These findings must be made within 30 days after the first teleconference under AB 361 and on a monthly basis thereafter.

ANALYSIS:

Due to the continuing, rapid spread of the variants of COVID-19, staff is recommending that the City Council make the necessary findings in order to continue holding teleconference meetings.

The findings were first made at the January 5, 2022 City Council meeting. Federal and state officials continue to recommend social distancing measures, including limiting in-door gatherings, in order to limit the spread of COVID-19 variants.

It is expected that virtual meetings will only be conducted pursuant to AB 361 where a City Council Member or other member of a commission/committee is unable to meet in person due to exposure to COVID-19. Under AB 361, the public must also be given an opportunity to participate in a virtual meeting via a teleconference option, and the amended agenda provides call-in information.

However, the public will continue to be permitted to attend the meeting in person. It is unclear if future meetings will require teleconferencing.

FISCAL IMPACT:

There is no fiscal impact caused by this item. The City already has the necessary equipment to hold a teleconferenced meeting.

Staff recommends that the City Council approve the 2022 Annual Review of the subject Development Agreement (“Agreement”).

BACKGROUND:

On January 19, 2022, the City Council adopted Ordinance 993, approving a Development Agreement (Case No. DRC2021-00175) setting forth additional terms for the development of two new industrial buildings totaling 655,878 square feet on a 35-acre project site located approximately 650 square feet east of Etiwanda Avenue and North of Napa Street.

Per Section 13 of the Agreement: Annual Review, during the term of the Agreement, the City shall annually review the extent of the good faith compliance by Property Owner with the terms of this Agreement. The property owner is required to file an annual report with the City indicating information regarding compliance no later than sixty (60) days prior to the anniversary of the effective date.

ANALYSIS:

The property owner has submitted a letter dated December 20, 2022 for calendar year 2022 (Attachment 2) and have complied with the following provisions and provided the annual review below:

FISCAL IMPACT:

Per the agreement, the Property Owner has provided the first installment (Payment 1) of the Community Benefit Fee in the amount of $2,150,000.

ne key accomplishment during this time involved the completion of the protective slab over the 12’ diameter Metropolitan Water District (MWD) water line. This is most notable because, with the slab in place, the general contractor has unimpeded access to the s ite for heavy equipment needed to lift wall panels.

lso of note were the extensive efforts to ensure compliance with various environmental mitigation meas ures required under the California Environmental Quality Act (CEQA). These efforts include d habitat surveys for birds such as the Burrowing Owl and Least Bell’s Vireo, erosion control, and lead/asbestos remediation.

pon complying with these measures , clearing and grubbing of the site and pre -watering were initiated during the 3 rd quarter in preparation for grading activity. Preliminary work on removal of the SC Edison poles was commenced in this period and coordination of annexation to various Community Facilities Districts (CFDs) was also initiated commensurate with the requirements of the Development Agreement.

uring the 4th quarter, rough grading and pad certification were commenced on both Building A and Building B. The next quarter will focus on the building structure s (slab, pad footings, forming and pouring of concrete walls and lifting panels).

BACKGROUND:

On January 22, 2020, the Planning Commission approved Case No. SUBTT20118 for the subdivision of a vacant 39.68-acre parcel into eight (8) numbered lots for condominium purposes for the development of 867 for-rent apartments.

On December 15, 2021, City Council approved an Improvement Agreement and associated securities to guarantee the construction of the public improvements in the following amounts:

Although the project is substantially complete, the developer is working to fully complete small portions of the improvements near the project’s perimeter. The developer anticipates all improvements to be completed within this year.

If approved, the Improvement Agreement would be extended until December 15, 2023.

ENVIRONMENTAL ANALYSIS:

It is recommended that the City Council approve and declare the listed computers, monitors, miscellaneous equipment, and vehicles that have been deemed no longer needed, obsolete or unusable as surplus.

BACKGROUND:

The City Council has provided authorization to the Procurement Manager request to dispose of City items that have been deemed as obsolete and unusable for City use. Methods for disposing of surplus are to exchange for or trade in on new supplies, transfer to another department, or offer for sale on a competitive bid basis. After a reasonable effort, and if no bids have been received, Procurement may dispose of surplus for the highest scrap value. The City may sell surplus property to any other governmental agency at a fair market value without any other bids or donate surplus property to any agency or entity which is exempt from federal income tax, with the approval of City Council.

ANALYSIS:

The items to be considered for surplus at this time were submitted by the Department of Innovation and Technology, Community Services, Library, and Engineering. Proposed surplus items include computers, monitors, miscellaneous equipment, and vehicles deemed no longer needed, obsolete or unusable. Staff recommends Council approve the disposal of these items through auction or best method ads determined by the Procurement Manager.

FISCAL IMPACT:

To date, in FY 22/23, surplus has accumulated $38,763.96 in sales through the Public Surplus auction site.

