BD COMM CHARTER REV 104-33 111
APPROVED MOTION TO ELIMINATE CHARTER REV CMTE
CHAIRMAN'S VETO POWER & PROVIDE CHAIRMAN W/
VOTING & MOTION-MAKING PRIVILEGES & RECOMMEND
THAT THE CMTE FOLLOW THE COUNCIL'S LEAD RE PUBLIC
PARTICIPATION ON NON-AGENDA ITEMS IF THE CMTE SO DESIRES Regarding Councilmember Dawidziak's recommendation that the City Council realign the Charter Review Committee's rules of procedure to eliminate the veto and to limit the overall time which is devoted to public participation for non-agenda items, Councilmember Dawidziak moved, seconded by Councilmember White, to concur in the recommendation.
Prior to the vote:
Councilmember Dawidziak felt that Chairman David Serena does a good job presiding over the Committee's meetings.
Mayor Parton pointed out that there would be no reason for Chairman to attend the meetings if he cannot vote, make motions or veto motions, because he would merely be presiding over the meeting.
David Serena, Chairman of the Charter Review Committee, commented:
1. At the present, he can only vote in case of a tie, and that occurred once;
a. Subsequently, the Council met and decided that the
Chairman should have veto power;
2. He has only used the veto power on one occasion, and now the Council wants to change that;
3. Regarding the motion that he vetoed, it pertained to completely eliminate
3-2 vote, and had it passed, it would have stifled further comment on that issue (regarding City Boards and
Commissions), and he vetoed the motion so that the issue could benefit from further discussion;
4. The Committee has the power to override a veto by four votes; and
5. He believes he has acted very responsibly, and he would never veto a motion to send a recommendation on to the
Council.
Mayor Parton felt that Mr. Serena has done a good job
presiding over the Committee's meeting and has not abused the power of the Chair.
Larry Cote of Redondo Beach, a member of the Committee, expressed opposition to allowing the Chairman to have veto power, and suggested that the Chairman be able to vote only in the case 7 kic 8/23/94
John Parsons of Redondo Beach expressed opposition to 112 allowing the Chairman to have veto power, with which
Sal Princiotta, Chris Boyle and Tom O'Leary of Redondo Beach concurred.
Councilmember White indicated that she has no criticism of the way Mr. Serena presides over the meetings, but does not feel the Chairman should have veto power.
Councilmember White moved to amend the motion to add that the Chairman have voting and motion-making privileges. The amendment was accepted.
Councilmember Dawidziak's motion as amended carried by the following vote:
AYES: Dawidziak, Hill, Colin, Pinzler, White;
NOES: None;
ABSENT: None.
