3. A larger than the standard 315' by 315' site (final site dimensions will be determined once evaluation is completed), pre -approved by IID, will be required.

Final site dimensions will be determined once evaluation is completed. Additional requirements include but are not limited to, grading, fencing, permits, zoning change, environmental compliance documentation, landscaping (if required by the City), and all rights of way and easements for the substation, and access rights for both ingress and egress, as well as for transmission and distribution power line facilities, all of which are required to be provided to IID before starting the substation implementation.

4. The applicant will be required to extend one (1) distribution feeder (conduit and cable) from the new substation to the proposed project with a high level cost of $0.7 Million. This cost is in addition to the cost share for the substation. In addition, the applicant will be required to install the necessary conduit/vault systems following the Permanent Plan of Service as well as distribution getaways conduit systems from the required substation.

5. IID will not begin any engineering studies to provide electrical service to the project until the applicant submits a customer project application (available for download at http://www.iid.com/home/showdocument?id=12923 and detailed loading information, panel sizes, project schedule and estimated in-service date. Applicant shall bear all costs associated with additional facilities deemed necessary to provide electrical service to the project, including but not limited to distribution feeder/backbone extensions, distribution overhead and/or underground line extensions, as well as any other related upgrades and applicable permits, zoning changes, landscaping (if required by the County) and rights -of -way and easements.

6. It is important to note that a transmission -level power flow analysis (the cost of which is to be borne by the applicant) will be required to properly assess the impacts caused by this project once a customer project application and loading calculations are received. This detail information will allow IID to perform an accurate assessment and provide a full report of any potential impacts and mitigation measures. The conditions of service could change as a result of additional studies.

7. The applicant should be advised that pursuant to IID process, the standard time frame for the implementation of a new substation (engineering, equipment procurement and construction) requires an average of 36 months. As a result, the applicant should adjust the project's in-service dates accordingly.

8. Based upon the above, by a date no later than June 4, 2025, the applicant must provide the following documentation to IID: 1) Evidence of issuance of all local authorizations required to initiate construction, 2) Application for the installation of 4-496

underground infrastructure system and payment of accompanying fees and 3) Application for service and payment of accompanying fees. Absent receipt of such evidence and documentation by the referenced date, a new study will be required including a revised Plan of Service.

9. Line extensions to serve the project will be made in accordance with 110 Regulations:

No. 2 ( http://www.iid.com/home/showdocument?id=2540) , No. 13 ( http://www.iid.com/home/showdocument?id=2553) , No. 15 ( http://www.iid.com/home/showdocument?id=2555)

10. For additional information regarding electrical service for the project, the applicant should be advised to contact the IID Energy - La Quinta Division Customer Operations, 81-600 Avenue 58 La Quinta, CA 92253, at (760) 398-5841 and speak with the project development planner assigned to the area.

11.It is important to note that IID's policy is to extend its electrical facilities only to those project that have obtained the approval of a city or county planning commission and such other governmental authority or decision -making body having jurisdiction over said developments.

12. The applicant will be required to provide rights of ways and easements for any proposed power line extensions and/or any other infrastructure needed to serve the project as well as the necessary access to allow for continued operation and maintenance of any IID facilities located on adjoining properties.

13. The project proponent will be required to provide and bear all costs associated with acquisition of rights of way, easements, and infrastructure relocations deemed necessary to accommodate street or road improvements imposed by the municipality.

14. Public utility easements over all private public roads and additional ten (10) feet in width on both side of the private and public roads shall be dedicated to IID for the construction, operation, and maintenance of its electrical infrastructure.

15.Any construction or operation on IID property or within its existing and proposed right of way or easements including but not limited to: surface improvements such as proposed new streets, driveways, parking lots, landscape; and all water, sewer, storm water, or any other above ground or underground utilities; will require an encroachment permit, or encroachment agreement (depending on the circumstances). A copy of the IID encroachment permit application and instructions for its completion are available at https://www.iid.com/about-iid/department- directory/real-estate. The IID Real Estate Section should be contacted at (760) 4-497

339-9239 for additional information regarding encroachment permits or agreements.