RECOMMENDATION:

Staff recommends that the City Council:

1. Approve the specifications for the Traffic Signal Battery Backup System Replacement FY 22-23 Project.

2. Accept the bids received for the Project.

3. Award and authorize the execution of a contract in the amount of $260,150.00 (Base Bid plus Additive Bids 1 and 2) for the “Traffic Signal Battery Backup System Replacement FY 22-23 Project” to the lowest responsive bidder, Yunex LLC, of Riverside, California. A copy of the contract can be found in the City Clerk’s office.

4. Authorize the expenditure of a contingency in the amount of $17,350.00.

BACKGROUND:

The purpose of a traffic signal battery backup system (BBS) is to provide electrical power to a traffic signal so it will operate in red flash mode during a power outage. This allows the traffic signal to temporarily operate in four-way flash during an outage. The Public Works Services Department is proactively replacing existing BBS that have exceeded their ten-year life expectancy and are no longer supported by the manufacturer. Rather than waiting for a BBS to fail and replacing it on an emergency basis, proactively replacing BBS reduces the replacement cost and minimizes the time the signalized intersection will be blacked out.

This project is the fifth phase in a multi-phase project. To date, we have replaced one hundred fifty-two (152) BBS. Phase Five will replace twenty-two (22) BBS, totaling one hundred seventy- four (174) BBS completed in the first five phases. The remaining fifty-four (54) BBS will need to be replaced in the final phases.

ANALYSIS:

Six (6) bids for this project were opened at 2:00 pm on Tuesday, December 13, 2022, see Attached 1 - Bid Summary. Staff has completed the required background investigation and finds that the lowest responsive bidder, Yunex LLC. of Riverside, California has met the requirements of the bid documents. The project budget is sufficient to award the Base Bid along with Additive

Bids 1 and 2 to the lowest responsive bidder. This will replace the BBS for a total of twenty-two (22) signalized intersections, eighteen (18) as part of the Base Bid plus two (2) for Additive Bid 1 and two (2) for Additive Bid 2. The project is scheduled to be completed in forty-four (44) working days; thirty-six (36) working days for the Base Bid items and eight (8) additional working days for the intersections listed in awarded Additive Bids 1 and 2. Working days are defined as Monday through Thursday for this project.

FISCAL IMPACT:

The Fiscal Year 2022/2023 Adopted Budget includes $277,500 for traffic signal battery backup system replacements. The funding breakdown is shown in the following table:

SUBJECT: Consideration of a Contract with AMC Builders, Inc. for the Heritage Park Equestrian Center Roof Repair Project in the Amount of $132,251. (CITY) RECOMMENDATION:

Staff recommends the City Council approve the plan and specifications, accept the bids received, award and authorize the execution of a contract in the scaled down amount of $132,251.00 for the “Heritage Park Equestrian Center Roof Repair Project” to the lowest responsive bidder, AME Builders, Inc. of Pomona, California; authorize the expenditure of a contingency in the amount of $17,749.00 and appropriate $150,000 from PD 85 fund balance to account 1848303-5607.

BACKGROUND:

This project involves removing, protecting then later re-installing the existing undamaged roof tiles, disposing of damaged roof tiles, and installing new roof tiles to replace any damaged or missing roof tiles; removing and replacing the underlayment and metal trim; removing and replacing all the wood facia and trim; and painting the new facia, trim and any exposed wood framing and other related work. This work will be done for both the upper and lower roofs of the equestrian center.

ANALYSIS:

Two (2) bids for this project was/were opened at 2:00 pm on Tuesday, December 13, 2022 (see attached Bid Summary). Staff has completed the required background investigation and finds that the lowest responsive bidder, AME Builders, Inc. of Pomona, California, has met the requirements of the bid documents. The project is scheduled to be completed within forty-five (45) working days.

Due to existing access restrictions (corrals to the north and south, trees to the west and bridge weight restriction to the east), the roof repair work must be done in phases. Staff is requesting a contingency of $17,749.00 in the event of something unexpected being discovered during construction.

A copy of the project contract can be found at the City Clerk’s Office.

FISCAL IMPACT:

Originally, funding ($150,000) was included in the Fiscal Year 2021/2022 adopted budget for this project in account number 1848303-5607 (PD 85). Unfortunately, the contracts for design consultants / architectural services for multiple firms were not approved until March 2022, which

meant that the project plans and specifications could not be completed in time to bid and award this project before the end of Fiscal Year 2021/2022. To award this project, appropriation is requested from PD 85 fund balance in the amount of $150,000 to account number 1848303-5607.

COUNCIL MISSION / VISION / VALUE(S) ADDRESSED:

The equestrian center is a valued component of the City’s equestrian community. By repairing the center’s roof, this project addresses the City Council goal of providing and nurturing a high quality of life for all.

