PROJECT WITH THE LOS ANGELES COUNTY RECORDER AND RELEASE THE FINAL RETENTION PAYMENT OF $13,514 TO PUB CONSTRUCTION, INC., UPON EXPIRATION OF THE 35-DAY LEIN PERIOD AFTER RECORDATION AND NO CLAIMS BEING FILED UPON THE

PROJECT

EXECUTIVE SUMMARY
On November 16, 2021, the City Council awarded PUB Construction, Inc. a Public Works contract for $247,000 for construction of the Pier Restroom Improvements Project (Project), Job No. 70640.

During construction staff issued three (3) change orders totaling $23,284.36, bringing the final contract amount to $270,284.36. The change orders addressed unforeseen conditions requiring removal and replacement of rotten and termite-damaged wood bases, studs, and structural columns, and was within the authorization limit of the City Engineer as prescribed in the City’s Administrative Policies and Procedures (APP 14.1).

The project is now complete and ready for City Council acceptance and authorization to release the final retention amount of $13,514 to the contractor upon expiration of the 35-day lien period and there being no claims filed.

BACKGROUND
The Project, Job No. 70640, was included in the FY 2021-22 adopted CIP and provided tenant and ADA improvements for public restrooms at the seaward end of the Monstad Pier, including replacement of the building exterior siding and fascia, doors and frames, interior finishes, plumbing fixtures (water closets, sinks, etc.), restroom amenities (hand dryers, soap dispenser, toilet paper dispensers, etc.), ADA improvements (railing, doors, signage, fixtures heights, etc.), lighting, electrical, plumbing, exhaust fans, and related work.

On August 17, 2021, the City Council approved the plans and specifications for the Project and authorized the City Clerk to advertise the Project for competitive bids. On October 14, 2021, three bids were received and publicly opened in the City Clerk’s office. After reviewing the bids, PUB Construction, Inc. (“PUB”) was found to be the lowest responsible bidder. On November 16, 2021, the City awarded the Project contract to PUB in the amount of $247,000. Construction began on February 1, 2021. On May 27, 2022 the Project was reviewed by staff and determined to be

substantially complete.

During construction, staff issued two change orders totaling $22,313.02, which addressed unforeseen conditions requiring removal and replacement of rotten and termite-damaged wood bases, studs, and structural columns. A third change order in the amount of $971.34 was issued to take advantage of PUB’s access under the pier deck (while addressing incomplete construction items) and install previously missing hanger supports to existing plumbing pipes under the pier. The total of the three change orders amounted to $23,284.36, bringing the final contract amount to $270,285.

Upon acceptance of the Project by the City Council, staff will record a Notice of Completion with the LA County Recorder’s office and prepare to pay out the retained funds. The retention payment, totaling $13,514, will be released upon the expiration of a 30-day period for subcontractors to make claims for payment, assuming there are no claims.

COORDINATION
The Project was coordinated between the Public Works Engineering and Maintenance Divisions.

FISCAL IMPACT
The original estimated cost to complete the Project, including construction, project management and contingency was $291,202. Project funding was provided by CIP Capital Projects Fund and Tideland Funds. The final total project costs were within budget and amounted to $270,285. The remaining project funds will be used for future pier restroom improvements.
