The applicant, John Silverman of Smartlink, on behalf of AT&T Wireless, is requesting approval of a Conditional Use Permit to install an unmanned 60-foot-tall stealth wireless telecommunication facility designed to resemble a palm tree (monopalm). The wireless telecommunication facility will be placed in a 900 square foot block wall enclosure with an equipment shelter and emergency generator. The project site will be located southeast of the Rancho Mirage Fire Station 50 located at 70801 Highway 111. Although the project site includes two parcels, no development will occur on the Fire Station property, it will only be used to access the wireless telecommunications facility.
BACKGROUND
In some portions of the City of Rancho Mirage, wireless communication has extremely poor reception. In an effort to increase network connectivity and eliminate gaps in coverage, the City has supported similar wireless telecommunication facilities. In 2014 the City Council approved a Verizon Wireless telecommunication facility approximately 115 feet northwest of the Rancho Mirage Fire Station. AT&T is proposing a similar facility on the southeast side on a vacant parcel owned by the City of Rancho Mirage, which has the same height and similar design as the existing Verizon wireless telecommunication facility.
In 2022 City Staff was approached by Smartlink representatives looking to install a new wireless telecommunications facility at Fire Station 50 since there is a gap in cellular coverage within the general vicinity for AT&T customers. City Staff brought up the potential to collocate onto the existing Verizon monopalm, but due to the new antenna's placement requirement to be at a lower height, AT&T mentioned that would not meet their need to fill in the coverage gap. AT&T either had have a minimum setback of 100 feet from the existing Verizon monopalm or propose a facility taller than 60' if a new monopalm was placed close to the existing Verizon monopalm.

Therefore, the current location was selected on the east side of Fire Station on a vacant lot owned by the City.
Prior to the application submittal, Staff set up a meeting with the Thunderbird Homeowners' Association at the project site to share plans provided by AT&T showing a 60' tall wireless telecommunications facility to obtain initial feedback from the adjacent community. An approval letter from the Thunderbird HOA is included as Attachment No. 7.
Land Lease Agreement
The City is currently working on a Land Lease Agreement for this proposed wireless telecommunication facility. Initial lease payments for use of City owned property are proposed to be $2,000 per month by the applicant. Authorization to enter into a Land Lease Agreement is within the jurisdiction of the City Council and will be presented at a future City Council meeting for consideration.
Site and Surrounding General Plan, Zoning and Land Uses The subject vacant parcel is rectangular shaped, and measures approximately 272 feet wide by 240 feet long. The subject monopalm location is on a vacant lot immediately southeast of Fire Station 50 owned by the City. The subject parcel has an existing rock barrier along the middle of the lot and contains scattered desert vegetation throughout the area.
The vacant parcel is zoned Very Low Density Residential (R-L-2). Wireless telecommunications facilities are permitted upon approval of a Conditional Use Permit within this zone. The following table describes the surrounding land uses and zoning designations located adjacent to the subject property:

PROJECT DESCRIPTION
AT&T is proposing to install an unmanned 60-foot-tall stealth wireless telecommunication facility enclosed within a 30-foot by 30-foot, 8-foot-high block wall enclosure that is designed to match the existing rock barrier immediately in front of the facility. The enclosure area will include the mono -palm structure, generator, equipment shelter, and other associated equipment. The tower will resemble a palm -tree and will blend in with the surrounding area. To effectively disguise the Planning Commission Staff Report AGENDA /TEN#