SUBJECT: Consideration of the 2022 Annual Review of the Development Agreement by and between SC Rancho Development Corp., a California Corporation and Empire Lakes Holding Company, LLC, a Delaware Limited Liability Company and the City of Rancho Cucamonga, Case No. DRC2015- 00118. (CITY)
RECOMMENDATION:

Staff recommends that the City Council approve the 2022 Annual Review of the subject Development Agreement (“Agreement”).

BACKGROUND:

On September 5, 2018, the City Council adopted Ordinance 934, approving a Development Agreement (Case No. DRC2015-00118) setting forth additional terms for the development of the Empire Lakes Golf Course (now referred to as The Resort). Per Section 14 of the Agreement:

Annual Review; during the term of the Agreement, City shall annually review the extent of the good faith compliance by Property Owner with the terms of this Agreement. Property owner is required to file an annual report with the City indicating information regarding compliance no later than January 7 for the previous calendar year.

ANALYSIS:

The property owners have submitted a letter dated January 9, 2023, for calendar year 2022 (Attachment 2) and have complied with the following provisions and provided the annual review below:

analysis to the City documenting the traffic impact
nexus of the Project’s for-sale single-family
detached units and condominium units relative to
the “Residential Multi-Family Attached” product for
purposes of calculating development fee impact

to the City for review and approval. The analysis
was presented to and approved by the City
Council on November 20, 2019.

This obligation has been satisfied

The JUPF is located within development Phase 2

Street and a future street is expected to be named
the “Resort Parkway” as shown on Exhibit B to the
Agreement (the “Parcel”). The offer of dedication
shall occur by separate instrument within ninety
(90) days after (i) Property Owners have
completed full public street improvements
adjacent to the Parcel, or (ii) Property Owners
have obtained a building permit for the 2,000th
residential dwelling unit within the Property,
whichever occurs first.

Owners concurrent with, or prior to, the issuance

irrevocable offer of dedication of the Parcel and
full payment of the Outstanding Full Amount,
provided that City has issued certificates of
occupancy for, and commercial uses occupy, at
least 22,500 square feet of non-residential building
construction located south of 6th Street.

Section 11 (D) was amended by the First
Amendment to Development Agreement on
October 7, 2020 as follows:

City shall commence development of the JUPF
within eighteen (18) months of Property Owners’
irrevocable offer of dedication of the Parcel and
full payment of the Outstanding Full Amount,
provided the City has issued certificates of
occupancy for at least 22,500 square feet of non-
residential building space and 2,000 residential
dwelling units within the Subject Property.

The threshold for this obligation has not yet been
met.

Section 12 – Public Art – Property owners agree
to participate in the City’s Public Art Program and
comply with all the requirements of Chapter

17.124 of the Municipal Code and Ordinance No.
912.

On January 31, 2019, Property Owners
submitted an “Application for Installation of
Artwork on Public Property” detailing the artwork
to be installed south of 6th Street. The artwork
has a total value of $1,216,901. Additional public
art has been installed along the west side of the
Resort Parkway. Artwork in the “Outdoor Room”
area of the project was completed.

This obligation has been satisfied.

Section 13 (A) – Camp Improvements – Property
Owners shall improve an approximately 1.30-acre
private park within Planning Area N-15 (the Camp)
with the development of Phase 2 of the Project
(north of 6th Street) and not later than the issuance
of a building permit for the 2,000th dwelling unit
The Specific Plan Amendment was approved on
May 18, 2022, by the Planning Commission and by
the City Council on June 15, 2022. By the terms of
the First Amendment to the Development
Agreement upon adoption of the new Framework
Plan by the City, the requirement to construct a

within the Project.

In the First Amendment to Development
Agreement Recital D, the City acknowledges that
the implementation of the Framework plan (as
contemplated in the First Amendment) would
eliminate the available location and need for the
Camp under section 13.A of the Original
Agreement, therefore, City acknowledges that
Sections 13.A, 13.C and clause (iii) of Section

13.B in the Original Agreement related to the Camp
should terminate if the Framework Plan is approved
by the City. In January 2021, Property Owners
submitted a Specific Plan Amendment to the City to
implement the Framework Plan which eliminated
the camp.

1.3-acre private park within Planning Area N-15,
was eliminated.

Section 13 (B) – Formation of Property Owners
Association. Prior to issuance of the first building
permit for the Project, Property Owners shall record
a declaration of covenants, conditions, and
restrictions (“CCR’s”) for the Subject property that
forms a master property owners association (the
“Association”)
The Master Declaration of Covenants, Conditions
and Restrictions and Reservation of Easements
for The Resort was recorded in the official
records of the County of San Bernardino on
November 30, 2018.

This obligation has been satisfied as it relates
to Phase 1 of the Project for the homes south of
6th Street.

