TITLE

DISCUSSION AND RECEIVE & FILE CERTIFICATE OF SUFFICIENCY OF RECALL PETITION FOR COUNCILPERSON ZEIN OBAGI, JR., DISTRICT 4, IN THE CITY OF REDONDO BEACH

EXECUTIVE SUMMARY
The Los Angeles County Registrar-Recorder/County Clerk (“County”) has completed the signature verification of the petitions to recall District 4 Councilmember Zein Obagi, Jr., and found that the number of valid signatures was sufficient. Presented is a Certificate of Sufficiency for the City Council to receive and file in accordance with California Elections Code (“EC”) §11227.

California EC §11240 states within 14 days after the Certificate of Sufficiency is received by Council, the governing body (City Council) shall issue an order stating that an election shall be held to determine whether or not the officer named in the petition shall be recalled. Therefore, the City Clerk/Elections official will return to the City Council on July 19th with documents calling for the special election for District 4, request for County services, and budget modifications to conduct the election. Subsequently, if Council fails to issue the order within the time specified, within 5 days, the County shall issue the order to set the date for holding the election pursuant to EC §11241.

Insofar as the date of special election, pursuant to EC §11242, the special election shall be held not less than 88, nor more than 125, days after the issuance of the order and consolidated with the regular or special election. As such, the special election for District 4 shall be called in consolidation with the November 8, 2022 General Election.

BACKGROUND
The City Clerk’s Office received a petition requesting recall of Councilmember Obagi, District 4, on June 22, 2022. 459 books/segments were submitted with a total of 2,794 signatures, including approximately 16 signatures of voters identified as non-residents of District 4; 2,452 signatures were verified, and signatures were found sufficient. Pursuant to EC §11221, the required number of signatures is 25% of registered voters of the District. It was determined that the Los Angeles County Registrar Recorder’s last official report of registration to the Secretary of State, at the time the Intent to Circulate the petition was published, was 9,606 registered voters, or 2,402 valid signatures to qualify a recall for the ballot. Therefore, the Elections Official has found the petition to be sufficient and is certifying the results to the City Council.

A budget modification request will be presented to Council with the documents required to call the special election.