16.Any new, relocated, modified or reconstructed IID facilities required for and by the project (which can include but is not limited to electrical utility substations, electrical transmission and/or distribution lines, ancillary facilities associated with the conveyance of energy service; the acquisition and dedication of real property, rights of way and/or easements for the siting and construction of electrical utility substations, electrical transmission and/or distribution lines and ancillary facilities associated with the conveyance of energy service, etc.) need to be included as part of the project's California Environmental Quality Act (CEQA) and/or National Environmental Policy Act (NEPA documentation, environmental impact analysis and mitigation. Failure to do so will result in postponement of any construction and/or modification of IID facilities until such time as the environmental documentation is amended and environmental impacts are fully mitigated. Any mitigation necessary as a result of the construction, relocation and/or upgrade of IID facilities is the responsibility of the project proponent.

17. Dividing a project into two or more pieces and evaluating each piece in a separate environmental document (Piecemealing or Segmenting), rather than evaluating the whole of the project in one environmental document, is explicitly forbidden by CEQA, because dividing a project into a number of pieces would allow a Lead Agency to minimize the apparent environmental impacts of a project by evaluating individual pieces separately, each of which may have a less -than -significant impact on the environment, but which together may result in a significant impact.

Segmenting a project may also hinder developing comprehensive mitigation strategies. In general, if an activity or facility is necessary for the operation of a project, or necessary to achieve the project objectives, or a reasonably foreseeable consequence of approving the project, then it should be considered an integral project component that should be analyzed within the environmental analysis. The project description should include all project components, including those that will have to be approved by responsible agencies. The State CEQA Guidelines define a project under CEQA as "the whole of the action" that may result either directly or indirectly in physical changes to the environment. This broad definition is intended to provide the maximum protection of the environment.

CEQA case law has established general principles on project segmentation for different project types. For a project requiring construction of offsite infrastructure, the offsite infrastructure must be included in the project description. San Joaquin Raptor/Wildlife Rescue Center v. County of Stanislaus (1994) 27 Cal.App. 4th 713.

18. When the project goes through the CEQA compliance process, it is important to bear in mind that to address the project impacts to the electrical utility (i.e., the IID electrical grid), considered under the environmental factor "Utilities and Services" of the Environmental Checklist/Intial Study, to determine if the project would 4-498

require or result in the relocation or construction of new or expanded electric power facilities, the construction or relocation of which could cause significant environmental effects; a circuit study/distribution impact study, facility study, and/or system impact study must be performed. The impact of the developmentof the proposed 17 -lot gated residential community on the electrical utilty was not was not evaluated.

19. Applicant should be advised that landscaping can be dangerous if items are planted too close to IID's electrical equipment. In the event of an outage, or equipment failure, it is vital that IID personnel have immediate and safe access to its equipment to make the needed repairs. For public safety, and that of the electrical workers, it is important to adhere to standards that limit landscaping around electrical facilities. IID landscaping guidelines are available at https://www.iid.com/energy/vegetation-management .

Response 3:

On May 3, 2024, the Imperial Irrigation District received from the City Of Rancho Mirage Planning Division, a request for agency comments on the Notice of intent to adopt a Mitigated Negative Declaration for the 17 Lot Subdivision project in Rancho Mirage, California; Tentative Tract Map No. 38041. The project proposes to subdivide the 8.42- acre project site, located on the east side of Via Josefina at the terminus of Victory Drive (APNs 685-080-031, -010 & 685-030-006) in Rancho Mirage, CA; into a 17 -lot gated residential community with lots ranging in size from approximately 12,511 sq. ft. to 22,323 sq. ft.

Based on the preliminary information provided to the IID, to accommodate the power load to service the proposed project will require the site acquisition, design, construction and commissioning of a new substation with two (2) 50 MVA 92/13.2 kV transformer banks in addition to distribution getaways and transmission line extensions. The required substation is currently anticipated to be constructed under a cost -share agreement concept on a per KVA basis, with a high-level cost estimate of $28 Million, based on 2024 IID rates. As a result, the project is not likely [to be] solely responsible for the entire cost, but the plan of service for the project is contingent upon the implementation of the substation and related upgrades, and the project will be required to contribute to the cost share arrangement. To the extent the cost share arrangement is not finalized, the project may be required to facilitate construction of the substation.

