City Council Staff Report
Vista Del Sol Street and Waterline Improvement District #31-26
DATE ITEM #
September 3, 2026 PUBLIC HEARINGS - 6A.
Presented To Presented By
Mayor and City Council Tyler Fowlkes, Senior Management Analyst
RECOMMENDED ACTION
Consider whether to proceed with formation of Vista Del Sol Street and Waterline Improvement District No. 31-26, provided a majority protest does not exist following the public hearing and ballot tabulation.
DISCUSSION
On June 4th, 2026, the City Council initiated proceedings for the proposed Vista del Sol Street and Waterline Improvement District #31-26 (“District”). The proposed District would finance roadway and water infrastructure improvements that provide special benefit to properties within the District.
The proposed roadway improvements generally include curb and gutter, asphalt pavement, and surface drainage improvements. The proposed water improvements generally include waterlines, valves, fittings, service connections, fire hydrants, and related infrastructure.
At the June 4th meeting, the City Council adopted resolutions initiating the assessment district proceedings, establishing procedures for the completion, return, and tabulation of assessment ballots, and preliminarily approving the Engineer’s Report. As part of those actions, the City Council established September 3 rd, 2026, as the date for the required public hearing.
Following the June 4th meeting, notices and assessment ballots were mailed to affected property owners in accordance with Proposition 218 and applicable state law. The ballots allow property owners to indicate their support for or opposition to the proposed assessment. Votes are weighted according to each property’s proportional financial obligation under the proposed District.
As part of the City’s outreach efforts, a community information meeting was held on August 6 th, 2026, at the Rancho Mirage Library and Observatory Community Room. The meeting provided property owners with an opportunity to receive information regarding the proposed District, improvements, assessments, financing, and ballot process and to ask questions regarding the project.
PUBLIC HEARING AND BALLOT TABULATION
378
At today’s meeting, the City Council is conducting the required public hearing for the proposed District. During the public hearing, the City Council will receive testimony regarding the proposed improvements and assessments.
Property owners may submit, change, or withdraw assessment ballots until the conclusion of the public input portion of the hearing.
Following the close of the public input portion of the hearing, the assessment ballots will be tabulated in accordance with the procedures previously adopted by the City Council. The ballots are weighted according to the proportional financial obligation of each affected property.
If the weighted ballots submitted in opposition to the assessment exceed the weighted ballots submitted in favor, a majority protest exists. In that circumstance, the City Council may not impose the proposed assessment and the District cannot proceed as proposed.
If a majority protest does not exist, the City Council may, but is not required to, proceed with formation of the District. The Council may consider the ballot results and determine whether to approve formation of the District, levy the assessments, and proceed with the proposed improvements.
Staff is not recommending a position regarding formation of the District. The purpose of today’s item is to conduct the required public hearing, tabulate the assessment ballots, determine whether a majority protest exists and, if a majority protest does not exist, provide the City Council the opportunity to determine whether to proceed with the project.
FISCAL IMPACT
There is no new fiscal impact associated with conducting the public hearing and tabulating the assessment ballots.
If the City Council elects to proceed with formation of the District, the fiscal impacts would be consistent with those previously presented to the City Council as part of the June 4th, 2026 proceedings. 379
City Council Staff Report
Coachella Valley Association of Governments (CVAG) Joint Powers Agreement Amendment
DATE ITEM #
September 3, 2026 ACTION CALENDAR - 7A.
Presented To Presented By
Mayor and City Council Juan Guerra , Administrative Analyst
RECOMMENDED ACTION
Approve Amendment No. 1 to the Third Amendment and Restatement of the Joint Powers Agreement of the Coachella Valley Association of Governments (CVAG).
DISCUSSION
The Coachella Valley Association of Governments (CVAG) has requested that its member jurisdictions consider Amendment No. 1 to the Third Amendment and Restatement of their Joint Powers Agreement (JPA). The proposed amendment revises provisions concerning alternates serving on CVAG's Executive Committee and provides the Executive Committee with the ability to establish attendance requirements for Executive Committee members and their alternates.
The proposed amendment originated from a request by the Twenty-Nine Palms Band of Mission Indians to revise the JPA to allow Tribal staff, specifically the Tribe's Chief Executive Officer, to serve as its alternate representative on the CVAG Executive Committee. Under the existing JPA, only current members of a member jurisdiction’s legislative body may serve as members of the Executive Committee. The proposed amendment creates an exception for Tribal Nations.
Specifically, Amendment No. 1 revises Section 2.4.3 of the JPA to provide that, for Tribal Nations, the alternate may be the highest-level executive or administrative officer, provided the individual is formally appointed by resolution of the Tribal Nation's legislative body.
In order to further encourage participation in CVAG meetings, the amendment also adds Section 2.4.6, authorizing the CVAG Executive Committee to adopt and amend bylaws governing attendance by the Executive Committee membership. Such bylaws may establish attendance requirements and consequences for repeated absences, including temporary suspension, deactivation, or loss of voting privileges.
