CONTRACT SUMMARY
Jason Jaurigue, Director of Information Services
July 7, 2022
SUBJECT: Savant Solutions Cybersecurity Services
Background:
One responsibility of the Information Services Department is to manage the City's cybersecurity posture by reducing or preventing risks to the network, computer devices, and the City's data. This work entails utilizing standard IT industry tools such as anti malware software, firewalls, email spam filtering, identity management, and multifactor authentication. It also requires adherence to procedural and administrative best practices such as maintaining robust physical and logical security of network infrastructure, maintenance of backup systems, and patching operating systems on servers and personal computers with security updates, among other responsibilities.
While the City has not experienced a significant cybersecurity incident to date, due diligence is required to reduce the risks or impacts of future incidents. It is no longer a matter of "if' a breach, malware attack, or phishing incident will occur but more about having tools in place for alerting staff when events occur and having a remediation plan in place to return operations to an operational state within a reasonable timeframe.
For the past year staff has been satisfied with the proactive reporting and other cybersecurity services provided by Savant Solutions. Staff is satisfied that continuing use of services provides ongoing benefit to the city. Staff recommends entering into a contract with Savant Solution, Inc for Arctic Wolf Network cybersecurity services for an amount not to exceed $38,305.75 with Savant Solution to provide cloud-based cybersecurity event logs aggregations, monitoring, and incident notification. 6-4
Fiscal Impact:
Funds are appropriated in the amount of $38,305.75 in the Information Services Department FY 2022/23 operating budget. Funding for subsequent years will be requested as part of the City's annual budget process.

SUBJECT: Glass Box Technology, Hyper-Converged Infrastructure Background:
The Rancho Mirage Library & Observatory's (RMLO) current Hyper-Converged Infrastructure (HCI) solution it's approaching End-of-Life (EOL) and End-of-Service-Life (EOSL). During this phase, the manufacturer will provide limited support, including software maintenance , bug fixes, and critical security patches to the system. As systems age, hardware compatibility constraints may limit these services.
On April 19, 2022, the City issued a Request for Proposal (RFP) for a Hyper-Converged Infrastructure (HCI) solution that can provide a solution that aims to reduce infrastructure costs, eliminates infrastructure complexity, and improves system performance for the Rancho Mirage Library & Observatory .
Staff recommends entering into a contract with Glass Box Technology for Scale Computing HCI. The city received four proposals by the deadline of May 10, 2022.
Glass Box Technology was the lowest bidding vendor while meeting all requirements outlined in the RFP.
Fiscal Impact:
This item is budgeted for the 2022/2023 Fiscal Year. The contract consists of Software, Support and Remote professional Services not-to-exceed 80,000. 6-6

CONTRACT SUMMARY
TO: Mayor and City Council DATE: July 7, 2022
FROM: Ryan Stendell, Public Works Director
SUBJECT: Contract Award for Citywide Rubberized Emulsion Aggregate Slurry (REAS) Project, CP 22-373
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council award a contract to Petrochem Materials Innovation, LLC (PMI) for Citywide Rubberized Emulsion Aggregate Slurry (REAS) in the amount of $733,797.48 with no contingency.
JUSTIFICATION OR INFORMATION
BACKGROUND:
Rubberized Emulsion Aggregate Slurry ("REAS") is the primary pavement maintenance surface treatment Public Works uses to preserve the City's public streets. REAS has been the material of choice for the City's slurry seal projects for the past eleven years because of its superior quality. The rubberized slurry includes a high content of recycled tire rubber, which gives the roadway a smoother and quieter ride, lasts longer than the standard slurry, and remains black longer.
DISCUSSION:
The City uses a routine slurry schedule to cycle through the REAS resurfacing of all public streets in the City limits. The schedule for this year contains a complete refresh of the Tamarisk Neighborhood . Table 1, attached to this staff report, identifies the sections of roadway scheduled for REAS application in the fall.
The bid to perform the REAS resurfacing for the City's roadways is based on the City of Los Angeles "piggyback" bid price. The cost for all streets identified in Table 1 is $733,797.48, which includes sweeping, traffic control, application of the REAS, cleanup and restriping for a period of 15-20 working days in October. Additional Class 2 striped bike lanes will also be added where sufficient roadway width exists. The Contractor will be responsible for notifying adjacent property owners prior to start of work.
AGENDA ITEM#
6-8
DATE: July 7, 2022 Page 2 of2
Contract Award to PM! for Citywide REAS
JUSTIFICATION OR INFORMATION CONTINUED:
This will be the standard "piggyback" contract the City has entered into with PMI since 2012, whereby the City is able to take advantage of the reduced pricing through the multi-year pricing structure between PMI and the City of Los Angeles. This process was outlined in City Ordinance No. 1083 which allows shared-agency purchases in place of project-specific bidding (a process known as piggybacking) .
The Contractor has requested to work weekends, including Saturdays and Sundays. Staff recommends allowing weekend work to minimize the traffic impacts on residents, accelerate the project timeline, and reduce costs, as was done in years past.
FISCAL IMPACT:
The total project cost for all streets identified in Table 1 is $733,797.48, with no contingency.
The project was budgeted in Fiscal Year 2022/2023 Measure A & Gas Tax Funds; no budget adjustment is required.