Section 2.2 – Specific Plan Amendments (from First
Amendment to Development Agreement)
(A) Interim Access Condition – City agrees to
process an amendment to the Specific
Plan in order to modify Section 7.0 of
Appendix A to the Specific Plan to delete
the Interim Access Condition requirement
for construction of an interim access
connection between 4th street and the
existing intersection of Anaheim Place and
7th Street prior to the issuance of the
400th certificate of occupancy in Phase 1
of the Project.
(B) Street Framework – if the City Council
approves a Specific Plan amendment,
which will be processed separately from
the Specific Plan amendment in Section

2.2 above, relating to the street network,
alignments and connections within
Planning Area 1 that substantially complies
with the Framework Plan attached as
Exhibit B, then (iii) Sections

13.A and 13.C and clause (iii) of Section

13.B in the Original Agreement related to
the Camp shall terminate and the Camp
shall cease to be a part of the Project.

The Amendment to the Specific Plan deleting the
condition requiring the construction of an interim
access road was approved by the City Council on
September 16, 2020.

The Specific Plan amendment for the Framework
Plan was submitted by Property Owners to the City
in January 2021. The specific Plan Amendment
was approved by the Planning Commission on
May 18, 2022, and by the City Council on June 15,
2022. Pursuant to the terms of the First
Amendment to the Development Agreement, the
obligation to construct The Camp was terminated
and The Camp is no longer part of the Project.

ENVIRONMENTAL ANALYSIS:

Pursuant to the California Environmental Quality Act (CEQA) the City certified an Environmental Impact Report (EIR) SCH No. 20150410083 on May 18, 2016 which analyzed the potential environmental impacts of the Project and related approvals.

FISCAL IMPACT:

Per the agreement, Offset DIFs (Development Impact Fees), includes the amount of Police DIFs, Library DIFs, and Community and Recreation Center DIFs collected within the service area.

Under the agreement, Offset DIFs are credited toward the construction of a Joint Use Public Facility (JUPF) conditioned to be funded by the master developer. At the time of the agreement, the developer and City agreed to an amount of $11,000,000 to be funded by the developer toward the JUPF in addition to the dedication of the land for the facility. This agreed-upon amount is increased annually at the end of each reporting year based upon the Engineering News Record (ENR) Construction Index. The increase to the ENR for reporting year 2022 is 7.6%.

This project includes 435 units that were permitted through calendar year 2022, 200 units in 2021, 208 units in 2020, and 103 units in 2019. In total, 946 units have been permitted.

The Offset DIFS collected through the end of 2022 within the development (Zone 1) and the service area (Zone 2) as described in the agreement are shown in the following table:

Staff recommends the City Council:

1. Accept the Heritage and Etiwanda Creek Parks LED Sports Lighting Upgrade Project, Contract No. 2022-110, as complete.

2. Approve the final contract amount of $253,685.65.

3. Authorize the release of the Faithful Performance Bond and acceptance of Maintenance Bond.

4. Authorize the release of the Labor and Materials Bond in the amount of $248,000.00, six months after the recordation of said notice if no claims have been received.

5. Authorize the Public Works Services Director to file a Notice of Completion and release of the retention in the amount of $12,684.28, 35 days after acceptance.

BACKGROUND:

The Heritage and Etiwanda Creek LED Sports Lighting Upgrade Project scope of work consisted of the removal of existing light fixtures and their replacement with new LED light fixtures at the senior field at Heritage Park and the south football/soccer field at Etiwanda Creek Park plus other related items of work.

Pertinent information of the project is as follows:

ANALYSIS:

The subject project has been completed in accordance with the approved plans and specifications and to the satisfaction of the Public Works Services Director. The net increase in the total cost of the project is a result of two (2) Contract Change Orders (CCO). One CCO changed the voltage of the electrical circuits serving the Heritage Park sports field light poles from 277v single phase to 480v 3 phase. This increased the efficiency of the new lighting system. The second CCO involved the contractor crew changing out the light bulbs for the north football/soccer field at Etiwanda Creek Park. Since the contractor already had the necessary equipment on-site, the CCO costs were for the new light bulbs and the contractor crew time, eliminating the need for staff to complete this work in-house.

FISCAL IMPACT:

Originally, funding ($100,000 for each park) was included in the Fiscal Year 2021/2022 adopted budget for this project in account numbers 1848303-5607 (PD 85) and 1025001-5607 (Capital Reserve). Unfortunately, the contracts for design consultants / architectural services for multiple firms were not approved until March 2022, which meant that the project plans and specifications could not be completed in time to bid and award this project before the end of Fiscal Year 2021/2022. To award this project, Council, at its August 17,2022 meeting, appropriated $161,700 from the PD 85 fund balance (for Heritage Park) and $130,300 from Capital Reserve fund balance (for Etiwanda Creek Park).

THEREOF
A. Recitals.

1. The City of Rancho Cucamonga is proposing to amend existing development standards and create new development standards in order to better calibrate the Development Code to the vision of the General Plan and update the official Zoning Map to address technical zone changes.