The comment is noted for the record. No further response is required.

The extension of two (2) 92 kV transmission lines with an in and out configuration is also needed to serve the substation from IID's existing 92 kV transmission system in the project vicinity.

The comment is noted for the record. This information has been incorporated into the IS/MND by reference.

The comment is noted for the record. This information has been incorporated into the IS/MND by reference. The project's implementation would conform to all pertinent City of Rancho Mirage requirements.

Response 15: The comment is noted for the record. This information has been incorporated into the IS/MND by reference.

Comment 16: Any new, relocated, modified or reconstructed IID facilities required for and by the project (which can include but is not limited to electrical utility substations, electrical transmission and/or distribution lines, ancillary facilities associated with the conveyance of energy service; the acquisition and dedication of real property, rights of way and/or easements for the siting and construction of electrical utility substations, electrical transmission and/or distribution lines and ancillary facilities associated with the conveyance of energy service, etc.) need to be included as part of the project's California Environmental Quality Act (CEQA) and/or National Environmental Policy Act (NEPA documentation, environmental impact analysis and mitigation.

Response 16: The analysis of electrical energy consumption was included in Section 6. Pertinent information included in the IS/MND is shown in italics and is provided below and on the following pages :

The proposed project would involve the subdivision of a seventeen lot residential development within the 8.42 acre project site. The proposed development would connect to a new 8 inch sewer line on the internal roadways and a new 12 inch sewer line on Via Josefina. The relatively level site is approximately 272 feet above mean sea level (AMSL) and contains no slope. The vegetation community present on site supports a sparse desert dune habitat encompassing mainly smaller native plants and some non-native grasses. The project site is comprised of 3 vacant, undeveloped parcels. These parcels are subject to the Section 30 Design Guidelines and Master Circulation Plan. The Zoning designation for the westernmost parcel is Very Low Density Residential (R -L-2). A 1.5 -acre portion of this parcel would require a General Plan Zoning Map Amendment (GPZMA) to change the current zoning from Very Low Density Residential (R -L-2) to Medium Density Residential (R -M). The remaining two parcels are designated as Medium Density Residential (R -M).

During construction, the proposed project would consume energy related to the use of fuels used to power construction vehicles and other equipment that would be used during site clearing, grading, and construction. Fuel use associated with construction vehicle trips generated by the proposed project was also estimated; trips include construction worker trips, haul truck trips for material transport, and vendor trips for construction material deliveries.

Energy consumed during construction would be temporary in nature and would not present a significant demand on energy resources. The proposed project would be constructed pursuant to the 2022 energy standards of Title 24. Construction equipment greater than 150 horsepower (hp), is also required to comply with the Environmental Protection Agency (EPA)/California Air Resources Board (CARB) Tier 3 emissions standards and shall ensure that all construction equipment is tuned and maintained in accordance with the manufacturer's specifications. For engines from 175 to less than 750 hp, the Tier 4 Final regulations took effect on January 1, 2014. For engines from 49 to less than 75 hp, it took effect on January 1, 2013. Finally, for engines from 75 to less than 175 hp, the Tier 4 regulations took effect on January 1, 2015. In addition, the project would be required to comply with the California Code of Regulations, Title 13, Sections 2449(d)(3) and 2485, which minimizes the idling time of construction equipment either by shutting it off when not in use or by reducing the time of idling to no more than five minutes. These emissions standards require highly efficient combustion systems that maximize fuel efficiency and reduce unnecessary fuel consumption. Therefore, no significant impacts due to wasteful, inefficient, or unnecessary consumption of energy resources during project construction are anticipated and no mitigation measures are required.