wireless telecommunication facility, the applicant is proposing additional landscaping. The landscape will help screen the facility and camouflage the equipment.
The proposed monopalm will consist of three (3) sector arrays with four (4) panel antennas per sector, thirty-six (36) remote radio units (RRUs), six (6) surge suppressors, and one (1) microwave antenna all disguised within a 60-foot-high mono -palm tree. The proposed tower's primary coverage layer and broader coverage area will be 4GE-LTE, but it will also have 5th generation equipment and coverage.
ANALYSIS
Review Authority (Rancho Mirage Municipal Code Chapter 17.32) Wireless communication facilities and ancillary structures require an application for a Conditional Use Permit (CUP) and are subject to review and approval by the Planning Commission and City Council. The purpose of a CUP is to allow for the individual review of uses that are authorized by the General Plan but might have project -specific site development features or operating characteristics that need to be evaluated to ensure compatibility with surrounding areas and uses.
When reviewing a CUP, consideration is given to the location, design, configuration, operational characteristics and potential impacts to determine whether or not the proposed use will pose a detriment to the public health, safety and welfare. The purpose of Chapter 17.32 of the Rancho Mirage Municipal Code is to ensure that wireless communications networks are completed in the least visible fashion, and with the least disruptive impact on the neighborhoods and the communities within the City of Rancho Mirage. If it can be found that the proposed use is likely to be compatible with its surroundings, the reviewing authority may approve the proposed use subject to conditions stipulating the manner in which the use must be conducted. If the reviewing authority finds that the proposed use is likely to be detrimental to the general peace, health and general welfare, then it must deny the request.
Site Plan
The proposed 900 square -foot AT&T facility will be enclosed by an 8-foot-tall block wall enclosure with Desert Tan rock veneer siding. The 30-foot by 30-foot equipment enclosure will house the mono -palm, a 20kW backup generator, an equipment cabinet, and other associated equipment.
The monopalm will be setback approximately 15' from the fence separating the Fire Station property and the vacant lot, 187'-4" from Highway 111, 93'-0" to the nearest residential property line to the southwest (with a setback of 150 feet to the residential structure on the property), and 271'-6" to the southeast. For reference the existing Verizon Monopalm is setback 53'- 4" to the nearest residential property line and 128' from the curb -line of Highway 111. The proposed design and placement of the proposed facility was intended to intermix with the surrounding desert landscape and maintain adequate setbacks from both Highway 111 and the existing residential. The placement of the facility will not interfere with the Fire Station operations and maintain the required clearances to all energized equipment.

Site Justification
AT&T has identified a significant coverage gap in the Highway 111 corridor and the surrounding community, as shown on the submitted radio frequency (RF) propagation maps (Attachment 6).
The 4G-LTE coverage propagation maps depict the network coverage that can be expected with the proposed facility at various overall heights: 60 feet above ground level, 50 feet above ground, 40 feet above ground level, and 30 above ground level. The propagation maps also include the current AT&T coverage without the proposed facility for comparison. The current conditions in the Highway 111 corridor reveal a lack of indoor and in -vehicle coverage.
The Rancho Mirage Fire Station has an existing wireless facility located northwest corner of the property (Verizon Monopalm). The existing structure is a 60-foot-tall mono -palm with a backup emergency generator, associated equipment, and is surrounded by an 8' tall decorative masonry wall. Like the proposed facility, the Verizon tower has three sector arrays that are concealed with palm tree fronds. The prosed AT&T wireless facility will be similar to the existing Verizon facility in terms of height, setbacks, and stealth design.
Wireless telecommunication facilities are encouraged to be placed in commercial, industrial, and public/semi-public zoning districts whenever feasible pursuant to Rancho Mirage Municipal Code Section 17.32.040. The subject project site includes two zoning classifications, Fire Station (P/FS), encompassing the site of the existing Rancho Mirage Fire Station, and Very Low Density Residential (R-L-2) for the vacant lot. All new development will occur on the vacant lot, the Fire Station property will only be used for parking and access purposes. Based on the design and placement of the proposed facility, the proposed facility will be able to close a significant gap in AT&T's coverage and significantly improve indoor coverage for residential areas near the Thunderbird Country Club, Morningside Country Club, Sunrise Country Club, and The Springs Country Club.
Visual Impacts
In accordance with the Rancho Mirage Municipal Code, wireless communications and ancillary structures shall be designed so that observers will be unable to discern the presence of wireless communications antenna or antenna array on the project site. Pursuant to Rancho Mirage Municipal Code Section 17.32.090, the installation of wireless communication facilities and ancillary structures shall not be subject to any absolute height limit, provided the proposed facility addresses potential visual impacts. The visual impacts are analyzed through photo stimulations and reviewed by the following techniques listed below. AT&T provided visual photo simulations from different elevations and perspectives to show how the wireless facility would visually impact the surrounding buildings, single-
family homes, and street view from Highway 111. The photo simulations show before and after pictures which include the proposed monopalm, two proposed Date Palms, and the equipment enclosure with landscape.
Stealth Design
The applicant is proposing a mono -palm design for this facility as it is one of the stealth designs to fill the existing gap in coverage. The antennas are "stealthed" where it is hidden behind the proposed synthetic palm tree foliage and painted to match the colors of a palm tree. The equipment area is within the footprint of the cell tower and is screened behind a block wall enclosure that will match an existing rock wall. Any portions of the equipment Planning Commission Staff Report AGENDA ITEM#