2. The City is proposing to amend Title 17 of the Municipal Code and the official Zoning Map for certain properties that will be subject to zone reclassifications. The City has prepared two amendments for this purpose consisting of Municipal Code Amendment DRC2022- 00464 and Zoning Map Amendment DRC2022-00466, as described in the title of this Ordinance (hereafter referred to as the “Amendments”).

3. As shown in Exhibits “A” and “B,” the Amendments propose to amend Title 17 of the Municipal Code to establish new and updated development standards for various Articles within Title 17 of the Municipal Code and to amend the official Zoning Map to incorporate the proposed zone reclassifications.

4. On December 13, 2022, the Planning Commission of the City of Rancho Cucamonga conducted a noticed public hearing on the Amendments and concluded said hearing on that date.

5. On January 18, 2023, the City Council conducted a duly noticed public hearing on the Amendments, and all interested persons were given an opportunity to present oral and written evidence regarding the Amendments and concluded said hearing on that date.

6. All legal prerequisites prior to the adoption of this Ordinance have occurred.

B. Ordinance.

The City Council of the City of Rancho Cucamonga does ordain as follows:

1. Recitals. The City Council hereby specifically finds that all of the facts set forth in the Recitals, Part A, of this Ordinance are true and correct.

2. Findings. Based upon the substantial evidence presented to the City Council during the above-referenced public hearing on January 18, 2023, including written and oral staff reports, together with public testimony, the City Council hereby specifically finds as follows:

a. Per Section 17.22.040(C) of the Municipal Code, amendments to the Municipal Code and Zoning Map “may be approved only when the City Council finds that the amendment[s] are consistent with the General Plan goals, policies, and implementation programs.” The proposed Amendments are consistent with the following Land Use Element and Housing Element policies:
•Land Use LC-1.2: Quality of Place. “Ensure that new infill development is compatible with the existing, historic, and envisioned future character and scale of each neighborhood.”
•Land Use LC-1.4: Connectivity and Mobility. “Work to complete a network of pedestrian- and bike-friendly streets and trails, designed in concert with adjacent land uses, using the public realm to provide more access options.” •Land Use LC-1.9: Infill Development. “Enable and encourage infill development within vacant and underutilized properties through flexible design requirements and potential incentives.”
•Land Use LC-1.11: Compatible Development. “Allow flexibility in density and intensity to address specific site conditions and ensure compatibility of new development with adjacent context.”
•Housing H-1.3: Accessory Dwelling Units. “Facilitate the development of accessory dwelling units to provide additional housing opportunities pursuant to State law and established zoning regulations.”
•Housing H-5.1: Development Review Processes. “Consider new polices, codes, and procedures that have the potential to reduce procedural delays, provide information early in the development process regarding development costs, and charge only those fees necessary to adequately carry out needed public services and improvements.”
•Housing H-5.4: Development Standards. “Evaluate and adjust as appropriate residential development standards, regulations, and processing procedures that are determined to constrain housing development, particularly housing opportunities for lower and moderate income households and for persons with special needs.”
b. The Amendments identified herein have been processed, including, but not limited to, public notice, in the time and manner prescribed by State and local law, including the California Environmental Quality Act (“CEQA”).
c. Pursuant to the California Environmental Quality Act (“CEQA”) and the City’s local CEQA Guidelines, the City has prepared an addendum to the certified Final Environmental Impact Report (“FEIR”) (SCH #2021050261) prepared for the General Plan Update and Climate Action Plan. The addendum concludes that the proposed Amendments do not result in any new significant environmental effects or a substantial increase in the severity of previously identified significant effects beyond what was analyzed in the certified FEIR. No new information has become available and no substantial changes to the circumstances under which implementation of the General Plan has been undertaken since the certification of the FEIR have occurred. The proposed Amendments would not substantially increase the severity of effects relative to the environmental topics analyzed in the Certified FEIR, nor would the proposed Amendments require new mitigation measures or alternatives. Based on this evidence and all evidence in the record, the City Council concurs with the Planning Commission and Planning

Department staff’s determination that the Amendments will not have a significant effect on the environment and an addendum is the appropriate level of environmental review under CEQA. The City Council has considered the proposed addendum attached to the staff report accompanying the Amendments, along with the certified FEIR, and hereby adopts the addendum. d. The Amendments are consistent with the direction, goals, policies, and implementation programs of the General Plan, including without limitation, the Housing and Land Use Elements thereof, and will provide for development in a manner consistent with the General Plan.
e. Subject to the approval of the related amendments (General Plan Amendment DRC2022-00465) the Amendments do not conflict with the policies and provisions of the General Plan, Planned Community, Specific Plan, and/or Master Plan identified herein. f. The City Council finds that the Amendments serve the important purpose of providing sufficient development standards that will apply to various development types throughout the City and to better calibrate the Development Code and the official Zoning Map to the vision of the General Plan. The City Council further finds that the proposed Amendments protect the public health, safety, and welfare.
g. The findings set forth in this Ordinance reflect the independent judgment of the City Council.

