STAFF REPORT
Mayor and City Council
Jessica Pulliam, Sr. Management Analyst
Isaiah Hagerman, City Manager
DATE: September 15, 2022
SUBJECT: Rancho Mirage Energy Authority -2021 Power Content Label and Attestation

SPECIFIC REQUEST OR RECOMMENDATION
Endorse the accuracy of information presented in Rancho Mirage Energy Authority's 2021 Power Content Label based on Staff and California Choice Energy Authority technical review.

JUSTIFICATION OR INFORMATION
Rancho Mirage Energy Authority (RMEA) is required to submit this staff report and related meeting minutes to the California Energy Commission (CEC) per Power Source Disclosure Program regulations to demonstrate compliance.

BACKGROUND
California Public Utilities Code requires all retail sellers of electric energy, including RMEA to disclose "accurate, reliable, and simple-to-understand information on sources of energy" that are delivered to their respective customers via an annual Power Content Label (PCL). The PCL is analogous to a nutrition label, conveying information regarding the various power sources/products that are procured on behalf of each retail electricity customer. California's retail electricity sellers, including RMEA, will each have unique PCLs based on internally adopted procurement policies and related power purchases that were completed during the reporting year. The PCL format is highly prescriptive, offering little flexibility to retail sellers when presenting such information to customers -the CEC administers these requirements under California's Power Source Disclosure Program.

Information presented in each PCL includes the proportionate share of total energy supply related to specific fuel sources/resource categories, including both renewable and conventional generating technologies. If a retail seller procures a certain percentage of its energy requirements from the market at large (meaning, sources of power that cannot be traced back to a specific generator), the PCL must identify such purchases as "unspecified sources of power". It is very common for most retail electricity sellers to utilize "unspecified source of power."
AGENDA ITEM#

3-2
DATE: September 15, 2022 Page 2 of 3
Rancho Mirage Energy Authority -2021 Power Content Label and Attestation JUSTIFICATION OR INFORMATION CONTINUED:

In accordance with statewide mandates and internally adopted planning targets, RMEA procured a substantial portion of its electric energy supply from generating resources utilizing various renewable fuel sources in 2021. Renewable fuel sources may include biomass & waste, hydroelectricity, solar, geothermal and wind. For RMEA Base Choice customers, 39.4% of total energy supply was sourced from renewable energy resources. RMEA Premium Renewable Choice customers, 100% of energy deliveries were sourced from renewable energy resources .

Power source disclosure regulations require that certain renewable energy purchases must be reported/reflected on the PCL. More specifically, "unbundled" renewable energy certificates (meaning, renewable energy attributes that are sold/purchased separately from associated electric power) are required to be displayed outside the area in which "bundled" renewable energy purchases (meaning, renewable energy attributes that are sold/purchased with associated electric power) are reported. This PCL format may result in some customer confusion, as determining the total quantity of renewable energy purchased on behalf of each customer now requires the summation of two values: "Eligible Renewable", plus "Percentage of Retail Sales Covered by Retired Unbundled RECs". RMEA is prepared to answer related questions, should they arise.

Consistent with applicable regulations, all customers currently enrolled in the RMEA program will soon receive the PCL via U.S. mail.

To fulfill its Power Source Disclosure Program reporting obligations for 2021, RMEA as a public agency, must provide the CEC with the City Council's attestation regarding the accuracy of information included in the annual Power Source Disclosure Reports (submitted to the CEC earlier in 2022, according to the applicable reporting deadline) and PCL, consistent with the following element of PSD Program regulations.

A retail supplier that is a public agency providing electric services is not required to comply with the provisions of subdivision (a)(1) if the board of directors of the public agency submits to the Energy Commission an attestation of the veracity of each annual report and power content label for the previous year.

In the following excerpt from appliable regulations, subdivision (a)(1) refers to a third-party audit, which is not necessary for public agencies, including the City.

While developing RMEA's PCL, California Choice Energy Authority (CalChoice) and its technical consultants performed a detailed review of all power purchases completed for the 2021 calendar year. The review performed by CalChoice and its technical consultants found no inaccuracies or inconsistencies in such information, which was subsequently entered in RMEA's annual Power Source Disclosure reports and PCL. To fulfill its attestation requirements for 2021, Council is being asked to provide an attestation covering both the PCL and associated Annual Reports, as specified in the excerpt above -both elements of the PSD Program reflect information that was consistently and accurately presented for the RMEA CCA Program .