LODGE TI1:jAYLOSISLJNVIRONMENTAI! PLANNING
The increased demand is expected to be sufficiently served by the existing Imperial Irrigation District (IID) facilities. As shown in Table 5, the proposed project is anticipated to consume 262 kWh daily. The proposed project is located within the service area of the Southern California Gas Company. The project site currently has no demand for natural gas. Therefore, the development of the proposed project would create a permanent increase in the demand for natural gas. As shown in Table 5, the proposed project is anticipated to consume 3,776.8 cubic feet of natural gas on a daily basis.

Table 5 Proposed Project's Energy Consumption

Consumption Rate
Daily Energy Consumption
Electrical Consumption

California Air Pollution Control Officers Association. California Emissions Estimator Model.

Version 2022.1.1.21 (Used in Appendix A)
According to the CaIEEMod air quality emissions model, the 17 units would consume 158,767 kWh of electricity on an annual basis. According to the same model, the 17 units would consume 604,593 BTUs on an annual basis. The proposed project's energy consumption would be related to energy that would be used for lighting and other household activities.

Lighting would be required to follow the City's Outdoor Lighting Policy, which includes the use of energy efficient lighting. For these reasons, the project would not result in the wasteful, inefficient, or unnecessary use of energy. The project applicant would be required to work with the local electrical utility company to identify existing and future strategies that would be effective in reducing energy consumption. As a result, the impact would be less than significant.

Comment 17: Dividing a project into two or more pieces and evaluating each piece in a separate environmental document (Piecemealing or Segmenting), rather than evaluating the whole of the project in one environmental document, is explicitly forbidden by CEQA, because dividing a project into a number of pieces would allow a Lead Agency to minimize the apparent environmental impacts of a project by evaluating individual pieces separately, each of which may have a less -than - significant impact on the environment, but which together may result in a significant impact.

County of Stanislaus (1994) 27 Cal.App. 4th 713.

Response 17: The comment is noted for the record. The project, in its entirety, was evaluated in the IS/MND.

As a result, no piecemealing has occurred.

PAGE 5

LODGE TI1:jAYLOSISLJNVIRONMENTAI! PLANNING
Comment 18: When the project goes through the CEQA compliance process, it is important to bear in mind that to address the project impacts to the electrical utility (i.e., the IID electrical grid), considered under the environmental factor "Utilities and Services" of the Environmental Checklist/Initial Study, to determine if the project would require or result in the relocation or construction of new or expanded electric power facilities, the construction or relocation of which could cause significant environmental effects; a circuit study/distribution impact study, facility study, and/or system impact study must be performed. The impact of the development of the proposed 17 -lot gated residential community on the electrical utility was not was not evaluated.

Response 18: Please refer to Response 17.

Comment 19: Applicant should be advised that landscaping can be dangerous if items are planted too close to IID's electrical equipment. In the event of an outage, or equipment failure, it is vital that IID personnel have immediate and safe access to its equipment to make the needed repairs. For public safety, and that of the electrical workers, it is important to adhere to standards that limit landscaping around electrical facilities. PROJECT DESCRIPTION
The proposed project will subdivide 8.42 acres into seventeen single-family residential lots and lettered lots for common areas that include the private streets, landscaped parkways, and a retention basin. The residential subdivision will be gated, similarly to other residential subdivisions in the vicinity. Access to the proposed parcels will be provided by the private street (Veduta Way) off Via Josefina.

Detailed site planning, building footprints, floor plan, exterior design, landscaping, and grading will be submitted for review during the development review application process for the future development of the proposed parcels. The development of the proposed parcels will be subject to the development standards of the underlying zoning district in effect at the time of application submittal.

