CITY COUNCIL REGULAR MEETING MINUTES
April 27, 2022
The meeting was called to order at 7:02 p.m. in the Council Chambers. Present: Mayor Anne D.
Figueroa, Mayor Pro Tempore Jerry Holloway, Council Members L. Anthony Beall, Carol A. Gamble and Bradley J. McGirr (5). Absent: None (0). The Salute to the Flag was led by Council Member Beall.
Staff Present: Jennifer M. Cervantez, City Manager; Greg Simonian, City Attorney; Brendan Dugan, Public Works Director/City Engineer; Cheryl Kula, Development Services Director; Mihaela Kennedy, Captain; Amy Diaz, City Clerk.

4. CONSENT CALENDAR
Mayor Pro Tempore Holloway moved, seconded by Council Member Gamble to approve the Consent Calendar (Item Nos. 4.1 through 4.6).

4.1 WAIVE READING IN FULL OF ALL ORDINANCES ON THE AGENDA Waived reading in full of all ordinances on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.
4.2 APPROVAL OF CERTIFICATES OF RECOGNITION
Approved the following Certificates of Recognition:
1) Business Recognition to Pavilions; and
2) Boys and Girls Club Youth of the Year, Xitlalic Rojas; and 3) Certificates of Recognition - Student Recognition Program:
a) Melinda Heights Elementary School - Caroline Vincent and Peyla Dahn; b) Rancho Viejo Montessori School- Devaya Rao and Reagan de Zwart.
4.3 APPROVAL OF MINUTES
Approved the April 13, 2022 City Council Regular meeting minutes.
4.4 APPROVAL OF WARRANT REGISTERS DATED APRIL 11, 2022 AND APRIL 18, 2022 Approved the warrant registers totaling $1 ,438,517.94.
4.5 INVESTMENT REPORT FOR THE MONTH OF MARCH 2022
Received and filed the Investment Report for the month of March 2022.
4.6 APPROVAL OF PROPOSED AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES AGREEMENT WITH CHARLES ABBOTT ASSOCIATES, INC., TO PROVIDE
ON-CALL PROFESSIONAL CIVIL ENGINEERING, BUILDING & SAFETY, PLAN
REVIEW AND INSPECTION CONSULTING SERVICES
1) Approved proposed Amendment No. 1 to the current Professional Services Agreement with Charles Abbott Associates, Inc., for On-Call Professional Civil Engineering, Building & Safety, Plan Review and Inspection Consulting Services, which a) extends the term of the agreement by two years through June 30, 2024, and b) increases the total maximum not-to-exceed compensation amount by $595,000, from $860,000 to $1,455,000 for a total five-year contract term, in order to provide continued Professional Civil Engineering, Building & Safety, Plan Review and Inspection Consulting Services; and
2) Authorized the Mayor to execute the proposed Amendment No. 1 to the Professional Services Agreement with Charles Abbott Associates, Inc. 2 City of Rancho Santa Margarita

5.1 A PROPOSED RESOLUTION AMENDING THE CITY'S MASTER FEE SCHEDULE BY
ADJUSTING CERTAIN GENERAL GOVERNMENT FEES AND OTHER CITY RATES,
CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES BASED ON
THE INCREASE IN THE CONSUMER PRICE INDEX
Mayor Figueroa introduced City Manager Cervantez who introduced Cheryl Kula, Development Services Director, both of whom presented the item.
Mayor Figueroa opened the item to City Council questions of staff; there was none.
Mayor Figueroa opened the public hearing to receive public testimony, seeing no one present to address the City Council; Mayor Figueroa closed the public hearing.
Mayor Figueroa opened the item to City Council discussion and deliberation.
Council Member Gamble inquired if there is a charge for researching public records requests documents.
Council Member McGirr moved, seconded by Council Member Beall to approve the following staff recommendation:
Approved and adopted Resolution No. 22-04-27-01 entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO SANTA
MARGARITA, CALIFORNIA, AMENDING THE MASTER FEE SCHEDULE BY
ADJUSTING CERTAIN FEES AND OTHER CITY RATES, CHARGES, AND USER
FEES FOR VARIOUS GOVERNMENT SERVICES BASED ON THE INCREASE IN
THE CONSUMER PRICE INDEX (CPI) AND FINDING THAT THE ACTION IS
STATUTORILY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PER SECTION 15273 OF THE CEQA GUIDELINES AND PUBLIC RESOURCES CODE SECTION 21080(B)(8)

9. CITY MANAGER REPORT
City Manager Cervantez reported that the Central Park Splash Pad is working wonderfully. The bridge feature is being made safer for the kids, the rest of the features are working well, and encouraged the public to come out to enjoy the Splash Pad.
10. MATTERS PRESENTED BY MAYOR AND COUNCIL MEMBERS
10.1 COMMITTEE ASSIGNMENT REPORTS
Received Oral Reports on the following City Council Committee Assignments:
1) FOOTHILL/EASTERN TRANSPORTATION CORRIDOR AGENCIES
Council Member Beall reported he attended the Foothill/Eastern Transportation Corridor Agency (TCA) meeting held on April 14, 2022. Council Member Beall reported the TCA approved an amendment to the 2016 Master Settlement Agreement with the Environmental Community, designed to balance transportation needs and protect the natural environment.
2) ORANGE COUNTY FIRE AUTHORITY
Council Member Gamble reported she attended the Orange County Fire Authority (OCFA) meeting held on April 14, 2022. Council Member Gamble reported the OCFA approved Assembly Bill 361 for teleconferencing meetings.
10.2 COUNCIL MEMBER REPORT/COMMENT
Mayor Pro Tempore Holloway invited everyone to the Every Fifteen Minutes presentation being held on Monday, May 2, 2022 from 10:45 a.m. to noon.
Mayor Figueroa announced that the City will be holding the first Coffee and Community event at the Starbucks located at the Lowe's Shopping Center on Saturday, April 30, 2022 from 8:30 to 10:00 a.m.

Mayor Figueroa indicated there was no reportable action taken as a result of the Closed Session Agenda items.
12. NEW BUSINESS (CONTINUED)
12.1 CONSIDERATION OF COMPENSATION FOR CITY MANAGER
Mayor Figueroa introduced Council Member Beall who reported that as a result following the completion of the annual performance evaluation of the City Manager and the tremendous work she has provided to the City this year; Council Member Beall moved, seconded by Council Member Gamble to approve the following City Council recommendations:
(1) to approve and authorize a 5% increase to the current annual base salary of the City Manager, effective July 1, 2022; and
(2) to approve and authorize a $500 per month auto allowance for the City Manager, effective July 1, 2022; and
(3) to direct the City Attorney to prepare a resolution and any other applicable authorizations ratifying this minute action for consideration and final approval by the City Council at its next regularly scheduled City Council meeting to be held on May 11, 2022.