Rancho Mirage Energy Authority -2021 Power Content Label and Attestation JUSTIFICATION OR INFORMATION CONTINUED:

Based on reviews previously completed by staff and CalChoice's technical consultants, staff is requesting that your Council provide the requisite attestation at this time.

Upon approval, a copy of this staff report and related meeting minutes will be forwarded to the CEC, thereby completing RMEA's attestation requirements under California's Power Source Disclosure Program for the 2021 calendar year.

FISCAL IMPACT
None.

RECOMMENDATION

STAFF REPORT
TO: Honorable Mayor and City Council DATE: September 15, 2022 FROM: Ryan Stendell, Director of Public Works
SUBJECT: Initiation of General Street Vacation Proceedings for a roughly 80' wide street right- of-way located east of Bob Hope Drive in Sections 19 and 24 on the abandoned alignment of Rio Del Sol, and approval of a Dedication of a 30' street right-of-way for the replacement access to remaining vacant properties

SPECIFIC REQUEST OR RECOMMENDATION
That the City Council:
1) Adopt Resolution No. 2022-(Next-in-Order), Summarily vacating approximately 56,656 square feet of excess right-of-way on the former Rio Del Sol Road, east of Bob Hope Drive in Sections 19 and 24; and
2) Authorize approval of Dedication of a 30' wide replacement street right-of-way running east and west in Sections 19 and 24 to maintain legal access to vacant properties. This action is subject to final review and approval of the City Engineer and City Attorney and must remain consistent with all provisions of the Section 19 Specific Plan on file with the Development Services Department.

JUSTIFICATION OR INFORMATION

BACKGROUND
Prior to City incorporation, Bob Hope Drive, between Ramon Road and Dinah Shore Drive, was realigned leaving a portion of what was then Rio Del Sol Road physically abandoned. Since that time the right-of-way has served as legal access to vacant properties to the east. This realignment created a roughly 1.15 acre triangular "remnant" property (Exhibit A) between the old and new rights-of-way. The owners of this triangular "remnant" and the roughly 112.51-acre property to the east of the old Rio Del Sol right-of-way are working on combining acreage to make it more practical for development. The property owner has proposed vacation of this remnant as it bifurcates their property and replacing with a dedication of a 30' wide access easement along the north edge of the property (Exhibit C). This east-west 30' access easement is aligned in conformance with the future Section 19 Specific Plan Road network. The process of abandoning an easement is through a summary vacation. The City Council has authority to accept or dispose of real property or easements over real property.

Vacation of Property: Bob Hope Drive@Vacated Rio Del Sol JUSTIFICATION OR INFORMATION CONTINUED:

Excess right-of-way that is not required for street or highway purposes is eligible for vacation in accordance with California Streets and Highways Code Section 8312 of the Public Streets, Highways, and Service Easements Vacation Law (Sts. & Hwys. Code §§8300 et. seq.). If there are in -p lace public utility facilities that are in use, the City, unless the City Council determines the public convenience and necessity require otherwise, shall reserve, and except from the vacation any easement and right necessary to maintain, operate, replace, remove, or renew the public utility facilities. In this case, there are no utility structures present in the old Rio Del Sol right-of- way, and no utility companies expressed a need to preserve the right-of-way, so no reservation of utility easements is needed.

ENVIRONMENTAL INFORMATION
The vacation of a right-of-way is exempt from CEQA pursuant to Section 15061 (b)(3) of the CEQA Guidelines. The vacation of this right-of-way does not have the potential for causing a significant effect on the environment.

