PROJECT SUMMARY
The original project approval included an entitlement package with multiple applications for the development of a mixed-use project, “Rancho Cove,” on the south side of Highway 111 where it intersects One Mirage Place. The 13-acre project site is triangular in shape and is comprised of 10 parcels. The mix of uses includes 21,200 square feet of commercial/retail space, a 100-room four-story hotel, and 35 attached residential dwelling units (condominiums). The following applications comprised the original entitlement package: Environmental Assessment (EA), General Plan Zoning Map Amendment (GPZMA), Specific Plan Amendment (SPA), Tentative Tract Map (TTM), and Preliminary Development Plan (PDP).

The City Council approved the project on January 1, 2019. On April 16, 2019, the applicant filed a lawsuit against the City, alleging that Condition of Approval No. 69 is invalid. The City denies that the condition is invalid and denies generally and specifically the allegations in the lawsuit.

On June 30, 2022, the applicant and City entered into a Settlement Agreement requiring the City Council to consider revisions to Condition of Approval No. 69. No changes to the project itself are proposed with this request.

Planning Commission Staff Report AGENDA ITEM #

2.Subject to compliance with (1) above, the two existing culverts under Highway 111 are deemed, by the City of Rancho Mirage, to be an acceptable disposal site for all drainage of storm water flows for existing drainage condition; the developer is not required to upgrade the existing two, forty-two inch reinforced concrete pipe culverts under Highway 111 for existing condition drainage of storm water flows.

However, if developer's Project results in incremental increased flows greater than existing condition flows to the existing culverts, the developer is responsible for modifying or improving the culverts and/or related infrastructure at developer's sole cost.

3.Nuisance water caused by the developer's Project must be absorbed to the satisfaction of the City Engineer.

4.The "first flush runoff' caused by the developer's Project must be retained onsite in accordance with Whitewater SMWP BMP Manual requirements.

5.A Hydrology/Hydraulic Report, in accordance with the Riverside County Hydrology Manual, shall be submitted from a Registered Civil Engineer, showing how this stormwater is handled.

The Staff Report from the Project’s original 2019 entitlement is attached to this staff report.

ENVIRONMENTAL DETERMINATION
A Notice of Exemption pursuant to California Environmental Quality Act (CEQA) Section 15162 (Subsequent EIRs and Negative Declarations) will be filed with the Riverside County Clerk once a final determination has been made by the City Council. A Mitigated Negative Declaration pursuant to the California Environmental Quality Act was adopted in 2019. The complete Initial Study, along with the Mitigation Measures and Monitoring Program is attached to the original staff report (Attachment 3).

SUMMARY
No changes are proposed to the project design or layout with this request. The subject request is simply to consider a revision to Condition of Approval No. 69 of the original entitlement package that clarifies the City’s requirements in regard to Project Site drainage and water retention. 10-465

REVISED CONDITION OF APPROVAL
I.(TTM37122 and PDP16003)
Prior to City Council approval of the Final Map, the following Conditions shall be satisfied:

STORMWATER RETENTION

69.If the project is south of the Whitewater Flood Channel, the grading of the project may be designed for the drainage to be conveyed to an acceptable disposal site as determined by the City Engineer. Surface streets are not considered “an acceptable disposal site” for common “nuisance water” from sprinklers and cleaning. Therefore, at a minimum, all projects shall make provisions to absorb such “nuisance water” to the satisfaction of the City Engineer. In this case, since the project is south of the Whitewater Channel, the 100% retention is optional. There is an existing pair of 42” storm drain inlets at the southeast end of the project, which may be used for stormwater overflow after the “BMP Volume” (aka “first flush runoff”) in accordance with the Whitewater SWMP BMP Manual, is retained on-site. Additionally, the project shall be designed to hold the “incremental increase” runoff, or calculations shall be provided to support the ability of these pipes to handle the 100-year worst case runoff from the developed project area and any upstream tributaries. A Hydrology/Hydraulic Report, in accordance with the Riverside County Hydrology Manual, shall be submitted from a Registered Civil Engineer, showing how this stormwater is handled.

1.Per the included Exhibit 1 hereto, the developer is not required to retain 100% of storm flows onsite. The developer is only required to retain the incremental increase in storm water flows caused by the Project and, therefore, must design the Project in a manner so as to not increase existing drainage condition storm flows to the two culverts under Highway 111.

2.Subject to compliance with (1) above, the two existing culverts under Highway 111 are deemed, by the City of Rancho Mirage, to be an acceptable disposal site for all drainage of storm water flows for existing drainage condition; the developer is not required to upgrade the existing two, forty- two inch reinforced concrete pipe culverts under Highway 111 for existing condition drainage of storm water flows.

4.The "first flush runoff' caused by the developer's Project must be retained onsite in accordance with Whitewater SMWP BMP Manual 10-466

FINDINGS
Minor Modification Case No. MOD22-0048:

1.The proposed modification is permitted within the subject zoning district (Mixed Use/ District 8 of the Highway West 111 Specific Plan) and complies with all of the applicable provisions of the Zoning Ordinance and the spirit and intent of the original approval.

