Action Galendar No. 12: Gonsider Adopting Ordinance (Next-in-Order), Repealing Section 2.02.130 (Vacancies in City Council Offices) of Ghapter 2.01 (City Council) of Title 2 (Administration and Personnel) of the Rancho Mirage Municipal Code
Good afternoon Mr. Mayor and Council Members.
l'm lsiah Harris and I live in Rancho Mirage,
I appreciate the opportunity to address you regarding this important change in how the City fills vacancy on the City Council.
I fully support the process that the Council has embarked on to repealing Section 2.02.130. l'm here today to share with you my thoughts on the proposed ordinance as published with the meeting agenda.
The way the ordinance is written, the residents of Rancho Mirage would have to read Government Code 36512 to try and decipher the actions to be taken by the Council to fill a vacancy.
I believe the ordinance should be clear and straight fonrvard for the residents to understand and for the Council to implement.
To that end, I offer the following:
1. The ordinance as written does not have a Section 3, so I suggest that Section 3 should be inserted as follows:
Section 3. COUNCIL VACANCIES
A. lf a vacancy occurs on the City Council, the City Council shall, within sixty (60) days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy as provided by subsection (b) of California Government Code Section 36512.
B. lf the City Council fills the vacancy by appointment, the person appointed shall hold office only until the date on which the City holds a special election, which shall immediately be called to fill the remainder of the term as permitted under Subsection (c)(3) of California Government Code Section 36512. The special election may be held either on the date of the next regularly established election or regularly scheduled municipal election to be held throughout the City not less than one hundred and fourteen (114) days from the call of the special election, as provided by Subsection (c)(3) of California Government Code Section 36512.
C. The person appointed shall be barred from being a candidate to fill the remainder of the term of this vacancy.
' D. Amendments to Government Code Section 36512 Subsections (b) and (c)(3) are hereby automatically incorporated into this Section.
The above lays out precisely how the process will work.
Regarding Section 7 Amending of Bail Schedule, it's unclear to be as to the relevance of this section to the filling of vacancies on the City Council. Maybe the City Attorney can address it. , I have every confidence that the Council will make a decision that's best for the City of Rancho Mirage.
Thanks for your time and consideration.