GENERAL PLAN ZONING MAP AMENDMENT
The existing General Plan and zoning designation of the project site is Very Low Density Residential for one parcel (4.91 acres) and Medium Density Residential (3.51 acre) for two parcels. A 1.5 -acre portion of parcel (APN: 685-080-031) currently designated as Very Low Density Residential is proposed to be amended to Medium Density Residential to allow for. The remaining two parcels are designated as Medium Density Residential (R -M). This proposed change will align with the Medium Density Residential parcel to the north that is part of the project site and will create a more uniform zoning in the vicinity. JUSTIFICATION OR INFORMATION CONTINUED:

Avenue have a Medium Density Residential designation, while properties along Via Josefina primarily maintain a Very Low Density Residential designation. Residential densities increase towards Monterey Avenue going east and the proposed land use change is in line with existing conditions in the vicinity. The minimum lot sizes also exceed the R -M zone and the average density for the project site is 2.02 dwelling units per gross acre which is compatible with the existing neighborhood. The project site will serve as a good transition and buffer between the higher residential densities allowed west of the project site.

In addition, this GPZMA will help achieve and/or establish the framework for implementation of Goals, Policies and Programs within the Land Use Element of the City's General Plan.

GOAL LU1: A resort residential community of desirable neighborhoods, a variety of community facilities, and high -quality development.

Response: Due to the unique configuration of the subdivision consisting of three parcels with different land use designations. The shift from R -L-2 to R -M will create a more desirable neighborhood by allowing a clean transition between the change in land uses.

Housing Goals & Policies
• GOAL H 1: A variety of housing types that meet the needs of residents in Rancho Mirage. • Policy H 1: The General Plan shall provide for a mixture of residential densities dispersed throughout Rancho Mirage.
• Policy H 2: The City's residential development standards shall allow for a diversity of housing types to provide new housing choices and enhance housing mobility while adhering to the General Plan's community design policies.

Response: The proposed change from R -L-2 to R -M for a 1.5 acre portion of the site will allow for more variety in housing types and allows for a mix of residential densities. Various housing choices will be available based on the configuration of lots and lot sizes contained within this subdivision. The minimum lot sizes also exceed the R -M zone and the average density for the project site is 2.02 dwelling units per gross acre which is compatible with the existing neighborhood. The project site will serve as a good transition and buffer between the higher residential densities allowed west of the project site.

ANALYSIS
Review Authority (Rancho Mirage Municipal Code Section 16.12.065) A tentative map is a map approving the division of land for the purpose of sale, lease, or financing, and is governed by the Subdivision Map Act. A tentative map prescribes how the land is to be subdivided. The City's Subdivision Ordinance (Rancho Mirage Municipal Code Title 16 Subdivisions) establishes the minimum standards for the design of the lots, and the public improvements which serve them.

As set forth in the above analysis, the proposed subdivision is in conformance with the Rancho Mirage General Plan, Zoning Code, and all applicable requirements of the Subdivision Map Act.

Access and Circulation
The Project site is located on the east side of Via Josefina at the terminus of Victory Drive. The proposed subdivision will be gated, similar to other residential developments in the vicinity.

Access to the proposed parcels will be provided by the private street (Veduta Way) off Via Josefina and an interior cul-de-sac street named Paesaggio Court. Staff routed the proposed street names to emergency services and the post office; no concerns with the street names were brought up. The private streets will be 37 feet wide and contain landscape islands in conformance with the Section 30 Design Guidelines. A secondary 24 -foot -wide emergency access gate will provide access to Key Largo Avenue and will be located south of the retention basin.

Grading and Drainage
The Project site naturally slopes to the west to east and is situated at an elevation of approximately 308 to 327 feet above mean sea level. Adjacent residential and vacant properties are flat -lying and are approximately at the same elevation as the site.

The proposed pad elevations for the seventeen (17) proposed lots have been determined by the site topography reviewed by the City Engineer. The table below lists the proposed pad elevations for each parcel:

All storm water and nuisance water drainage will be contained on site, including the street frontage area. Lot B located at the northeast corner of the project site will contain a retention basin which has a capacity of 47,013 cubic feet to serve the entire project site. As conditioned, the applicant is responsible for submitting the final hydrology report and grading plan to the Engineering Division for review and approval.

