Administrative
Report
N.1., File # 22-3604 Meeting Date: 2/1/2022
To: MAYOR AND CITY COUNCIL
From: ELEANOR MANZANO, CITY CLERK
TITLE

DISCUSSION AND POSSIBLE ACTION REGARDING CERTIFICATION OF AN INITIATIVE

ORDINANCE PERTAINING TO CANNABIS REGULATION, ADOPT ORDINANCE, CALL AN

ELECTION, OR ORDER A REPORT

EXECUTIVE SUMMARY
a) The City Council is asked to receive and file the Certification of Sufficiency; and b) Adopt ordinance without alteration;
OR
c) Direct the Elections Official to prepare for the Initiative to be placed on a ballot at an election date to be determined by the Council with one of the following options.

1. Redondo Beach General Municipal Election, March 7, 2023: to add this measure would cost between $5,000 - $10,000. The last day to add this measure would be December 6, 2022.

Note: Elections Code (“EC”)1405(a) …initiative that qualifies pursuant to EC Section 9215 or 9310 shall be held at the jurisdiction’s next regular election occurring not less than 88 days after the date of the order of election; or
EC1405(b)…city may call a special election…the election shall be held not less than 88 days nor more than 103 days after the order of the election.

2. Special Election, June 7, 2022: to add this measure would be to consolidate with the County (Statewide Direct Primary Election) for the estimated cost of $244,000. The last day to add this measure would be March 11, 2022 (or March 7, 2022 City Council Meeting).

Given the constraints of this EC section(1405b), mathematically, a special election in consolidation with the November 2022 (statewide) General Election is not an option; and d) The City Council may direct the city elections official to transmit a copy of the measure to the City Attorney to prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure in accordance with EC Section 9280;
AND
e) Council may request a report of effect of the proposed initiative pursuant to EC Section 9212; the report shall be presented to the City Council no later than 30 days after certification of the

sufficiency of the petition to the City Council; it will be presented at the City Council Meeting of March 1, 2022. Upon presentation of the report, the City Council has 10 days to adopt the ordinance without alteration or order an election (EC9215c), therefore would be ordering a special election for June 7, 2022.

BACKGROUND
The City Clerk’s Office received an initiative petition on December 13, 2021. 937 books were submitted with a total of 6,601 signatures; 6,614 signatures were verified, and 6,151 signatures were found sufficient. Pursuant to California Elections Code §9215, the required number of signatures is 10% of registered voters of the City. It was determined that the Los Angeles County Registrar Recorder’s last official report of registration to the Secretary of State, at the time the Intent to Circulate the petition was published, was 47,948 registered voters as of July 16, 2021, or 4,795 valid signatures to qualify the initiative. Therefore, the Elections Official has found the petition to be sufficient and is certifying the results to the City Council.

COORDINATION
This report was prepared in coordination with the City Attorney and City Manager.

FISCAL IMPACT
If the election is held June 7, 2022, a budget modification would be necessary to cover the full costs of the election of $244K.

The additional cost to include the initiative on the GME March 7, 2023 (City) ballot is $5-$10K, which would be requested with the Fiscal Year 2023 City Clerk’s Operating Budget.

The cost to provide report(s) pursuant to EC9212 depends on the type and amount of information sought by the City Council.
