My wife and I received an Administrative Citation to remove all 9 Allepo pine trees because they are dead. We disagree with the Citation because it does not apply to our situation. More importantly the two "arborists" reports used as a basis for the Citation lack procedural and certifiable authenticity.
We are filing this Appeal because when we asked for a Readonable Accomodation to see if the pine trees start greening in the Spring months until the end of May, the Code Enforcement officer said no.
We noticed that our pine tree situation does not meet the criteria outlined in the RMMC 14.60.050:
a) We do not have any "dead, decayed, diseased or hazardous trees or shrubs...." All 9 Aleppo pintrees are as immovable as the California Redwood. Very little encroachment on neighbors' property. b) Our trees don't have dead or fallen limbs or branches to present a safety hazard or obstruct the use of a public right of way. (encl photos)
The Code Enforcement officer's findings akso came from the two reports the HOA claimed were from Certified arborists. a) The first Report is from a company that's been tree trimming for the HOA for over 20 years. The report seems casual without any on site observations and testing. However this report includes tree trimming services for removal. b) The second Report also involves remote observation and irrigation assumptions. This Report also lacks on site testing and accuracy. It mentaons tubing around trees only. What the arborist doesn't see is the extensive tubing throughout under the desert landscaping (encl photo).
When I received the email from the HOA which included the Reports, I requested credentials that indicates they are certified, licensed and registered with the International Society of Arboriculture (ISA) or any registered organization that deals with arborist.
I didn't get a reply from the HOA.
I emailed the RMCE officer with an article about the Aleppo Pine Mystery Blight detailing how the Aleppo goes through this phase of looking dead especially November thru April. According to the article, the Aleppo pines will start greening in May/June. I also included a picture of one Aleppo pine with 75% greening pine needles all over (encl photo). I also forwarded the Arborits' Reports in the email from the HOA with my concern that the reports were not detailed and lacked validation.
Even though the RMCE officer on his visits referred to the "value" that the condition of our pine trees might have on properties, the homes have been selling for around a million or more. I'm sure our pine trees didn't impact those sales negatively.
We request the following remedy:
1. We would like to have an extension till the late Spring (May - June) to see which Allepo pine trees will survive the Aleppo Pine Blight. The trees that don't survive will be removed.
2. We would request you consider waiving the Fine because of confusion and I find it interesting to justify the Citation criteria cannot be justified from the "Arborists"' Reports mainly.
Please note that all referenced (encl photos) and emails can be provided on request.
Thany you for your courtesy,

Hi Jamie,
SANCHEZ
LANDSCAPE INC.
Thank for reaching out to us regarding this arborist report, although it is difficult to determine a tree/plants cause of death after it is dead/dry. However, I was able to use the helpful information you emailed us regarding their landscape conversion. I also visited the property and did a visual inspection,I did not take pictures of some crucial information as I did not want to invade the residents privacy but I will explain below; the following is a minor summary of my finding:
The Pine trees in the front landscape are Scotch Pines(Pinus silvestris), these trees do very well here in the Coachella Valley with the exception of some minor die back from summer heat. They do require heavy irrigation , especially in the summer time.
I noticed a brown netafin irrigation tubing(drip) was installed around the base of the trunks of all pines, I did not visually see any other source of irrigation other than a water hose on a sprinkler.
This type of irrigation install is inadequate as it is placed at base of the Trunk. Pine roots near the trunk and surrounding areas are primarily used to anchor the tree. The irrigation is recommended to be installed at the feeder roots(drip line). Im attaching a picture to illustrate where theirrigation should have been installed. It also helps the trees when small plants are planted around and surrounding the trees as well. The tree roots will normally benefit from these plants as it serves as additional irrigation for the trees.
Conclusion: The resident failed to have proper irrigation installed when transitioning from his turf to desert landscape. A deep water irrigation system should have been installed to salvage the trees into their new surrounding environment. Note: even with proper Irrigation installed, the trees would have taken on some stress as they do not too well in a drought tolerant irrigation system.
Recommendation: Removal of Pines is highly recommended as dead trees become unstable especially these particular Pines that are very tall.
Sincerely,
Jeff Sanchez

Mr Nitao thank you for your Courtesy Notice.
I would like to address concerns regarding your "Courtesy Notice". I would like to call attention to several details. More notably I will submit an article with studies and insights of the Aleppo Pine Tree Blight Mystery.
First you and I looked at the pine trees and you took photos of some pine trees with green pine needles and others struggling to green (cf photo),I also explained to you that the extreme heat of 2024 and our conversion to desert landscaping may have been the cause of the problem that affected the trees.
Respectfully I noted that we are aggressively taking steps to bring most of these trees to their luscious green glory. Most of the trees showed signs of greening pine needles which disappeared on some once the Fall conditions set in.
We are requesting a courtesy grace period when the trees come out of dormancy which based on the Arcticle is around May 2025. If we get confirmation which trees are not going to survive, we will coordinate the schedule for removing the dead pine trees.
Secondly you mention "conditions... located at 47 Lincoln Place that are in violation of the Rancho Mirage Municipal Code...."
I would like a copy of this RMMC that deals specifically with pine trees and also our rights as a homeowner regarding these violations.
Furthermore I would like a copy of the complaint and documentation your referencing in your Notice. More importantly I know from my own observations that most of the trees are alive and a.
thriving. An "Arborisr's" declaration without empirical evidence that the Aleppo pine trees are dead is careless condemnation of the trees and of the International Society Arboriculture (ISA) Certification that they are claiming.
Thank you for your cooperation and attention and I apologize for the sloppy Courtesy Response.
Respectfully,
Willma Hurst and Mitchell Krupa