Entry, Landscaping, and Walls
The project site is located within Section 30. The Section 30 Design Guidelines require a minimum of a 19 feet parkway from the curb to a wall. The proposed project meets this requirement with the parkways along Via Josefina and Key Largo Avenue being 19 feet. The Section 30 Design Guidelines also require transparency in the front and side yards. The applicant proposed metal vehicle entry gates that allow for visibility and decorative wrought iron fencing along the front and side yards satisfying the requirement. A 6 -foot -tall black metal entry vehicular gate with various linear openings allows transparency into the subdivision on both the Via Josefina main entry and Key Largo Avenue emergency access gate. Four small decorative black metal shade structures (13' x 9'), with a maximum height of 10.5 feet will line the entry into the subdivision. The proposed shade structures are similar to those found within the Escala community along Via Marta. The subdivisions six-foot tall perimeter walls will be of an 8"x8" block painted white with 12"x12" breeze block along some segments of the wall to conform to the Section 30 Design Guidelines and the Rancho Mirage Municipal Code (RMMC). The landscape parkways along Via Josefina and Key Largo Avenue feature a desert -appropriate landscape palette and the required six-foot wide "Yosemite Brown" colored concrete meandering sidewalk in accordance with the Section 30 Design Guidelines. The private streets will contain three landscape islands with four total 36 inch box Sonoran Palo Verde trees in conformance with the Section 30 Design Guidelines. In addition, the retention basin will be richly landscaped with the same trees proposed in the subdivision and various shrubs like Purple Training Lantana and Pink Mulhy.

As stipulated in the Rancho Mirage Municipal Code (RMMC) Section 17.24.040 (B) trees must be planted at a rate of at least one tree for every thirty linear feet of street frontage. The project site has approximately 1,157 linear feet of frontage off Via Josefina and Key Largo Avenue with a proposed fifteen (15) Sonoran Palo Verde trees (36 -inch box) and twenty-three (23) Mulga trees. This will result in a ratio of one shade tree per every 30 feet, which meets the RMMC requirement. In between the trees, the landscape will be enriched forty (40) Date Palms (14 foot tall and by shrubs like Red Yucca. Ground cover will consist of Pewter Gray crushed rock in a 3/8" size.

ADDITIONAL CORRESPONDENCE
As part of the subdivision review, staff sent notices to the Public Works Department, Riverside County Fire Marshal's Office, and all public utility companies and service agencies regarding the proposed subdivision on November 22, 2023. As conditioned all agencies are expected to provide service to the proposed parcels. Any received comments have been incorporated into this report and the Conditions of Approval.

ENVIRONMENTAL DETERMINATION
An environmental assessment application was submitted for the proposed project and the determination was made that the project required an Initial Study. An Initial Study has been prepared resulting in the recommendation to adopt a Mitigated Negative Declaration (MND).

Mitigation measures were recommended for Biological & Tribal Cultural Resources. A Notice of Determination will be filed with the Riverside County Clerk once a final determination has been made by the City Council. The complete Initial Study, along with the Mitigation Monitoring and Reporting Program, is included in Attachment 3 — Draft Mitigated Negative Declaration.

A Notice of Intent to Adopt a Mitigated Negative Declaration was published in the Desert Sun on May 5, 2024, and distributed to interested parties on May 3, 2024. The Initial Study/ Mitigated Negative Declaration was circulated for a 30 -day public review period starting on May 6, 2024 to June 4, 2024, and the City received one comment letter from the Imperial Irrigation District (IID).

While the City is not required to respond to comments, Sections 21091(d)(1) and 21092.5 of the Public Resources Code (PRC) and Section 150874 (b) of the California Environmental Quality Act Guidelines require that before project approval a Lead Agency must consider all comments received before making a final determination. With due consideration of the proposed mitigation measures, the City included a response to comments which was included as in the Draft Mitigated Negative Declaration.

SB18 & AB 52 Tribal Consultation
The City initiated tribal consultation in accordance with Assembly Bill 52 (AB 52) and Senate Bill 18 (SB 18) on November 22, 2023, with contacts for twenty-four (24) tribes and representatives provided by the Native American Heritage Commission (NAHC) notifying them of the proposed project. The City was contacted by two tribes which included the Agustine Band of Cahuilla Indians which mentioned they were unaware of specific cultural resources but to contact them if any are discovered. The Cahuilla Band of Indians requested tribal monitors during ground disturbing activities. No additional requests for formal consultation were received and the SB 18 and AB 52 noticing period was concluded on February 22, 2024.

