SUBJECT: Extension of Completion Date for Tract Map 33329 (Via Josefina)
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council authorize a Second Amendment of Subdivision Improvement Agreement, which provides for the extension of the completion date for Tract Map 33329 until November 4, 2025.
JUSTIFICATION OR INFORMATION
Tract Map 33329 subdivided an existing 4.77-acre parcel into nine residential lots on the east side of Via Josefina, approximately 500 feet north of Ginger Rogers Road. Offsite improvements include parkway landscaping, entry gates and walls, and a retention basin, in compliance with Section 30 design guidelines. Decorative paving will be used at the project’s entry and at the cul-de-sac bulb.
The Final Tract Map for the project was approved by City Council on November 4, 2021. The agreement that the developer entered into with the City required that all improvements be completed no later than two years from approval date, which was November 4, 2023 (see Attachment 2). City Council approved the First Amendment of the Subdivision Improvement Agreement on October 19, 2023. As a result of a delay in horizontal improvements, the development stalled, and the agreement expired on November 4, 2024. The Developer is requesting an extension to complete the improvements.
The Developer is in the final stages of project completion; however, there is still offsite and onsite work to be completed, and the Developer has requested an extension of the required completion date until November 4, 2024 (See Attachment 3).
DISCUSSION:
Section 16.20.110B of the City’s Municipal Code permits the extension of the completion date by the City Council if a timely request is made and adequate evidence is provided to justify the extension.

If the extension is approved, the Code states that the subdivider shall enter into a subdivision improvement agreement extension with the City. In consideration of a subdivision improvement agreement extension, the following adjustments may be required:
a. Revision of improvement plans to provide for current design and construction standards.
b. Revised improvement construction estimates to reflect current improvement costs. c. Increase of improvement securities in compliance with revised estimates. d. Additional inspection fees.
e. Any fees then in effect.
Engineering staff has reviewed the Tract circumstances and sees no need to increase securities or fees or make other adjustments per the above list at this time. The Council may impose additional requirements as it may deem necessary as a condition to approving any time extension for the completion of subdivision improvements.
The developer has requested the extension so that she can complete the improvements per the attached construction schedule. The offsite and onsite improvements for the Tract Map are to be completed by November 4, 2025.
Staff supports the requested extension. Upon completion of the improvements, the project will be final inspected by the City and a punch list of necessary corrections will be generated. Upon completion of the punch list and acceptance of improvements by the City Council, the project will be complete, and securities released.