Legally We did not give you permission to trespass on our property to do any testing on our trees? Why weren't we notified in a timely manner of the testing for permission? In your email you refrence violations of specific rules and Code. Please forward any and all rules or Codes you are refrencing and applicable to the trees.

would like a copy of the arborits reports and aoo eat t'iie gy of their certifica.io . Importantly whatsts they performed to come to the conclusionh ees are dead. Are they even aware of e APB (Aleppo Pine Blith) phenomenon and how it affects the Aleppo pines? Our position continues to be that the Aleppo pine trees are thriving and are going through one of their blythe phases where they appears to be" dead" but manage to recover. This is an idiosyncrasy of the Aleppo pine and a mystery of the APB phenomenon. The Aleppo pine trees should continue their greening glory by around May 2025 and continue unless it is interrupted by "THE MIGHTY MYSTERY OF ALEPPO PINE BLIGHT." We will continue to be vigilant and caring for our Aleppos as long as they show signs of life.
Thank you Gor your concerns.

Dear Homeowner(s):
Owning in Presidential Estates Homeowners Association, Inc., offers many advantages as well as imposing some restrictions. To ensure that these benefits are available to all residents requires observance of the association's Rules and Regulations as well as neighborly considerations.
Every member of the community has agreed to abide by the Covenant's Conditions and Restrictions (CC&Rs), Architectural Guidelines, and Rules and Regulations adopted by Presidential Estates Homeowners Association, Inc.. These safeguards benefit the entire community. Such uniformity in necessary to maintain the beauty of our community as well as the individual investments each of you has made.
On 12/07/2024 it was noted: Per visual/written evaluation of two licensed arborists, and by request of the HOA board of directors, it has been determined the pine trees located on your property are dead and should be removed for safety reasons. The Architectural guidelines mandate you must first submit an application and landscape plan outlining the removal of all dead pines trees and requested/desired replacement plants/trees, of your selection, for review by the ARC.
Pursuant to Architectural Guidelines J. Trees may not be removed without prior Architectural Committee approval.
LAF0036
As you were previously notified on September 25, 2024 of this item, the HOA requests:
Please submit an Architectural application and landscape plan to address the removal/ replacement of the dead/dying trees on your property, within 30 days of the date of this letter.
We are requesting your voluntary cooperation/compliance in taking the necessary measures to correct this situation as noted above. Failure to do so may result in further communications in the form of violations, which could ultimately result in suspension of amenities (if applicable), and/or action from the Board of Directors with the possibility of fines assessed to your account, if not resolved in a timely manner.
We greatly appreciate your attention to this matter. If you have any questions, please email me at [email protected].

Good morning,
I am writing to you on behalf of my client, Presidential Estates HOA located off of Gerald Ford and DaVall on Lincoln Place.
I am copying in our Board President, Lee Lahtinen.
The Association sent a courtesy notice (attached) to the owner of record, Wilma Hurst, 47 Lincoln Place, dated 10 -31 - requesting an architectural application and landscape plan be submitted within 30 days of the date of the letter, to dmove/replace the dead pines located on the property (front and rear).
The Association received written response (attached) from Wilma Hurst's partner, Mitchell (Mitch) Krupa, dated 11-4- 2024 (attached) debating the matter.
The Association Board of Directors met on November 21 & again December 18, 2024, to further discuss this matter.
IManagement was requested to obtain a 2nd independent opinion from a certified arborist on the condition of the pines located at 47 Lincoln Place.
The Association also received written complaints from concerned neighbors, over the condition of these pine trees due to their extreme height/size.
IThe Association has 2 written reports from 2 certified arborists identifying that due to the desertscape conversion (attached are all documents and photos from that project) and other mitigating factors, those pines are dead and should be removed.
I have attached copies of both of the communications from the Association; the owner's partner's response; the past desertscape conversion info; and 2 certified arborist reports on the condition of the pine trees located at 47 Lincoln Place for review and action by Rancho Mirage Code Compliance in conjunction with the HOA enforcement, for the health and safety of all concerned.
e Board of Directors for the Association is meeting this Thursday, January 16, 2025 at 3:00 PM.
We thank you in advance for your assistance here and look forward to your response. i