21. STORMWATER RETENTION
The grading of the project shall be designed such that all storm water to the level of a 100 -year frequency storm; worst case of the 1, 3, 6, or 24 -hour duration, shall be retained on site, including the street frontage area. A Hydrology/Hydraulic Report, in accordance with the Riverside County Hydrology Manual, shall be submitted from a Registered Civil Engineer, showing how this stormwater is handled. Combination drywell/catch basins per city Standard 311 are expected on Via Josefina, one at the north end of the project frontage, and another just upstream from the project entry. On the Key Largo frontage, a catch basin and pipe to the retention basin at the northeast corner of the tract would be best, allowing overflow from the catch basin after retention of the worst case duration of the 100 year storm stormwater quota is met.

22. WQMP
Whether they are in areas that must retain 100% stormwater or not, all discretionary projects that meet any of the following criteria must submit "Project -Specific Water Quality Management Plans (WQMP)" in accordance with Appendix H of the Whitewater River Region Storm Water Management Plan (SWMP) (available at:
http://content.rcflood.orq/N PDES/WhitewaterWS.aspx)

Commercial and industrial developments of 100,000 square foot or more; D.) Automotive repair shops [includes Standard Industrial Classification (SIC) codes 5013, 7532, 7333,7534, 7537, 7538, and 7539];
E.) Retail gasoline outlets disturbing greater than 5,000 square feet; F.) Restaurants disturbing greater than 5,000 square feet; G.) Home subdivisions with 10 or more housing units;
H.) Parking lots of 5,000 square feet or more or with 25 or more parking spaces and potentially exposed to Urban Runoff; or
I.) Discharge into the MS4 (aka Municipal Storm Drain System) and disturb an area of one acre or more, or disturb less than one acre, but are part of a larger common plan of development or sale (referred to as Other Development Projects) If any of the above criteria exist, or at the discretion of the City, a Final WQMP shall be required prior to permit issuance, with Recording of a Covenant, or other approved mechanism, establishing the WQMP as a Public Record that shall apply upon occupancy, and continuing forward, to all future operators/residents of the project. Any approved design modifications that take place during construction shall be documented and incorporated into the Recorded WQMP Covenant prior to occupancy.

FINDINGS
Tentative Tract Map Case No. TTM23-0003 (Tentative Tract Map No. 38041) Pursuant to RMMC Section 16.12.065 Action on tentative tract maps, a tentative tract map may be approved only if the following findings are made:

1. The proposed Tentative Tract Map is consistent with the City's General Plan as specified in Section 65451 of the California Government Subdivision Map Act. The current General Plan and zoning designation for the Project Site is Very Low Density Residential (R - L -2) and Medium Density Residential (R -M). The maximum residential densities for the R -L-2 zone are 2 dwelling units per gross acre and for the R -M zone 4 dwelling units per gross acre. Overall the project has a combined density of 2.02 dwelling units per gross acre but densities within each of the two zones comply with their maximums. As conditioned, the proposed tentative map is consistent with the City's General Plan and Subdivision Map Act.

2. The design or improvement of the proposed subdivision is consistent with the City's General Plan, Zoning Ordinance requirements, as conditioned. The development of the proposed parcels will be subject to the development standards of the underlying zoning district in effect at the time of application submittal. As set forth in the above analysis, the proposed subdivision is in conformance with the City's General Plan, zoning, and all applicable requirements of the Subdivision Map Act. The General Plan and zoning designation of the project site is Very Low Density Residential for one parcel (4.91 acres) and Medium Density Residential (3.51 acre) for two parcels.

A 1.5 -acre portion of parcel (APN: 685-080-031) currently designated as Very Low Density Residential is proposed to be amended to Medium Density Residential. The remaining two parcels are designated as Medium Density Residential (R -M). This proposed change will align with the Medium Density Residential parcel to the north that is part of the project site and will create a more uniform zoning in the vicinity.

