Re: Written letter to be entered into the Public record - Agenda Item: 1, for the Rancho Mirage "Special" City Council meeting of August 23, 2023 Dear Rancho Mirage City Council,
Please record this written statement as being in opposition of the proposed action of City officials to declare a State of Emergency in regards to the most recent weather event of August 20/21, 2023.

As stated by City of Rancho Mirage Municipal Code: 2.52.020 (State of Emergency defined) A State of Emergency would potentially exist if conditions are, or are likely to be, beyond the control of the City to manage (or words to that effect).

Please also consider, Municipal City code: 2.52.110 (City Managers powers - State of Emergency) opinion of the City Manager the locally available resources are Inadequate to cope with the emergency (or words to that effect).

It's crystal clear that "If" a State of Emergency is decided to be declared by City of Rancho Mirage officials day's after the stated weather event had passed through the area, and by considering the Municipal Code's listed above - showing that City officials are not able to provide and or retain the City's responsibilities beacuse of the August 20/21, 2023 weather event (Wind/Rain Flooding) Then it's reasonable that All available external forces should be retained for the management of City services and City departments. Plus, it should be considered that long term management of City finances and the operations of ALL City administrative services be performed by external forces due to potentially compromised City officials and their lack of ability to fulfill it's obligations to it's Residents and Businesses.

City of Rancho Mirage roadways that were deemed impassable and or damaged because of a recent weather event - were preventable. City controlled "Washes" were known to have increased water volume and velocity because of "Low water roadway passovers" being

removed upstream (Whitewater River). Combined with City's disturbances of wash area stream beds and other actions throughout the City where development projects were allowed to degrade the integrity of landscapes (Soil/sand detainment).

If the City's legal counsel (Steven Quintanilla and associates) and it's current City Council members are considering the declaration of an State of Emergency for the pupose (scheme) of gaining financial support for private sector businesses and or certain selected City Residences - those plans should be abandoned.

City of Rancho Mirage has the resources and abilities to cope with the most current Weather event - other City's in the region appear to have conspired to declare their "State's of Emergencies"
Please consider abiding to city regulations and Code's that clearly show that the declaration of a State of Emergency would be unjustified.

Sincerely,
Brad Anderson | 37043 Ferber Dr. Rancho Mirage, CA. 92270 [email protected]