The proposed amendment does not otherwise modify the existing JPA. All provisions not expressly amended would remain unchanged.
On June 29, 2026, The CVAG Executive Committee approved Amendment No. 1 to the Third Amendment and Restatement of the JPA and directed the Executive Director to distribute it to member jurisdictions for consideration. The amendment becomes effective upon approval by two-thirds of CVAG's member jurisdictions.
If this JPA amendment is approved, CVAG’s bylaws will be amended to clarify that CVAG’s officers must be current members of a member jurisdiction’s governing body.380

ITEM 4D
Coachella Valley Association of Governments
Executive Committee
June 29, 2026
STAFF REPORT
Subject: Request from Twenty-Nine Palms Band of Mission Indians to Amend the CVAG Joint Powers Agreement
Contact: Erica Felci, Deputy Executive Director ([email protected]) Recommendation: Approve Amendment No. 1 to the Third Amendment and Restatement of the Joint Powers Agreement, direct the Executive Director to distribute it to member jurisdictions for approval and, upon two-thirds approval, implement an amendment to the By-Laws to clarify CVAG’s officers must be elected officials
Background: At its April 27, 2026 and June 1 meetings, CVAG’s Executive Committee reviewed a request from Twenty-Nine Palms Band of Mission Indians Chair Darrell Mike to amend CVAG’s Joint Powers Agreement (JPA) in order to revise the alternates who can represent a member jurisdiction at the Executive Committee. The request is to amend the JPA to allow Tribal staff, specifically Chief Executive Officer George Nicholas Jr, to serve as the Tribe’s representative on the Executive Committee. CVAG staff previously provided a number of options for potential JPA revisions, and was directed to come return with language that was more specific to Tribal Nations.
Since CVAG’s inception, JPA member jurisdictions agreed that the Executive Committee would be made up of the mayors of the member jurisdictions or their alternate/designee, so long as they are sitting elected members of the city. All five Riverside County Supervisors were also made members of the Executive Committee. The Third Restatement of the JPA, authorized in 2018, expanded that to include “the Tribal Chair from each Indian Tribe” and noted that “any Indian Tribal Council may appoint one of its current council members in place of the Tribal Chair.” The Twenty-Nine Palms Band of Mission Indians has been a CVAG member since 2021.
The Tribe’s request focuses on Section 2.4.3 of the JPA, which specifies the alternates on CVAG’s Executive Committee. Based on feedback from members, CVAG Legal Counsel has drafted Amendment No. 1 to the Third Amendment and Restatement of the JPA. The amendment includes language that was provided to the Executive Committee at its June 1 meeting. In order to further encourage participation in CVAG meetings, Amendment No. 1 also authorizes the Executive Committee to adopt and amend bylaws governing attendance by Executive Committee members and their alternates at meetings of the Executive Committee. Any such policy would come to the Executive Committee for consideration at a future meeting.
Staff recommends approving Amendment No. 1 and directing the Executive Director to circulate it to member jurisdictions for adoption. Amendment No. 1 would become effective upon approval of two- thirds of CVAG’s member jurisdictions. Staff also recommends that, upon the approval, that CVAG’s By-Laws be amended to make it clear that staff alternates on the Executive Committee cannot serve as CVAG’s officers. This will help the agency avoid a scenario where a member jurisdiction’s staff is governing over elected officials. Article II, Section 2B of the By-Laws would be amended as follows:
ATTACHMENT 2
385
The Executive Committee, as defined in Article III, shall recommend nominees for Chairman and Vice-Chairman. Ordinarily, the Vice-Chairman will succeed the Chairman at the conclusion or his or her term of office. Except as provided below, the nominees shall be rotated among the member agencies in the following order: Agua Caliente Band of Cahuilla Indians, Indio, Cabazon Band of Mission Indians, Torres Martinez Desert Cahuilla Indians, Twenty-Nine Palms Band of Mission Indians, Palm Springs, Coachella, Desert Hot Springs, Rancho Mirage, Riverside County’s Fourth Supervisorial District, Blythe, La Quinta, Palm Desert, Cathedral City, Indian Wells, and Riverside County’s Fifth Supervisorial District. New members will be added last in order to the rotation. The Chairman and Vice-Chairman must be members of their member jurisdiction’s governing body. The jurisdiction next in order to serve as an officer will be passed over and moved to the end of the rotation if its representative or alternative alternate have not attended seventy-five percent or more of the Executive Committee meetings in the previous year. Based on a recommendation of the Administrative/Personnel Committee, the Executive Committee may in making its nominations deviate from the strict rotation set forth above if determined to be in CVAG’s best interests.
As noted in previous reports, JPA amendments and changes requires 15 separate actions at City Council, Tribal Council and Riverside County Board of Supervisors meetings. This lengthy process is part of the reason that CVAG has only amended the JPA on rare occasion in its five decades of existence. Staff will provide an update to the Executive Committee once the two-thirds approval benchmark has been reached.
Fiscal Analysis: There is no fiscal impact to the JPA amendment. Costs related to circulating the amendment would be covered under staff time and expenses for legal services.
