STAFF REPORT
TO: Mayor and City Council DATE: December 21, 2023
FROM: Jacob De La Cruz, Financial Analyst
SUBJECT: Five-Year Development Impact Fee Report

SPECIFIC REQUEST OR RECOMMENDATION
That the City Council receive and file the Five-Year Development Impact Fee Report.

JUSTIFICATION OR INFORMATION
The City of Rancho Mirage Development Impact Fee (DIF) program was established in 2004 (Ordinance 881 ), transitioning the City from the License Tax Fee which was in place from 1973- 2004.

Government Code §§ 66000-66025 (the "Mitigation Fee Act") regulates how public agencies collect, maintain, and spend impact fees imposed on developers for the purpose of defraying costs of public facilities. It includes requirements for accounting, spending, and annually reporting the fees and related interest earnings, and for findings or refunds if funds remain unspent for five or more years after receipt.

Government Code § 66006(b)(1) sets forth the specific reporting requirements that should be included in this report, the basics of which are detailed below. • A brief description of the type of fee in each account or fund; • The amount of the fee;
• The beginning and ending balance of the account or fund; • The amount of the fees collected and the interest earned; • An identification of each public improvement for which fees were expended and the amount of each expenditure;
• An identification of the approximate date by which the construction of the public improvement will commence;
• A description of any inter-fund transfer or loan and the public improvement on which the transferred funds will expend;
• The amount of refunds made and any allocations of unexpended fees that are not refunded.

Five-Year Development Impact Fee Report
The attached document was prepared pursuant to the requirements set forth above and addresses them accordingly.

The City's Development Impact Fee Nexus Analysis identifies a list of improvements for which this fee is to be used, as well as the portion of improvements to be funded by impact fee revenues.

This study can be found on the Finance page of the City's website. Specific other sources and amounts offunding anticipated to be used to complete improvements are determined on a project by-project basis and are documented in the City's annual Capital Improvement Program adopted by City Council. The exact date of impact fee collection and deposit of funding is impossible to predict, as impact fee revenue is dependent on economic cycles associated with development activity.

Public Availability:

The Development Impact Fee Annual was made available to the public on December 11, 2023.

A copy of the annual report was posted to the City's Finance Division website and was delivered to the City Clerk for public accessibility at City Hall.