area that can be seen above the enclosure, such as the GPS antenna, are required to be painted to match the trunk of the mono -palm. The mono -palm is the same design used for an existing wireless telecommunication facility located northwest of the Fire Station.
The proposed unmanned wireless telecommunications facility will consist of three (3) sector arrays with four (4) panel antennas per sector, thirty-six (36) remote radio units (RRUs), and six (6) surge suppressors all disguised within a 60-foot-high mono -palm tree designed to blend in with the surroundings. The top of the proposed mono -palm fronds will be 60 feet above ground level, and the top of the proposed AT&T panels antennas will be approximately 54 feet above ground level. To help conceal the antennas and associated equipment, the applicant proposes to paint the equipment to match the monopalm. Foliage and antennas will be painted green, and the palm tree leaf fronds will be installed on the proposed AT&T antennas for concealment. The 4-foot microwave antenna will be painted brown to match the monopalm trunk. Furthermore, the existing mature Date Palms in front of the property along Highway 111 range in height between 49'-55', there are exiting large shrubs scatted along the vacant property, an existing rock barrier traverses almost the entire length of the property, and the Fire Stations carports are immediately to the west of the facility, all of this combined will help screen and shield a significant portion of the facility.
Although the proposed wireless facility can support co -location due to its proposed height, the current plan does not have a specific co -location area. If another carrier proposes a co -location, the antennas must be placed at a lower height on the structure. The proposal would be subject to a review by the Planning Department.
Landscape Screening
To minimize the visual impact of the proposed wireless telecommunications facility, the applicant has proposed additional landscaping which includes two 36-foot-tall Date Palms around the equipment enclosure. Additionally, there are multiple Date Palms along the properties frontage on Highway 111 that range in height from 49'-55' and scattered vegetation throughout the lot. The existing and proposed landscape will blend in together to help screen the development. Eight (8) 15-gallon cat's claw vines and thirty (30) 5- gallon Texas ranger shrubs will be planted to grow along the block wall enclosure. The approved planting palette matches and/or compliments the existing landscaping on -site.
The groundcover within the equipment enclosure will be gravel. No existing landscaping is proposed to be removed as a result of the proposed project. The proposed landscaping complies with the City's landscape standards.
Access
The wireless telecommunication facility will be accessed through the Fire Station's south parking lot. AT&T in coordination with City Staff is proposing a non-exclusive maintenance parking space, which is the third parking space from the entrance driveway. In front of the non-exclusive parking space will be removeable bollards and chains for an access route. AT&T is proposing a five -foot -wide access route starting from the non-exclusive parking space to the proposed mono - palm location and AT&T ground equipment lease area. A portion of the existing rock barrier as shown on the site plan will be removed to provide access to the facility. A networks operation personnel member will visit the site every 4-6 weeks for general maintenance review.

Lighting
The only lighting proposed for the facility will be two shielded light fixtures mounted on the inside of the equipment enclosure wall for the technicians servicing the equipment. As conditioned, the proposed wireless telecommunications facility meets the overall intent of the City's Development Code.
ADDITIONAL CORRESPONDENCE
As previously mentioned due to the wireless facility's close proximity to homes within the Thunderbird neighborhood, Staff has been coordinating with the Thunderbird HOA. On February 16, 2023, Staff received an approval letter from the Thunderbird HOA for the proposed wireless facility. The letter requested the City of Rancho Mirage to notify all homeowners within 1,000 feet from the proposed monopalm site.
As part of the review, staff sent notices to Public Works Department, Riverside County Fire Marshal's Office, and all applicable public utility companies and service agencies regarding the proposed project on March 3rd, 2023. Any received comments have been incorporated into this report and the Conditions of Approval.
ENVIRONMENTAL DETERMINATION
The Project has been reviewed for compliance with the California Environmental Quality Act (CEQA). Article 19 Categorical Exemptions includes a list of classes of projects that have been determined not to have a significant effect on the environment and that are, therefore, exempt from the provisions of CEQA. Section 15303 (New Construction or Conversion of Small Structures) of the CEQA Guidelines exemption provides for the construction and location of limited numbers of new, small facilities or structures.
The proposed Project consists of a Conditional Use Permit (CUP) to construct and operate an unmanned 60-foot mono -palm wireless telecommunications facility with associated ground equipment to improve the wireless coverage and capacity for existing and new users. The proposed location is not considered environmentally sensitive. The proposed Project would not involve the use of significant amounts of hazardous substances, as it would consist of standard cell tower communications panels that are regulated by federal and State agencies, including the Federal Communications Commission (FCC). Sufficient setback distancing and screening is provided, which will minimize the visual impacts to surrounding properties. All public utilities and services will be available to the Project site. Based on staffs review, no special circumstances exist that would create a reasonable possibility that granting a CUP for this project will have a significant effect on the environment. Based on the proposed design, location, and standard conditions of approval, the proposed Project is a small structure with no expected significant effect on the environment. Therefore, the Project is exempt from CEQA, and no further environmental review is required.