3. Determination on Municipal Code Amendment DRC2022-00464. Based on the findings set forth in this Ordinance and the totality of the administrative record before it, the City Council hereby approves Municipal Code Amendment DRC2022-00464 set forth in Exhibit “A,” attached hereto and incorporated herein by reference.

4. Determination on Zoning Map Amendment DRC2022-00466. Based on the findings set forth in this Ordinance and the totality of the administrative record before it, the City Council hereby approves Zoning Map Amendment DRC2022-00466 as set forth in Exhibit “B”, attached hereto and incorporated herein by reference. The City Council hereby amends the official Zoning Map reflecting the amendments set forth in Exhibit B. For reference purposes, the updated official Zoning Map for Zoning Map Amendment DRC2022-00466 is also attached as Exhibit “C”.

5. The City Council declares that, should any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance for any reason is held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.

6. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published within in the manner required by law.

SUBJECT: Public Hearing of the Rancho Cucamonga Fire Protection District to Consider Fee Adjustments and Adopt Resolutions Approving Updated Fees and Authorizing Annual Adjustments on Certain Fees. (RESOLUTION NOS. 2023-002 AND 2023-003) (FIRE)
RECOMMENDATION:

Staff recommends that the Fire Board:

1. Conduct a public hearing on the proposed new and amended fees;

2. Adopt a Resolution to establish new fees, repeal outdated fees, and amend certain existing fees for Fire District user fees, and authorize annual adjustments to certain fees based on Employment Cost Index (ECI);

3. Adopt a Resolution to adopt and waive the collection of certain permit and inspection fees.

BACKGROUND:

The Fire District can impose fees under the authority granted by the California Government Code.

Fees are allowed to be imposed in order to recover costs associated with the provision of specific services benefiting the user, thereby reducing the use of General Fund monies for such purposes.

To impose fees, the Fire District must hold at least one public hearing as part of a regularly scheduled meeting to allow for public comment on the proposed fees.

As a matter of routine, City departments revisit fees at least once per year to ensure that small adjustments can be made over time to keep up with operational and construction costs. In accordance with this approach, the Fire District has reviewed fees to determine if adjustments are needed.

ANALYSIS:

Staff recommends establishing, revising, and adjusting various permit, inspection, and user fees, as detailed below.

Operating and Special Services Permits and Fees
In November 2022, the Fire Board adopted the 2022 California Fire Code together with local amendments and District standards, all of which constitute the Fire Code of the Rancho Cucamonga Fire Protection District. As a result of these amendments, new permits and

inspection fees must be adopted. To determine fee amounts, staff identified existing permits and inspections that were similar in nature and required a similar amount of staff time.

The fees listed below are recommended for adoption, however the collection of certain fees has been waived for the current fiscal year by Resolution No. FD 2022-028. This waiver is part of an annual analysis to determine the need to collect fees, in whole or in part, to meet the fiscal needs of the Fire District for the current fiscal year. These new operating permit fees, as well as the fees for special service provided during normal work hours, are also recommended for waiver. •Special services fees are related to non-recurring inspections of events or operations that require or benefit from safety oversight. The special service fees recommended for adoption are Bonfire, Model Rockets, and Portable Generator. •Operating permit fees are related to recurring inspections of certain hazardous and high- risk business operations in order to ensure compliance with all of the safety requirements for the particular operation or occupancy as conditioned by the permit. The operating permit fees recommended for adoption include: Additive Manufacturing; Artificial Combustible Vegetation; Commercial Kitchen Exhaust Inspection and Cleaning; Commercial Cooking Oil Storage; Distilled Spirits and Wines; Electrical Energy Storage System; Electrically Locked Egress; Emergency Power System; Flaming Foods or Beverages; Fuel-Fired Appliance; Gas Detection System; Hyperbaric Facility; Lithium Batteries; Mobile Fueling of Hydrogen-Fueled Vehicles; Open Flames in Group E Occupancies; Plant Extraction System; Solar Photovoltaic Power System; Standby Power System; and Vehicle Mounted Fire Extinguishers.

Additionally, staff performed a comprehensive review of existing operating and special service permits and recommends the following changes:
•Delete obsolete and duplicate fees, including Large Family Daycare, Live Audience, Open Flame categories, and Wrecking Yard.
•Revision of fees to reflect actual cost, including Fire Alarm Services, Fire Extinguisher Recharge, Padlocks, Signs and Placards, and Incident Related Materials and Supplies. •Increase of the Fire CFD Annexation Application Fees to recover actual costs which have increased since the fees adoption in 2012. The fee is for properties conditioned by the Fire District join existing CFDs in order to satisfy service mitigation impacts.

A summary of the fees discussed above is included in Attachment 1.

