EXECUTIVE SUMMARY
By direction from the City Council, the City Clerk /Elections Official is making preparations for the holding of a Special Municipal Election, November 4, 2014, consolidated with the Los Angeles County Election, for the purpose of submitting to the qualified registered voters of the City of Redondo Beach three measures to amend the charter; the first measure relates to City Treasurer Section 11.1 of Article XI by deleting the requirement that the City Treasurer shall devote his full time duties of the office and shall not engage in private business practice during City business hours; and adding new language to have the authority to audit all moneys collected by the City from any source in order to prepare monthly reports mandated by the Charter; the second measure relates to Section 26 of Article XXVI to permit a person to serve up to three full terms as a Councilman, from any combination of districts, and up to three full terms as Mayor by extending term limits from two to three terms; and the three measure Section 16.7 of Article XVI to permit a person to serve up to three full terms as members of the Board of Education by extending term limits from two to three terms.

BACKGROUND
On July 1 City Council meeting, by direction from the City Council, to direct to the City Clerk and City Attorney to pursue the placement of three measures on the ballot for the Los Angeles County Election, to be held on November 4, 2014. The City Clerk has prepared six resolutions which must be adopted this evening for placement of any measure on the Los Angeles County Ballot.

At the March 27, 2014 Strategic Plan meeting, a three -year goal to increase organizational effectiveness and efficiency, an objective coordinated by the City Clerk, City Treasurer and City Attorney, was submitted from Council to pursue the discussion and potential direction charter changes related to modifying term limits and adjusting City Treasurer duties for the November 4, 2014 Election.

In the last couple of years there have been numerous legislative changes to the California Election Code due to the demise of the City of Bell. Due to these changes, a new law was passed effective January 1, 2014 Election Code 1415 (2)(A) A charter proposal that proposes to amend a charter in a manner that does not alter a procedural or substantive protection, right, benefit, or employment status of any local government employee or retiree or of any local government employee organization can be placed at the next regularly scheduled general municipal election; however, if the amendment alters a procedural or substantive protection, right, benefit or employment status, then pursuant to Election Code 9255 (b) the city charter proposals shall be submitted to the voters at an established statewide general election. Since the proposed measure for the City Treasurer seeks to make a substantive alteration by deleting the full time status, the only available election would be the November 4, 2014 Statewide General Election with Los Angeles County.

The first resolution is calling and giving notice that the election will be held. The second resolution is requesting the Los Angeles Board of Supervisors permission to consolidate the City of Redondo Beach's Special Election with the County Election. Both of these resolutions are sent to the Board of Supervisors and the elections division of the Los Angeles County Clerk/Registrar Recorder. It is anticipated that the request will be approved unless it is found that the ballot style, voting equipment, or computer capacity is such that additional elections or materials cannot be handled by the County Clerk/Registrar Recorder'sOffice. The third, fourth, and fifth resolutions are to setting priorities for the filing of written arguments for and against for each measure placed on the ballot with the set deadlines to file the primary arguments. This resolution also defines the process for choosing authors and /or organizations, and the order that the City Elections Official shall use to give preference and priority if more than one argument is submitted and to transmit a copy of the measure to the City Attorney to prepare an impartial analysis showing the effect on the existing law and the operation of the measure. The sixth resolution is the deadlines set for the filing of rebuttal arguments for City measures submitted for the November 4, 2014 election.

The City Clerk's office has requested an informal quote from the Los Angeles County Clerk/Registrar Recorders office for the costs associated with the consolidation. The quote received is $124,500 for four measures. This is dependent on the number of agencies that participate in the election. The fewer agencies participating the higher the costs will be and the more agencies participating, the lower the costs.

FISCAL IMPACT
The November 4, 2014 Election was approved in the current fiscal year 2014 -2015 budget of 124,500.

N.4 DISCUSSED CHARTER CHANGES PURSUANT TO THE STRATEGIC PLAN

REGARDING POSSIBLE AMENDMENTS OF THE CITY CHARTER SUCH AS

ADJUSTING THE DUTIES OF THE CITY TREASURER AND /OR MODIFYING TERM

LIMITS, AND PROVIDING STAFF DIRECTION AS TO WHICH PROPOSED CHARTER CHANGES, IF ANY, THE COUNCIL WANTS PLACED ON THE NOVEMBER 4, 2014 BALLOT.

RECOMMENDATION:
a. Direct staff as to which proposed charter changes the Council wants placed on the November 4, 2014 ballot.

City Attorney Webb gave a staff report and requested direction from City Council to bring back a resolution no later than the July 15, 2014 City Council meeting, directing the City Clerk to call for this special election, changing the provisions of the Charter requiring the City Treasurer to be a full -time position and reducing the salary down to $25,000, and making clear that the Treasurer has audit authority to make certain monies received by all of the departments can be audited by the City Treasurer. He gave a history on term limits and suggested the most pragmatic option would be extending term limits from 2 to 3.

Delia Vechi said she spoke to hundreds of people and 9 out of 10 do not know what is going on in the City and are not informed. She said changing the salary of the Treasurer needs to be transparent regarding benefits, along with how much money will saved with this change, and the obligation of the City Treasurer. She also said everybody needs to know what the $25,000 means for a part-time job and the equivalent of the previous job and benefit changes, and how much the City will gain. She stated this all needs to be spelled out in the five districts, noting North Redondo has no idea what's going on in the city.