FINDINGS
Conditional Use Permit Case No. CUP23-0002
Pursuant to RMMC Section 17.48.060, Findings and decision, a conditional use permit application may be approved only if the following findings are made:
The proposed use is conditionally allowed within, and would not impair the integrity and character of, the subject zoning district and is in compliance with all of the applicable provisions of this title. The General Plan and zoning of the project site is R-L-2 (Very Low Density Residential) and Fire Station (P/FS). Wireless telecommunications facilities are permitted in both zoning districts upon approval of a Conditional Use Permit. Wireless telecommunication facilities are encouraged to be placed in commercial, industrial, and public/semi-public zoning districts whenever feasible pursuant to Rancho Mirage Municipal Code Section 17.32.040. The subject wireless telecommunications facility will be built on a vacant parcel zoned R-L-2 and will utilize the Fire Station property in order to gain access to the site and park vehicles.
Based on the design and placement of the proposed facility, the proposed location is an ideal location to close AT&T's gap in coverage and significantly improve coverage in residential communities and for first responders. The equipment enclosure will be setback 187'-4" from Highway 111, 93'-0" to the nearest residential property line to the southwest, and 271'-6" to the southeast. In addition, the proposed design and placement of the facility will blend in with the surrounding desert landscape. The proposed wireless facility will be similar to the existing Verizon wireless telecommunications facility on the Fire Station property in terms of architecture, stealth design, height, and landscape screening.
2. The proposed use is consistent with the City's General Plan, Zoning Ordinance requirements, as conditioned. As set forth in the above analysis, the proposed wireless telecommunications facility is in conformance with the City's General Plan and Zoning Ordinance. No variances or exceptions are requested. The General Plan and zoning of the monopalm location is R-L-2 (Very Low Density Residential). Wireless telecommunications facilities are permitted within this zoning district upon approval of a Conditional Use Permit.
3. The design, location, size, and operating characteristics of the proposed use are compatible with the existing and future land uses and would not create significant noise, traffic, or other conditions or situations that may be objectionable or detrimental to other allowed uses operating nearby or adverse to the public interest, health, safety, convenience, or welfare of the city. The Project is an unmanned, wireless telecommunications facility, which has been disguised as a palm tree to be blend in with existing and proposed palm trees and not be highly visible from surrounding properties. It is required to operate within the regulations of the Federal Communications Commission. Infrastructure exists to serve this CUP application. Pursuant to Section 17.32.040 Preferred locations of the Rancho Mirage Municipal Code, wireless communication facilities are encouraged to be "located in commercial, industrial and public/semi-public zoning districts whenever feasible." Although the facility will not be located directly on the Fire Station property which is a within a public (P/FS) zoning district, the Planning Commission Staff Report AGENDA /TEN#

