ENVIRONMENTAL ASSESSMENT
The Project has been reviewed for compliance with the California Environmental Quality Act (CEQA). Article 19 Categorical Exemptions includes a list of classes of projects that have been determined not to have a significant effect on the environment and that are, therefore, exempt from the provisions of CEQA. Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines exemption provides for the construction and location of limited numbers of new, small facilities or structures.
The proposed Project consists of a Conditional Use Permit (CUP) to construct and operate an unmanned 75-foot mono-eucalyptus wireless telecommunications facility with associated ground equipment to improve the wireless coverage and capacity for existing and new users.
The proposed location is not considered environmentally sensitive. The proposed Project would not involve the use of significant amounts of hazardous substances, as it would consist of standard cell tower communications panels that are regulated by federal and State agencies, including the Federal Communications Commission (FCC). Sufficient setback distancing and screening is provided, which will minimize the visual impacts to surrounding properties. All public utilities and services will be available to the Project site. Based on staff's review, no special circumstances exist that would create a reasonable possibility that granting a CUP for this project will have a significant effect on the environment. Based on the proposed design, location, and standard conditions of approval, the proposed Project is a small structure with no expected significant effect on the environment. Therefore, the Project is exempt from CEQA, and no further environmental review is required.

The applicant, Chris Doheny of Smartlink on behalf of AT&T Wireless, is requesting approval of a Conditional Use Permit to install an unmanned 75-foot-tall stealth wireless telecommunication facility designed to resemble a eucalyptus tree (mono -e ucalyptus) located at the Southern California Edison Santa Rosa Substation property located at the northwest corner of Monterey Avenue and Clancy Lane. The proposed project will also include associated equipment within a 990 square-foot enclosure. The subject property includes two zoning classifications, Utility Substation (PU/SS), encompassing the site of the existing Southern California Edison (SCE) substation, and Very Low Density Residential (R-L-2).
BACKGROUND
In some portions of the City of Rancho Mirage, wireless communication has extremely poor reception. The City has a history of supporting wireless facilities in an effort to increase network connectivity and eliminate gaps in coverage. Of the 57 applications that have been submitted to the City for cell towers, 70% have been approved. Due to circumstances beyond the City's control, only 70% of the approved towers and/or facilities have been constructed and are operational.
Due to the significant increase in demand for phone and data coverage, AT&T radio frequency (RF) engineers have prioritized the proposed project and deemed the proposed location as the most feasible location to close AT& T's gap in coverage while finding the least intrusive means to do so. This project is partnered with Southern California Edison and Federal Government's FirstNet Program, which is the nation's communications network dedicated to emergency responders and the public safety community. The proposed project will fill a significant gap in Planning Commission Staff Report AGENDA ITEM#

ANALYSIS
Review Authority (Rancho Mirage Municipal Code Chapter 17.32) Wireless communication facilities and ancillary structures require an application for a Conditional Use Permit (CUP) and is subject to review and approval by the Planning Commission and City Council. The purpose of a CUP is to allow for the individual review of uses that are authorized by the General Plan but might have project-specific site development features or operating characteristics that need to be evaluated to ensure compatibility with surrounding areas and uses.
When reviewing a CUP, consideration is given to the location, design, configuration, operational characteristics and potential impacts to determine whether or not the proposed use will pose a detriment to the public health, safety and welfare. The purpose of Chapter 17.32 of the Rancho Mirage Municipal Code is to ensure that wireless communications networks are completed in the least visible fashion, and with the least disruptive impact on the neighborhoods and the communities within the City of Rancho Mirage. If it can be found that the proposed use is likely to be compatible with its surroundings, the reviewing authority may approve the proposed use subject to conditions stipulating the manner in which the use must be conducted. If the reviewing authority finds that the proposed use is likely to be detrimental to the general peace, health and general welfare, then it must deny the request.
Site Plan
The Project is located on a site that is owned and operated by Southern California Edison.
The proposed mono-eucalyptus within the equipment enclosure is located 25 feet north of the electrical substation. The equipment enclosure is placed 43'-7" from the back of street curb along Monterey Avenue, and the mono -e ucalyptus is approximately 59 feet away from the back of street curb. The mono-eucalyptus will be approximately 792 feet from the nearest residential structure to the north, 197 feet to the nearest residential structure to the east, 658 feet to the nearest residential structure to the south, and 443 feet to the nearest residential structure to the west. The proposed design and placement of the facility was approved by Southern California Edison to ensure that the cell site does not interfere with substation operations and maintain the required clearances to all energized equipment and access gates.
In addition, in a letter dated July 14, 2022, SCE has stated that the proposed cell site cannot be relocated further west in an area that has been reserved for future substation expansion. In addition to the 55-foot-tall electrical substation, utility and transmission poles are located throughout the subject property, which helps the proposed facility blend in with surrounding vertical elements and reduce the visual impact of the proposed mono-eucalyptus. The utility poles range from 55 feet to 65 feet tall, whereas the transmission poles range from 73 to 82 feet tall, with the 82-foot tall transmission pole located at the southwest corner of Verbenia Road and Monterey Avenue.
The proposed 990 square-foot AT&T lease space will be enclosed by an 8-foot-tall block wall enclosure with an 8-foot high, 12-foot wide metal gate painted in desert tan. The 30-foot by 33-foot equipment enclosure will house the mono-eucalyptus, a 20kW backup generator, and other associated equipment and equipment cabinets.