Facility Use Fees
The Fire District adopted the current facility use fees in Resolution No. FD 18-003 in coordination with the opening of the All-Risk Training Center in 2018. Staff performed a comprehensive analysis of these current fees and recommends that they be restructured and streamline for consistency with the Community Services and Library Services departments. This restructure will include the following, detailed in Attachment 2:
•User Groups will be adjusted to better categorize public safety and non-public safety agencies. This includes separating current User Group 2 which combines non-profits and outside government agencies. This assists with specifying the specific rooms and training props that these groups are authorized to use.

•A defined discount structure will be applied to the User Groups, ranging from a no fee for local government agencies to full fee for for-profit agencies. •Indoor rooms will be categorized as conference room, classroom (small), classroom (medium), and classroom (large). Individual rooms are categorized based off size and amenities, allowing for consistency in the rental fees charged for each room category. •Outdoor training props will be categorized as Training Tower, Residential/Commercial House, Specialized Training Prop, and Live Fire Training Prop. Individual training props will be grouped within the broader categories based off specialized use, allowing for a streamlined fee document and consistency in the rental fees charged for each training prop.

Rental fees on several rooms and training props increased as part of the restructure, however remain relatively low in order to facilitate regional public safety training. On average, rental fee increases for User Group 2 through 4 range between $0 and $30 per hour for indoor room rentals (hourly rental rates) and between $0 and $102 for outdoor training props (daily rental rates).

In addition to the proposed restructuring of facility rental fees, Staff also proposes the following changes, detailed in Attachment 3:

Increased Fees:
•Application processing fee increase from $25.00 to $35.00 to cover staff time and materials required to process and route rental applications. This is consistent with the Community Services and Library Services departments.

Modification of Existing Fees:
•Individual staffing rates have been replaced with a standard fully burdened staff rate calculation of top pay step multiplied by current fringe benefit rate as approved by the Fire Board biannually. This is consistent with the Community Services and Library Services departments.
•Filming and photography fee ranges for Fire District facilities were modified to be consistent with the Epicenter. Fees are dependent upon the filming/photography requirements and actual Fire District costs.

New Fees:
•ActiveNet service fee of 4.0% to cover the cost of processing financial transactions through the software system. This is consistent with the Community Services and Library Services department.
•Various optional equipment and material use fees, including shredding services, copies, smoke machine, liquid smoke, plywood, and propane.
•Multiple Rental Package for discounted rental of multiple rooms in one day or one room over multiple days at the All-Risk Training Center.
•Cancellation/rescheduling fees for Live Fire Training Props and Specialized Training Props. These fees already apply to other facility rental categories.

•Irrelevant equipment rentals and service fees.

Annual Escalator
As labor effort and costs associated with the provision of services fluctuate over time, a significant element in the development of fees is the flexibility to remain current. To allow fees to stay current over time, staff recommends adoption of an annual automatic escalator based on the Employment Cost Index (ECI), which considers the change in compensation costs for state and local government workers. An automated process for annual fee updates will provide uniformity and consistency in Citywide fees and ensure continuous adjustment to recover costs. ECI is currently applied to Fire Construction Service Fees and was approved for use across City departments in December 2022.

ECI accounts for wage and benefits increases and such adjustments will apply to fees directly related to Fire District staffing. Adjustments will be calculated by the percentage change in the ECI for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31st of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. Adjusted fees will be rounded to the nearest whole dollar and effective annually on July 1st.

Certain fees are set by government statute and are not subject to an automatic escalator, such as duplication fees for public records. Staff has also identified fees that should be excluded from annual adjustments because they lack the required staffing component or so that they remain competitive. The Fire Board will continue to approve new fees or fees requiring additional studies or analysis to ensure that fees charged are sufficient to recover the cost of services provided.

Public Outreach
Staff has already begun public outreach through informal notification to existing permit holders regarding the fee analysis and anticipated fee increases. During the months of February and March, staff will continue working with existing permit holders, as well as advertise increased fees on the front counter of the ARTC. Rental rates for current permit holders will be honored.

EFFECTIVE DATE OF FEES
Fire District operating fee, special services fees, and facility use fees will be effective 60 days from the adoption of the resolution. Annual fee adjustments based on ECI will be effective on the first day of each fiscal year, effective July 1, 2024.

PUBLIC NOTICE:

Pursuant to Government Code Section 65090, this item was advertised fifteen (15) days in advance as a public hearing (1/8-page ad) in the Inland Valley Daily Bulletin newspaper. The corresponding cost analysis worksheets for each new or increased fee were placed on file in the City Clerk’s office on January 19, 2023.

FISCAL IMPACT:

By consistently examining user fees annually, these user fee updates provide additional revenue per fiscal year to offset the Fire District’s costs.

RESOLUTION OF THE BOARD OF DIRECTORS OF THE RANCHO

CUCAMONGA FIRE PROTECTION DISTRICT, RANCHO

CUCAMONGA, CALIFORNIA, ESTABLISHING AND WAIVING THE
COLLECTION OF CERTAIN PERMIT AND INSPECTION FEES.