project will utilize the Fire Stations parking lot for access to the facility. Based on the propagation maps, the proposed facility is an ideal location to close AT&T's gap in coverage and significantly improve coverage in residential areas and for first responders. The project will not expose people or habitable structures to potential adverse geological impacts and the soil for the site is not unstable or expansive. The wireless telecommunications facility must be designed in conformance with standards as required by the California Building and Fire Codes. In addition, the antennas are "stealthed" where it is hidden behind the proposed synthetic palm tree foliage and painted to match the colors of a palm tree.
4. The site is physically suitable for the type of development, as conditioned. The wireless communication facility will be located next to Fire Station 50, which will provide access to the site within the existing parking area by having removal bollards. The location of the facility was selected in order to provide the most effective setbacks from existing residential and Highway 111. Based on the propagation maps, the proposed facility is an ideal location to close AT&T's gap in coverage and significantly improve coverage in residential areas. The proposed Project is required to operate within the regulations of the Federal Communications Commission (FCC).
In addition, the applicant has proposed additional landscaping to match that of the existing landscaping to help screen portions of the proposed facility.
5. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety. The wireless telecommunications facility must be designed in conformance with standards as required by the California Building and Fire Codes. In addition, it is required to operate within the regulations of Federal Communications Commission (FCC). Infrastructure exists to serve this CUP application. Based on the design of the proposed facility, it is expected that the project site will not generate or emit odors, dust, noise, vibrations, smoke, heat, glare, or lower property values in the immediate area based on the recommended conditions. There will not be any significant, unmitigated adverse public health, safety or environmental effects resulting from the proposed new mono -palm, as no known biological or environmental issues were identified on site. The Project will not expose people or habitable structures to potential adverse geological impacts and the soil for the site is not unstable or expansive.
6. The proposed project has been reviewed in compliance with the provisions of the California Environmental Quality Act (CEQA) and there would be no potential significant negative effects upon environmental quality and natural resources that would not be properly mitigated and monitored, unless findings are made in compliance with CEQA.

The proposed Project consists of a Conditional Use Permit (CUP) to construct and operate an unmanned 60-foot-tall mono -palm wireless telecommunications facility with associated ground equipment to improve the wireless coverage and capacity for existing and new users. Based on Staff's review, no special circumstances exist that would create a reasonable possibility that granting a CUP for this project will have a significant effect on the environment.
Based on the proposed design, location, and standard conditions of approval, the proposed Project is a small structure with no expected significant effect on the environment. Therefore, the Project is exempt from CEQA, and no further environmental review is required.

Commissioner Comments
Commissioner Chanter asked for clarification on the completion bonds and inquired about the amount of proposed live turf.
Ms. Lopez clarified that the project would be required to adhere to Rancho Mirage Municipal Code (RMMC) Section 16.20.090, which required performance and payment bonds to be in place to ensure site improvements were completed. She stated that the applicant proposed less than 10% live turf for the project, which satisfied the RMMC landscape standards.
Commissioner Curran stated that he had concerns regarding potential traffic, but that his concerns had been addressed after reading the staff report and the presentation.
Vice Chair Agostini welcomed public participation. He stated that, similar to Commissioner Curran, his concerns regarding traffic had been addressed. He requested that the City Attorney address the question regarding the current covenants or restrictions if those were changed.
Commissioner Bryant commented that he was impressed with the project, especially the studies on the site views and the style of the buildings. He asked if the two residential towers that had been approved in 1993 could still be constructed.
Ms. Lopez answered that the proposed Desert Island Hotel Specific Plan Amendment would supersede the 1993 amendment.
Majna Dukic, Development Services Director, added that the Specific Plan would need to be amended again for any future development.
Commissioner Bryant asked about transient occupancy tax (TOT) related to the hotel and condo - hotel units.

Steve Quintanilla, City Attorney, stated that condo -hotel units would be required to pay a minimum of $70,000 in the form of a public benefit fee, which was basically in -lieu TOT. This would be a yearly fee imposed on the condo -hotel units.
Commissioner Bryant asked the City Attorney to clarify if the condo -hotel unit use was considered a short-term rental.
Mr. Quintanilla stated that the City of Rancho Mirage currently had an ordinance banning all short- term rentals. The proposed condo -hotel units did not fall within the category or definition of a short-term rental. This was a unique product, referred to as a condo -hotel unit, and had to be rented through the hotel operator.
Ms. Lopez added that there was also a provision within the development agreement that required the condo -hotel units to only be rented through the hotel operator.
Commissioner Bryant asked if the condo -hotel units were required to be registered with the Securities Exchange Commission.
Mr. Quintanilla added that the Development Agreement included a provision requiring the condo - hotel units to be registered with the Securities Exchange Commission, if required.
Commissioner Bryant asked for further clarification on the shade structures.
Ms. Lopez answered that the shade structures were being commissioned as an art installation and prior to the approval of the Final Development Plan, the complete plans for the shade structures must be submitted to the Planning Division. The PDP Booklet sets the height and overall dimensions of the structures.
Commissioner Bryant asked if the concerns raised by the Architectural Review Board had been addressed.
Ms. Lopez replied that the Architectural Review Board endorsed the project with a few conditions concerning site circulation. She showed slides of the updated circulation exhibits and stated that the concerns had been addressed and incorporated into the PDP Booklet.
Commissioner Bryant asked if the access driveway off Frank Sinatra Drive would be limited to emergency services.
Ms. Lopez confirmed that the second access driveway would be limited to emergency services only and equipped with a Knox box.
Vice Chair Agostini invited the applicant to come up and make any comments.