Site Justification
AT&T has identified a significant gap in coverage in the Monterey Avenue corridor, Eisenhower Medical Center, and the surrounding community, as identified on the submitted radio frequency (RF) propagation maps (Attachment 5). The 4G-L TE coverage propagation maps depict the network coverage that can be expected with the proposed facility at various overall heights: 75 feet above ground level, 70 feet above ground, 65 feet above ground level, and 55 above ground level. The RF exhibits also include the current AT&T coverage without the proposed facility for comparison. The current conditions in the Monte.rey Avenue corridor reveal a lack of indoor and in-vehicle coverage.
Wireless telecommunication facilities are encouraged to be placed in commercial, industrial, and public/semi-public zoning districts whenever feasible pursuant to Rancho Mirage Municipal Code Section 17.32.040. The subject property includes two zoning classifications, Utility Substation (PU/SS), encompassing the site of the existing Southern California Edison (SCE) substation, and Very Low Density Residential (R-L-2 ), making the subject property an ideal location for a new facility. Based on the design and placement of the proposed facility, the proposed location is the most feasible and least intrusive location available to close AT& T's gap in coverage and significantly improve coverage in areas such as Eisenhower Medical Center, Rancho Las Palmas shopping center, and adjacent residential communities.
As a part of the submittal, Smartlink conducted an alternative site analysis that included four potential alternate sites within the project site vicinity. The table below summarizes the alternative sites that were explored but were found infeasible:
Alternative Locations Reason
Albertson's Shopping Center Location was deemed infeasible since the landlord of shopping 40101 Monterey Ave center was not interested in providing a lease site.
Rancho Mirage, CA 92270
Plaza de Monterey Shopping Center Location was deemed infeasible due to the lack of available 73101 Country Club Dr. space, limited parking stalls and small drive aisles, and Palm Desert, CA 92260 proximity to existing residences to the east and south (shopping center is less than 50 feet to nearest residential structure).
Temple Sinai Location was deemed infeasible as wireless telecommunication 73251 Hovley Ln W. facilities are not permitted in the subject property underlying Palm Desert, CA 92260 zoning district in the City of Palm Desert.
Desert Arc Location was deemed infeasible since it did not meet the City of 73255 Country Club Dr . Palm Desert's setback requirements.
Palm Desert , CA 92260
Visual Impacts
In accordance with the Rancho Mirage Municipal Code, wireless communications and ancillary structures shall be designed so that observers will be unable to discern the presence of wireless communications antenna or antenna array on the project site. Pursuant to Rancho Mirage Municipal Code Section 17.32.090, the installation of wireless communication facilities and ancillary structures shall not be subject to any absolute height limit, provided the proposed facility addresses potential visual impacts . This objective is achieved through the following techniques:

• Stealth Design
The applicant is proposing a mono-eucalyptus design for this facility as it is one of the stealth designs that has the capability to hold the required antennas in order to fill the existing gap in coverage. The antennas are "stealthed" where it is hidden behind the proposed synthetic eucalyptus foliage and painted to match the colors of a eucalyptus tree. The equipment area is within the footprint of the cell tower and is screened behind a block wall enclosure. There are no existing structures in the area that AT&T could utilize which would provide similar coverage. Any portions of the equipment area that can be seen above the enclosure , such as the GPS antenna , are required to be painted to match the trunk of the mono-eucalyptus.
The proposed AT&T facility will consist of four (4) sector arrays with five (5) panel antennas per sector and twenty (20) RRUs all disguised within a new 75 -foot high mono-eucalyptus tree tower designed to blend in with the surroundings. The top of proposed mono -eucalyptus branches will be 75 feet above ground level, and the top of the proposed AT&T panel antennas will be approximately 69 feet above ground level.
To help conceal the antennas and associated equipment, the applicant proposes to paint the equipment to match the tree. The branch will be painted in Dunn -Edwards "Drifting," and the bark will be painted in Dunn-Edwards "Hickory" and Dunn-Edwards "Portobello Mushroom ." Foliage and mechanical equipment will be painted green, and eucalyptus style leaf socks will be installed on the proposed AT&T antennas for concealment.
The faux eucalyptus tree design allows for further screening capabilities for future collocation in comparison with a mono-palm design. The height of future collocation is depicted in the plan set, with the panel antennas at a centerline height of 45 feet.
Although the proposed wireless facility is collocatable, the future carrier will have to obtain a separate ground lease agreement for their ground equipment with Southern California Edison. Furthermore, the existing electrical substation and landscaping will screen and shield a significant portion of the leasehold area and a portion of the proposed mono -eucalyptus.
• Landscape Screening
To minimize the visual impact of the proposed wireless telecommunications facility, the applicant has worked with Southern California Edison to extend the existing landscape palette. Three 36 -inch box bottle trees are proposed around the mono-eucalyptus and equipment enclosure . Five 15-gallon cat's claw vines will be planted to grow along the equipment enclosure to further camouflage the enclosure . The SCE-approved planting palette matches the existing trees and shrubs on-site, and include coyote bush, bougainvillea, and Texas ranger shrubs. The groundcover within the equipment enclosure will be gravel. No existing landscaping is proposed to be removed as a result of the proposed project, as the only ground disturbances are within the footprint of the project site. The propose landscaping complies with the City 's landscape standards .
Access
The existing 17'-5" wide driveway access off Monterey Avenue is located approximately 726 feet north of the Clancy Lane and Monterey Avenue intersection. A 12-foot-wide, non - Planning Commission Staff Report AGENDA ITEM#

exclusive access easement starting from the existing driveway access to the proposed mono- eucalyptus location and AT&T ground equipment lease area has been proposed. The access path will be made of Class II Base, which is an aggregate made of recycled asphalt concrete and other recycled materials. A networks operation personnel member will visit the site every 4-6 weeks for general maintenance review.
Lighting
The only lighting proposed for the facility will be four shielded light fixtures mounted on the inside of the equipment enclosure wall for the technicians servicing the equipment.
As conditioned, the proposed wireless telecommunications facility meets the overall intent of the City's Development Code.
ADDITIONAL CORRESPONDENCE
As the project parcel is located adjacent to residential zoned properties, staff advised the applicant to notify the adjacent homeowners' associations . On July 14, 2022, the applicant mailed notification letters with tracking to the following homeowners' associations (HOA): La Terraza, Monterey Country Club, Rancho Las Palmas , and Revelle. Staff did not receive any comments from the HOAs regarding the proposed project.
As part of the review, staff sent notices to the Building and Safety Division, Public Works Department, and the Riverside County Fire Marshal's Office, and all applicable public utility companies and service agencies regarding the proposed project on June 14, 2022. Any received comments have been incorporated into this report and the Conditions of Approval.
ENVIRONMENTAL DETERMINATION
The Project has been reviewed for compliance with the California Environmental Quality Act (CEQA). Article 19 Categorical Exemptions includes a list of classes of projects that have been determined not to have a significant effect on the environment and that are, therefore, exempt from the provisions of CEQA. Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines exemption provides for the construction and location of limited numbers of new, small facilities or structures.
The proposed Project consists of a Conditional Use Permit (CUP) to construct and operate an unmanned 75-foot mono-eucalyptus wireless telecommunications facility with associated ~round equipment to improve the wireless coverage and capacity for existing and new users.
Based on the proposed design, location, and standard conditions of approval, the proposed Project is a small structure Planning Commission Staff Report AGENDA ITEM#

with no expected significant effect on the environment. Therefore, the Project is exempt from CEQA, and no further environmental review is required.
NOTICING REQUIREMENT
Rancho Mirage Municipal Code Section 17.74.020, Hearing and notice, requires that all property owners, as shown on the county's latest equalized assessment roll, within a 500-foot radius of the boundaries of the subject parcel(s) be notified of matters requiring a public hearing. If the number of property owners to whom the notice would be mailed to is less than 25, then the mailing radius is required to be increased to 1,000 feet as measured from the exterior boundaries of the subject parcel.
On February 8, 2023, public hearing notices were mailed to property owners within a 500-foot radius of the parcel boundary and posted at the City's designated community posting sites pursuant to the requirements of Chapter 17. 7 4 of the Municipal Code. Notification of the public hearing was published in The Desert Sun on February 12, 2023. Any information addressed to the Planning Commission, but received after completion of this final report, will be distributed at the public hearing. No comments have been received as of the publication date of this report.

