ORDINANCE NO. 1090
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RED BLUFF AMENDING SECTION 13.13 OF CHAPTER 13, ARTICLE III OF THE RED BLUFF MUNICIPAL CODE
RELATING TO THE GENERAL PARKING TIME LIMIT
WHEREAS, Chapter 13, Article III of the Red Bluff Municipal Code establishes regulations governing parking on public streets, alleys, and public rights-of-way within the City of Red Bluff; and
WHEREAS, Section 13.13 currently limits the parking of vehicles on public streets, alleys, and public ways to no more than twenty-four (24) consecutive hours; and WHEREAS, Section 13.11 of the Red Bluff Municipal Code authorizes the removal of vehicles that remain parked in violation of City parking regulations for more than seventytwo (72) consecutive hours; and WHEREAS, the City Council has determined that increasing the general parking limit from twenty-four (24) hours to seventy-two (72) hours will better align the Municipal Code with existing enforcement authority, improve consistency within Chapter 13, and provide a more practical and enforceable parking standard for residential neighborhoods while continuing to discourage the long-term storage of vehicles within the public right-of-way; and WHEREAS, on September 2, 2025, the City Council directed staff to prepare an ordinance amending Section 13.13 to increase the general parking limit from twenty-four (24) hours to seventy-two (72) hours; and
WHEREAS, the City Council conducted a duly noticed public hearing on the proposed ordinance and considered all oral and written testimony presented.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RED BLUFF DOES ORDAIN AS FOLLOWS:
SECTION 1. Findings
The City Council finds that the foregoing recitals are true and correct and are incorporated herein by this reference.
SECTION 2. CEQA
The City Council finds that adoption of this ordinance is not a project under the California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(5) of the CEQA Guidelines because it involves organizational and administrative activities that will not result in a direct or reasonably foreseeable indirect physical change in the environment. Alternatively, if the ordinance is determined to constitute a project, it is exempt from CEQA pursuant to Section 15061(b)(3) of the CEQA Guidelines because it can be seen with certainty that there is no possibility the ordinance may have a significant effect on the environment.
SECTION 3. Amendment to Red Bluff Municipal Code
Section 13.13 of Chapter 13, Article III of the Red Bluff Municipal Code is hereby amended to read as follows:

The City Council declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, and portion thereof irrespective of the fact that any one or more portions may be declared invalid or unconstitutional.