3. Environmental Assessment Case No. EA23-0001, Conditional Use Permit Case No.
CUP23-0002. Applicant: Smartlink LLC on behalf of AT&T Wireless. Consideration to install an unmanned 60-foot-tall wireless telecommunication facility designed to resemble a palm tree (mono -palm) with an equipment shelter and generator within a 900 square foot block wall enclosure. The subject property is immediately southeast of the Rancho Mirage Fire Station No. 50 located at 70801 Highway 111, Rancho Mirage, CA 92270 (APN: 690-182-016, & -017).
The facility and block wall enclosure will be placed in the vacant lot south of the Fire Station.

Construction or Conversion of Small Structures); and
B. Consider the recommendation for the City Council to approve Conditional Use Permit Case No. CUP23-0002, subject to the conditions of approval and based on the content and findings in the staff report.
Lezlee Vasquez, Assistant Planner presented the staff report.
Public Comments — None.
Commissioner Comments
Commissioner Curran stated that the facility design was in line with others and the applicants had done a good job in order to improve coverage for residents.
Commissioner Chanter commented that most of the time we heard such positive things about Rancho Mirage and the only negative she hears about was that sometimes people lose their phone connection when they're driving within the City. She commented she was glad the project was being considered and it looked appropriate.
Vice Chair Agostini commented that as a long-time resident there were certain spots within the City that had coverage gaps. He mentioned it was important to continue to move into the next digital age with technology as people moved away from physical phone lines.
Commissioner Bryant asked if any public comments had been received.
Ms. Vasquez answered that two public comments against the project were received and distributed to the Planning Commission prior to the meeting. Both comments were from the Thunderbird community.
Commissioner Bryant asked if the new cell tower would interfere in any way with Fire Department communications.
Ben Torres, Planning Manager, noted that the cell tower was going to be located on City property, and a lease was being negotiated with AT&T, which included extensive interference provisions to ensure that fire station operations were not impacted by the proposed facility.
MOVED/SECONDED BY AGOSTINI /CHANTER TO RECOMMEND THAT THE CITY COUNCIL:
A. APPROVE THE FILING OF A NOTICE OF EXEMPTION BASED ON ENVIRONMENTAL ASSESSMENT CASE EA23-0001 AND PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) GUIDELINES SECTION 15303 (NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES); AND B. APPROVE CONDITIONAL USE PERMIT CASE NO. CUP23-0002, SUBJECT TO THE
CONDITIONS OF APPROVAL AND BASED ON THE CONTENT AND FINDINGS IN THE STAFF REPORT.
MOTION CARRIED 410.
4. Rancho Monterey Specific Plan Amendment Environmental Assessment Case No.
EA22-0001, General Plan Zoning Map Amendment Case No. GPZMA22-0001, Specific Approved 6/22/2023 Planning Commission Regular Meeting Minutes
9-30
Plan Amendment Case No. SPA22-0001. Applicant: MSA Consulting. The Rancho Monterey Specific Plan Amendment project site occupies approximately 35 acres of vacant undeveloped land west of Monterey Avenue and north of the Dick Kelly Drive/Ginger Rogers Road alignment. The project is within the boundaries of the Monterey Specific Plan which encompasses approximately 320 acres. The project proposes a mixed -use development of up to 400 residential units, up to 150,000 square feet of commercial retail space (including up to 150 hotel keys) and associated improvements. A General Plan/Zoning Map Amendment is also proposed to amend the underlying designation of Community Commercial to a combination of Mixed Use and Community Commercial. Location: The project site is located at the northwest corner of Monterey Avenue and Dick Kelly Drive (APNs: 685-090-002, -003, -005, -006, and -007) on approximately 35 acres.
A. Consider the recommendation for the Planning Commission to adopt Resolution No. [next in line] recommending that the City Council take the following actions:
1) Adopt Resolution No. [next in line] approving the Mitigation Monitoring and Reporting Program and Mitigated Negative Declaration (SCH#2023020253) for the Proposed Project based on Environmental Assessment Case No. EA22-0001; 2) Adopt Resolution No. [next in line] approving General Plan Zoning Map Amendment (GPZMA22-0001), to change the underlying zoning designation of the approximately 35- acre Subject Property from Community Commercial to a combination of Mixed Use and Community Commercial; and
3) Introduce and adopt Ordinance No. [next in line] approving Specific Plan Amendment (SPA22-0001).
Ben Torres, Planning Manager, presented the staff report.
Public Comments — None.
Commissioner Comments
Commissioner Bryant asked about the four public comments received.
Mr. Torres explained that the comments received were part of the environmental document comment period, not the typical public hearing noticing that was sent to property owners 15 days before the meeting. The comments were from public agencies like the Imperial Irrigation District and the City of Palm Desert.
Commissioner Bryant asked about the access points and roads to the project site.
Mr. Torres answered that at this time there was no development plan, but as the project site developed, they would have to do half width street improvements to provide access to the site.
Commissioner Curran added that he thought it was a great plan.
Vice Chair Agostini commented that he was encouraged to see the plan move forward with a mix of commercial and residential.
MOVED/SECONDED BY CHANTER /CURRAN TO ADOPT RESOLUTION NO. [NEXT IN LINE] RECOMMENDING THAT THE CITY COUNCIL TAKE THE FOLLOWING ACTIONS:
Approved 6/22/2023 Planning Commission Regular Meeting Minutes
9-31
A. ADOPT RESOLUTION NO. [NEXT IN LINE] APPROVING THE MITIGATION
MONITORING AND REPORTING PROGRAM AND MITIGATED NEGATIVE DECLARATION (SCH#2023020253) FOR THE PROPOSED PROJECT BASED ON ENVIRONMENTAL ASSESSMENT CASE NO. EA22-0001;
B. ADOPT RESOLUTION NO. [NEXT IN LINE] APPROVING GENERAL PLAN ZONING MAP AMENDMENT (GPZMA22-0001), TO CHANGE THE UNDERLYING ZONING DESIGNATION OF THE APPROXIMATELY 35-ACRE SUBJECT PROPERTY FROM