W
HEREAS, the Rancho Cucamonga Fire Protection District (“RCFPD”) is a public agency located in the County of San Bernardino, State of California; and W
HEREAS, the California Government Code requires that prior to levying a new fee or increasing an existing fee or service charge, as hereinafter set forth, the local agency shall hold a noticed public hearing to consider the matter; and
W
HEREAS, On February 1, 2022, the Rancho Cucamonga Fire Protection District conducted and concluded a duly noticed public hearing concerning the proposed fees, as required by law; and W
HEREAS, all legal prerequisites to adoption of this Resolution have occurred.

W, THEREFORE, THE BOARD OF DIRECTORS OF THE RANCHO CUCAMONGA FIRE PROTECTION DISTRICT HEREBY FINDS AND RESOLVES AS FOLLOWS:

1. The f
oregoing Recitals are true and correct.

2. The
Fire District has conducted a study of all costs incurred by the District in providing inspection and
permit services. Costs to the District in providing the Services include, but are not limited to, salary and benefits paid to District employees, cost of maintaining the necessary equipment and facilities, asset usage costs, and risk management costs.

3. The Fi
re District has calculated the minimum number of staff -hours that will necessarily be ex
pended based upon the specific type of Services required.

4. The f
ee amounts established herein do not exceed the minimum cost to the District in providi ng eac
h of the listed services to include the initial inspection and one re-inspection.

5. The
Fire Code of the Rancho Cucamonga Fire Protection District as adopted and amended by O
rdinance No. FD 58 has required operational permits and special event inspections which were not included in previous ordinances.

6. Fees
for the aforementioned operational permits and special event inspections have not been established in fee resolutions previously approved by the Board.

7. The B
oard hereby approves and adopts new permit and inspection fees included herein as Exhibit A effective 60 days from adoption of this resolution.

8. The B
oard hereby repeals the Fire Alarm Services Fee adopted in Resolution FD 12- 057 and adopts a new Fire Alarm Services Fee in the amount of $110.

9. As previously determined by Resolution FD 2022-028, for fiscal year 2022-23, there does not exist a fiscal need to collect the fees approved herein.

10. The Board hereby waives the collection of the fees approved herein for fiscal year 2022-23 only.

Thereafter, said fees will be collected unless the Board again approves a waiver as to such collection.

11. Nothing in this Resolution shall be deemed to affect any other fees of the District currently in effect.

12. The Secretary shall certify to the adoption of this Resolution.

UPDATING VARIOUS FEES.

A. RECITALS.

1. The C
alifornia Government Code allows the Rancho Cucamonga Fire Protection District to es
tablish fees and charges for services, provided such fees and charges do not exceed the estimated reasonable cost to the District in providing the service to which the fee or charge applies.

2. D
ata indicating the estimated or actual cost to provide each service, for which the fees and charges set forth herein apply, was made available to the public at least ten (10) days prior to the date of the public hearing.

3. O
n February 1, 2023, the Board of Directors of the Rancho Cucamonga Fire Protection District conducted and concluded a duly noticed public hearing concerning the proposed fees and service charges, as required by law.

4. A
ll legal prerequisites prior to the adoption of this Resolution have occurred.

B. RESOLUTION.

The B
oard of Directors of the Rancho Cucamonga Fire Protection District finds and resolves as follows:

SECTION 1: The Board of Directors hereby specifically finds that all the facts set forth in the Recitals, Part A, of this Resolution are true and correct.

SECTION 2: The Board of Directors hereby specifically finds that the fees and charges set forth do not exceed the estimated reasonable cost of providing the service for which the fee or charge be levied.

SECTION 3: The Board of Directors hereby authorizes the Chief Executive Officer, or designee, to make annual adjustments to fees, commencing on July 1, 2024, and each year thereafter, without further action of the Board of Directors, based on the Employment Cost Index for State and Local Government Employees, Total Compensation, during the 12-month period ending on December 31st of the immediately preceding year, as released by the U.S. Department of Labor’s Bureau of Labor Statistics and rounded to the nearest whole dollar. If this index is discontinued, a replacement index, as determined by the Board of Directors, shall be utilized.

S ECTION 4: The Board of Directors hereby approves and adopts the fees included herein as Exhibit A effective 60 days from adoption of this resolution. All previously adopted and existing fees for performance of District Services identified in Exhibit A are hereby deemed to be superseded and replaced by the fees herein.

S ECTION 5: The Board of Directors hereby repeals the permit and inspection fees included herein as Exhibit B effective 60 days from adoption of this resolution.

1.1 EMPLOYEE COST INDEX (ECI) ADJUSTMENT

1.1.1 Effective July 1, 2024, fees will be automatically adjusted annually by the percentage change in the Employee Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12- month period ending on December 31st of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics.
