For the City Clerk's Office to manage a standalone election the estimated cost would be $ 270,000 with full text of cannabis ordinance. The County declined to consider conducting an additional election on a separate day for the City.

He added Council may give staff direction to return with a resolution to call a special election for the cannabis measure and then consolidate the recall election with it; discussed the SB 415 lawsuit, and talked about avoiding voter confusion.

Mayor Pro Tem Nehrenheim invited public comments.

Joan Irvine, District 1, felt the issue has become very confusing; noted cost savings by holding the election on November 8, 2022; suggested keeping it simple and keeping the cannabis initiative for the election in March.

Lezlie Campeggi spoke in support of holding the cannabis initiative and the recall initiative together.

Rolf Strutzenberg stated the City cannot call a special election just for the recall and noted the recall would need to be consolidated with a special election for the cannabis initiative.

Wayne Craig, District 1, via Zoom, agreed with the previous speakers; spoke about not wanting outside interests to tell the City how it should be run and voiced support for consolidating the two initiatives.

Chief Deputy City Clerk Kroneberger read eComments from Philip Rebentisch and Maggie Healy.

Councilmember Emdee noted the City Attorney's opinion that it is a Brown Act violation to introduce and pass the resolution regarding the cannabis initiative, at this meeting and City Attorney Webb confirmed his opinion.

Councilmember Emdee stated she does not like the cannabis initiative because it takes away the City's local control; reported the cannabis initiative person indicated that if the City passed a cannabis ordinance, they would consider withdrawing the initiative; agreed it would be confusing for voters to receive two ballots, one for November 8th and another for October 19th and opposed spending extra money for a few extra weeks.

the cannabis ordinance, did not support consolidation of the ballot measure with the recall, and talked about needing a budget modification should Council approve a special election on October 19th.

Councilmember Horvath stated he does not agree with recalls; opposed calling a special election within two weeks of a general election; spoke about City Council's consensus to place the cannabis initiative on the March 2023 ballot. He spoke of his concern that the cannabis initiative will pass on a special election and remove the City's local control, and commented on the recall initiative and the need to modify the budget if a special election is held. He said he did not support a special election.

Mayor Brand entered the meeting at 9: 16 p.m.

Substitute motion by Councilmember Horvath, seconded by Councilmember Emdee, to adopt the resolutions as presented in the Administrative Report and consolidate the recall for $36,000 with the November 8, 2022 election.

Mayor Brand reported he came into the meeting because he sensed there would be a tie vote; stated he has watched and read all documents and meetings related to the subject matter; voiced his opposition to the recall; spoke about the recall and the cannabis initiative being funded by outside interests and believed the initiatives should not be buried in the general election on November 8, 2022.

In response to Mayor Brand pertaining to funding a special election, City Manager Witzansky responded the budget that was adopted includes funding the election in March, 2023; noted staff would typically return to City Council at midyear with a decision package requesting appropriations to cover additional costs of the special election.

Mayor Brand felt the agenda is clear and respectfully disagreed with the City Attorney regarding the need to return for an amended resolution.

City Clerk Manzano reported that per the Election Code ( EC Section 9605) the measure would have to be amended within seven days from now or no later than July 26, 2022; it is the only time City Council can amend or withdraw a measure if City Council agreed to holding a special election on October 19, 2022.