RESOLUTION NO. 2022 -

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE, CALIFORNIA, SUMMARILY VACATING APPROXIMATELY 56,656 SQUARE FEET

OF EXCESS RIGHT-OF-WAY ON THE FORMER RIO DEL SOL ROAD, EAST OF BOB HOPE DRIVE IN SECTIONS 19 AND 24
WHEREAS, the City of Rancho Mirage ("City") is a charter City, and recognized for certain purposes as a political subdivision of the state; and WHEREAS, the City has identified as "Excess Right-of-Way", approximately 56,656 square feet of excess right-of-way on the former Rio Del Sol Road, now abandoned, located half way between Ramon Road and Dinah Shore Drive, just east of Bob Hope Drive, which is described and depicted more fully in the exhibits attached hereto, incorporated herein by this reference; and
WHEREAS, the property owners of APN 685-410-008 and APN 685-010-013 have requested the City summarily vacate the Excess Right-of-Way, and have offered an alternative access easement dedication that fits better with the Section 19 Specific Plan road network; and
WHEREAS, the Excess Right-of-Way was irrevocably dedicated to the County of Riverside in Patent recorded 12/5/1979 as instrument #258518, and in Deed recorded 5/24/1949 in Book 1078, Page 582, of Riverside County Official Records. The City took over the rights and responsibilities for this right-of-way when those portions of Section 24 and Section 19 were annexed into the City; and
WHEREAS, the City may dispose of an irrevocable offer of dedication through summary vacation procedures (Government Code 7050); and WHEREAS, excess right-of-way that is not required for street or highway purposes is eligible for summary vacation in accordance with California Streets and Highways Code Section 8334 of the Public Streets, Highways, and Service Easements Vacation Law (Streets & Highways Code §§8300 et. seq.); and
WHEREAS, California Streets and Highways Code Section 8335 provides that the City Council, as the City's legislative body, may summarily vacate excess right-of-way by adopting a resolution of vacation in compliance with the requirements set forth therein; and
WHEREAS, the City Engineer has determined the Excess Right-of-Way is no longer necessary for its intended public purpose as right-of-way or for street or highway purposes; and
WHEREAS, the City sha ll retain, reserve and except therefrom, its rights respecting the public utility and public service uses so dedicated so that the vacated 1 8-5
Excess Right-of-Way shall not affect any in-place public utility facilities that are in use; and
WHEREAS, the proposed summary vacation and quitclaim is exempt from the provisions of the California Environmental Quality Act because there is no possible significant effect directly related to the action, and therefore no further action is required under CEQA pursuant to th~ "common sense" exemption set forth in Section 15061 (b)(3) of the State CEQA Guidelines because the vacation does not disturb the physical environment and any further development of any portion of the Excess Right-of-Way is subject to future approvals and environmental analysis; and is categorically exempt pursuant to Sections 15304 (Class 4) (Minor Alterations to Land), 15305 (Class 5), and 15312 (Surplus Government Property Sales) of the State CEQA Guidelines. The City Council has reviewed the project and based upon the whole record before it, in the exercise of its independent judgment and analysis, concurs that it can be seen with certainty that there is no possibility the action may have a significant effect on the environment, and that it meets the above referenced Categorical Exemptions; and WHEREAS, the City desires to summarily vacate and quitclaim the Excess Right- of-Way, while retaining, reserving and excepting therefrom its rights respecting public utility and public service uses, under authority of the Public Streets, Highways, and Service Easements Vacation Law.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE DOES RESOLVE, AS FOLLOWS:

Section 1. Recitals.

That the recitals set forth above are true and correct and are incorporated herein by this reference.

Section 2. Resolution of Vacation.

That the Excess Right-of-Way respecting public road purposes, the legal description and depiction of which are attached hereto and incorporated herein by this reference as Exhibit "A", and Exhibit "B" is hereby vacated pursuant to the Public Streets, Highways, and Service Easements Vacation Law (Streets & Highways Code §§8300 et. seq.).

Section 3. Recordation of Resolution.

That in accordance with Streets and Highways Code Section 8336, the City Clerk is hereby directed to cause a certified copy of this Resolution, attested by her under seal, to be recorded in the Recorder's Office of the County of Riverside without acknowledgment, certificate of acknowledgment, or further proof. 2 8-6
Section 4. Effect of Recordation.

That from and after the date this Resolution is recorded, the Excess Right-of-Way shall no longer constitute a public right-of-way, but that the City shall retain, reserve and except therefrom, its rights respecting public utility and public service uses.

Section 5. Further Actions.

That the City Council hereby authorizes the Director of Public Works and/or its designee to take all further actions to effectuate this Resolution.

Section 6. Severability.

That the City Council declares that, should any provision, section, paragraph, sentence or word of this Resolution be rendered or declared invalid by any final court action in a court of competent jurisdiction or by reason of any preemptive legislation, the remaining provisions, sections, paragraphs, sentences or words of this Resolution as hereby adopted shall remain in full force and effect.

Section 7. Repeal of Conflicting Provisions.

That all the provisions heretofore adopted by the City Council that are in conflict with the provisions of this Resolution are hereby repealed.

Section 8. Effective Date.

That this Resolution shall take effect upon its adoption.

That the City Clerk shall certify to the passage of this Resolution and enter it into the book of original resolutions.

