SUBJECT: Final Acceptance of Emergency Street Repairs to Highway 111 from Tropical Storm Hilary
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council accept the subject improvements (Emergency Street Repairs to Highway 111 from Tropical Storm Hilary) and authorize staff to record the Notice of Acceptance with the County Recorder's office.
JUSTIFICATION OR INFORMATION
On November 2, 2023, City Council approved the emergency street repairs to Highway 111 from a large tropical storm which caused road subsidence along Highway 111 due to water infiltration to the subsurface of the road at Library Way and Highway 111 and Mirage Cove and Highway 111 . The sinking in the roadway caused a traffic safety concern and needed to be repaired . The Van Dyke Corporation was directed by staff to perform an immediate emergency temporary repair, followed by permanent patch repairs as materials became available.
The Van Dyke Corporation performed the repairs for $70,495.00. The work has been inspected by staff and found to be within City standards.
Sufficient funds were available for the repairs from account 101-34000, emergency repair fund. No budget adjustments are required.
Staff recommends that the City Council accept the construction repairs and authorize staff to record the Notice of Acceptance with the County Recorder's office.

Notice is hereby given that the following public improvements have been completed and accepted by the City of Rancho Mirage City Council on December 21, 2023.

The five percent retention payment shall be retained in full value for thirty-five days from the date of the recordation of the Notice of Acceptance.
The labor and material security (payment bond) shall be retained in full value for seven (7) months from the date of this Acceptance.
This Notice of Acceptance is executed under authority of a directive from the City Council of the City of Rancho Mirage.
I, Ryan Stendell, declare under the penalty of perjury that I am the Public Works Director for the City of Rancho Mirage, that I am familiar with the facts stated in the foregoing Notice of Acceptance executed for and on its behalf, and that I have read the foregoing Notice of Acceptance and know the contents thereof to be true .