STAFF REPORT
TO: Mayor and City Council DATE: July 7, 2022
FROM: Jessica L. Pulliam, Sr. Management Analyst
SUBJECT: FIND Food Bank Services for the Edible Food Recovery Program
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council authorize the City Manager to enter into an agreement with FIND Food Bank for the purpose of meeting SB-1383 regulatory requirements and providing support to the Rancho Mirage Edible Food Recovery Program.
JUSTIFICATION OR INFORMATION
BACKGROUND:
Senate Bill No. 1383 was signed into law on September 19, 2016. It is the most significant waste reduction mandate to be adopted in the State of California in the last thirty years. SB 1383 required the reduction of organic waste disposal by 50% by January 2020 and by 75% by 2025.
Additionally, SB 1383 requires an increase of 20% in edible food recovery by 2025 and introduced regulatory requirements for both food generators and jurisdictions. SB 1383 places many requirements on jurisdictions including establishing an edible food recovery program to include documentation, contracts between edible food generators and recovery organizations, coordination, data collection, and reporting, among other items, with fines of up to $10,000 per day for non-compliance.
The City is required to ensure Tier 1 generators which includes grocery stores over 10,000 sq ft. in size, wholesale vendors, and food distributors donate edible food, have contracts in place with the non-profit(s) to receive recovered edible food and ensure these generators are keeping records for inspection. Starting this year, 2022, the City will be required to ensure compliance with inspection of records to include review of contracts and data to ensure there is proper reporting on Tier 1 generators.
To successfully divert edible food from landfills there is considerable infrastructure, systems and staffing needed to include: tracking and coordination systems, edible food contract management, data collection of types and weights of food recovered, coordination and transportation of food and food safety training. There would be considerable expense and staffing needed if the City were to implement an impactful program internally but, partnership with a food recovery organization could enhance the success, reduce the costs and ensure compliance by Rancho Mirage businesses.

JUSTIFICATION OR INFORMATION CONTINUED :
FIND Food Bank has submitted a proposal to the City of Rancho Mirage to help meet regulatory requirements and provide support to the Rancho Mirage Edible Food Recovery Program. FIND Food Bank is the Coachella Valley's Regional Food Bank and has been operating since 1983.
FIND has expertise, established systems, a network of volunteers and a history of providing food assistance directly as well as through distribution to other non-profit organizations. A partnership with FIND food bank will help the city and its edible food generators expediently meet the SB- 1383 requirements, reducing the risk of unnecessary fines. Staff is requesting an agreement be established with FIND Food Bank to help meet SB-1383 regulatory requirements and provide support to the Rancho Mirage Edible Food Recovery Program.

S81383 Jurisdiction Services
Coachella Valley Region
Overview. SB1383's effect on food rescue and recovery operations introduced regulatory requirements for both food generators and jurisdictions. Failure to follow SB1383's requirements has the potential to result in fees ranging between $50- $10,000 per day depending on the agency enforcing the regulations in the local jurisdictions (articles 14 and 15). Further, SB1383 enters into law specificities on documentation, coord ination, data collection, reporting requirements and other nuances related to food rescue that requires expertise in food handling, tracking, inventory, and systems capable of navigating correct ly through the law. A jurisdiction trying to meet the SB1383 requirements using internal staff could be costly with the amount of staff training, IT food rescue tracking systems integration, SB1383 contracts program management and food rescue establish ment support. As part of SB1383 recommendations, CalRecycle mentions jurisdictions and establishments partning with their local regional food banks to support the ir efforts to achieve SB1383 requirements.
For the Coachella Valley region, FIND Food Bank is the Desert's Regional Food Bank since 1983 with the expertise, systems and ability to help jurisdictions and establishments meet the SB1383 requirements, reducing their risk of unnecessary fines. Additionally, FIND's services combines meeting the SB1383 require ments on behalf of the jurisdiction and establishments, with serving the most vulnerable populations who are in need of food assistance. A marriage is created between regulatory requirements and human services estab lishing corporate social responsibility for businesses, and jurisdictions elevate their services to community by engaging more deeply in the food insecurity sector. Edible food being equitab ly distributed to people in need, instead of going to landfill becomes a win for all: Jurisdictions, Food Establishments, Regional Food Bank, and People in Need.
FINO S81383 Services· To help jurisdictions meet their regulatory requ irements and provide support to their local establishments meet the ir requirements as well, FIND offers the following as contracted services with the jurisdictions:

