Mayor Beall introduced City Clerk Diaz who provided a brief overview of the staff report.

Mayor Beall asked City Attorney Simonian to further explain the statutory changes.

City Attorney Simonian clarified that the new procedure is occurring not because the city switched to districts but because we have a directly elected Mayor. City Attorney Simonian further detailed the procedural and legal context related to a directly elected Mayor and Planning Commissioner appointments.

Mayor Beall invited the following individual forward to address the Council on matters within the jurisdiction of the City Council. Mayor Beall noted that the speaker also submitted an eComment for Agenda Item No. 10.2:
8 City of Rancho Santa Margarita
City Council Regular Meeting Minutes December 11, 2024
Chris McLaughlin, City of Rancho Santa Margarita resident, referenced the City's municipal code regarding Planning Commissioner appointments and stated he believed the specifically cited state law does not apply to Rancho Santa Margarita.

Mayor Beall asked City Attorney Simonian to address the speakers' comments. City Attorney Simonian noted that the information he has previously provided to the City Council and the information in the staff report is correct, the speaker is incorrectly interpreting state law. City Attorney Simonian further explained that this is the procedure, it is preempted by state law, we have a directly elected mayor that was done pursuant to state law, and this is the controlling statute.

Mayor Beall inquired if there are any plans to modify the municipal code to conform to the new mandate from state law. City Attorney Simonian confirmed that they do have plans to update the City's municipal code on this and a variety of other areas.

Mayor Beall praised and thanked each of the existing members of the planning commission, he believes they have each served with great distinction and he has the highest respect for each of them. Mayor Beall shared a few words regarding his proposed appointments. Mayor Beall stated that his primary goal when putting together the proposed planning commissioner list was to ensure that there be at least one planning commissioner from each of the four districts. Mayor Beall believes the list of five commissioners have each demonstrated a significant commitment io serving the community, they are highly respected in the community, they have vast and varied professional and community experience. Mayor Beall shared three of the proposed appointees have served on the planning commission: Josh Bastain, Kristen Camuglia and Blaine Nelson. Mayor Beall highlighted the two new proposed appointees, Paul Persiani and Julie Schnieders.

Mayor Beall opened the item to Council discussion and deliberation.

Mayor Pro Tempore McGirr noted that he has known the proposed appointees for a long time and that the city cannot go wrong with the proposed appointees.

Council Member Holloway inquired from the City Attorney regarding the process to give input prior to the Mayor selecting his appointees; asked to define what "dictate" means in the Attorney General's opinion.

Council Member Holloway stated that he was not given the opportunity to advocate for his appointed commissioner nor was he notified that he was not to be included. Council Member Holloway asked Mayor Beall if it is his intent to solicit any kind of input from the Council prior to making his decision or will no input be requested.

Mayor Beall noted he is always available and happy to speak with Council Member Holloway and other members of the City Council to the extent they want to express an interest to him. Mayor Beall shared that he does not intend to implement some new process of solicitation, if the Council has something they would like to discuss he suggested they let him know and to bring it to his attention.

Council Member Holloway further explained that the Council did not know that this was going to occur, and the Mayor made the decisions without reaching out to the Council.

City Council Regular Meeting Minutes December 11, 2024
Mayor Beall clarified that there was a memo sent from the City Attorney a few weeks ago explaining the process; and that he was available for any questions for the past couple weeks.

Council Member Holloway stated that his comments have nothing to do with the individuals that have been selected but rather it is the process that he questions.

Mayor Beall reiterated what he stated in his earlier remarks, that he has nothing but praise for the members of the existing planning commission; that all five of them have served with great distinction and he has the highest respect for each of them, including Jim Leach and Eric Lima.

Council Member Baert understands that this is a new procedure for the Mayor to select each planning commissioner and she recognizes that there was limited time for Mayor Beall to complete the process for this year; she appreciates his decision to ensure that at least one commissioner represents each district as she believes that will provide a well rounded perspective on the City. Council Member Baert stated that for the future, she suggests an open application process that is clearly communicated to all residents.

Council Member Baert noted that many of her colleagues have served on the planning commission and have told her that they found it to be a valuable opportunity to serve the community and gain experience. Council Member Baert indicated she would be interested in playing an active role in the selection process moving forward.