2.The proposed modification(s) do(es) not involve a feature of the project that was: a) a basis for findings in a negative declaration or environmental impact report for the project; b) a basis for conditions of approval for the project; or c) a specific consideration by the review authority (e.g., the director, commission, or council) in granting the permit or approval, because the revised condition proposed a minor change that is still consistent with the purpose and intent of the original entitlements. A Mitigated Negative Declaration was adopted in 2019 and the purpose and intent has not changed.

3.The subject site is physically suitable for the type and intensity of the land use being proposed, because the project proposal is not changing from the original entitlements.

4.The proposed use would not impair the integrity and character of the zone in which it is to be located, because the modification is minor in nature and is not changing the project scope.

5.The proposed minor modification is compatible with the land uses presently on the Subject Premises, because the project proposal is not changing from the original entitlement and the Minor Modification proposal is consistent with the purpose and intent of the original entitlements.

6.There are adequate provisions for public access to serve the subject proposal, because the proposal is not changing from the original entitlement and all other entitlement conditions still hold.

7.There will not be a harmful effect upon the desirable neighborhood characteristics, as conditioned, because the project proposal is not changing from the original entitlement and all other entitlement conditions still hold.

8.The proposed location, size, design, and operating characteristics of the proposed modification would not be detrimental to the public interests, health, safety, convenience, or welfare of the City, because the project proposal is not changing from the original entitlement and all other entitlement conditions still hold. 10-468

PUBLIC HEARING

1. Minor Modification Case No. MOD22-0048 (Original Entitlement: Environmental Assessment Case No. EA160002; General Plan Zoning Map Amendment Case No.

GPZMA18002; Specific Pan Amendment Case No. SPA16001; Tentative Tract Map, Case No. TTM37122; and Preliminary Development Plan, Case No. PDP16003) – Rancho Cove, Applicant: Horizon Pacific - Rancho Cove, LLC represented by Rob Nolan. Located south of Highway 111 at the intersection of Highway 111 and One Mirage Place. (APNs: 674-490- 026, -027, -028, -031, -032, -033, -036, -037, -038, & -039).

a. Consider the determination that this Project is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15162 (Subsequent EIRs and Negative Declarations). A Mitigated Negative Declaration pursuant to the California Environmental Quality Act was adopted in 2019; and

b. Consider the recommendation for the City Council to Approve of Minor Modification Case No. MOD22-0048 (Original Entitlement: Environmental Assessment Case No.

EA160002; General Plan Zoning Map Amendment Case No. GPZMA18002; Specific Pan Amendment Case No. SPA16001; Tentative Tract Map, Case No. TTM37122; and Preliminary Development Plan, Case No. PDP16003) to revise Condition of Approval Number 69 of the Original Entitlement Package regarding Project Site drainage and water retention.

Colin Kirkpatrick, Assistant City Attorney, introduced the item.

Majna Dukic, Director of Development Services, presented the staff report.

Mr. Kirkpatrick added that the initial conditional of approval, as recommend by the Planning Commission and approved by the City Council in 2019, and now as modified, was a standard condition of approval the City normally imposed on projects of this nature. He added the condition was a standard condition to address onsite and offsite water flow caused by the project.

Commissioner Chanter commented that she was comfortable with staff’s recommendation.

Commissioner Agostini noted he agreed with staff’s recommendation.

Commissioner Bryant asked if the original plan included a retention basin.

Ms. Dukic replied that the original plan included underground chambers.

Commissioner Bryant asked if any changes or methods used for incremental runoff would have to be approved by the City Engineer.

Ms. Dukic responded that such changes would require City Engineer approval and submittal of a new hydrology report.

Commissioner Bryant asked if the original approval included a barrier to divert water coming down the mountain.
10-471

DRAFT 12/08/2022 Planning Commission Special Meeting Minutes Page 3 of 3

Ms. Dukic explained that the original project entitlements were not being modified; only the condition of approval. She added that any proposed changes affecting on-site drainage or storm water flows would require submittal of a new hydrology plan showing how water would be routed.

Vice Chair Grey noted he reviewed all 463 pages included in packet for the item and it appeared the matter was carefully posed, analyzed, and presented. He commented that the single dispute that resulted in a lawsuit was resolved between the project applicant and the City, and City staff did an excellent job explaining impacts of the proposed change. Vice Chair Grey added that the minimal change to the single condition was appropriate under the circumstances.

Public Comments - None

MOVED/SECONDED BY BRYANT/CHANTER TO RECOMMEND THAT THE CITY COUNCIL:

A. CONSIDER THE DETERMINATION THAT THIS PROJECT IS EXEMPT FROM THE

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15162 (SUBSEQUENT EIRS AND NEGATIVE
DECLARATIONS).

MOD22-0048 (ORIGINAL ENTITLEMENT:

ENVIRONMENTAL ASSESSMENT CASE NO. EA160002; GENERAL PLAN ZONING MAP AMENDMENT CASE NO. GPZMA18002; SPECIFIC PAN AMENDMENT CASE NO. SPA16001; TENTATIVE TRACT MAP, CASE NO. TTM37122; AND PRELIMINARY DEVELOPMENT PLAN, CASE NO. PDP16003) TO REVISE CONDITION OF APPROVAL NUMBER 69 OF THE ORIGINAL ENTITLEMENT PACKAGE REGARDING PROJECT SITE DRAINAGE AND WATER RETENTION.

MOTION CARRIED 4/0.