Mayor Aspel said the City is transparent but pointed out that 9 out of 10 residents don't vote.

Councilmember Aust stated all of the information will be on a sample ballot.

Marcie Guillermo stated people have to get involved. She said there was not a well - detailed study regarding the City Treasurer's new salary such as the benefits, Calpers, health care insurance, and how many hour will he be working such as attending City meeting. She asked that education take place on this issue.

Motion by Councilmember Brand, seconded by Councilmember Aust, to direct staff to bring back a resolution to be put on a ballot reducing the Treasurer to part-time at a salary of $25,000.

Motion carried unanimously.

Councilmember Kilroy indicated that other cities have voted to change their term limits from 2 to 3 terms due to accountability. He also said there are no term limits for the City Attorney, City Treasurer or City Clerk because there is too much experience required in the job, but the same thing can be said for the Council due to having a learning curve and losing institutional knowledge. He also pointed out that even if Council decides to put this on the ballot and if it passes, he could just turn around and get reelected. He believed this is the best thing for the City and residents and there is no cost putting it on the ballot. He also said it is difficult to get people to run for office and he supported changing the term limits from 2 to 3.

Councilmember Brand stated he did not support amending term limits and stated he feels very accountable even though he is termed out.

City Attorney Webb stated this is an initial item to bring back a resolution on July 15. He also said there are different ways to structure term limits. He said the election is November 4 and cannot be certified by the county for 30 days. It then has to go the Secretary State and isn't effective until received and filed by the Secretary of State and the nomination period closes December 7. He said even it this item is passed, there is no guarantee that it will be effective for this upcoming March election.

Councilmember Brand stated he will not support this item and stated it is important to have term limits and get the turnover on the dais, noting eight years is enough. He also stated it is very difficult to unseat an incumbent such as in other cities.

Councilmember Ginsburg noted a wealth of knowledge on the dais that could be lost and having 3 terms makes a lot of sense considering how the Council is put together along with limits.

Councilmember Kilroy stated he is just asking to let the voters decide and to put it on the ballot.

Councilmember Aust informed of two members of the North Redondo Beach Business Association who pushed and got term limits on the ballot which was passed and they got elected but could only serve two terms, and they fought to get it over turned using their own funds.

Christian Horvat, District 3, stated the City will lose two Councilmembers in the next year, but the point of serving is as civil servants and believed the job can get done in eight years and will be accountable through the second term. However, he did not support a lifetime ban on ever running again.

Don Szerlip stated he supported term limits until he got elected and realized there is an entire infrastructure beyond the City that benefits the City. He said the ability to be able to serve in those areas takes time and is part of institutional knowledge which is important. He said the public's opinion matters and the three terms may be worth considering, and he encouraged taking the opportunity to let the public decide.

Delia Vechi, District 2, stated she did not support three terms but supported after a period of time, Councilmembers could run again. She said everyone needs to have a chance to be on the elected side and then be on the other side with friends and neighbors.

Joanne Irvine, agreed there is institutional knowledge lost with two term limits along with the relationships with the state and federal. She recommend that three term limits go out to ballot.

Leslie Campeggi, stated there is a learning curve and believed that the Councilmembers should have some power over what will be on an agenda or discuss what's on an agenda before it appears. She pointed out that the City Attorney, City Clerk and City Treasurer do not set policy for the City which is why they don't have term limits. She also pointed out that residents cannot vote for five Councilmembers in the City and by extending term limits for the Councilmembers would disenfranchise those people who do show up even further. She expressed concern with delaying this another four years if she didn't agree with the person and stated she did not support extending term limits.

Jim Light, District 1, stated he opposed extending any term limits and that eight years is adequate. He said there is value to turnover at the leadership and the policy setting of the City Council and he opposed extending any term limits. He also pointed out that residents can serve a long time in the City such as on Commissions and Boards, and also jumping from Councilmember to Mayor.

Marcie Guillermo opposed extending term limits and the opportunity has to be given to other citizens and not having career politicians. She also opposed special interest people who make money for certain companies, and believed new leadership is needed with fresh ideas to help the community. She also said the Los Angeles County Board of Supervisors in 2012 wanted to increase the term limits but they rejected it. She stated there is a cost on the ballot and she suggested working on the AES moratorium rather than this issue.

Motion by Councilmember Kilroy to direct The City Attorney to craft a resolution defining term limits as one -term limit. Motion failed with no second.

Councilmember Kilroy pointed out that he has served 14 years on Commissions prior to the City Council and he continues to serve.

Motion by Councilmember Kilroy, seconded by Councilmember Ginsburg, to direct the City Attorney to bring back a resolution to put on a ballot a change in the City Charter from 2 terms to 3 terms that includes throughout the City Council and the School District. Motion carried, with Councilmember Brand voting no and Councilmember Aust abstaining.

City Clerk Eleanor Manzano explained that the cost for the City Treasurer alone is estimated at approximately $100,000 depending on how many agencies share the election with the City.

She also informed that the City Treasurer has to be on the November 4 election due to the law being changed this year requiring it being on a statewide election.

He also proposed breaking down the issues such as administrative updates, items no longer pertinent and offices no longer needed. He further suggested coming up with a framework and ballot measure, meeting once a month, reporting back to Council every other month, having two people appointed by each Councilmember plus an alternate, and meeting until the end of the year.

Councilmember Horvath recommended staff input on items to discuss as part of the process before forming the committee and suggested outreach to residents beforehand.
