CONTACT: ELEANOR MANZANO, CITY CLERK
City Clerk Manzano presented details of the Administrative Report and noted that she and the City Attorney's office do not recommend approval of the engagement letter.
City Attorney Webb added that The W Group would not agree to the City's standard indemnification language thereby making the City liable for the actions of an employee of the independent contractor; explained related issues and recommended that Council provide direction to repeal the ordinance and specifically rely on the State ordinance.
Mayor Brand indicated that relative to this matter, the City should rely on the State as this is a complicated issue.
Discussion followed regarding current contribution limits.
Councilmember Horvath stated he does not see the need to make changes other than fixing the CPI rounding relative to City Council candidates.
Discussion followed regarding the lack of available investigators and the need to decide who will conduct

enforcement.
Councilmember Nehrenheim commented on the City Attorney going over policy rather than legal matters; spoke about surrounding cities having campaign finance limits; felt it absurd to eliminate the ordinance after working on it for so many years; mentioned the "No on Measure C" campaign; opposed leaving anything in the hands of the FPPC and supported passing the stated amendments.
Councilmember Loewenstein felt the vote should be taken when the entire Council is in attendance.
City Attorney Webb noted Council has not addressed whether the ordinance is constitutional, as written, or who will prosecute violations and reported City Council did nothing for a year, after a budget report was requested and nothing was done. He added the Police Department does not want to be involved and stated Council can give the City Manger direction to find someone to perform prosecution and enforcement.
Motion by Councilmember Nehrenheim, seconded by Councilmember Loewenstein, to table this item to the City Council meeting of October 4, 2022, so the entire Council may vote on the matter. Motion carried 3-2, with Mayor Brand breaking the tie, with the following roll call vote:
AYES: Loewenstein, Nehrenheim, Mayor Brand
NOES: Emdee, Horvath
ABSENT: Obagi
Q. MAYOR AND COUNCIL REFERRALS TO STAFF
Councilmember Nehrenheim requested a status update on the parking study at Riviera Village and requested agendizing a discussion on whether to oppose or support Measure E to the meeting of September 20, 2022.
Councilmember Loewenstein requested agendizing a discussion on rules and regulations regarding operation and enforcement of eBikes.
Councilmember Emdee commented on the City posting flyers on the new " no watering for two weeks" mandate. City Manager Witzansky reported that is the responsibility of CalWater, not the City.
