FIRE EXPLORER PROGRAM
WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
DEFINITIONS:
For all purposes the following terms shall be defined as follows:
1. Department shall mean the Redondo Beach Fire Department.
2. City shall mean City of Redondo Beach.
3. Premises shall mean City fire stations.
4. Fire Explorer Program shall mean a training program which teaches students about fire suppression and fire prevention work to further their education and knowledge of Department work.
5. Explorer Member shall mean the student and/or member of the Fire Explorer Program.
GENERAL PROVISIONS:
The Undersigned acknowledges and fully understands that there are inherent risks participating in the Fire Explorer Program that include, but are not limited to, physical injury and property damage.
The Undersigned also claims that he or she is physically able to participate in rigorous physical activity and no known injuries or limitations exist that would be aggravated or result in further injury, including death.
The Undersigned represents he/she is a student at _______________________________ and his/her purpose is to learn about fire suppression and fire prevention to further his/her education and knowledge of Department work.
The Undersigned represents that he/she is not receiving any compensation or consideration of whatever nature from the City in exchange for his/her participation in the Fire Explorer Program.
In return for participating in the Fire Explorer Program and using the Premises, the Undersigned agrees to the following:
To the maximum extent permitted by law, the Undersigned agrees to indemnity, hold harmless and defend the City, its officials, officers, employees, volunteers, and contractors (collectively “Indemnitees”) from any and all fault, liabilities, cost, expenses, claims, demands of lawsuits arising out of, related to or connected with the Explorer Program even if such claims result from any act or failure to act of City’s performance hereunder, except for such loss or damage which was caused by the gross negligence or willful misconduct of the City.
The Undersigned furthermore waives for himself/herself and his/her executors, administrators, assignees or heirs, whether known or unknown, any and all rights and claims for damages, losses, demands and any other actions whatsoever, which he/she may have or which may arise against the City.
The Undersigned hereby expressly assumes the risk of entering the Premises and of taking part in activities on the Premises, which include, but are not limited to, any fire suppression and fire prevention activities
The Undersigned hereby acknowledges and agrees that he/she has read, understands and will at all times abide by all of the Department’s rules, procedures, program manuals, policies, and instructions.
The Undersigned hereby further agrees that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California.
If any provision or portion of this Waiver of Liability and Hold Harmless Agreement shall be determined to be illegal or unenforceable in any respect, such determination shall not affect the validity or enforceability of any other provisions or portions, each of which shall be deemed to be independent and severable.
I hereby represent that I have carefully read and understand the contents of this document and sign the same of my own free will.

RULES OF CONDUCT FOR FIRE EXPLORER MEMBERS
1. NO EXPLORER MEMBER SHALL COMMIT ANY ACT, WHICH IN ANY WAY TENDS TO BRING DISCREDIT TO THE DEPARTMENT OR THE CITY OF REDONDO BEACH.
2. NO EXPLORER MEMBER SHALL USE ANY INDECENT PROFANE, UNCIVIL, OR BOISTEROUS
LANGUAGE IN THE PRESENCE OF THE PUBLIC, AT THE CITY FIRE STATION, OR WHILE ACTING IN AN OFFICIAL CAPACITY FOR THE DEPARTMENT.
3. NO EXPLORER MEMBER SHALL USE ANY ALCOHOLIC BEVERAGE OR DRUGS, NOR SHALL THEY BE UNDER THE INFLUENCE WHILE IN UNIFORM OR ON DUTY.
4. ALL EXPLORER MEMBERS WHILE ACTING IN AN OFFICIAL CAPACITY FOR THE DEPARTMENT SHALL DO SO IN A PROFESSIONAL MANNER AT ALL TIMES.
5. GAMBLING, LIQUOR, DRUGS AND FIREARMS NOT IN THE POSSESSION OF A PEACE OFFICER ARE NOT PERMITTED IN ANY FIRE STATION OR ON THE GROUNDS OF ANY FIRE STATIONS.
6. NO EXPLORER MEMBER SHALL USE THE NAME OF THE DEPARTMENT, A FIRE STATION, BADGE, I.D. CARD, ETC., IN ANY COMMERCIAL OR PRIVATE ENTERPRISE FOR PERSONAL GAIN.
7. NO EXPLORER MEMBER SHALL ACCEPT ANY REWARD, FEE, OR GIFT FROM ANY SOURCE FOR SERVICE RENDERED IN THE PRESENCE OF DUTY.
8. NO EXPLORER MEMBER SHALL BE DISCOURTEOUS NOR DISRESPECTFUL TO ANY OTHER EXPLORER MEMBER, THE PUBLIC, OR ANYONE FROM A COOPERATING AGENCY.
9. NO EXPLORER MEMBER SHALL CHANGE, ALTER, ADD TO, OR REMOVE ANY EQUIPMENT OR
ARTICLE FROM ANY STATION OR APPARATUS WITHOUT WRITTEN CONSENT FROM THE STATION CAPTAIN OR HIS DESIGNATED PAID OFFICER.
10. EVERY EXPLORER MEMBER SHOULD ALWAYS EXERCISE PROPER PRECAUTIONARY SAFETY
MEASURES TO AVOID INJURY TO THEMSELVES AND OTHER WHILE THEY ARE ENGAGED IN ANY ACTIVITY AND WHILE WORKING AROUND THE STATION AND APPARATUS.
11. WHILE ATTENDING FIRE EXPLORER PROGRAM FUNCTIONS, EACH EXPLORER MEMBER SHALL PARTICIPATE AND CONDUCT THEMSELVES IN AN APPROPRIATE MANNER.
12. FAILURE TO KEEP YOUR UNIFORM CLEAN AND NEAT AFTER THREE WARNINGS MAY RESULT IN REMOVAL FROM ACTIVE ROSTER AT THE DISCRETION OF THE OFFICERS.
13. EACH EXPLORER MEMBER SHALL COMPLY WITH ALL DEPARTMENTS POLICY, RULES AND REGULATIONS, ALL APPLICABLE LAWS (CITY, STATE, AND FEDERAL). FAILURE TO DO SO MAY RESULT IN REMOVAL FROM THE ACTIVE ROSTER.

ATTENDANCE POLICY
I _____________________________________ understand that I am allowed two (2) absences in every three (3) months. An absence will be given only if I call my supervisor or a Post Advisor before training starts. Upon my third absence I will receive a written warning. Upon my fourth absence in three (3) months I will be placed on “Probation.” I will be on Probation for one (1) month. During this time, I will be required to attend all meetings without absence. After the Probation period, I will be returned to “Active” status in the Fire Explorer Program. If I fail to attend ALL meetings in this one-month time period I will be required to turn in my gear and be dropped from the program.
I understand if I do not notify my supervisor or Post Advisor of my absence, before training starts, I will be considered absent without leave (“AWOL”). I will receive a written warning on my first AWOL. If I have two (2) AWOLs in a year, I will be placed on Probation subject to the same rules as described in the foregoing section.