STAFF REPORT
TO: Mayor and City Council DATE: September 15, 2022
FROM: Jessica L. Pulliam, Sr. Management Analyst
SUBJECT: Single-use Foodware and Standard Condiments AB 1276-Enforcement

SPECIFIC REQUEST OR RECOMMENDATION
That the City Council adopt Resolution No. 2022-(Next-in-Order), Designating the City of Rancho Mirage as the Enforcement Agency for State Regulations on Single-Use Foodware Accessories and Standard Condiments .

JUSTIFICATION OR INFORMATION

BACKGROUND
Assembly Bill 1276, the Single-use Foodware Accessories and Standard Condiments Bill, was enacted on November 18, 2021, by the California Legislature and amended Chapter 5.2 of Part 3 of Division of the Public Resources Code, commencing with Public Resources Code Section 42270. This change requires local public agencies to enforce the state law, designate an enforcement agency and to impose certain restrictions on the use of single -use foodware accessories by food facilities, as defined in Section 113789 of the Health and Safety Code with the aim to reduce the number of single-use foodware items and condiments in the waste stream.

The bill went into effect January 1, 2022 and prohibits food facilities from providing any single- use foodware accessory or standard condiment to a consumer unless specifically requested by the consumer. Additionally, it prohibits those types of items from being bundled or packaged in a way that prohibits the consumer from only taking the desired item. There are provisions for drive-through and airport consumers and requirements on third-party food delivery platforms, as well as exclusions for correctional institutions, health care facilities, residential care facilities, and public and private school cafeterias.

Furthermore, the bill requires that cities authorize an enforcement agency to enforce these requirements. The bill specifies that the first and second violations result in a notice of violation, and any subsequent violation is an infraction punishable by a fine of $25 for each day in violation, but not to exceed an annual total of $300. The city would be effective in fulfilling enforcement itself and will be able to focus efforts on being proactive through providing on-going education and resources to businesses to help ensure compliance.

Staff has developed a robust AB-1276 webpage on the City website under the Business Recycling section which has downloadable signage for businesses. Additionally, the city will work through the Rancho Mirage Chamber of Commerce to distribute educational materials regarding AB 1276 for affected Rancho Mirage businesses to ensure they are informed of this new legislation and are aware of best practices on compliance.

Staff recommends adopting the attached resolution authorizing the city to serve as the enforcement agency for AB 1276 within the City of Rancho Mirage, California.

FISCAL IMPACT
There is no budgetary impact associated with the proposed adoption of the resolution. The impact to city staff is expected to be minimal. Costs associated with the development and distribution of educational material on AB 1276 will be paid out of Special Revenue Fund 251 (AB 939 Recycling Program).

STAFF REPORT
TO: Mayor and City Council DATE: September 15, 2022
FROM: Gabe Codding, Director of Marketing
SUBJECT: Coachella Valley Symphony Partnership for Amphitheater Programming

SPECIFIC REQUEST OR RECOMMENDATION
That the City Council authorize the City Manager and Director of Marketing to enter into an agreement with the Coachella Valley Symphony for free performances for residents and guests at the Rancho Mirage Amphitheater in an amount not to exceed $50,000.

JUSTIFICATION OR INFORMATION
In 2021, the City permitted the Coachella Valley Symphony to do a Halloween show at the Rancho Mirage amphitheater where almost 800 people showed up to hear instrumental renditions of their favorite Halloween songs (Ghost Busters, Thriller, etc .. ) The feedback from the musicians, patrons and attendees was overwhelmingly positive.

The CV Symphony recently approached the marketing department about a partnership for the upcoming 2022/2023 season. Staff feels it would be a great addition to the annual amphitheater programming to sponsor the CV Symphony and have them produce 4 shows that would be free to residents and guests. The CV Symphony would conduct the shows, plus many of their musicians are interested in being a part of the Desert Theatricals orchestra during the city sponsored Broadway musicals. The CV Symphony also has a youth symphony, so staff would explore opportunities to collaborate with the Library and Observatory much like what is being done with the youth theater productions. The CV Symphony have been looking for a home base and many of their membership and supporters are Rancho Mirage based musicians. Staff believe these four free events would be a nice addition to our amphitheater programing and is in line with our brand and resident base.

Staff's recommendation is to sponsor this production for $50,000 from the FY 22/23 Amphitheater Programming budget (no budget adjustment is necessary). A typical cost for a CV Symphony production is $25,000 per show, so the city would be paying 50% of the cost and it would be free for RM Residents and attendees. CV Symphony would fund the other half of the cost through their donor base.

Attached to this staff report is a draft of working titles, dates and times for the proposed productions.
