Motion by Commissioner Kilroy, seconded by Commissioner Light, to open the public hearing. Motion carried, without objection.

Senior Planner Antonio Gardea narrated a PowerPoint presentation with details of the proposed project.

City Engineer Andy Winje and project designer Vince Onel from Spohn Ranch responded to questions from the Commission regarding hours of operation, mitigating noise, security, railings and fencing, the status of the nearby restrooms, access, bicycle racks, differences in funding packages, the potential to install artwork, applying prior Harbor Commission suggestions to the current design, funding sources, reaching out to Kincaid's and businesses along the boardwalk, the possibility of presenting to the Pier Association, maximum capacity, potential restrictions (i.e., age), and yearly maintenance costs.

In reply to Commissioner Light's question, Senior Planner Gardea reported the ordinance stating no skating on the pier is not part of the LCP and noted that changes in the ordinances would not have to be heard by the Coastal Commission for certification. Commissioner Light suggested limiting the hours of operation until sunset.

Discussion followed regarding the findings relative to consistency with the LCP and consistency with design elements currently at the pier, concerns with parking eBikes in or out of the facility because of increased thefts, other potential uses for the park and the installation timeline.

Commissioner Chrzan agreed with setting hours of operation from dawn to dusk; noted there is no mention of electrical elements; suggested that Spohn Ranch serve as advisors; spoke about adding bicycle racks in the parking area close to Kincaid's; commented on seating, benches and other uses such as classes; discussed covers for the railings during non-skating events and inspections and suggested installing foldable/removable fencing for non-skating events.

Commissioner Bauer expressed concerns regarding enforcement and commented on the possibility of installing a gate at the end of the bollards.

Commissioner Light felt gates would be costly and not useful and spoke about needing to move the project forward
Vince Onel presented details of various design concepts; spoke about the future installation of artwork including a mural and noted this will be a well-used facility.

W.E.D Representative Hause read an eComment received from Amy Hoffman in opposition to the project.

Motion by Commissioner Kilroy, seconded by Commissioner Light, to close the public hearing. Motion carried, without objection.

Commissioner Chrzan suggested recommending that City Council consider a contingency plan if noise is a problem.

Commissioner Callahan expressed concerns regarding the noise level and suggested conducting robust sound tests before moving the project forward.

Commissioner Kilroy commented on the underutilized pad through the years; believed the park will attract younger kids; discussed the importance of reaching out to area businesses to get their buy-in and felt that noise will not be a big issue during the day.

Commissioner Walters asserted the park will be used by younger skateboarders as older skateboarders prefer increased challenges and suggested lowering the occupancy rate on a trial basis.

Commissioner Bauer stated he would like to have additional data regarding noise and agreed with the need to engage area businesses and analyze impacts before moving ahead.

Commissioner Chran suggested setting the hours of operation from 9:00 a.m. to dusk.

Commissioner Light refenced a noise study in relation to a skate park in another city and commented on the proximity of the closest facility.

Discussion followed regarding previous noise studies, the relevancy of ambient noise and challenges with enforcing occupancy.

Chair Carlson commented on noise issues and hoped it can be mitigated.

Motion by Commissioner Light, seconded by Kilroy, to modify the CUP to set operating hours from 9:00 .m. to sunset, adopt the resolution approving the masterplan project as presented except for artwork raphics, that the railings design mirror the railing around the rest of the pier, to recommend that Cit Council direct staff to change the ordinance that prohibits skateboarding on the pier and recommend that they find funding for the full master plan.