I am a resident of Thunderbird Heights, specifically
Oroville Circle, which is directly behind the proposed
WOR
tower.
I strongly object to the approval of this project at this meeting on the basis that inadequate work has been
done to assess and show the impact of the tower for all surrounding residents. The only very limited
simulations that have been done are insufficient as they do not show the impact of the project for any of the
residents at elevated positions behind it. The one
simulation from behind is taken at ground level only,
which looks up at the tower. But absolutely no
elevations are provided for more elevated properties on Placerville and Oroville which are far more likely to
look directly, potentially head on, at eye level, to the tower, and even directly at the head of the tower,
depending upon the elevation.
As a matter of basic fairness and equitable due
diligence, the City should not approve this as you do not have the requisite information to make an informed
decision. If you do so without any elevated level
simulations at all, you have completely ignored the
interests of those property owners. The process would
be illegitimate as you have not provided them with the
information needed to provide informed input.
I kindly request that the city require further elevated simulations be done for Placerville rd and Oroville cir, send those to all residents potentially impacted, and then again get feedback in order to decide.
Thank you.

Kristie
Forgive my late correspondence but I just learned of the cell tower Conditional Use hearing. My concerns center around the Tower design and placement as viewed for my property on Orovill Cycrle. I am not opposed to the tower itself but the lack of communication about design and placement on the Fire Station #1 property, and making sure the facility is sensitive to the residential community when it is sited and designed.
Some of these towers are wonderfully designed and they are hard to tell from an actual palm tree and others........... not so much.
Please make as conditions of approval working with the community on Tower Design and site placement so we in the community can be part of the solution.
No one has reached out to me to even have a conversion and design and siting.
Respectfully Joe Angel
