SUBJECT: Results of the November 8, 2022 General Municipal Election

SPECIFIC REQUEST OR RECOMMENDATION
That the City Council Adopt Resolution No. 2022-(Next-in-Order), Reciting the Facts of the General Municipal Election Held on Tuesday, November 8, 2022, Declaring the Results and Such Other Matters as Provided by Law.

JUSTIFICATION OR INFORMATION
The November 8, 2022, General Municipal Election was held to elect three City Council Members for full four-year terms as well as consideration of two ballot measures initiated by the City Council. Out of 13,128 registered voters, 9,938 ballots were cast, for a 75.70% voter turnout. The Riverside County Registrar of Voters canvassed the ballots and certified election results as follows:

JUSTIFICATION OR INFORMATION CONTINUED
AGENDA ITEM #

The California Elections Code requires that the City Elections Official present the certified results of the election to the governing body (City Council), which shall adopt a resolution (Attachment 1) reciting the facts of the election and declaring the results. A full official statement of the results of the election is attached as Exhibit A to the Resolution. Upon adoption of this Resolution, Steve Downs, Meg Marker, and Lynn T. Mallotto will each be declared elected to the City Council for four-year terms and required to take the Oath/Affirmation of Office as prescribed in the California Constitution and each will receive from the City Clerk a Certificate of Election.

In addition, an Ordinance of the People of the City of Rancho Mirage, amending the City Charter as set forth by voter-approved Measure C, will be included on a subsequent City Council meeting agenda. Measure C revises the timing of the annual appointment of the Mayor and Mayor Pro Tem to occur at the second City Council meeting in November in non-election years and at the City Council meeting when new Council Members are installed in election years.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO MIRAGE

RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, NOVEMBER 8, 2022, DECLARING THE RESULTS AND SUCH OTHER

MATTERS AS PROVIDED BY LAW
WHEREAS, the City’s General Municipal Election was consolidated with the statewide election held on Tuesday, November 8, 2022; and WHEREAS, the General Municipal Election was held in the entire City for the purpose of electing three officers to serve on the City Council for four-year terms, as required by laws relating to cities in the State of California, and for the consideration of two ballot measures initiated by the City Council; and
WHEREAS, notice of the General Municipal Election was duly provided in the time, form and manner as required by applicable law and in all respects the election was held and conducted, the votes were cast, received and canvassed, and the returns were made and declared in the time, form and manner required by the applicable provisions of the California Elections Code; and
WHEREAS, the Riverside County Registrar of Voters canvassed the returns of the General Municipal Election and certified the results of the election to the City Council, which were received and made a part of this Resolution as “Exhibit A.”

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
MIRAGE, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. Number of Ballots
That the total number of ballots cast in the City of Rancho Mirage was 9,938.

SECTION 2. Candidates
That the names of candidates appearing on the ballot for the three full four-year terms for City Council are as follows:

Steve Downs
Ken Ammann
Kim Martos
Meg Marker
Lynn T. Mallotto

2 SECTION 3. Ballot Measures
That the two ballot measures voted upon at this election are as follows:

Measure C. Shall the Charter be amended to provide that the council shall at its second regular meeting in November in non- election years and at the meeting when members are installed during election years, appoint members to serve as mayor and mayor pro tem for one-year that affords each member with an equal opportunity to serve as mayor and mayor pro tem under such guidelines established by ordinance?

Shall the Charter be amended to provide that the council shall at its first regular meeting in December, or as soon thereafter in the event of delayed certification of election results, appoint members to serve as mayor and mayor pro tem for a one-year period that affords each member of the council with an equal opportunity to serve as mayor and mayor pro tem under such guidelines established by ordinance?

SECTION 4. Number of Votes
That the number of votes for each of candidates listed above and the number of votes for and against each of the ballot measures referenced above, are listed in “Exhibit A” attached hereto
SECTION 5. Declaration and Determination
That the City Council does hereby declare and determine that:

Steve Downs is elected as City Council Member of the City of Rancho Mirage for a full four-year term, commencing December 2022.

Meg Marker is elected as City Council Member of the City of Rancho Mirage for a full four-year term, commencing December 2022;
Lynn T. Mallotto is elected as City Council Member of the City of Rancho Mirage for a full four-year term, commencing December 2022; and Measure C is approved in lieu of Measure E since Measure C received a greater number of votes (63.72%) in favor by the electorate than Measure E received (60.19%).

SECTION 6. Statement of Results
That the City Clerk shall enter in the records of the City Council of the City, a statement of the results of the election, showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The total number of votes given to each person; (5) The ballot measures voted upon; (6) The total number of “Yes” votes for each ballot measure; and (7) The total number of “No” votes for each ballot measure. 1-5

3 SECTION 7. Certificate of Election
That the City Clerk shall immediately make and deliver to each of the persons elected a Certificate of Election signed and authenticated by the City Clerk.

SECTION 8. Oath/Affirmation of Office
That the City Clerk shall administer to each person elected the Oath/Affirmation of Office prescribed in the Constitution of the State of California, have each of them subscribe to it and file the Oaths/Affirmations in the office of the City Clerk and all persons selected shall be included in the respective office to which they have been elected.

SECTION 9. Certification
That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