STAFF REPORT
Mayor and City Council
Jessica L. Pulliam, Sr. Management Analyst
Isaiah Hagerman, City Manager
SUBJECT: Turf Rebate Program
SPECIFIC REQUEST OR RECOMMENDATION
DATE: July 7, 2022
That the City Council approve the implementation of the Rancho Mirage Turf Rebate Program, in partnership with the Coachella Valley Water District, and a program budget of $500,000, and authorize the City Manager, or designee, to take all further actions to implement the same, including approving and executing all associated agreement(s), approved as to form by the City Attorney.
JUSTIFICATION OR INFORMATION
BACKGROUND:
In May of 2022, the California State Water Resources Control Board adopted a new emergency water conversation regulation to ensure a more aggressive approach to saving water, including a ban on the watering of nonfunctional turf. Regulation required water agencies to activate "Level 2" of their Water Shortage Contingency Plans, which assumes up to a 20% water shortage, which the Coachella Valley Water District (CVWD) Board of Directors adopted at their June 14, 2022, meeting.
As of June 10, 2022, the state ban on watering non-functional turf went into effect, and included:
• Irrigation of non-functional turf is prohibited at commercial, industrial, and institutional sites including HOAs.
• Non-functional turf means turf that is solely decorative. It does not include areas that are used for recreation or civic community events or turf areas with trees. • Fines up to $500 per day may be imposed.
Level 2 actions became effective on June 14, 2022, and included:
• Outdoor water use for spray irrigation is prohibited during daylight hours except to check for leaks.
• Restaurants can only serve water upon request.
• Overseeding is discouraged.

Turf Rebate Program
JUSTIFICATION OR INFORMATION CONTINUED:
The CVWD has continued to encourage customers to reduce their water use, especially outdoors, where the biggest water savings can be achieved. This includes fixing leaks immediately, applying for conservation rebates such as their $3 per square foot turf conversion program, irrigating more efficiently, and eliminating water waste.
The City of Rancho Mirage has long supported the reduction of water usage and has encouraged the removal of turf and conversion to more drought tolerant landscaping through the prior two Rancho Mirage Turf Rebate Programs which ran in 2011 and 2016 .
INFORMATION:
Establishing a new rebate program from the City of Rancho Mirage would incentivize our residents, HOAs and businesses to move forward with the costly endeavor of converting from living turf to drought tolerant landscaping, while maintaining aesthetics.
The CVWD currently offers a rebate of $3 per sq. ft. for turf conversion (max project size of 10,000 sq. ft. for residential and 25,000 sq. ft. for HOA/Commercial) but, the cost for conversion ranges from $5-12 per sq. ft. for those converting to desertscape, with the lower end completing labor themselves and upwards of $20+ per sq. ft. for the conversion to artificial turf. In addition, the use of a landscape architect is required for Rancho Mirage HOA's with parkways, those areas that abut City streets, increasing their costs to upwards of $7,000 or more.
It is proposed that the City consider providing a matching rebate of $3 per sq. ft. for all Rancho Mirage CVWD turf conversion rebate completed projects through a partnership with CVWD; providing our residents and HOAs/Commercial a total of $6 per sq. ft., per project, for living turf removal. In addition, it is proposed to provide a direct rebate through the City for those projects that are required to utilize a landscape architect for up to $6,000 per project.
CVWD is willing to collaborate with the City of Rancho Mirage to reduce application redundancy, running around on our residents and remove the overall City costs associated with administering a parallel rebate program. CVWD is willing to obtain and share all necessary documentation, photographs, submit landscape plans directly to our planning department, do all physical inspections and provide the full rebate of $6 per sq. ft. ($3 from CVWD & $3 from the City of Rancho Mirage) to applicants at a project's completion. In addition, CVWD would provide information for those projects eligible for the additional direct city rebate of up to $6,000 per project for the required use of a landscape architect. The City would be invoiced monthly to reimburse CVWD for the City's $3 per sq. ft. portion of the joint rebate.
FISCAL IMPACT
This program is requested to have an initial budget of $500,000, to be paid out of the 2022 budget surplus and will require a budget adjustment to the general fund. Any future funding requests will be presented to the City Council for approval.