The proposed GPZMA will help achieve and/or establish the framework for implementation of Goals, Policies and Programs within the Land Use Element of the City's General Plan.

GOAL LU1: A resort residential community of desirable neighborhoods, a variety of community facilities, and high -quality development.

Response: Due to the unique configuration of the subdivision consisting of three parcels with different land use designation. The shift from R -L-2 to R -M will create a more desirable neighborhood by allowing a clean transition between the change in land uses.

Housing Goals & Policies:
• GOAL H 1: A variety of housing types that meet the needs of residents in Rancho Mirage.
• Policy H 1: The General Plan shall provide for a mixture of residential densities dispersed throughout Rancho Mirage.

of housing types to provide new housing choices and enhance housing mobility while adhering to the General Plan's community design policies.

Response: The proposed change from R -L-2 to R -M for a 1.5 -acre portion of the site will allow for more variety in housing types and allows for a mix of residential densities. Various housing choices will be available based on the configuration of lots and lot sizes contained within this subdivision.

3. The site is physically suitable for the type of development, as conditioned. The proposed parcels comply with the City's Development Code standards pertaining to minimum lot size and dimension requirements for the underlying zoning designation of the Very Low Density Residential (R -L-2) and Medium Density Residential (R -M) zones.

4. The site is physically suitable for the proposed density of development, as conditioned. The proposed project consists of two different zoning districts and has an overall density of 2.02 dwelling unit per gross acre. Maximum densities in the Very Low Density Residential and Medium Density Residential Zones do not exceed the maximum permitted density. No variances or exceptions are requested. No development is being proposed in conjunction with the proposed subdivision. Detailed site planning, building footprints, floor plan, exterior design, landscaping, and grading will be submitted for review during the development review application process for the future development of the proposed parcels. The development of the proposed parcels will be subject to the development standards of the underlying zoning district in effect at the time of application submittal.

5. The design of the subdivision and proposed improvements is not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat.

The project has been reviewed for compliance with the California Environmental Quality Act (CEQA) and based on the implementation of the projects Biological Resource Mitigation Measures there would be no potential significant negative impacts upon environmental quality and natural resources.

6. The design of the subdivision or the type of improvements is not likely to cause serious public health problems, as conditioned. As part of the subdivision review, staff sent notices to the Public Works Department, Riverside County Fire Marshal's Office, and all public utility companies and service agencies regarding the proposed subdivision on November 22, 2023. As conditioned all agencies will be expected to provide service to the proposed parcels, including providers of gas, electrical, water, sewer, and cable telecommunication services. Permits are required to be obtained to construct the new site improvements. No public health impacts are expected.

7. The design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision, as conditioned. The subdivision's design complies with the Section 30 Design Guidelines. As part of the subdivision review, staff sent notices to the Public Works Department, Riverside County Fire Marshal's Office, and all public utility companies and service agencies regarding the proposed subdivision on November Planning Commission Staff Report 4Gil1 EM#

Commissioner Curran commented that he reviewed the plans for the proposed project. He noted that it resembled other subdivisions in the area and that it appeared to meet and exceed all the requirements of the City's development code. He did not see any reason not to move forward with this project.

Vice Chair Chanter inquired about the price of the future homes and asked staff to clarify the public street condition of approval in the staff report. She asked what would happen if the developer did not complete the project and the subdivision was not designed to withstand storm damage.

Ms. Tsai responded that there were no development plans for residences submitted with the request. She stated that subdividers were responsible for improving their side of the street and explained that they would have to go through the final map process and subdivision improvements to ensure design requirements were met.

Majna Dukic, Development Services Director, added that the developers are required to go through the Public Works Department. She also explained that the City was looking into potentially improving Vista Del Sol, but if the City did not move forward with improvement, the developer would be responsible to install their share of improvements.

09/12/2024 Planning Commission Meeting Minutes e 2 of 6