FINDINGS
Cond it iona l Use Permit Case No. CUP22-0005
Pursuant to RMMC Section 17.48.060, Findings and decision, a cond it iona l use permit app li cat ion may be approved on ly if the fo ll ow ing f ind ings are made:
1. The proposed use is condit iona ll y a ll owed within, and wou ld not impair the integrity and character of, the subject zoning district and is in comp liance with all of the app licab le prov isions of this title. The General Plan and zoning of the project site is R-L-2 (Very Low Density Residential with a maximum of two dwelling units per acre) and Utility Substation (PU/SS). Wireless telecommunications facilities are permitted in both zoning districts upon approval of a Conditional Use Permit. Wireless telecommunication facilities are encouraged to be placed in commercial, industrial, and public/semi-public zoning districts whenever feasible pursuant to Rancho Mirage Municipal Code Section 17.32.040. The subject property is the site of the existing Southern California Edison (SCE) substation, making the subject property an ideal location for a new wireless telecommunications facility. Based on the design and placement of the proposed facility, the proposed location is the most feasible and least intrusive location available to close AT&T's gap in coverage and significantly improve coverage in areas such as Eisenhower Medical Center, Rancho Las Palmas shopping center, and adjacent residential communities. The mono-eucalyptus will be approximately 792 feet from the nearest residential structure to the north, 197 feet to the nearest residential structure to the east, 658 feet to the nearest residential structure to the south, and 443 feet to the nearest residential structure to the west. The proposed 75-foot-tall mono-eucalyptus will be below the height of the existing 82-foot-tall transmission pole. 2 . The proposed use is consistent w ith the C ity's General Plan, Zon ing Ordinance requirements, as condit ioned . As set forth in the above analysis, the proposed wireless telecommunications facility is in conformance with the City's General Plan and zoning ordinance. No variances or exceptions are requested.

3. The design, location, size, and operating characteristics of the proposed use are compatible with the existing and future land uses and would not create significant noise, traffic, or other conditions or situations that may be objectionable or detrimental to other allowed uses operating nearby or adverse to the public interest, health, safety, convenience, or welfare of the city. The Project is a unmanned, wireless telecommunications facility, which has been disguised as a eucalyptus tree in order to be stealth and not be highly visible from surrounding properties. It is required to operate within the regulations of the Federal Communications Commission. Infrastructure exists to serve this CUP application. Pursuant to Section 17.32.040 Preferred locations of the Rancho Mirage Municipal Code, wireless communication facilities are encouraged to be "located in commercial, industrial and public/semi-public zoning districts whenever feasible." An electrical substation exists on the Project site and is owned and operated by Southern California Edison. The project will not expose people or habitable structures to potential adverse geological impacts and the soil for the site is not unstable or expansive. The wireless telecommunications facility must be designed in conformance with standards as required by the California Building and Fire Codes.
4. The site is physically suitable for the type of development, as conditioned. An electrical substation exists on the Project site and is owned and operated by Southern California Edison. The proposed Project is required to operate within the regulations of the Federal Communications Commission (FCC). In addition, the applicant has proposed additional landscaping to match that of the existing landscaping to help screen portions of the proposed facility. The proposed planting palette has been approved by Southern California Edison.
5. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety. The wireless telecommunications facility must be designed in conformance with standards as required by the California Building and Fire Codes. In addition, it is required to operate within the regulations of Federal Communications Commission (FCC). Infrastructure exists to serve this CUP application. Based on the design of the proposed facility, it is expected that the project site will not generate or emit odors, dust, noise, vibrations, smoke, heat, glare, or lower property values in the immediate area based on the recommended conditions.
There will not be any significant, unmitigated adverse public health, safety or environmental effects resulting from the proposed new mono-eucalyptus, as no known biological or environmental issues were identified on site. The Project will not expose people or habitable structures to potential adverse geological impacts Planning Commission Staff Report AGENDA ITEM#

and the soil for the site is not unstable or expansive.
6. The proposed project has been reviewed in compliance with the prov1s1ons of the California Environmental Quality Act (CEQA) and there would be no potential significant negative effects upon environmental quality and natural resources that would not be properly mitigated and monitored, unless findings are made in compliance with CEQA.
The proposed Project consists of a Conditional Use Permit (CUP) to construct and operate an unmanned 75-foot tall mono-eucalyptus wireless telecommunications facility with associated ground equipment to improve the wireless coverage and capacity for existing and new users.

Coverage Legend ~'
Rethink Possibte· ~
In-Building Service: In general, the areas shown in dark green should have the strongest signal strength and be sufficient for most in-building coverage.
However, in-building coverage can and will be adversely affected by the thickness/construction type of walls, or your location in the building (i.e., in the basement, in the middle of the building with multiple walls, etc.) .i
In-Transit Service: The areas shown in the yellow should be sufficient fo r o n - street or in-the-open coverage, most in-vehicle coverage and possib ly so me in-building coverage.
Outdoor Service: The areas shown in the purple should have sufficle. strength for on-street or in-the-open coverage, but may notJl vehicle coverage or in-building coverage.
