Additionally, I would like to thank City staff for their thoughtful work in updating the City's private property wireless ordinance.
Verizon greatly appreciates the City's collaborative approach to involve the industry in drafting this amendment and encouraging the critical infrastructure needed to support increased connectivity. Wireless telecommunications facilities on private property allow for the greatest coverage footprint, technology diversity and resiliency.
Thank you again for your leadership, partnership and continued support of connectivity in the community. We greatly value the ongoing dialogue and development with the City and look forward to continuing to improve our network to support the residents, businesses, visitors and emergency services in the City of Rancho Palos Verdes.

Dear City Council Members,
I am writing to urge the Council to support the acquisition and permanent preservation of the 0 Wind port Canyon property being discussed.
This parcel is a natural extension of Agua Amarga Canyon and is important to the area's habitat, views, open-space character, and ecological continuity. Once developed, those qualities cannot realistically be restored .
I understand there are financial and maintenance considerations, but I hope the Council will consider the long-term value of acquiring the entire parcel and preserving it in perpetuity as open space. There is also a conceptual trail called Indian Valley #506 that could be designed and setup by Open Spaces and Trails over the next 5-10 years providing great access to open space for the local nighborhood Clo<;.e~ (e-9.::, ol~ ,tt- z_,
near Hesse Park to Crest Ave. It is included in the latest Trails Network Plan and shown below in purple. Designing it would be much easier if easements are not required but regardless, I strongly support preserving it with or without a trail as it currently exists.
Thank you for your consideration.

Good afternoon Herb,
I can tell you that the City Council agrees with your remarks regarding local control.
I appreciate the attached write-up and have provided it to the City Attorney for review.
That said, as you may recall, the City joined four other General Law cities and filed suit against the state in response to SB 9.
The lawsuit claimed exactly what you cite in your email regarding the state constitution and local general plans and zoning.
The courts ruled in favor of the state and the cities, including RPV, appealed and also lost on appeal.
A similar suit was filed by Charter Cities, and they reached a similar outcome.
Retaining local control remains a high priority for RPV and is on the City's legislative platform along with the Council goals.
The City's letters on past legislation reinforce the Council's position on local control which can be found on the City's website.

Hi Ara,
I would like to suggest that there may be a legal basis for RPV to defend its traditional local land-use authority against the state's increasing land-use mandates.
California Constitution, Article XI, Section 7, provides cities and counties with the authority to make and enforce local ordinances and regulations concerning municipal affairs, except where such authority is preempted by state law or the matter is determined to be of statewide concern.
The state's position is that issues such as homelessness and the shortage of affordable housing constitute matters of statewide concern, thereby justifying increased state involvement in local land-use decisions.
I would suggest, however, that there is a legitimate question as to whether the state's own policies have contributed to the conditions it now characterizes as a statewide concern. In particular, the state's sanctuary-state policies and broader immigration policies have contributed to increased demands on housing and public services. The state has subsequently used the resulting housing pressures as a justification for overriding traditional local land-use authority.
I believe RPV should consider whether this issue warrants a legal challenge. The courts may ultimately need to determine whether the state can create, or materially contribute to, conditions that it then characterizes as a statewide concern and use those conditions to justify overriding constitutionally recognized local authority.
At a minimum, I believe the City should explore the legal basis for such a challenge rather than simply accepting the continuing expansion of state control over local land-use decisions.
I am attaching two papers that I have prepared for your consideration.
Herb
