City Council Special Meeting C. 1.

DATE: 03/13/2023
TO: Honorable Mayor and City Council Members
SUBJECT: Consideration and Direction to Implement Changes to the Reading of City Ordinances Consistent with Government Code Section 36934 as amended by SB 1489 (City Attorney Garcia)
MOTION(S):

If the City Council determines that staff’s recommendation is appropriate, the following motion is provided:

Authorize the implementation of the changes to the City procedure for the reading of city ordinances consistent with Government Code Section 36934 as amended by Senate Bill 1489 which would no longer require the reading of the text or the full title of a city ordinance provided:

The full title of the ordinance is included on the published agenda; and

1. A copy of the full text of the ordinance is made available to the public online and in print at the meeting prior to the introduction or passage.

2. RECOMMENDATION:

Staff recommends that the City Council authorize the implementation of the changes to the reading of city ordinances consistent with Government Code Section 36934 as amended by Senate Bill 1489.

DISCUSSION:

On September 18, 2022, the Governor signed into law Senate Bill 1489 entitled, “Local Government Omnibus Act of 2022”, which among other things, amended Government Code Section 36934 pertaining to the reading of city ordinances.

Prior to Senate Bill 1489, city ordinances were required to be read in full either Prior to Senate Bill 1489, city ordinances were required to be read in full either at the time of introduction or passage, except when, after reading the title, further reading is waived by regular motion adopted by a majority vote of the legislative body.

Effective January 1, 2023, Senate Bill 1489 amends Government Code Section 36934 by providing an exception to the general rule that ordinances be read in full or by title. A legislative body may dispense with reading an ordinance in full or by title provided the following conditions are met:

The full title of the ordinance is included on the published agenda; and

1. A copy of the full text of the Ordinance is made available to the public online and in print at the meeting prior to the introduction or passage.

2. The City Council's current practice for the introduction of an ordinance is that the Mayor will request the City Clerk to read the title of an ordinance and then a motion to waive further reading of the ordinance and to introduce the ordinance:

“Mayor requests the City Clerk to read the title of Ordinance No. xxx.”

“I move to waive further reading of Ordinance No. xxx and introduce Ordinance No. xxx" and find that the Ordinance is exempt from environmental review under the California Environmental Quality Act (“CEQA”) pursuant to Section 15061(b)(3) of the State’s Guidelines implementing CEQA.”

Under Senate Bill 1489, if the ordinance’s full title is included on the published agenda and a copy of the full text of the ordinance is made available to the public online and in print at the meeting prior to introduction or passage of the ordinance, the same motion would read:

“I move to introduce Ordinance No. xxx and find that the Ordinance is exempt from environmental review under the California Environmental Quality Act (“CEQA”) pursuant to Section 15061(b)(3) of the State’s Guidelines implementing CEQA.”

The manner in which we adopt an ordinance would remain unchanged from our current practice.

ALTERNATIVES:

Continue the current practice of reading city ordinances by title only and motions to waive further reading of such ordinances.
